The Categorical Distinction Between Adolescents And Adults: The Supreme Court's Juvenile Punishment Cases—Constitutional Implications For Regulating Teenage Sexual Activity, Martin R. Gardner Jul 2013

The Categorical Distinction Between Adolescents And Adults: The Supreme Court's Juvenile Punishment Cases—Constitutional Implications For Regulating Teenage Sexual Activity, Martin R. Gardner

Brigham Young University Journal of Public Law

I undertake in this article the task of exploring the impact of the punishment cases in resolving one particular controversial family law issue involving the possible existence of a juvenile’s constitutional right to engage in sexual conduct prohibited by the state and against the wishes of that juvenile’s parents. While the Supreme Court has seldom decided cases involving direct claims by children of constitutional rights disfavored by their parents, assertions by minors of constitutionally protected sexual liberty have become more prevalent of late in light of the Supreme Court’s recognition in Lawrence v. Texas of a constitutionally protected right, at …

Vanessa Lopez - Family Ties: Exploring Familial Relationships For Individuals With A Felony Conviction, Vanessa Lopez Jul 2013

Vanessa Lopez - Family Ties: Exploring Familial Relationships For Individuals With A Felony Conviction, Vanessa Lopez

Ronald E. McNair Scholars Program 2013

This qualitative study explores the difficulties released prisoners and their families encounter through the reintegration process. The reentry process into society is a challenge for both released prisoners and their families to overcome, since the social stigma of a criminal conviction creates barriers. The challenging component of the social stigma essentially prevents individuals with a criminal conviction from sustaining themselves financially and finding a place to live. Besides the stress of overcoming the barriers of judgments created by society; many of these individuals have to face the rejection of their children, partners, and extended kinship groups. Existing literature has focused …

Transpersonal Sociology: Origins, Development, And Theory, Ryan Rominger, Harris L. Friedman Jul 2013

Transpersonal Sociology: Origins, Development, And Theory, Ryan Rominger, Harris L. Friedman

International Journal of Transpersonal Studies

Transpersonal theory formally developed within psychology through the initial definition of the field in the publishing of the Journal of Transpersonal Psychology. However, transpersonal sociology also developed with the Transpersonal Sociology Newsletter, which operated through the middle 1990s. Both disciplines have long histories, while one continues to flourish and the other, comparatively, is languishing. In order to encourage renewed interest in this important area of transpersonal studies, we discuss the history, and further define the field of transpersonal sociology, discuss practical applications of transpersonal sociology, and introduce research approaches that might be of benefit for transpersonal sociological researchers and practitioners.

Taking Mistakes Seriously, Paul J. Larkin Jr. Jul 2013

Taking Mistakes Seriously, Paul J. Larkin Jr.

Brigham Young University Journal of Public Law

Part I of this article discusses the principle that mistake or ignorance of the law is no excuse. It is settled law that no one can defend against a criminal charge on the grounds that he did not intend to flout the law and, at worst, made only a reasonable, honest mistake as to what he was free to do. Part II examines several areas in which the law does precisely the opposite by repeatedly manifesting a willingness to forgive reasonable mistakes by one or more actors in the criminal justice system. Part III then asks whether the developments discussed …

Mistaking U.S. Citizenship, Jorge Gavilanes Jul 2013

Mistaking U.S. Citizenship, Jorge Gavilanes

Brigham Young University Journal of Public Law

United States (“U.S.”) citizenship has been closely protected from those who cannot claim it. In fact, the value of citizenship is so strong that the law penalizes any who falsely claim citizenship or the benefits derived from being a citizen. Such penalties are imposed even upon those who have not intentionally claimed citizenship, but merely have mistakenly done so. Ironically, despite these efforts to safeguard U.S. citizenship’s privileges and protections, those who rightfully claim citizenship have been deported as aliens because of mistakes made by those enforcing immigration laws. Such juxtaposition leaves us wondering what the real value of citizenship …

Smoking Behaviours And Cessation Services Among Male Physicians In China: Evidence From A Structural Equation Model, Cheng Huang, Chaoran Gao, Shaohua Yu, Yan Feng, Julia Song, Michael Erikson, Pam Redmon, Jeffrey Koplan

Global Health Faculty Publications

Objective To investigate smoking prevalence and cessation services provided by male physicians in hospitals in three Chinese cities.

Methods Data were collected from a survey of male physicians employed at 33 hospitals in Changsha, Qingdao and Wuxi City (n=720). Exploratory factor analysis was performed to identify latent variables, and confirmatory structural equation modelling analysis was performed to test the relationships between predictor variables and smoking in male physicians, and their provision of cessation services.

Results Of the sampled male physicians, 25.7% were current smokers, and 54.0% provided cessation services by counselling (18.8%), distributing self-help materials (17.1%), and providing traditional remedies …

Medical Advances, Criminal Disadvantages: The Tension Between Contemporary Antiretroviral Therapy And Criminal Hiv Exposure Laws In The Workplace, Chelsey Heindel Jul 2013

Medical Advances, Criminal Disadvantages: The Tension Between Contemporary Antiretroviral Therapy And Criminal Hiv Exposure Laws In The Workplace, Chelsey Heindel

Washington Journal of Law, Technology & Arts

In 1988, the Washington Legislature classified intentionally exposing individuals to the human immunodeficiency virus (HIV) as criminal assault in the first degree. Lawmakers intended to penalize infected individuals without conditioning criminal liability on actual HIV transmission. Since 1988, however, medical technologies and effective HIV treatment have rapidly advanced. Recent studies indicate that effective antiretroviral therapy (ART) can reduce HIV transmission risks to a virtual impossibility during moments of intentional exposure. Despite these medical advances, the 1988 exposure law remains unchanged. Consequently, individuals undergoing effective ART risk felony liability within the course of commonplace work conduct by intentionally exposing others to …

The Ideologies Behind Newspaper Crime Reports Of Latinos And Wall Street/Ceos: A Critical Analysis Of Metonymy In Text And Image, Theresa Catalano, Linda R. Waugh Jul 2013

The Ideologies Behind Newspaper Crime Reports Of Latinos And Wall Street/Ceos: A Critical Analysis Of Metonymy In Text And Image, Theresa Catalano, Linda R. Waugh

Department of Teaching, Learning, and Teacher Education: Faculty Publications

This study illustrates how metonymy in image and text work together to produce dominant ideologies in US media discourse, through careful, multidisciplinary analysis of over 25 articles in online US newspapers from the years 2004 to 2011 that reported crimes committed by Wall Street/CEOs and Latino migrants. Using critical discourse analysis/ studies, multimodal analysis, and cognitive linguistic frameworks, we examine examples of metonymy, which combine to negatively “Other” Latinos and (re)produce positive representations of Wall Street/CEOs. While work in critical metaphor analysis shows how metaphor plays a crucial role in the depiction of participants and events, we argue that metonymy …

Ringers Revisited, Richard H. Underwood

Law Faculty Scholarly Articles

In this short essay, Professor Underwood addresses an important development in the law dealing with eyewitness testimony and the New Jersey case of State v. Henderson. He gets at the subject by looking back to a 1950s television play starring fellow Kentucky resident, William Shatner. However, in this particular instance, William Shatner would not change the world.

The Evolution Of A National Response To Violence Against Women, Robin R. Runge Jul 2013

The Evolution Of A National Response To Violence Against Women, Robin R. Runge

UC Law SF Journal on Gender and Justice

The Violence Against Women Act has a long and important history. VAWA has had a profound impact on the way the legal system defines, identifies, and responds to violence against women. In these remarks, based on Ms. Runge's extensive professional history working on VAWA and related legal issues, she examines the remaining shortcomings of VAWA and praises the progress achieved since the first VAWA was passed in 1994 to the most recent reauthorization in 2013.

The Ongoing Correctional Chaos In Criminalizing Mental Illness: The Realignment's Effects On California Jails, Anastasia Cooper Jul 2013

The Ongoing Correctional Chaos In Criminalizing Mental Illness: The Realignment's Effects On California Jails, Anastasia Cooper

UC Law SF Journal on Gender and Justice

This note explores the increasing presence of the mentally ill in California county jails, specifically in the Los Angeles County Jail. particularly in the context of California's Realignment legislation. The case igniting this reform in California, Brown v. Plata alleged Eighth Amendment violations in California's prison system based on shortcomings in mental health care and medical care. The Supreme Court attributed the violations and deficiencies in care to overcrowding in the prison population. California legislators responded to the Supreme Court's prison-population reduction mandate with Assembly Bill 109 which redirects inmates to county jail. The mentally ill were largely and ironically …

Amicus Curiea Brief: Stormans, Inc. V. Selecky, Sarah L. Ainsworth Jul 2013

Amicus Curiea Brief: Stormans, Inc. V. Selecky, Sarah L. Ainsworth

UC Law SF Journal on Gender and Justice

Preventing pregnancy after sexual assault and violence is critical to a woman's psychological recovery and physical health. Emergency contraception works effectively to prevent pregnancy, and is the medical standard of care for treating women and girls of reproductive age after a sexual assault. While pregnancies pose health risks for every woman, rape-related pregnancies hold profound consequences including compounded trauma and an increased vulnerability to violence. In this brief, amici urge the Ninth Circuit to recognize the importance of access to emergency contraception for all women, and its critical nature for rape and domestic violence survivors.
