Predisposition And Positivism: The Forgotten Foundations Of The Entrapment Doctrine, T. Ward Frampton

Journal of Criminal Law and Criminology

For the past eighty years, the entrapment doctrine has provided a legal defense for defendants facing federal prosecution, but only for those lacking criminal “predisposition” prior to the government’s inducement. The peculiar contours of this doctrine have generated significant academic debate, yet this scholarship has failed to explain why the entrapment doctrine developed as it did in the first instance. This Article addresses this gap by examining competing views on criminality and punishment in America during the doctrine’s emergence, highlighting the significant, though largely forgotten, impact of positivist criminology on the early twentieth-century legal imagination. Race scholars have begun to productively deploy structuralism to discuss cumulative racial disadvantage and the ongoing, racially segregative effects of government systems and policies.

A search of the cancer literature reveals the strong association between long-term nighttime shiftwork and increased risk of breast cancer in female workers. Since 2007, the International Agency for Research on Cancer (IARC) has categorized shiftwork as "probably carcinogenic to humans", a Group 2A carcinogen1. Evidence from epigenetic studies shows that differential methylation of genes is one possible mechanism by which long-term shiftwork disrupts the expression patterns of the genes responsible for maintaining a cancer free status.

Introduction: Coronary Heart Disease (CHD) is the leading cause of death worldwide. While different types of stress have been linked to CHD development and prognosis, literature regarding the effect of marital stress on positive health behaviors in the early recovery period following myocardial infarction (MI) is limited.

Objective: The present analysis was undertaken to explore the relationship between marital stress and medication adherence and physician follow up, two important components of early post-MI recovery.

Purpose: Cancer-related fatigue negatively impacts quality of life and possible recurrence and overall mortality in breast cancer survivors. This study aimed to investigate the associations between inflammation and cancer-related fatigue in breast cancer survivors using methods of systematic review and quantitative assessment of the Hormones and Physical Exercise (HOPE) Study in a high-risk population.

Methods: A PubMed search was conducted to identify peer-reviewed studies that assessed the associations among inflammatory markers, CRP, IL-6, and TNF-α, and cancer-related fatigue in breast cancer survivors. Liberal democracies aspire to respect minimum standards of individual liberty and due process to all. They structurally limit their powers with respect to how they treat all persons-including noncitizens, also known as "aliens." Nonetheless, the exact scope and nature of the limitations imposed by international and domestic legal regimes for the expulsion of noncitizens still remains uncertain and is in a constant state of evolution in multiple directions. Stories of scarcity litter the morning newspapers. Around the world, resources — food, water, fuel sources, clean air — seem stretched to, or even beyond, capacity. Consequences have already been serious, including suffering and unrest. Competition for resources seems likely only to increase. Does international law have the tools to manage or even solve this growing global problem? It was with this question in mind that the editors of the Georgia Journal of International and Comparative Law convened their 2012 symposium: “International Law in a Time of Scarcity.”

Sperm competition leads to increased sperm production in many taxa. This response may result from increases in testes size, changes in testicular architecture or changes in the kinetics of spermatogenesis, but the impact of each one of these processes on sperm production has not been studied in an integrated manner. Furthermore, such response may be limited in species with low mass-specific metabolic rate (MSMR), i.e., large-bodied species, because they cannot process energy and resources efficiently enough both at the organismic and cellular levels. On April 16th, the US Supreme court will hear arguments in the case Adoptive Couple v. Baby Girl. This case involves an Indian child whose attempted adoption by a non-Indian couple in South Carolina violated the provisions of the Indian Child Welfare Act (ICWA). Because of this violation, the family court ordered her return to her biological father. The case has received extensive media attention and has resulted in the vilification of ICWA. Nevertheless, the Court’s decision to hear the case was surprising. The issues in the case are straightforward and the lower courts’ decisions were clearly correct. Consequently, the …

Model-based analysis of data from quantitative reverse-transcription PCR (qRT-PCR) is potentially more powerful and versatile than traditional methods. Yet existing model-based approaches cannot properly deal with the higher sampling variances associated with low-abundant targets, nor do they provide a natural way to incorporate assumptions about the stability of control genes directly into the model-fitting process. In our method, raw qPCR data are represented as molecule counts, and described using generalized linear mixed models under Poisson-lognormal error. A Markov Chain Monte Carlo (MCMC) algorithm is used to sample from the joint posterior distribution over all model parameters, thereby estimating the effects …

This study assessed productivity and nutritional condition of deer in New Hampshire, and physical condition, productivity, and recruitment in northeastern North America. In New Hampshire, few fawns bred, but pregnancy rate and productivity of older deer were high and stable since the 1980s, despite substantially higher population density. Productivity increased due to a higher proportion of adults in 2011-2013; however, recruitment declined steadily suggesting that summer fawn mortality has increased. Nutritional condition declined throughout winter, and regardless of winter severity, most deer had depleted energy reserves and were in poor condition after April 1. Cover crops suppress weeds by competing for resources. The purpose of the first study was to quantify the effects of cover crops on weeds and the soil environment. Forage radish (Raphanus sativus L. var. longipinnatus 'Tillage Radish') was most effective at reducing weeds. The purpose of the second study was to quantify the effects of these cover crops planted the previous summer on growth of a test crop and residual weed populations. Test crop yield and chlorophyll levels were highest and weed populations were lowest in plots that had previously been planted with forage radish. In the third cover cropping …

Sigma (σ) receptors have recently been identified as potential targets for the development of novel therapeutics aimed at mitigating the effects of methamphetamine. Particularly, σ receptors are believed to mitigate some of the neurotoxic effects of methamphetamine through modulation of dopamine, dopamine transporters and body temperature. Furthermore, recent evidence suggests that targeting σ receptors may prevent cognitive impairments produced by methamphetamine. In the present study, an optimized σ receptor antagonist, AZ66, was evaluated against methamphetamine-induced neurotoxicity and cognitive dysfunction. Microgel multi-layer films assembled from anionic particles and linear polycation were prepared on elastomeric substrates and their self-healing properties studied. Dried films were imaged in situ during mechanical deformation and were determined to undergo plastic deformation in response to linear strain, leading to film buckling upon strain relaxation. Hydration leads to rapid reorganization of the film building blocks, permitting recovery of the film to the undamaged state. Additionally, films were determined to heal in the presence of high relative humidity environments, suggesting that film swelling and hydration is a major factor in the restoration of film integrity, and that full …

The Grand Forks Waste Water Treatment Plant (GFWWTP) is currently sending its waste activated sludge (WAS) from the activated sludge treatment process to an existing on-site wastewater treatment lagoon which has been in operation since 2003. The plant produces approximately 65,000 gallons of WAS per day. Because of this high level of loading, the existing lagoon system is likely to get replaced by a more sustainable treatment option. The purpose of this study was to gain an understanding of six state-wide policies and procedures used in the family assessment process within early intervention services. This study looked at the administrative understanding of the family assessment federal regulations, state policies and procedures, and local implementation from the perspective of the Part C coordinator in his or her state.

This qualitative study utilized methodologies associated with a grounded theory approach through in-depth interviews. The participants in this study included six state Part C coordinators. Based on the findings of this study, two broad conclusions are offered:

Grassland songbirds are declining faster and more consistently than other avifauna of North America. This has resulted in many species being placed on state and federal lists as species of concern. These declines can be linked to former and current land use practices which have resulted in an extensive loss of habitat. Natural resource agencies are trying to offset these habitat losses by reconstructing grasslands formerly cropped areas and protecting remaining grassland tracts. In this paper we develop a theoretical frame to understand self-regulation of aneuploidy rate in cancer and stem cells. This is accomplished building upon quasispecies theory, by leaving its formal mathematical structure intact, but by drastically changing the meaning of its objects. In particular, we propose a novel definition of chromosomal master sequence, as a sequence of physically distinct whole or fragmented chromosomes, whose length is taken to be the sum of the copy numbers of each whole or fragmented chromosome.
