Transnational Human Rights Litigation And Territorialized Knowledge: Kiobel And The ‘Politics Of Space’, Philip Liste
Transnational Human Rights Litigation And Territorialized Knowledge: Kiobel And The ‘Politics Of Space’, Philip Liste
Comparative Research in Law & Political Economy
In Kiobel v. Royal Dutch Petroleum Dutch and British private corporations were accused of having aided and abetted in the violation of the human rights of individuals in Nigeria. A lawsuit, however, was brought in the United States, relying on the Alien Tort Statute - part of a Judiciary Act from 1789. In its final decision on the case, the US Supreme Court has strongly focused on ‘territory.’ This usage of a spatial category calls for closer scrutiny of how the making of legal arguments presupposes ‘spatial knowledge,’ especially in the field of transnational human rights litigation. Space is hardly …

What Lies Before, Behind And Beneath A Case? Five Minutes On Transnational Lawyering And The Consequences For Legal Education, Peer Zumbansen
Comparative Research in Law & Political Economy
The following paper serves as the Epilogue to an edited volume that celebrates the first decade of McGill’s ambitious legal education reform in "Transsystemic Law". Placing this innovation in a larger context of curriculum reform, law school crisis – then and now -, it becomes apparent that McGill’s program can be seen as part of global changes in the way that law schools struggle with student expectations, market demands, and shifting frameworks of domestic and transnational lawyering. Karl Llewellyn’s observations "On What is Wrong With Legal Education" ring true still today, almost eighty years later. Still we seek ways to …
Gender Differences And Factors Affecting Brand Loyalty, Olivia Rajska
Gender Differences And Factors Affecting Brand Loyalty, Olivia Rajska
Honors Capstones
Little is known about apparel brand loyalty regarding satisfaction of clothing purchase. This study was developed to examine whether brand satisfaction and brand reputation influence brand loyalty. Another objective of this study was to compare clothing satisfaction of a loyal brand between males and females. Following a focus group interview, a survey questionnaire was developed. A total of 106 participants consisting of 46 males and 58 females completed the survey questionnaire. Results of Pearson Correlations showed brand loyalty was positively related to brand satisfaction (r = .37, p <.001) and brand reputation (r = .33, p <.001). A strong positive correlation (r = .51, p <.001) was found between brand satisfaction and brand reputation. Independent sample t-tests indicated significant differences between males and females in trend (Mf = 4.46, Mm=3.98), promotion(MF = 3.60, Mm=2.90), return policies (Mf = 3.98, Mm=3.20)., display (Mf = 4.08, Mm=3.02), fitting rooms(MF = 3.64, Mm=2.68), store environment (Mf = 4.21, Mm=3.54), sales associates (Mp = 4.02, Mm=3.39) and overall experience (Mf = 3.15, Mm=2.63) on a 5-point scale. This study had implications for apparel retailers and marketers and they could develop brand loyalty for male and female customers. In order to develop customer loyalty, apparel brand should focus on trendy apparel, sales and promotions, return policies, displays, fitting rooms, merchandise layout, sales associates and an overall good store experience.

Investigating Barriers To Celiac Disease Diagnosis And Patient Wellbeing In The U.S. : A Comparative Study Of The United States And Italy, Medelaine Dickinson
Honors Capstones
This study compared awareness of and attitudes toward celiac disease (CD) among American and Italian medical professionals, patients, and the general public in order to better understand and identify barriers to celiac disease diagnosis and patient wellbeing in the United States. Although the U.S. prevalence of the disease is somewhat higher than in Italy, the rate of diagnosis in the United States is significantly lower. One of the biggest differences between the two countries is awareness level (Guandalini, 2012 & Fasano, 2001). Factors that impact awareness are an important topic for study because of the strong relationship between awareness level …
Skin Cancer - Education And Prevention: The Role Of Social Marketing, Tim Crowley
Skin Cancer - Education And Prevention: The Role Of Social Marketing, Tim Crowley
Theses
Skin cancer is the most common cancer in Ireland and worldwide. Skin cancer rates have been steadily rising in recent times. The high use of sunbeds in both Ireland and the UK is quite worrisome. Skin cancer is caused by over exposure to UV rays or through the use of sunbeds and as a result it is actually a highly preventable disease. It is estimated that 90-95% of all skin cancers are preventable. This thesis focuses on the use of social marketing in order to educate people on the dangers of skin cancer with the eventual aim of making recommendations …

Resurrecting Old Pattonia: Uncovering The Lifeways Of A 19th Century Shipping Port Community, Zachary M. Overfield
Sociology & Anthropology Theses - Archive
An East Texas steamboat landing community, known as Pattonia, operated from 1843 to the late 19th century. Here I attempt to identify what socioeconomic stratification and consumerism on the landscape meant for the daily lives of Pattonia's past occupants. In order to address this question, I interpret the architectural features that once stood at Pattonia and their spatial organization. Additionally, I conduct a ceramic analysis of two household assemblages with unknown occupants in order to determine their relative socioeconomic status and reconstruct the social landscape of Pattonia. These methods enable a greater understanding of the unique historical and social significance …

Couchsurfing In North Texas: A Localized View Of A Global Phenomenon, Rory L. Bradbury
Sociology & Anthropology Theses - Archive
The purpose of this study was to conduct an exploratory research project to discover issues and problems faced by people who are a part of Hospitality Exchange Networks. This research focuses on the largest free travel based network, CouchSurfing.org, which currently has over 5 million members. Mixed methods were used to gather the data. The main source of data was taken qualitatively when the researcher conducted nineteen in-depth interviews with couchsurfers who had varying degrees of experience in this community. Ethnographic techniques were also used during field work, which included "surfing" five times and going to numerous local couchsurfing events …
Gendered Cues In Job Advertising: Perpetuating Occupational Segregation, Stephanie Mastromoro
Gendered Cues In Job Advertising: Perpetuating Occupational Segregation, Stephanie Mastromoro
Sociology & Anthropology Theses - Archive
Current approaches within literature inadequately explain the presence and persistence of occupational sex segregation. In addition, little research empirically examines allocation methods as a key contributor to this phenomenon. I consider the role that allocation methods, such as job recruitment and advertisement, play in maintaining occupational sex segregation. Specifically, I examine the gendered nature of language used within job advertisements and how this acts as a filter for job applicants. The literature review outlines material concerning occupational segregation, gendered language, and gender cues in job ads. I reveal gaps in this literature in order to solidify the need for more …
Computer-Based Versus Paper-Pencil Modes Of Administration United States Government End Of Course Exams: Student Cumulative Grade Point Averages As Predictors Of Success, Barbara A. Ryan
Dissertations
Beginning with the No Child Left Behind federal legislation, states were required to use data to monitor and improve student achievement. For high schools, the Missouri Department of Elementary and Secondary Education chose End of Course Exams (EOC) to demonstrate levels of student achievement. The policy changed from school choice of paper-pencil or computer-based testing to mandated computer-based testing. This study examined whether this decision best demonstrates the level of student mastery. Using high school EOC test scores for United States Government exams as the independent variable and high school cumulative grade point average (CGPA) as the dependent variable, the …
Land Use And Climate Change: Lawyers Negotiating Above Regulation, John R. Nolon
Land Use And Climate Change: Lawyers Negotiating Above Regulation, John R. Nolon
Elisabeth Haub School of Law Faculty Publications
Sea level rise requires a new paradigm for controlling the development of coastal lands that are in harm’s way, calling for adjustments in the law, legal practice, and legal education. This article discusses the historical tendency of the law to adjust to changes in society and the recent emergence of new legal institutions and strategies for mitigating and adapting to climate change, particularly sea level rise. It illustrates how the lack of certainty about the extent and pace of sea level rise collides with the total takings doctrine of the Lucas case to frustrate the application of traditional land use …

Joining The Team: A Case Study Identifying And Assessing Critical Factors Influencing Ncaa Division Iii Student-Athlete Matriculation, Daniel D. Covell, Marilyn K. Pelosi, Jodi Lemoi
Journal of Applied Sport Management
This research sought to understand what factors influence how first-year student-athletes at a National Collegiate Athletic Association (NCAA) Division III institution chose the school to attend in light of the heuristic perspective of bounded rationality, which posits that decision makers are rational in some but not all elements of the decision-making process. Data were assessed for the entire respondent group as well as subgroups based on gender and by amount of non-loan financial aid received by using the principal component analysis and the Mann-Whitney U test. The analysis showed athletic variables such as conference affiliation, quality of opponents, recruiting materials, …

Impact Of Intercollegiate Athletics On Undergraduate Enrollment At A Small, Faith-Based Institution, Matthew J. Brunet, Michele W. Atkins, Gary R. Johnson, Linn M. Stranak
Journal of Applied Sport Management
Based on previous research, it is apparent many National Collegiate Athletic Association (NCAA) Division I institutions benefit from the existence of and success in intercollegiate athletics. However, few studies have researched the impact of intercollegiate athletics at National Association of Intercollegiate Athletics (NAIA) institutions. Therefore, the purpose of this study was to investigate the effect of intercollegiate athletics at a small, faith-based institution affiliated with the NAIA. More specifically, does success in or the existence of intercollegiate athletics have an effect on students’ decisions to enroll at this institution? Findings indicate the majority of freshmen student participants, including many intercollegiate …

Game Day Experience Through The Lens Of Critical Incident Technique, Robin Hardin, Brody Ruihley, Cindy Veraldo
Journal of Applied Sport Management
This qualitative study examined the game-day experiences of fans at a college football game using Critical Incident Technique. This technique identifies and examines important occurrences, or incidents, identified by participants based on their own positive or negative experience. A total of 2,450 individuals responded to the optional open-ended question on a survey. Respondents indicated the most positive aspects of the experience as the enjoyment, pride, and tradition associated with attending the games. The facility, atmosphere, and policies and operations were reported as the most negative aspects of the experience. It is important to understand the experience of fans at events …
Female Mate Choice For Multimodal Courtship And The Importance Of The Signaling Background For Selection On Male Ornamentation, Jay A. Stafstrom, Eileen A. Hebets
Female Mate Choice For Multimodal Courtship And The Importance Of The Signaling Background For Selection On Male Ornamentation, Jay A. Stafstrom, Eileen A. Hebets
Eileen Hebets Publications
Conspicuous visual ornaments are frequently incorporated into complex courtship displays that integrate signal components from multiple sensory modalities. Mature male Schizocosa crassipes (Walckenaer, 1837) wolf spiders wave, arch, and tap their ornamented forelegs in a visual courtship display that simultaneously incorporates seismic components. To determine the importance of modality-specific signal components in female mate choice, we used a signal ablation design and compared the mating frequency of female-male pairs across signaling environments with manipulated modality-specific transmission properties. We found that the successful transmission of isolated visual or seismic signaling was sufficient for mating success; neither signaling modality was necessary. Additionally, …
The Family And The Market At Wal-Mart, Naomi Schoenbaum
The Family And The Market At Wal-Mart, Naomi Schoenbaum
GW Law Faculty Publications & Other Works
The Supreme Court’s decision in Wal-Mart Stores v. Dukes received much attention for what it means for collective litigation. Far less attention has been paid to what the case reveals about sex discrimination law. This symposium contribution uses an overlooked aspect of the Dukes case — the challenge to Wal-Mart’s relocation policy — as a lens to explore employment discrimination law’s failure to adequately take account of employees’ families in a way that further entrenches the family-market divide and seriously hinders the promise of sex discrimination law.
The challenge to the relocation policy exposes how employment discrimination law simultaneously pays …
Emotional Intelligence And Negotiation Performance, Charles B. Craver
Emotional Intelligence And Negotiation Performance, Charles B. Craver
GW Law Faculty Publications & Other Works
When individuals negotiate, they employ many personal and intellectual skills. Over the many years I have taught Negotiation courses, I have sought to determine the factors that influence bargaining outcomes. I have found no statistically significant differences based upon the gender or race of the participants, and no correlation with student GPAs. Since Daniel Goleman suggests that if something is not due to IQ it must be based upon EQ, or emotional intelligence, I decided to determine whether there is any correlation between my student perofmance on negotiation exercises and their individual emotional intelligence scores. I had the exceptional assistance …
Niklas Luhmann's Theory Of Autopoietic Legal Systems, Hugh Baxter
Niklas Luhmann's Theory Of Autopoietic Legal Systems, Hugh Baxter
Faculty Scholarship
Between 1984 and his death in 1998, German sociologist Niklas Luhmann developed a comprehensive theory of what he called autopoietic or self-referential systems. He worked out this approach both at the level of a social system as a whole and at the level of various social subsystems, such as state, economy, science, religion, education, art, family, and — the concern of the present article — law. My particular topics in this critical introduction to Luhmann’s theory are (a) its relation to more standard legal theory, (b) foundational or self-referential problems in law, and (c) the problem of law’s relation to other …

Philosophy Faculty Research and Publications
My approach .to environmental aesthetics here begins with reflections on previous encounters with the subject, focusing initially on aesthetics of the city. Then follows a brief look at current theories of environmental aesthetics as they relate to nature aesthetics. The final section will consider garden as a symbolic link of nature/city. Nelson Goodman 's theory of exemplification will serve as an account of garden as a symbol linking nature and city .
Zadoff On Kwall: A Historian’S Critique, Ethan Zadoff
Zadoff On Kwall: A Historian’S Critique, Ethan Zadoff
Cardozo Law Review de•novo
The relationship between law and culture is a complex, dynamic, variegated, and multifaceted accord, an entanglement that belies the traditional dynamic of categorical distinction that, many posit, lies at the center of the two amorphous terms. Increasingly over the last decade and a half, scholars, particularly legal scholars, have started to reconsider the complexities of the legal in social and cultural environs, partially as a result of interdisciplinary methods of cultural theory, which have permeated the guarded borders of legal studies. Roberta Kwall’s article titled “The Cultural Analysis Paradigm: Women and Synagogue Ritual as a Case Study” in the December …
Study Abroad And Identity: The African American Experience, Alicia Ranney
Study Abroad And Identity: The African American Experience, Alicia Ranney
Capstone Collection
Not all students are alike, nor should they be treated as 'one size fits all' in study abroad. Students have different backgrounds, goals, and expectations of what they will gain from an international academic experience. Minority students face different types of challenges in study abroad than their non-minority counterparts.
This paper seeks to answer the question “does study abroad change the identity of African American students?” and examines the challenges of identity and racism and how those two factors may decrease participation rates of African Americans in study abroad. Students from Marygrove College in Detroit, Michigan were surveyed before and …
Exploring Motivation Through Athlete Communication, Tye G. Davis
Exploring Motivation Through Athlete Communication, Tye G. Davis
University of the Pacific Theses and Dissertations
The current study examined the communication ecology of athlete motivation. Furthermore, gender differences in communication ecologies were evaluated, as were variations in communication tendencies for highly and lowly motivated athletes. Findings suggest that teammates and parents are strong motivators for athletes. Mass media were associated with athlete motivation while social media were not. Gender differences were found with males reporting being more motivated by mass media than females, while females were more strongly motivated by their parents and friends. There were significant differences found in the communication ecologies of highly motivated athletes compared to less motivated athletes. Athletes who were …

The Impact Of Colorism On Historically Black Fraternities And Sororities, Patience Denece Bryant
Department of Conflict Resolution Studies Theses and Dissertations
This dissertation study was conducted in order to examine and gain an insight on two topics that are considered to be highly under researched: American historically black fraternities and sororities and colorism within the back American community. The purpose of the study was to examine the impact that colorism has had on black American collegiate Greek letter organizations. Using the qualitative phenomenological approach, 18 graduate or alumni members, two from each of the nine historically black Greek letter organizations that make up the National Pan-Hellanic Council were interviewed using open ended questions to see what impact (if any) colorism has …
A Real Option Dynamic Decision (Rodd) Framework For Operational Innovations, Wilawan Onkham
A Real Option Dynamic Decision (Rodd) Framework For Operational Innovations, Wilawan Onkham
Electronic Theses and Dissertations
Changing the business operations and adopting new operational innovations, have become key features for a business solution approach. However, there are challenges for developing innovative operations due to a lack of the proper decision analysis tools, lack of understanding the impacts transition will have on operational models, and the time limits of the innovation life cycle. The cases of business failure in operational innovation (i.e. Eastman Kodak Company and Borders Group Inc.,) support the need for an investment decision framework. This research aims to develop a Real Option Dynamic Decision (RODD) framework for decision making, to support decision makers for …
Systems Geometry: A Methodology For Analyzing Emergent System Of Systems Behaviors, Christina Bouwens
Systems Geometry: A Methodology For Analyzing Emergent System Of Systems Behaviors, Christina Bouwens
Electronic Theses and Dissertations
Recent advancements in technology have led to the increased use of integrated ‘systems of systems’ (SoS) which link together independently developed and usable capabilities into an integrated system that exhibits new, emergent capabilities. However, the resulting SoS is often not well understood, where secondary and tertiary effects of tying systems together are often unpredictable and present severe consequences. The complexities of the composed system stem not only from system integration, but from a broad range of areas such as the competing objectives of different constituent system stakeholders, mismatched requirements from multiple process models, and architectures and interface approaches that are …

Parent-Child Dynamics And Emerging Adult Religiosity: Attachment, Parental Beliefs, And Faith Support, Kathleen C. Leonard, Kaye V. Cook, Chris Boyatzis, Cynthia N. Kimball, Kelly S. Flanagan
Faculty Journal Articles
Parental religiosity has been shown to predict child and adolescent religiosity, but the role of parents in emerging adult religiosity is largely unknown. We explored associations among emerging adult religiosity, perceived parental religiosity, perceived similarity to mother's and father's religious beliefs, parental faith support, and parental attachment. Participants were 481 alumni of two Christian colleges and completed surveys online. Emerging adult religiosity (measured by Christian orthodoxy and intrinsic religiosity) was high and similar to parents' religiosity. Perceived similarity to parents' religious beliefs, faith support, and attachment to fathers predicted emerging adult religiosity. However, parental religiosity alone was a weak predictor …
Cornerstones, Curb Cuts, And Legal Education Reform , Judith Welch Wegner
Cornerstones, Curb Cuts, And Legal Education Reform , Judith Welch Wegner
Journal of Dispute Resolution
This essay seeks to contribute to this dialogue by offering both theoretical and practical observations about legal education reform. This approach reflects the judgment that current efforts to improve legal education will only get so far unless underlying impediments to change that are often invisible become better understood. The essay provides legal educators with theoretical insights from the design, organizational behavior, education, and psychology literature in order to help that process along. Theoretical insights can be hard to apply in the abstract, however. The essay therefore also offers practical recommendations about both small and large actions that might be taken …

Warriors, Machismo, And Jockstraps: Sexually Exploitative Athletic Hazing And Title Ix In The Public School Locker Room, Susan P. Stuart
Western New England Law Review
Sexually exploitative athletic hazing on boys’ athletic teams is an increasingly frequent feature in the news. The physical and psychological abuse of younger team members by those who are more senior is not just humiliating but dangerous. Indeed, some athletes are charged with crimes that are committed during hazing activities. More to the point, the features of sexually exploitative hazing have all the
earmarks of sexual harassment when team leaders use sexual assaults to keep younger members in their place by feminizing them or otherwise challenging their ability to conform to a hegemonic masculine sports stereotype. Athletic hazing’s part in …
