Othering, Mirroring, And Identity In John Edgar Wideman's Brothers And Keepers, James E. Walker
Othering, Mirroring, And Identity In John Edgar Wideman's Brothers And Keepers, James E. Walker
ETD Archive
Jacques Lacan's notion of the mirror stage of human development, formulated from the theories of Sigmund Freud, lies at the core of psychoanalytic theory. Fundamental components of the mirror stage include the concepts of Otherness and Identity. This examination proffers a critical reading of John Edgar Wideman's Brothers and Keepers, through a psychoanalytic matrix and contemporary constructions of Othering, Mirroring, and Identity. To that end, this examination traces the evolution of the ways subsequent scholars have understood, applied, and expanded Lacan's classical mirror stage, and its components. Nancy VanDerHeide transforms the solitary, individual, experience of Lacan's mirror stage into a …

Re-Thinking Minnesota's Criminal Justice Response To Sexual Violence Using A Prevention Lens, Caroline Palmer, Bradley Prowant
Re-Thinking Minnesota's Criminal Justice Response To Sexual Violence Using A Prevention Lens, Caroline Palmer, Bradley Prowant
Symposium: 50th Anniversary of the Minnesota Criminal Code-Looking Back and Looking Forward
Sexual violence is one of the most difficult issues we face in the human condition. Even with the many strides that have occurred in recent years to support a victim-centered response, survivors who seek help from the legal, medical and mental health systems, among others still “may face disbelief, blame, and refusals of help instead of assistance.” It is a problem that demands a response from all levels of society. And yet this response is lacking.
The key question we as a society confront is what changes will satisfactorily balance justice for victims with offender accountability, attempts at rehabilitation through …

Drugs, Dignity And Danger: Human Dignity As A Constitutional Constraint To Limit Overcriminalization, Michal Buchhandler-Raphael
Drugs, Dignity And Danger: Human Dignity As A Constitutional Constraint To Limit Overcriminalization, Michal Buchhandler-Raphael
Scholarly Articles
This Article proposes a constitutional constraint to limit criminalization of victimless crimes and, particularly, to alleviate the pressures on the criminal justice system emanating from its continuous “war on drugs.” To accomplish this goal, the Article explores the concept of human dignity, a fundamental right yet to be invoked in the context of substantive criminal law. The U.S. Supreme Court’s jurisprudence invokes conflicting accounts of human dignity: liberty as dignity, on the one hand, and communitarian virtue as dignity, on the other. However, the Court has not yet developed a workable mechanism to reconcile these competing concepts in cases where …
An Examination Of Academic Growth Of Minority Elementary Magnet School Students, David Wayne Snapp
An Examination Of Academic Growth Of Minority Elementary Magnet School Students, David Wayne Snapp
Education Dissertations and Projects
This research was designed to examine the difference in student performance between minority magnet school students who live in the residential area for those magnet schools and minority students assigned to a non-magnet residential school. This difference in performance was measured by scale score differences from the North Carolina End-of-Grade tests in reading and math after the sample scores were converted to z scores using the state mean and standard deviation for the given years in the study. Performance growth was measured for students who were in the third grade in 2009-2010 and remained at their school through the fifth …

Smoking Experimentation Among Elementary School Students In China: Influences From Peers, Families, And The School Environment, Cheng Huang, Jeffrey Koplan, Shaohua Yu, Changwei Li, Chaoran Guo, Jing Liu, Hui Li, Michelle Kegler, Pam Redmon, Michael Eriksen
Global Health Faculty Publications
The aim of this study was to investigate experimentation with smoking among primary school students in China. Data were acquired from a recent survey of 4,073 students in grades 4 to 6 (ages 9–12) in 11 primary schools of Ningbo City. The questions were adapted from the Global Youth Tobacco Survey (GYTS). Results suggest that although the Chinese Ministry of Education (MOE) encourages smoke-free schools, experimentation with cigarettes remains a serious problem among primary school students in China. Peers, family members, and the school environment play important roles in influencing smoking experimentation among students. Having a friend who smoked, seeing …

'Scared Straight' And Other Juvenile Awareness Programs For Preventing Juvenile Delinquency, Anthony Petrosino, Carolyn Turpin-Petrosino, Meghan E. Hollis-Peel, Julia G. Lavenberg
Criminal Justice Faculty Publications
Background: 'Scared Straight' and other similar programs involve organized visits to prison by juvenile delinquents or children at risk for criminal behavior. Programs are designed to deter participants from future offending through firsthand observation of prison life and interaction with adult inmates. These programs remain in use despite research questioning their effectiveness. This is an update of a 2002 review.
Objectives: To assess the effects of programs comprising organized visits to prisons by juvenile delinquents (officially adjudicated, that is, convicted by a juvenile court) or pre-delinquents (children in trouble but not officially adjudicated as delinquents), aimed at deterring …

How The Medicate-To- Execute Scheme Undermines Individual Liberty, Offends Societal Norms, And Violates The Constitution, Caitlin Steinke
How The Medicate-To- Execute Scheme Undermines Individual Liberty, Offends Societal Norms, And Violates The Constitution, Caitlin Steinke
Hofstra Law Student Works
This article sets forth two arguments why states should be prohibited from forcibly medicating mentally ill inmates in order to achieve competency for execution. First, the state does not have an important governmental interest in executing an individual who cannot be constitutionally executed. Second, such forcible medication violates the Eighth Amendment because it is left purely to chance whether antipsychotic medication will restore a mentally ill inmate to competency.
In order to place the involuntary medication of death row inmates within the larger context of forcibly medicating mentally ill individuals, this article begins by addressing the state’s interest in forcibly …

Localizing Justice: Beyond The Chambers Of The Icty To The People Of Sanski Most, Kathleen Sprague
Honors Thesis Collection
My research focuses on the efficacy of the International Criminal Tribunal of the Former Yugoslavia (ICTY), a judicial mechanism established in The Hague in response to the mass atrocities committed throughout the northern Balkans in the 1990s. Based on my ethnographic fieldwork conducted in Sanski Most, a small town in northwestern Bosnia, I explore residents’ notions of justice following the Yugoslav wars and their overlap as well as disjuncture from Western priorities and initiatives. More broadly, my research hovers at the intersection of legal anthropology and human rights. While it is founded soundly in anthropological methodology and literature, I also …

In many countries around the world, including Argentina, the number of women who are deprived of their liberty has risen over time and has increased disproportionately in comparison to male prisoners. In Argentina, the number of female prisoners within the federal system increased 193%, while the male population rose 111% from 1990 to 2012. Nonetheless, little research has been done to understand why there has been such a dramatic increase in women’s incarceration. At the same time, international and domestic laws governing prisons and prison policies and practices have traditionally been designed for men. In 2010, however, the United Nations …

Guilty Or Not Guilty: Can Dna Help Prove Guilt Or Innocence?, Suzanne Eckstein
The Science Journal of the Lander College of Arts and Sciences
Throughout our history, science was always on the front lines for discovery and exploration. Science is used as an investigative tool by the human race to figure out all the mysteries of the universe. The discovery of DNA was tremendous, providing each human being with their own unique genetic identity - no longer would an individual be genetically confused with another. DNA fingerprinting, in particular, has changed the world. In the 1980's the legal system began using DNA fingerprinting to help establish the guilt of an indicted criminal. DNA (besides for fingerprints) is the only way to confirm scientifically if …
