Second-Class Families: The Challenges And Strategies Of Mixed-Status Immigrant Families, Diana Maritza Guelespe Jan 2013

Second-Class Families: The Challenges And Strategies Of Mixed-Status Immigrant Families, Diana Maritza Guelespe

Dissertations

The most recent peak in migration has involved large numbers of undocumented people and much of the sociological scholarship on immigration explores their lives as individuals and how they stay connected to their family across borders, but there is little research about the new phenomenon of mixed-status immigrant families-- families with at least one unauthorized immigrant and one U.S. citizen--or how their families face the looming risk of separation. The purpose of this dissertation is to describe the experiences and challenges these families confront. Why has there been a rise in mixed-status immigrant families? How does the relative permanence of …

Knowing The Communities We Serve, Liana Fiol Matta Jan 2013

Knowing The Communities We Serve, Liana Fiol Matta

Court Review: Journal of the American Judges Association

When courts and poor communities interact, they sometimes seem to move on different planes and speak different languages. The reality is that most judges are alienated from poor communities. We don’t understand their problems, their needs, and their aspirations, because we don’t generally have a background in poverty, whether personal or professional. But we are, after all, public servants and, as such, we must transcend this alienation and truly get to know the communities we serve.

This, however, is not an easy task, because these communities are not all the same nor do they have the same problems, characteristics, and …

Gothic Slumming: Realist Writers And Gothic Texts In Progressive Era America, Gillian Nelson Bauer Jan 2013

Gothic Slumming: Realist Writers And Gothic Texts In Progressive Era America, Gillian Nelson Bauer

Dissertations

During the Progressive Era, American realist and naturalist writers frequently employed the gothic mode. In contrast with critics who contend that the gothic is a subversive or disruptive mode, I suggest that the relationship between realism and the gothic is one of collaboration rather than conflict. These modally mixed works, which I refer to as gothic realism, express class anxieties that arose during this period, concerns that resulted from the rapid urbanization, immigration, increased cross-class interaction, and economic precariousness that mark the latter end of the nineteenth and the early years of the twentieth centuries. Following Teresa Goddu, I consider …

Improving Judicial- Performance Evaluation: Countering Bias And Exploring New Methods, Jennifer K. Elek, David B. Rottman Jan 2013

Improving Judicial- Performance Evaluation: Countering Bias And Exploring New Methods, Jennifer K. Elek, David B. Rottman

Court Review: Journal of the American Judges Association

Official judicial-performance evaluation (JPE) programs in the United States emerged to achieve important judicial-branch objectives. JPE programs respond to the need for courts to demonstrate accountability, provide information for voters in low-information judicial-retention elections, improve the quality of the bench by providing feedback for individual judges to use for self-evaluation purposes, and assist judicial administrators in making decisions on retention and assignments in some states with appointed judiciaries. A number of professional organizations, such as the American Bar Association, American Judicature Society, and the Institute for the Advancement of the American Legal System, are strong advocates for the value of …

Who Are You Going To Believe?, Richard Schauffler, Kevin S. Burke

Court Review: Journal of the American Judges Association

Although most of the time people tell the truth, people do lie. On a bad day, those working in the justice system get lied to all day long. Some days the lies are harmless, even unnecessary, and they amuse and entertain. Some of the lies are a product of self-deception: “I can quit doing drugs any time I want.” Some statements are not lies but honest mistakes: “I’m sure that is the guy who robbed me.” But on other days the lies are despicable and dangerous, and they must be exposed.

The question is: Can we tell the difference between …

Why We Have No Theory Of European Private Law Pluralism, Ralf Michaels Jan 2013

Why We Have No Theory Of European Private Law Pluralism, Ralf Michaels

Faculty Scholarship

The recent popularity of legal pluralism has now reached the area of European private law. In this paper Michaels scrutinizes the concepts of legal pluralism used by three of its most prominent proponents: Pierre Legrand, Jan Smits, and Thomas Wilhelmsson. He does not offer fully-fledged criticism of their theories (each of which are among the most fascinating and helpful in the European private law debate) but only address their use of ideas of legal pluralism, and the relation of these ideas with the legal pluralism debate. His analysis shows not only that these three use sharply different concepts of legal …

Remix Perspectives presents a bricolage synthesis of transdisciplinary insights for workshop leaders and creative writers, appropriated from selected artistic and literary voices from more or less the last hundred years. Seminal concepts from arts such as painting, poetry, dance, music, and photography are gathered here as they inform the arts of literary fiction and creative nonfiction. When Socrates Meets Confucius: Teaching Creative And Critical Thinking Across Cultures Through Multilevel Socratic Method, Erin Ryan, Xin Shuai, Yuan Ye, You Ran, Li Haomei Jan 2013

When Socrates Meets Confucius: Teaching Creative And Critical Thinking Across Cultures Through Multilevel Socratic Method, Erin Ryan, Xin Shuai, Yuan Ye, You Ran, Li Haomei

Nebraska Law Review

This Article presents a case study of adapting the Socratic method to teach critical-thinking skills underemphasized in Chinese universities and group competency skills underemphasized at U.S. institutions. As we propose it here, Multilevel Socratic teaching integrates various levels of individual, small group, and full-class critical inquiry, offering distinct pedagogical benefits in Eastern and Western cultural contexts where they separately fall short. After exploring foundational cultural differences underlying the two educational approaches, this Article reviews the goals, methods, successes, and challenges we encountered in the development of an adapted “Multilevel Socratic” method, concluding with recommendations for further application in both contexts. …

Review Of Working People In Alberta: A History Edited By Alvin Finkel., Tom Langford Jan 2013

Review Of Working People In Alberta: A History Edited By Alvin Finkel., Tom Langford

Great Plains Quarterly (through 2013)

Working People in Alberta can be divided into three main parts. Two relatively short chapters comprise the first part, summarizing what is known about the working lives of Aboriginals in what we now call Alberta prior to contact with Europeans, and the experiences of workers during the period of the fur trade and early European settlement. The second part is the bulk of the book: six chapters presenting a detailed chronological history from 1885 to 2010 that melds labor history, social history, and political economy. Two additional chapters, comprising the third part, highlight important themes (namely “Women and Labour” and …

Food: A Human Rights Issue Ignored In Sociology, Kathryn Strother Ratcliff, Trisha Tiamzon Jan 2013

Food: A Human Rights Issue Ignored In Sociology, Kathryn Strother Ratcliff, Trisha Tiamzon

Societies Without Borders

Mainstream sociology, including the sociology of health, has been remiss by ignoring food as an important human right both in the United States and globally. This article documents the neglect of food as a topic of sociological inquiry and argues for the centrality of a sociological lens in understanding food as a human right. Sociological ideas are important in understanding forces which have encouraged the globalization of food production and distribution, decreased the equality of access to nutritious food, and threatened core human rights. Sociologists as teachers and researchers need to become academic activists on this important human rights topic.

A Critical View Of Graduate Unions, Deeb Paul Kitchen Ii Jan 2013

A Critical View Of Graduate Unions, Deeb Paul Kitchen Ii

Societies Without Borders

Institutions of higher education increasingly focus on their economic functions and have adopted labor force practices that resemble private businesses. One such strategy is a greater reliance on employing graduate students to perform tasks previously done by faculty. Simultaneously, graduate employees have organized labor unions and pushed for rights and benefits other organized workers have sought. This is a practice that should be of concern to human rights sociologists, lest we neglect to critically reflect on the social relations that our work is embedded within, thereby damaging our abilities to champion the oppressed. This case study examines how graduate labor …
