The Aesthetic Of Failure: Authenticity, Effort, And Imperfection In American Contemporary Dance, Delaney Mcdonough

This research examines a slice of American contemporary dance artists and their audiences. American postmodern choreographers such as David Dorfman, Heidi Henderson, Sara Hook, and Paul Matteson use what I am calling the aesthetic of failure as a method to punctuate their work, momentarily blur clarity, steer the viewer’s gaze, make space for live choice making, and in some cases draw laughter. Almost any emotion can be associated with failure: anger, grief, hilarity, absurdity, etc. The underpinning of failure in live performance is the medium of the craft, human bodies. To tell the story of The EDFC I build a theory of activism that I call 'Interactivism as Anarchism' that reveals how certain structures and processes affect activism. Using Readers Theaters To Help Students Develop Reading Fluency, Adrianna D. Cavanaugh

This study examines how Readers Theater can support the literacy development of struggling readers, especially in regards to improving fluency. The study was done over two school years, each time focusing on four students with the lowest fluency scores. The study focuses on using Readers Theater to increase student's fluency. The first year fiction Readers Theater was used, while the second year the focus was on using nonfiction Readers Theater. The results indicate that using Readers Theater has a positive impact on increasing student's fluency and disposition towards reading. The study showed an increase in students' WCPM from their baseline …

The Art of Scoring for Improvisational Theater draws on traditions whose origins are obscured by the fog of History and Myth. With no prior plan, a musician is tasked with providing accompaniment that creates or reinforces mood, era, location, or genre. Through such accompaniment, a musician reads and activates nodes in a semiotic network, to generate context, subtext, or both. The blackface minstrel show is often disregarded in both popular and professional discourse when American popular culture is being examined. Often dismissed as a unilateral, purely racist spectacle, this paper argues for a more nuanced understanding of blackface minstrelsy and its formative role in the creation of a trans-regional American culture. Through an exploration of the ways in which ethnic minorities, women, language, and histrionics were presented on the blackface minstrel stage, an understanding of the ways in which popular entertainments both reflect and create popular sentiment can be formed. Victims of human trafficking may be exploited for prostitution, sweatshop labor, domestic work, and as child soldiers for armed conflicts. According to the U.S. Department of Health and Human Services, "after drug dealing, human trafficking is tied with the illegal arms industry as the second largest criminal industry in the world today, and it is the fastest growing, with an annual profit of $32 billion" (U.S Department of Health and Human Services, 2004). Modern Models Of Organ Donation: Challenging Increases Of Federal Power To Save Lives, Jonathan G. August

Much of today's scholarship on noninformed consent organ donation models has focused on either presumed consent or paid donation systems. Recently, however, individual states and foreign countries have begun to rethink their organ donation procedures in an attempt to increase donation rates.

Looking specifically at the informed consent model and the brand-new Israeli incentive program, this note first examines the success rates of these programs as potentially viable alternatives to traditional organ donation models. Next, this note argues that adopting these programs at the federal level will not violate the United States constitution under First Amendment and Fourteenth Amendment challenges, …

While the essays in this volume contribute individually to collective reflection on the Bible in mission, the larger significance of the book is greater than the sum of its parts. First it must be noted that the volume is part of the larger 2010 process, a collection of essays that grew from a “transversal” theme identified for the centennial of the World Missionary Conference at Edinburgh. As such, it joins a rich collection of contemporary missiological reflection generated by the series of 2010 meetings.

In this article I will read Before Night Falls as Arenas' queer version of Cuban literary history and his relation to it. Against the commonplace assertions that demand that Before Night Falls be primarily understood, if not exclusively, as an invective against Fidel Castro or, in the other extreme, as an ars moriendi and AIDS testimonial from a sexual dissident, I wish to revisit this text on the twentieth anniversary of its publication to underscore a missed reading that can help situate how Arenas, one of the most transgressive writers theorized in this collection as the Generation of '72, might …

Mutual Assent In The Corporate Contract: Forum Selection Bylaws, Benjamin D. Landry

Fordham Journal of Corporate & Financial Law

In recent years, frivolous and inefficient multijurisdictional stockholder litigation has become a costly burden on corporations in the United States. A popular solution among boards of directors has been to adopt bylaws with forum selection provisions (which require certain disputes to be litigated before one forum). Those who oppose this solution have challenged these provisions on the grounds that they were passed as bylaws—which are unilaterally adopted by boards without stockholder consent. These challengers argue that bylaws are like contracts, and, therefore, require the mutual assent of both stockholders and the corporation to be enforceable. This argument implicates a classic …

This essay discusses our work on the digital archive, The Fight for Knowledge: Civil Rights and Education in Richmond, Virginia, which grew out of our five-year documentary theater project at the University of Richmond. We include the voices of six collaborators—students, a special collections librarian, a digital archivist, and faculty members—to closely examine the multiple archives that have grown out of this project, and the way this has led us to propose a new way of thinking both about archives and about our documentary theater methodologies. This collaborative process has helped us to reconceptualize the relationship between archive and …
