What Lies Beneath: Interpretive Methodology, Constitutional Authority, And The Case Of Originalism, Christopher J. Peters Jan 2013

What Lies Beneath: Interpretive Methodology, Constitutional Authority, And The Case Of Originalism, Christopher J. Peters

All Faculty Scholarship

It is a remarkable fact of American constitutional practice that we cannot agree on a methodology of constitutional interpretation. What can explain our disagreement? Is it the product of a deeper, principled dispute about the meaning of constitutional law? Or is it just a veneer – a velvet curtain obscuring what is really a back-room brawl over political outcomes?

This Article suggests that these, in essence, are the only viable possibilities. Either we disagree about interpretation because we disagree (or are confused) about constitutional authority – about why the Constitution binds us in the first place; or we disagree because …

Law Enforcement Personnel And Lawmaking, Katrina Roberts Jan 2013

Law Enforcement Personnel And Lawmaking, Katrina Roberts

A with Honors Projects

Police officers have the difficult job of reconciling two deeply held but conflicting values: our desire to be safe and secure and our strong belief in the right of individuals to be free from government coercion and excessive control. How law enforcement officers and departments handle this conflict has a direct bearing on how the public sees them. As a culture, we expect our police officers to be able to balance these goals, but when they veer off too far we criticize them. At the extreme, too heavy a focus on order and safety may border on police brutality.

Religion Research In International Relations: A Taxonomy, John Rees Jan 2013

Religion Research In International Relations: A Taxonomy, John Rees

Arts Papers and Journal Articles

The discipline of international relations (IR) is beginning to readily engage with the variegations of religion manifest in world politics. The essay argues that the perception of research about religion can therefore no longer remain homogenous and it is imperative to differentiate between types of religion research available to IR scholars and policy-makers. With this objective in mind, the essay differentiates between four suggested types of religion research in the IR corpus (policy, cultural, global and postsecular research) and briefly identifies three additional types (disciplinary, data, and primary source research). It is posited that the demarcation between types is important …

Feminist Approaches And The South African News Media, Denise Buiten Jan 2013

Feminist Approaches And The South African News Media, Denise Buiten

Arts Papers and Journal Articles

Despite apparent feminist advancements within contemporary South Africa, gender transformation in the South African media industry has been both limited and irregular in terms of the ways in which newsroom cultures are being transformed, and the ways in which this impacts on the production of gendered media texts. Based on interviews with journalists and editors from three weekly South African newspapers, the Sunday Times, the Sunday Sun and the Mail & Guardian, this article explores the ways in which journalists articulate their understandings of gender and gender transformation within the media, and reflects on the ways in which these articulations …

Constructions And Representations Of Masculinity In South Africa's Tabloid Press: Reflections On Discursive Tensions In The Sunday Sun, Denise Buiten, Kammila Naidoo

Arts Papers and Journal Articles

The South African print news media have witnessed a sharp rise in tabloidised news forms and newspapers in recent years. While tabloidisation offers interesting possibilities in terms of contesting and transforming traditional masculinised news forms, it also raises serious questions with regard to the appropriation of these forms of news towards reinforcing and naturalising constructions of gender. This article explores the ways in which a South African tabloid newspaper, the Sunday Sun, represents and constructs masculinity. It is argued that the performance of masculinity, especially through the performance of (hetero)sexuality, is central to the way in which the ‘project’ of …

Gender Segregation And Non-Conformity In Public Restrooms, Jake Paiva Jan 2013

Gender Segregation And Non-Conformity In Public Restrooms, Jake Paiva

Theses & ETDs

This thesis explores public opinions of sex-segregated restrooms and reactions to gender non-conforming individuals in these gendered spaces via open-ended surveys distributed in downtown Sarasota, FL. The emerging arguments for sex-segregated restrooms bring up seemingly practical concerns: safety, privacy, and cleanliness. However, these concerns are raised in the context of necessitating gender separation by individuals who exist in a gendered society, and are thus indicative of a larger set of underlying societal attitudes and beliefs about sex and gender. These attitudes convey a conceptualization of women as more vulnerable and needy than men, in terms of protection, quality of facilities, …

To Think Or Not To Think: The Effects Of Emotionally Charged Introspection Before Written Emotional Expression Of A Traumatic Experience, Zoe Posner Jan 2013

To Think Or Not To Think: The Effects Of Emotionally Charged Introspection Before Written Emotional Expression Of A Traumatic Experience, Zoe Posner

Theses & ETDs

The effects of two types of introspection, one emotional and relevant to writing and one neutral and unrelated to writing, were compared in combination with a ten minute period of written emotional expression about a traumatic life experience. Forty five undergraduate participants were randomly assigned to one of three conditions: 1) emotional introspection, 2) neutral introspection, or 3) control. Participants in the emotional introspection condition experienced significantly fewer intrusive and avoidant thoughts as compared to participants in the neutral introspection condition. Affective scores significantly differed after writing for both introspection conditions but did not surpass that of the control condition …

Visible Formalizations And Formally Invisible Facticities, Saskia Sassen Jan 2013

Visible Formalizations And Formally Invisible Facticities, Saskia Sassen

Indiana Journal of Global Legal Studies

This essay focuses on a range of formal and informal practices that I hypothesize as the making of new types of jurisdictions with variable relations to the traditional jurisdiction of the state over its territory. One effect is to contribute to an emergent misalignment between territory and territoriality. A second effect is to make structural holes in the tissue of national state sovereign territory. Both processes contribute new types of borderings inside national territory. The action is not on interstate borders, but in the interior of the state, which can mean an extension of one state into another's territorial jurisdiction …

Mimosa 2012/2013, Jacksonville State University

JSU Yearbooks

The JSU Yearbook Collection spans the years from 1926 to the present. The publication began in 1926 as the Teacola (some volumes spelled "Teacoala") and continued under this title through 1933. The yearbook appears to have ceased printing after that year; the student newspaper took the name Teacola (later changed to the Collegian and finally the Chanticleer) and began publication in 1934. The yearbook started up again in 1947 under the name Mimosa. The Library holds all volume years that were printed: 1926-1933, 1947-1950, 1952-present.

Human Behavioral And Ecological Risk Factors For Lyme Disease Infection On Block Island, Rhode Island, Casey James Finch Jan 2013

Human Behavioral And Ecological Risk Factors For Lyme Disease Infection On Block Island, Rhode Island, Casey James Finch

Public Health Theses

Peridomestic exposure to infected Ixodes scapularis nymphs is considered the dominant means of infection with tick-borne pathogens in the eastern United States. Previous studies of risk of developing tick-borne infection established a positive association between the density of infected nymphs and Lyme disease cases at the population level. Studies examining the effectiveness of personal protective behaviors have not included measures of tick exposure. This study simultaneously assesses the effect of tick exposure and human behavior in Lyme disease infection risk using a longitudinal serosurvey study on Block Island, RI. Tick exposure risk at all Island properties was estimated by identifying …

In-Service Teachers’ Understanding And Teaching Of Humane Education Before And After A Standards-Based Intervention, Stephanie Itle-Clark

Education Collection

The purpose of this study was to examine the ways in which credentialed educators conceptualized, understood, and perceived humane education, as well as their intent to include humane education in personal practice and their knowledge of strategies for integrating humane education concepts into their classroom work. The group of 25 educators participated in an online eight-week professional development course and completed pre- and post-surveys. The participants consisted of educators from the United States, British Columbia, and Vietnam. Participants were 11 secondary educators, 10 primary educators, 2 substitute teachers, 1 administrator, and 1 librarian. Results indicate that after an eight-week professional …

Online Education: Issues, Challenges And Implications, Michael Olalekan Olatunji, Michael Olalekan Jan 2013

Online Education: Issues, Challenges And Implications, Michael Olalekan Olatunji, Michael Olalekan

Khazar Journal of Humanities and Social Sciences

Swenson (2007) observed that “in the space of one brief decade, the internet has changed our world and most of us with it”. He remarked further that our ways of doing things are different now as a result of digital revolution in education. To be successful therefore in a 21st century world, in which knowledge is generated at an ever increasing pace, requires that learning be made an ongoing process of skill development and knowledge creation. Online education programs are a reflection of this new world as they offer education without borders (Levine & Sun, 2003). Online education has experienced …

Legality, Criminality And Agency Beyond The State: Forest Governance, Illegal Logging And Associated Trade, Lorraine Elliott Jan 2013

Legality, Criminality And Agency Beyond The State: Forest Governance, Illegal Logging And Associated Trade, Lorraine Elliott

Comparative Research in Law & Political Economy

This paper examines the disconnect between the literature on and practice of legality verification (LV) in the forest sector and what would seem to be a logical extension into the literature on and responses to forest crime and, more specifically, transnational criminality associated with the trade in illegally logged timber. The apparently logical overlap between these two areas of endeavour arises because both are dealing with aspects of supply chains or chains of custody involving raw timber, forest products or timber products more generally. The disconnect, I suggest here, arises because of a lack of ‘joined up thinking’ between the …

The Impact Of The Human Provincial Administrative Procedure Provisions, Peter Witherington Jan 2013

The Impact Of The Human Provincial Administrative Procedure Provisions, Peter Witherington

UC Law SF International Law Review

In April, 2008, Zhou Qiang, then the governor of Hunan Province (and current president of China's Supreme People's Court), presided over the adoption of the Hunan Provincial Administrative Procedure Provisions ("Provisions"). At its passage, this regulation represented the first comprehensive code of administrative procedure to be adopted in the People's Republic of China. This Note contends that Provisions represent a departure for administrative procedure in China, and should be viewed as a positive, if preliminary, step towards comprehensive rule of law.

Beginning with a brief overview of modern Chinese administrative law and its theoretical underpinnings, this Note presents the argument …

The Equal Employment Opportunity Commission And Structural Reform Of The American Workplace, Margo Schlanger, Pauline T. Kim Jan 2013

The Equal Employment Opportunity Commission And Structural Reform Of The American Workplace, Margo Schlanger, Pauline T. Kim

Law & Economics Working Papers

In 2011, the United States Supreme Court struck down a class action suit alleging that Wal-Mart stores discriminated against female employees in pay and promotion decisions, making it more difficult to obtain certification of private employment discrimination class actions. As a result, the role of the Equal Employment Opportunity Commission in seeking structural reform of the workplace, always of substantial influence, has gained in comparative importance. Yet there is remarkably little written about the EEOC’s large-scale injunctive cases. This Article addresses this major gap in scholarship.

Using both qualitative case studies and a new quantitative data-set, we test existing theories …

Evidence-Based Sentencing And The Scientific Rationalization Of Discrimination, Sonja B. Starr Jan 2013

Evidence-Based Sentencing And The Scientific Rationalization Of Discrimination, Sonja B. Starr

Law & Economics Working Papers

This paper critiques, on legal and empirical grounds, the growing trend of basing criminal sentences on actuarial recidivism risk prediction instruments that include demographic and socioeconomic variables. I argue that this practice violates the Equal Protection Clause and is bad policy: an explicit embrace of otherwise-condemned discrimination, sanitized by scientific language. To demonstrate that this practice should be subject to heightened constitutional scrutiny, I comprehensively review the relevant case law, much of which has been ignored by existing literature. To demonstrate that it cannot survive that scrutiny and is undesirable policy, I review the empirical evidence underlying the instruments. I …

Exploring The Gender-Specific Needs Of Female Refugees During Resettlement And Integration: A Case Study In Pittsburgh, Kristina Sue Kimura Jan 2013

Exploring The Gender-Specific Needs Of Female Refugees During Resettlement And Integration: A Case Study In Pittsburgh, Kristina Sue Kimura

Electronic Theses and Dissertations

Recently Pittsburgh has experienced a noticeable increase in the number of incoming refugees, which has put added pressure on local service providers to develop more efficient resettlement practices. While female refugee's experiences have been largely ignored, this study attempts to better understand the gender-specific needs of female refugees who resettle and integrate into Pittsburgh. I used Ager and Strang's (2004) Indicators of Integration framework, with a focus on the indicators of "employment," "social bridges," "language and culture," and "rights and citizenship," and adapted it to a gendered perspective to analyze data from two focus group sessions with 11 refugee women …
