2013 Massachusetts Family Impact Seminar: Youth At Risk, Part 2, Denise A. Hines, Fern L. Johnson, Donna Haig Friedman, Deborah A. Frank

Mosakowski Institute for Public Enterprise

The youth of Massachusetts are of primary concern to legislators and citizens. This briefing report features three essays by experts — Fern Johnson, Deborah Frank, and Donna Haig Friedman — who focus on three aspects of children in need: children in foster care who need adoption, children who are hungry, and children who are homeless. Each report has further and more detailed suggestions for helping these children in need; below is a summary of the problems we face.

Vulnerability And Just Desert: A Theory Of Sentencing And Mental Illness, E. Lea Johnston Mar 2013

Vulnerability And Just Desert: A Theory Of Sentencing And Mental Illness, E. Lea Johnston

UF Law Faculty Publications

This Article analyzes risks of serious harms posed to prisoners with major mental disorders and investigates their import for sentencing under a just deserts analysis. Drawing upon social science research, the Article first establishes that offenders with serious mental illnesses are more likely than non-ill offenders to suffer physical and sexual assaults, endure housing in solitary confinement, and experience psychological deterioration during their carceral terms. The Article then explores the significance of this differential impact for sentencing within a retributive framework. It first suggests a particular expressive understanding of punishment, capacious enough to encompass foreseeable, substantial risks of serious harm …

Network Firewall Dynamics And The Subsaturation Stabilization Of Hiv, Bilal Khan, Kirk Dombrowski, Mohamed Saad, Katherine Mclean, Samuel Friedman Mar 2013

Network Firewall Dynamics And The Subsaturation Stabilization Of Hiv, Bilal Khan, Kirk Dombrowski, Mohamed Saad, Katherine Mclean, Samuel Friedman

Publications and Research

In 2001, Friedman et al. conjectured the existence of a “firewall effect” in which individuals who are infected with HIV, but remain in a state of low infectiousness, serve to prevent the virus from spreading. To evaluate this historical conjecture, we develop a new graph-theoreticmeasure that quantifies the extent towhich Friedman’s firewall hypothesis (FH) holds in a risk network. We compute this new measure across simulated trajectories of a stochastic discrete dynamical system that models a social network of 25,000 individuals engaging in risk acts over a period of 15 years. The model’s parameters are based on analyses of data collected …

Beyond A Reasonable Doubt: Executions Of Women In The United States, Erin Bush Mar 2013

Beyond A Reasonable Doubt: Executions Of Women In The United States, Erin Bush

Women's History in the Digital World

Digital methodologies are valuable for helping to narrow voluminous potential subjects of historical research into a scalable endeavor. In this paper, I will present a project that stemmed from an effort to understand the volume, types, timing, and geography of capital cases involving women in the United States. I applied visualization and querying techniques to data from "The Executions in the United States" database to help identify patterns in state-sanctioned executions of women between 1608 and 2002. While scholars have traditionally told the story of American executions through individual case studies, by exposing the patterns and similarities across cases involving …

Marking The 50th Anniversary Of Gideon, Neil Fulton, Tim Purdon

Faculty Publications

Here in North Dakota, the U.S Attorney's Office and the Federal Public Defender's Office are engaged in joint efforts to protect this important right. For example, we have worked together on training for private defense lawyers who take appointments to represent indigent defendants at compensation rates well below what they charge the general public. We have both reached out to tribal officials to provide training for prosecutors and defense attorneys in tribal courts. We have begun discussions with other court officials about ways to keep those convicted from committing new offenses by targeting resources at re-entry, so they leave the …

The Collision Of Law And Science: American Court Responses To Developments In Forensic Science, Sarah Lucy Cooper Mar 2013

The Collision Of Law And Science: American Court Responses To Developments In Forensic Science, Sarah Lucy Cooper

Pace Law Review

This paper considers how American courts have responded to developments in forensic science by focusing on four popular forensic science disciplines: (1) fingerprint identification (friction ridge analysis); (2) firearms identification (tool-mark analysis); (3) bite mark identification (forensic odontology); and (4) arson investigation (fire science). Part I briefly explores the relationship between law and science. Part II charts the development of the legal frameworks that govern the admissibility of expert evidence in America. Part III discusses the identification methods employed by these four disciplines and provides examples of erroneous identifications. Part IV comments on the NAS Report findings that relate to …

Justice James D. Hopkins: Jurist, Dean, Scholar And Expert On New York Law, Jay C. Carlisle Ii, Anthony Dipietro

Pace Law Review

It is an appropriate tribute to our late Dean James D. Hopkins that this edition of Pace Law Review be dedicated to a man who many leaders of the bench, bar, and academia believe is one of the twentieth century’s greatest common law appellate jurists. Dean Hopkins, better known as Judge Hopkins, was Pace Law School’s second Dean from 1982 to 1983, an associate justice of the Supreme Court of New York, and a justice of the Appellate Division for the Second Department from 1962 to 1981. He authored hundreds of significant majority, dissenting, and concurring judicial opinions on New …

An Examination Of The Correlates Of Prison Misconduct In The Arkansas Prison System, Gavin Lee Mar 2013

An Examination Of The Correlates Of Prison Misconduct In The Arkansas Prison System, Gavin Lee

Theses and Dissertations

The study of prison misconduct has been a topic which has been a subject of great import to criminological literature from the early 20th Century onward. The implications of the carceral experience have both ethical and utilitarian import to society as a whole. Over the last 80 years, two competing theoretical perspectives have been used to view this phenomenon: the importation model (Irwin and Cressey, 1962) and the work of Clemmer (1940) and Sykes (1958), the institutionalization/deprivation model. This dissertation seeks to examine the relative strengths of each perspective using official data. The findings of this study provide support for …

License To Kill: Theoretical Critique Of “Stand Your Ground” Policies, Lonn Lanza-Kaduce, Andrea Davis Mar 2013

License To Kill: Theoretical Critique Of “Stand Your Ground” Policies, Lonn Lanza-Kaduce, Andrea Davis

Center for the Study of Race & Race Relations: Lectures and Events

This paper extends themes from sociologist Austin Turk’s theory of normative-legal conflict to the Martin tragedy and Florida’s “Stand Your Ground Law” as a point of entry for examining more general theoretical notions about how legal and social statuses can combine in counterintuitive ways. His theory is premised on deference and the impact that different ways of structuring social interaction will have on the probabilities that conflict will become overt. In some contexts, the relationship between legal status and social status allow the potential for conflict to de-escalate. In others, the relationship aggravates the prospect for overt conflict. Because laws …

Racial Socialization And Fear Of Crime, Jodi Lane, Ashley Kuhn Mar 2013

Racial Socialization And Fear Of Crime, Jodi Lane, Ashley Kuhn

Center for the Study of Race & Race Relations: Lectures and Events

Several studies have found a link between ethnocentric attitudes and fear of crime, where negative attitudes toward other races are associated with fear of crime. In the literature on fear, this is referred to as subcultural diversity. It may be that people are socialized to fear other racial and ethnic groups and that this will impact how they respond to stressful situations. That is, if people have a heightened fear of people who look different than they do, some may be more likely to respond to perceived threats with violence in an effort to protect themselves. In this paper, we …
