Risk And Protective Factors For Recidivism Among Juveniles Who Have Offended Sexually, Andrew Spice, Jodi L. Viljoen, Natasha Elkovitch, Mario J. Scalora, Daniel Lee Ullman

University of Nebraska Public Policy Center: Publications

Literature on risk factors for recidivism among juveniles who have sexually offended (JSOs) is limited. In addition, there have been no studies published concerning protective factors among this population. The purpose of this study was to examine the relationship of risk and protective factors to sexual and nonsexual recidivism among a sample of 193 male JSOs (mean age = 15.26). Youths were followed for an average of 7.24 years following discharge from a residential sex offender treatment program. The risk factor opportunities to reoffend, as coded based on the Estimate of Risk of Adolescent Sexual Offense Recidivism, was associated with …

Teaching The Carceral Crisis: An Ethical And Pedagogical Imperative, Taja-Nia Y. Henderson

University of Maryland Law Journal of Race, Religion, Gender and Class

"Teaching the Carceral Crisis: An Ethical and Pedagogical Imperative," demonstrates that although mass incarceration and mass conviction has increased in the United States, law school curricula has continued to lack any substantive discussion on these issues. The article highlights the need for law schools to improve their current curricula in order to prevent further stigmatization of criminal offenders and the continued increase of incarceration rates.

Beyond “Life And Liberty”: The Evolving Right To Counsel, John D. King Jan 2013

Beyond “Life And Liberty”: The Evolving Right To Counsel, John D. King

Scholarly Articles

The majority of Americans, if they have contact with the criminal justice system at all, will experience it through misdemeanor courtrooms. More than ever before, the criminal justice system is used to sort, justify, and reify a separate underclass. And as the system of misdemeanor adjudication continues to be flooded with new cases, the value that is exalted over all others is efficiency. The result is a system that can make it virtually painless to plead guilty (which has always been true for low-level offenses), but that is now overlaid with a new system of increasingly harsh collateral consequences. The …

Ham Sandwich Nation: Due Process When Everything Is A Crime, Glenn Harlan Reynolds Jan 2013

Ham Sandwich Nation: Due Process When Everything Is A Crime, Glenn Harlan Reynolds

Scholarly Works

Though extensive due process protections apply to the investigation of crimes, and to criminal trials, perhaps the most important part of the criminal process -- the decision whether to charge a defendant, and with what -- is almost entirely discretionary. Given the plethora of criminal laws and regulations in today's society, this due process gap allows prosecutors to charge almost anyone they take a deep interest in. This Essay discusses the problem in the context of recent prosecutorial controversies involving the cases of Aaron Swartz and David Gregory, and offers some suggested remedies, along with a call for further discussion.

Plea Bargaining In The Shadow Of The Constitution, Richard L. Lippke Jan 2013

Plea Bargaining In The Shadow Of The Constitution, Richard L. Lippke

Duquesne Law Review

In two recent decisions, the United States Supreme Court moved further in the direction of at least limited constitutionalization of plea bargaining. A majority on the Court held that criminal defendants must be given "effective assistance" by their attorneys as they contemplate whether to waive important legal rights and enter guilty pleas. Fortunately for the Court, the defense attorneys in the two cases had almost comically failed to do their jobs and thus the majority could, as it acknowledged, avoid addressing in any very thorough way the parameters of effective assistance in the plea bargaining context. In spite of this, …

Leadership Strategies And Initiatives For Combating Medicaid Fraud And Abuse, Krista K. Laursen

Frank Dilley Award for Outstanding Doctoral Study

An estimated 3-10% of the $2 trillion spent annually on health care in the United States is lost to fraud. Improper payments undermine the integrity and financial sustainability of the Medicaid program and affect the ability of federal and state governments to provide health care services for individuals and families living at or below the poverty level. This study explored how health care leaders in the state of Arizona described factors contributing to the invisible nature of Medicaid fraud and abuse and necessary strategies for counteracting the business opportunities of Medicaid fraud and abuse. Unemployment And Marital Quality In Single- And Two-Earner Marriages, Andrew M. Bland Jan 2013

Unemployment And Marital Quality In Single- And Two-Earner Marriages, Andrew M. Bland

All-Inclusive List of Electronic Theses and Dissertations

A need was recognized for a broad-based quantitative study on the impact of unemployment upon marital relationship quality in light of recent societal changes and the current economic climate. Recently, researchers have suggested that unemployment is less severe in partnerships that reflect progressive shifts in values and expectations within marital relationships. It was worth exploring whether this claim generalized across a broader sample of contemporary marriages, including those that uphold more traditional values. An ex post facto correlational design was used to assess how unemployment impacts marital quality in single breadwinner vs. dual-earner couples in the current economy. Participants were …

Effective Prison Management: An International Collaboration, Ariana Youmans Jan 2013

Effective Prison Management: An International Collaboration, Ariana Youmans

The Corinthian

There have been universal efforts to regulate the management of prisons via the United Nations; however, it is important to be aware of cultural differences when it comes to effective prison management. It is not only important to recognize cultural diversity in one’s own country, but it is also important to understand cultural diversity in other countries abroad. This understanding allows for greater understanding in regards to policy implementation and why certain processes and mandates are considered to be effective for these various systems. In addition, it should be realized that what works for one nation may not be applicable …

Measurement Properties Of The Motivation For Youth Treatment Scale With A Residential Group Home Population, Matthew C. Lambert, Kristin Duppong-Hurley, M. Michele Athay Tomlinson, Amy L. Stevens Jan 2013

Measurement Properties Of The Motivation For Youth Treatment Scale With A Residential Group Home Population, Matthew C. Lambert, Kristin Duppong-Hurley, M. Michele Athay Tomlinson, Amy L. Stevens

Department of Special Education and Communication Disorders: Faculty Publications

A client’s motivation to receive services has long been identified as a highly relevant component of mental health treatment. In fact, ample evidence demonstrates that client motivation is significantly related to seeking services, remaining in services, and improved client outcomes (e.g., Broome, Joe, & Simpson, 2001; Ryan, Plant, & O’Malley, 1995; Schroder, Sellman, Frampton, & Deering, 2009). Additionally, it has been recognized that motivation is a “dynamic” characteristic that changes throughout treatment (Melnick, De Leon, Hawke, Jainchill, & Kressel, 1997; Schroder et al., 2009). In this way, motivation is an important client factor to assess and monitor throughout the treatment …

Captive Markets, Leah A. Plunkett Jan 2013

Captive Markets, Leah A. Plunkett

Law Faculty Scholarship

Today, inmates in county jails nationwide are billed for some or all of the costs of their room-and-board behind bars. Statutes authorizing counties to implement these “pay-to-stay” programs are on the books in roughly 70% of states, yet the financial mechanism on which these programs typically rely is not well understood. Although the pay-to-stay obligation bears some resemblance to familiar citizen-state financial transactions — such as fines and penalties, restitution, taxes, and fees — it in fact usually belongs to a distinct model that this Article calls the “government-imposed-loan.” This Article provides an overview of the landscape of pay-to-stay programs …

Genetic Privacy And The Fourth Amendment: Unregulated Surreptitious Dna Harvesting, Albert E. Scherr Jan 2013

Genetic Privacy And The Fourth Amendment: Unregulated Surreptitious Dna Harvesting, Albert E. Scherr

Law Faculty Scholarship

Genetic privacy and police practices have come to the fore in the criminal justice system. Case law and stories in the media document that police are surreptitiously harvesting the DNA of putative suspects. Some sources even indicate that surreptitious data banking may also be in its infancy. Surreptitious harvesting of out-of-body DNA by the police is currently unregulated by the Fourth Amendment. The few courts that have addressed the issue find that the police are free to harvest DNA abandoned by a putative suspect in a public place. Little in the nascent surreptitious harvesting case law suggests that surreptitious data …

Social Versus Conservative Democracies And Homicide Rates, Marcus Marktanner, Luc Noiset Jan 2013

Social Versus Conservative Democracies And Homicide Rates, Marcus Marktanner, Luc Noiset

Faculty Articles

Purpose – The purpose of this paper is to critique recent findings that democratic practices are positively related to homicide rates. Design/methodology/approach – Economic rational choice model supported by empirical evidence. Findings – It was found that higher homicide rates are only characteristic of democracies that fail to respond to the median voter's call for equitable social development. Originality/value – The paper makes an original distinction between conservative and social democracies, operationalizes this distinction theoretically and empirically, and shows that higher homicide rates are a phenomenon of conservative, not social, democracies.
