Inferring Desire, Jessica A. Clarke Dec 2013

Inferring Desire, Jessica A. Clarke

Duke Law Journal

In the course of debates over same-sex marriage, many scholars have proposed new legal definitions of sexual orientation to better account for the role of relationships in constituting identities. But these discussions have overlooked a large body of case law in which courts are already applying this model of sexual orientation, with inequitable results.

This Article examines a set of fifteen years of sexual harassment decisions in which courts have endeavored to determine the sexual orientations of alleged harassers. Under federal law, sexual harassment is actionable because it is a subspecies of sex discrimination. A man who makes unwanted sexual …

Promises And Expectations, Florian Ederer, Alexander Stremitzer Dec 2013

Promises And Expectations, Florian Ederer, Alexander Stremitzer

Cowles Foundation Discussion Papers

We investigate why people keep their promises in the absence of external enforcement mechanisms and reputational effects. In a controlled laboratory experiment we show that exogenous variation of second-order expectations (promisors’ expectations about promisees’ expectations that the promise will be kept) leads to a significant change in promisor behavior. We provide clean evidence that a promisor’s aversion to disappointing a promisee’s expectation leads her to keep her promise. We propose a simple theory of lexicographic promise keeping that is supported by our results and nests the findings of previous contributions as special cases.

Expressions Of Grief On Facebook: Navigating Discomfort, Persistent Identity, And Public Memorialization, Molly Kalan

Theses - ALL

When someone dies, their online identity does not die with them. If a deceased Facebook user leaves behind a once active profile, friends and family members may choose to use this virtual space to express grief, interact with one another, and engage in active memorialization. Young adults who are traditionally marginalized in the grieving process can take advantage of the digital space to engage in mourning rituals. Through qualitative inquiry and in-depth interviews with 20 young adults who have dealt with the death of a friend or family member on Facebook, this study addresses phenomenological research questions concerning expression of …

It assesses whether current practice, which is largely predicated on ideas of positively shaping audiences perceptions and attitudes towards the United States, is actually fit for purpose. Indeed, it finds that the United States has for many years now been encouraged by large contractors to approach communications objectives through techniques heavily …

Politics And Economics In Putin's Russia, Stephen J. Blank Dr. Dec 2013

Politics And Economics In Putin's Russia, Stephen J. Blank Dr.

Books, Monographs & Collaborative Studies

View the Executive Summary

In one way or another, the papers included in this monograph, from the Strategic Studies Institute’s annual conference on Russia in May 2012, all point to the internal pathologies that render Russian security a precarious affair at the best of times. As the editor suggests, the very fact of this precariousness makes Russia an inherently unpredictable and even potentially dangerous actor, not necessarily because it will actively attack its neighbors, though we certainly cannot exclude that possibility, but rather because Russia may come apart trying to play the role of a great power in Eurasia or …

Reflections On The Metamorphosis At Robben Island: The Role Of Institutional Work And Positive Psychological Capital, Wayne F. Cascio, Fred Luthans

Department of Management: Faculty Publications

Nelson Mandela and other political prisoners from South Africa were imprisoned on notorious Robben Island from the mid-1960s until the end of the apartheid regime in 1991. The stark conditions and abusive treatment of these prisoners has been widely publicized. However, upon reflection and in retrospect, over the years, a type of metamorphosis occurred. Primarily drawing from firsthand accounts of the former prisoners and guards, it seems that Robben Island morphed from the traditional oppressive prison paradigm to one where the positively oriented prisoners disrupted the institution with a resulting climate of learning and transformation that eventually led to freedom …

The High Cost Of Child Support In Rape Cases: Finding An Evidentiary Standard To Protect Mother And Child From Welfare’S Cooperation Requirement, Aviva Nusbaum Dec 2013

The High Cost Of Child Support In Rape Cases: Finding An Evidentiary Standard To Protect Mother And Child From Welfare’S Cooperation Requirement, Aviva Nusbaum

Fordham Law Review

Indigent single parents who turn to welfare for financial support must cooperate with their state’s child support enforcement requirements before receiving some or all of their benefits. Single parents are required to provide information about the absent parent because states use the information to pursue the absent parent for child support. While child support helps reduce poverty and increase parental emotional support for children, it can also be very dangerous for some single mothers. The good cause exception exempts parents from child support enforcement when it would be contrary to the “best interests of the child.” Mothers and children who …

Head Versus Heart: Applying Empirical Evidence About The Connection Between Child Pornography And Child Molestation To Probable Cause Analyses, Emily Weissler

Structural equation modelling of data from 178 working adults revealed negative relationships between surface acting and perceptions of meeting effectiveness. Perceived meeting effectiveness partially mediated the relationship between surface acting and both intention to quit and emotional exhaustion …

Human error has been identified as the primary contributing cause for up to 80% of the accidents in complex, high risk systems such as aviation, oil and gas, mining and healthcare. Many models have been proposed to analyze these incidents and identify their causes, focusing on the human factor. One such safety model is the Human Factors Analysis and Classification System (HFACS), a comprehensive accident investigation and analysis tool which focuses not only on the act of the individual preceding the accident but on other contributing factors in the system as well. Since its development, HFACS has received substantial research …

From Emotions To Shared Values, David Chan Dec 2013

From Emotions To Shared Values, David Chan

Research Collection School of Social Sciences

In an invited commentary, SMU director of Behavioural Sciences Institute Professor David Chan noted that although the negative emotions that dominated 2013 have led to some positive outcomes, emotions cannot be the foundation for society’s progress. Professor Chan suggested that, moving forward, Singapore should focus on three shared values (integrity, fairness, social harmony) and three guiding principles (rule of law, accountability, people-centricity).
