Levels Of Generality, Constitutional Comedy, And Legal Design, Adam M. Samaha Jan 2013

Levels Of Generality, Constitutional Comedy, And Legal Design, Adam M. Samaha

Faculty Articles

Many commentators write happy endings to their constitutional stories. This Article examines a few techniques for reaching preferred conclusions without falling outside the boundary of conventional constitutional argument. The investigation is oriented around the levels of generality by which sources of constitutional law are characterized. Level of generality characterizations apply to all sources of constitutional argument including constitutional clauses, originalist history, tradition, and judicial precedent. But there is more than one kind of “generality”—or at least more than one idea associated with that concept in the law literature. We can isolate three different dimensions of source characterization that recur in …

Correlates Of Hunger: Evidence From The Community Based Monitoring System (Cbms) Data Of Pasay City, Frumencio F. Co, Rechel G. Arcilla, Shirlee R. Ocampo

Angelo King Institute for Economic and Business Studies (AKI)

Hunger is one of the major problems in several countries, and the objective to reduce it has become a global concern. A major initiative of the United Nations Millenium Development Goals (MDG) is the eradication of extreme poverty and hunger. However, the attempt to reduce the abovementioned issues, calls for proper identification as to who the impoverished and hungry are. There are several ways to identify the poor, but pinpointing who the hungry are, is another task.

Community Mediation Of Parenting Disputes Between Estranged Parents, Madhawa Palihapitiya, Kaila Obstfeld Eisenkraft Jan 2013

Community Mediation Of Parenting Disputes Between Estranged Parents, Madhawa Palihapitiya, Kaila Obstfeld Eisenkraft

Massachusetts Office of Public Collaboration Publications

Community mediation, characterized by free or low cost mediation services delivered primarily by volunteer mediators, aims to provide effective dispute resolution services to a broad spectrum of the population, particularly to underserved and low-income populations. The present study seeks to determine whether community mediation fulfills this goal with respect to divorce/separation-related parenting disputes while concomitantly testing the legitimacy of concerns about the quality of mediation services offered according to a community mediation model. Thus, the effectiveness of community mediation in resolving these disputes is measured through indicators reported by mediation participants, such as the population served, mediation results and party …

New Silicon Valleys Or A New Species? Commoditization Of Knowledge Work And The Rise Of Knowledge Services Clusters, Stephan Manning

Management and Marketing Faculty Publication Series

This paper explores knowledge services clusters (KSCs) as a distinct and increasingly important form of geographic cluster, in particular in emerging economies: KSCs are defined as geographic concentrations of lower-cost skills serving global demand for increasingly commoditized knowledge services. Based on prior research on clusters and services offshoring, and data from the Offshoring Research Network (ORN), major properties and contingencies of KSC growth are discussed and compared with both high-tech clusters and low-cost manufacturing clusters. Special emphasis is put on the ambivalent effect of commoditization of knowledge work on KSC growth: It is proposed that KSCs attract most projects if …

Christ And Class: The Protestant Episcopal Church In The South, 1760-1865, Ryan Lee Fletcher

Electronic Theses and Dissertations

Christ and Class: The Protestant Episcopal Church in the South, 1760-1865 Ryan Lee Fletcher This dissertation examines the emergence, practices, religious culture, expansion, and social role of the Protestant Episcopal Church in the American South from 1760 to 1865. The dissertation employs three major research methodologies by: (1) centralizing the role of social class in the Episcopal Church's history, (2) seriously considering the Episcopal Church's distinctive theology, and (3) quantifying the connections that linked the Episcopal Church to the South's economic structures. Archival research, periodicals, and published records related to the Protestant Episcopal Church provided the primary evidence used in …

Policing Alcohol And Related Crimes On Campus, Andrea Nicole Allen Jan 2013

Policing Alcohol And Related Crimes On Campus, Andrea Nicole Allen

Theses and Dissertations

Research shows that college students drink alcohol frequently and heavily. This can compromise their health and well-being. Student drinking is also tied to crime. While prior work explores the nature and extent of crimes involving alcohol on campus, to date no study has examined how police handle these incidents or crime generally. This study fills that gap in the literature. Qualitative and quantitative data were collected by observing and interviewing campus officers at a large Southeastern university as they navigated through encounters with citizens. Findings include the following. Officers handle a variety of crimes, and do not have a single-faceted …

Theses and Dissertations

The purpose of this study is to test Gordon Allport's theory of Contact Hypothesis about cultural attitude change in college students. Participants were college First year students participating in First year seminar classes in a small southeastern liberal arts university. The treatment group of randomly selected First year seminar classes was exposed to a one-week seminar designed to address the issue of cultural diversity. A non-treatment group received the standard instruction on this issue. The content of the seminar included exposure to multicultural issues that include Allport's most important tenants for changing prejudicial attitudes. For this study components of Allport's …

A Constructivist Examination Of Counselors' Conceptualization Of "Sexuality": Implications For Counselor Education, Wenndy Dupkoski Mallicoat Jan 2013

A Constructivist Examination Of Counselors' Conceptualization Of "Sexuality": Implications For Counselor Education, Wenndy Dupkoski Mallicoat

Theses and Dissertations

Due to the dialectical dilemma between meeting the demands of the managed health care industry through the adherence to the medical model while promoting an emphasis on wellness, the counseling profession does not promote a consistent definition of sexuality. Using a qualitative, phenomenological approach from a constructivist lens, this study was conducted to examine the construct "sexuality" and "sexuality counseling" from counselors' perspectives. One synchronous online focus group and two online individual interviews were conducted with counselors predominantly in the Southeastern United States. Themes from the data include: Sexuality is multi-dimensional; sexuality is developmental; sexuality counseling is dialectical; and sexuality …

“Just Let Us Teach!”: Living Literacy Policy In And Around Maplewood Elementary School, Cindy Anne Morton-Rose Jan 2013

“Just Let Us Teach!”: Living Literacy Policy In And Around Maplewood Elementary School, Cindy Anne Morton-Rose

Theses and Dissertations

Through a sociocultural lens this study explored how four teachers, a reading teacher, and their principal lived literacy policy in practice in and around Maplewood Elementary School. This work grew out of three questions: (a) How do six policy stakeholders at one elementary school--four teachers, one administrator, and one reading teacher--make meaning of literacy policies? (b) How do these stakeholders' understandings shape the appropriation of these policies in their day-to-day literacy practices? and (c) How does the meaning-making of other stakeholders--district, state, and federal policy-makers--intersect with and inform the appropriation of policy by the six focal stakeholders? In asking these …

A Global Joyce: Early Sightings Of Cosmopolitan Ethics In Ulysses, Matthew Zeller Jan 2013

A Global Joyce: Early Sightings Of Cosmopolitan Ethics In Ulysses, Matthew Zeller

Theses and Dissertations

'Ulysses is like a great net let down upon the life of a microcosmic city-state, Dublin, wherein lie captured all sorts and conditions of men and minds,' wrote Stuart Gilbert, the famous literary scholar whose landmark 1930 book-length investigation into Joyce's magnum opus cemented his legacy as one of the first Joyceans. In saying so, Gilbert quietly proposes an early reading of Joyce's global ethics long before the study of humanities had developed the post-colonial focus necessary to more fully grasp the cosmopolitan ethics asserted in Ulysses. Gilbert was not alone. Because of his self-imposed exile and thematic insistence on …

The Rhetorical Event Of Modern Southern Humor: "A Requisite Element In Discourse", David Allen Wright Jan 2013

The Rhetorical Event Of Modern Southern Humor: "A Requisite Element In Discourse", David Allen Wright

Theses and Dissertations

This dissertation examines the rhetorical nature and dynamics of Southern humor in the second half of the twentieth century by analyzing, from a distinctly rhetorical perspective, a selection of popular Southern humor texts. It seeks to understand how Southern humor happens--its methods and techniques--and it also seeks to understand, as much as possible, the implications of these events for the various interlocutors and participants involved. By investigating the stylistic, storytelling, and linguistic techniques of Southern humor, while relying on the scholarship of writers in a variety of academic disciplines, I hope to answer the following research question: how does Southern …

Childish Figuring: The Child As Symbol And Actor In Lillian Smith's Killers Of The Dream And James Agee's Let Us Now Praise Famous Men, Katherine Eveline Upton Jan 2013

Childish Figuring: The Child As Symbol And Actor In Lillian Smith's Killers Of The Dream And James Agee's Let Us Now Praise Famous Men, Katherine Eveline Upton

Theses and Dissertations

In this thesis, I examine the presentation of the child in James Agee's Let Us Now Praise Famous Men and Lillian Smith's Killers of the Dream as part of a rhetoric of growth. Both Agee and Smith present southerners as psychologically immature due to their traumatic childhood experiences of sexism, racism and poverty. Childhood is a recurring theme in both texts. Agee and Smith present childhood as a biological, developmental stage and a metaphor for growth in their texts. The child is a real, contextually-specific figure, drawn from Agee's and Smith's observations of children in Depression-era society. Images of children's …

Does Human Genetic Diversity Affect Net Productivity?, Breyon Jontae Williams Jan 2013

Does Human Genetic Diversity Affect Net Productivity?, Breyon Jontae Williams

Theses and Dissertations

Quamrul Ashraf and Oded Galors' (2013) study, "The `Out of Africa' Hypothesis, Human Genetic Diversity, and Comparative Economic Development", seeks to explain cross-country variations in economic development, particularly per capita income, through variations in human genetic diversity. Their analysis depends on two fundamental assumptions; genetic diversity's positive effect upon technological productivity and its negative effect upon social capital. This study tests the validity of the results presented by Ashraf and Galor. Specifically, this study seeks to test whether or not the hump-shape relationship observed between income per capita and predicted genetic diversity is validated. Our empirical work supports their findings.

Theses and Dissertations

As the number of individuals age 60 years of age and older continues to rise in the United States, the care and safety of this population will be a growing issue. There are many contributing factors and reasons why elder abuse occurs. Elder abuse is an emerging issue; however there is limited research and understanding in the area. There are barriers to the detection and prevention of the issue. Emergency department staff is essential to the identification and detection of possible abuse, and it is important that these providers understand the risk factors and physical manifestations of abuse and neglect …

The Indian Removal Debate And The Rise Of Partisan Identity In The Age Of Jackson, Benjamin Greene Jan 2013

The Indian Removal Debate And The Rise Of Partisan Identity In The Age Of Jackson, Benjamin Greene

Theses and Dissertations

The election of Andrew Jackson to the presidency in 1828 coincided with the rise of the nation's "second party system." The divide which emerged between Jacksonian Democrats and their opposition party, the Whigs, is generally accepted as marking the origin of an American political culture defined by a partisan divide. Political historians of the period have often focused on the key divisive issues: South Carolina's nullification agitation, the Bank Crisis, and working class identity politics have been most often featured in this scholarship. The Indian Removal Debate has generally been examined as ancillary to these partisan developments, an after-effect for …

The Role Of Gender In Intergenerational Transmissions Of Education And Occupational Promotion, Si Wang Jan 2013

The Role Of Gender In Intergenerational Transmissions Of Education And Occupational Promotion, Si Wang

Theses and Dissertations

While several studies have suggested the importance of maternal schooling to children's outcomes during childhood, less is known about the role when the child is older. In the first chapter, I estimate the relationship between maternal education and children's college attendance. After developing a theoretical model to consider the transmission of education across generations, I use the NLSY79 Child and Young Adult Surveys for empirical analysis. College proximity is used as an instrument for mother's schooling. All else equal, results suggest that maternal schooling significantly increases a child's probability of attending college by about 2 to 3 percentage points. The …

Drawing The Line: Student Reassignment Policies In South Carolina, Naomi Rachel Simmons Jan 2013

Drawing The Line: Student Reassignment Policies In South Carolina, Naomi Rachel Simmons

Theses and Dissertations

This study investigates the complex nature of student reassignment plans developed between 2006 and 2008 in three South Carolina school districts: York School District 3, Dorchester School District 2, and Greenville School District. The study is guided by the following research question: How are the district policies for student reassignment understood through the lens of institutional and organizational theories? To answer this question this research draws on Institutional Theory (both old and new) to develop a comprehensive model that specifically addresses the strategies a district uses to create a plan that responds to the demographic and political pressures exerted on …

The Role Of Recovery In Attenuating The Negative Effects Of Perceived Stigmatizing Attitudes For Persons With Psychiatric Disabilities, Betsy Alison Davis Jan 2013

The Role Of Recovery In Attenuating The Negative Effects Of Perceived Stigmatizing Attitudes For Persons With Psychiatric Disabilities, Betsy Alison Davis

Theses and Dissertations

For many people who experience psychiatric disabilities (PD), community experiences are largely characterized by stigmatizing interactions, discrimination, and losses of opportunities for employment, housing, or relationships. Social withdrawal and loss of self-esteem can be secondary consequences of such negative experiences. However, research has also explored various mechanisms through which people in historically stigmatized social groups can minimize some of the negative effects of stigma. Many of these strategies are theorized to be similar to a mental health recovery orientation which emphasizes the empowerment, capabilities, and strengths of mental health consumers. The present investigation explores the possibility of recovery attenuating some …

That's News To Me: An Exploratory Study Of The Uses And Gratifications Of Current Events On Social Media Of 18-24 Year-Olds, John Vincent Karlis

Theses and Dissertations

Social media is a dominant news source among the college-age demographic (18-24). Inherent in news consumption on social media is current events, that is, news that has individual relevance, societal relevance and is time constrained. This study adds to the existing body of uses and gratification literature. This one-shot exploratory study is the first of its kind, examining the "what" or different dimensions of news and the "why" or uses and gratifications that 18-24 year-olds use current events on social media. It also looked at the factors predicting recall of current events on social media.

Using a survey of 896 …

Parental Involvement During College Preparation: Differences Between First And Non-First Generation College Students, Deronta Renard Spencer Jan 2013

Parental Involvement During College Preparation: Differences Between First And Non-First Generation College Students, Deronta Renard Spencer

Theses and Dissertations

In this thesis I explore differences in parental involvement during college preparation between first and non-first generation college students. I used the theories of social, cultural, and human capital to answer this question. I also look at how first and non-first generation differ among several other variables: parent's education, socioeconomic status, religion affiliation, religious attendance, gender, birth order, family structure, high school academic success, and parent involvement during sibling college preparation. I find that first generation students receive less parental involvement during college preparation than non-first generation college students. I also find differences between first and non-first generation students in …

The Parasitic Oligarchy? The Elites In Trinidad And Tobago, Alison Mc Letchie Jan 2013

The Parasitic Oligarchy? The Elites In Trinidad And Tobago, Alison Mc Letchie

Theses and Dissertations

The existence of an elite class within societies is often a topic of research in the study of inequality of power and influence. Researchers, however, acknowledge that the nature and composition of the elite varies. Trinidad and Tobago, with its colonial history and diverse population has had to confront issues surrounding access to power by various groups within the society. One driving force of the 1970s Black Power Revolution was the practice of color discrimination in the banking industry. Informed by Mills' (1956) elite theory and rooted in Beckford's (1972) economic theory, this project surveys the elite of Trinidad and …

The Body As Wartime Terrain: Social Control And Female Sexuality Under Military Occupation, Frances Choe Jan 2013

The Body As Wartime Terrain: Social Control And Female Sexuality Under Military Occupation, Frances Choe

Theses and Dissertations

This project is a comparative-historical sociological analysis of the informal and formal responses to sexual contact in two WWII period cases: between French women and Nazi troops, and German women and African-American GIs. I focus on the connection between the regulation of women's bodies and cultural expectations of gender, ideas about sexuality, and racial ideology. The results of war and subsequent occupation of the defeated nation - population decline and the acute loss of male life, strained material resources and the daily concern of survival, the social psychological sense of defeat, and intimate relationships between occupiers and the occupied - …

Inequality And Opportunity At Themsa-Level: Investigating Place As A Structure Of Inequality Shaping Mobility And Earnings, Colby R. King

Theses and Dissertations

This study examines how the new urban economy has transformed the structures that impact individual earnings opportunities across place. Using data from the 1990 and 2000 Census, this study is based on two multi-level data sets, each reporting characteristics for approximately 2 million individuals nested within more than 200 Metropolitan Statistical Areas (MSAs). This study examines how inequality varies across MSAs in the US. Associations between MSA-level characteristics, including proportion of employment in new economy sectors, earnings, educational attainment, and inequality, are tested. Strong evidence is found demonstrating strong and statistically significant correlations between new economy indicators and MSA-level inequality, …

Ruminating On Ruminants: Goats And The People Who Raise Them In South Carolina, Brianna Dyan Farber Jan 2013

Ruminating On Ruminants: Goats And The People Who Raise Them In South Carolina, Brianna Dyan Farber

Theses and Dissertations

In South Carolina, many farmers and homesteaders have utilized goats as an adaptive and versatile resource and component of their diversified farming operations. This thesis addresses the experiences, motivations, difficulties, and successes of people raising goats in South Carolina, in the context of sustainable agricultural practice and landscapes. Goats cohabit insecure but promising ecological, political, economic, and sociocultural landscapes with humans and other nonhuman species. These relationships can undermine and support goats as belonging in South Carolina. My participants cannot simply raise goats as a purely economic choice because they create meaningful emotional relationships with their animals. Goats can become …

Divine Discontent: Nathan Carter Newbold, White Liberals, Black Education, And The Making Of The Jim Crow South, Barry Malone Jan 2013

Divine Discontent: Nathan Carter Newbold, White Liberals, Black Education, And The Making Of The Jim Crow South, Barry Malone

Theses and Dissertations

In the first half of the twentieth century, a small but vocal group of white southerners believed it possible to protect the flanks of the South's caste system by dampening black impatience with Jim Crow. Nathan Carter Newbold, a white racial moderate and State Agent for Negro Education, became a leading voice for the 'equalization without social equality' movement. Newbold believed blacks accepted the separation of the races as natural and beneficial to both, but they also expected whites to deliver equality of opportunity. The failure to meet this responsibility led blacks to engage in political and judicial activism. This …
