Malleable Law: The (Mis)Use Of Legal Tools In The Pursuit Of A Political Agenda, Manuel A. Gomez Jan 2013

Malleable Law: The (Mis)Use Of Legal Tools In The Pursuit Of A Political Agenda, Manuel A. Gomez

ILSA Journal of International & Comparative Law

The idea of law as an instrument is not new. For more than a century, law has been marshaled as a means to a particular end rather than a value in and of itself.

La Ley Maleable: El (Mal), Uso Del Derecho En La Consecucion De Una Agenda Politica, Manuel A. Gomez

ILSA Journal of International & Comparative Law

La idea de usar el derecho como instrumento no es nueva. Por más de un siglo, el derecho ha sido visto como un medio para alcanzar un fin en vez de un valor en si mismo.

An Exploratory Study Of Student Satisfaction With University Web Page Design, David E. Gundersen, Joe K. Ballenger, Robert M. Crocker, Elton Scifres, Robert Strader

Faculty Publications

This exploratory study evaluates the satisfaction of students with a web-based information system at a medium-sized regional university. The analysis provides a process for simplifying data interpretation in captured student user feedback. Findings indicate that student classifications, as measured by demographic and other factors, determine satisfaction levels towards various web sources of information. Differences in satisfaction levels across student groups based on gender, age, minority status, employment, and current course load were found. Implications for university web designers and university administrators are considered and discussed.

When The Course Management System Isn't Enough, M. Gail Weatherly, Susan Evans Jennings Jan 2013

When The Course Management System Isn't Enough, M. Gail Weatherly, Susan Evans Jennings

Faculty Publications

Many articles have been written extoling the need for interactivity in the online classroom. Zundel (2006) states that not only should interactivity be effectively integrated, but that it is essential for enhancing the learning in online courses just as interactivity is essential for on-campus learners. Mabrito (2004) contends that success is enhanced in online courses by engaging students as active learners rather than passive participants. Mabrito goes on to state that this engagement should include ample opportunities for students to interact with not only the course content, but also with the instructor and fellow classmates.

Violence Prevention In Middle School: A Preliminary Study, Wendy K. Killam, Catherine B. Roland, Bill Weber

Faculty Publications

Violence in schools continues reflecting violence within society. There is a growing need for violence prevention programs within the schools that provide students with the skills needed to cope with interpersonal and relationship is-sues effectively. This study was conducted at a middle school and there were 345 middle school students (6th to 8th grade) who participated in the study. The students participated in a violence prevention program. In this study, the researchers used a pre-test/post-test design and the results indicated that there were some changes in attitudes towards violence that occurred after the intervention.

The Impact Of Adult Attention Deficit Hyperactivity Disorder Symptoms On Maternal Parenting Behaviors, Le'ann L. Solmonson, Tiffany Stewart Jan 2013

The Impact Of Adult Attention Deficit Hyperactivity Disorder Symptoms On Maternal Parenting Behaviors, Le'ann L. Solmonson, Tiffany Stewart

Faculty Publications

The purpose of this qualitative research project is to examine the impact of maternal ADHD symptoms on managing the responsibilities related to parent-ing. The primary researcher conducted three interviews with mothers who exhibit ADHD symptoms in order to gain insight into their perceived difficulties related to the disorder. Analysis of the data indicates these mothers have difficulty completing tasks, are disorganized, and are easily overwhelmed with the responsibilities of parenting resulting in difficulty managing their own behavior and being consistent in disciplining their children. Due to these areas of deficiency, it is suggested the presence of maternal ADHD symptoms results …

Female-Only Classes In A Rural Context: Self-Concept, Achievement, And Discourse, Hope E. Wilson, Gloria J. Gresham Dr., Michelle Williams, Claudia Whitley, James G. Partin Jan 2013

Female-Only Classes In A Rural Context: Self-Concept, Achievement, And Discourse, Hope E. Wilson, Gloria J. Gresham Dr., Michelle Williams, Claudia Whitley, James G. Partin

Faculty Publications

Two middle schools in rural east Texas implemented an optional, single-sex program. Although previous studies have documented the effects of single-sex instruction, and recent educational innovations have focused on its benefits, little research has investigated its effects in rural contexts. This study found that for rural populations, patterns of discourse differ between female-only and coeducational classes, with all-female classes participating in higher levels of thinking and engaging in more discourse overall. However, girls in single-sex classes had significantly lower levels of general self-concept than girls in coeducational classes. There were no statistically significant differences in the achievement test scores between …

The Coming Constitutional Yo-Yo? Elite Opinion, Polarization, And The Direction Of Judicial Decision Making, Mark A. Graber Jan 2013

The Coming Constitutional Yo-Yo? Elite Opinion, Polarization, And The Direction Of Judicial Decision Making, Mark A. Graber

Faculty Scholarship

This Article offers a more sophisticated account of elite theory that incorporates the crucial insights underlying claims that Justices with life tenure will protect minority rights and claims that the Supreme Court follows the election returns. Put simply, the direction of judicial decision making at a given time reflects the views of the most affluent and highly educated members of the dominant national coalition. The values that animate the elite members of the dominant national coalition help explain the direction of judicial decision making for the last eighty years. During the mid-twentieth century, most Republican and Democratic elites held more …

Privacy, Antitrust, And Power, Frank Pasquale Jan 2013

Privacy, Antitrust, And Power, Frank Pasquale

Faculty Scholarship

When a dominant internet service collects information about its users, the situation is so far from the usual arm’s-length market transaction that neoclassical economic analysis is misleading. “Lack of surveillance” is not a product that individuals have varying preferences for and purchase accordingly. Rather, surveillance is an inevitable concomitant of life online. We need to tame the power that surveillance entails, rather than continuing to pursue illusory, surveillance-free alternatives on the platform level.

To the extent a company creates profiles of individuals and collects data on them, a third party ought to be collecting reports from the company on how …

The Future Of Hipaa In The Cloud, Frank Pasquale, Tara Adams Ragone

This white paper examines how cloud computing generates new privacy challenges for both healthcare providers and patients, and how American health privacy laws may be interpreted or amended to address these challenges. Given the current implementation of Meaningful Use rules for health information technology and the Omnibus HIPAA Rule in health care generally, the stage is now set for a distinctive law of “health information” to emerge. HIPAA has come of age of late, with more aggressive enforcement efforts targeting wayward healthcare providers and entities. Nevertheless, more needs to be done to assure that health privacy and all the values …

Has The Roberts Court Plurality's Colorblind Rhetoric Finally Broken Brown's Promise?, Phoebe A. Haddon Jan 2013

Has The Roberts Court Plurality's Colorblind Rhetoric Finally Broken Brown's Promise?, Phoebe A. Haddon

Faculty Scholarship

This Essay examines the continuing significance of the Keyes decision to the judicial vision of equality and racial isolation in public education. By comparing efforts to promote educational equality from the Keyes era through today, this Essay asserts that the judiciary has wrongly embraced a colorblind interpretation of the Equal Protection Clause. In so doing, courts have impeded the progress of children in Denver and around the country, ignored highly instructive social science studies on the benefits of desegregation, and broken the constitutional promise of equal citizenship. For future policy makers and lawyers to address these persistent problems, legal educators …

Stop Terry : Reasonable Suspicion, Race, And A Proposal To Limit Terry Stops, Renée M. Hutchins Jan 2013

Stop Terry : Reasonable Suspicion, Race, And A Proposal To Limit Terry Stops, Renée M. Hutchins

Faculty Scholarship

The Terry doctrine, which grants a police officer the authority to stop and frisk based on his or her reasonable suspicion rather than probable cause, was created by the Supreme Court at a time when the nation con- fronted a particular moment of violent racial strife. Since Terry was decided, the Supreme Court has continued to expand the reach of the doctrine—which opened the door for potential abuse. Existing data is increasingly proving that the loosening of constitutional standards is causing substantial harms to people of color nationwide. This article joins the existing scholarly discussion surrounding this decision to suggest …

The Motherhood Penalty: How Gender And Parental Status Influence Judgements Of Job-Related Competence And Organizational Commitment, Noël Burgess Jan 2013

The Motherhood Penalty: How Gender And Parental Status Influence Judgements Of Job-Related Competence And Organizational Commitment, Noël Burgess

Seminar Research Paper Series

The Motherhood Penalty is an ongoing problem in the United States as many women find themselves working full-time after becoming mothers. Women who become mothers are perceived as less competent, less committed, and thus less employable and/or promotable in the workplace. Unfortunately the status of “mother” has certain perceptions associated with it that are incompatible with the image of an “ideal worker.” Given this reality, the purpose of this research, which uses a literature review, is to examine the reasons for the Motherhood Penalty, the theory behind the negative perceptions of mothers, and how women and organizations can confront these …

A Quantitative Study Of Persistence Factors For First-Year Students At Urban And Residential Universities, Abigail Parsons Shiban Jan 2013

A Quantitative Study Of Persistence Factors For First-Year Students At Urban And Residential Universities, Abigail Parsons Shiban

ETD Archive

Persistence from the first to second year of college can be challenging for students at urban institutions given that they face added pressures and unique situations preventing them from persisting beyond the first year of higher education. While first-year persistence in higher education has been investigated, very little formal research exists on persistence at urban institutions. To bridge this gap, a quantitative analysis of 395 students at two urban and two residential four-year public institutions in Ohio was conducted using the Social Integration and Persistence Intentions Scale (Pascarella & Terenzini, 1980) while exploring comprehensive factors such as students' pre-college and …
