Occasional Publications Of The Bounds Law Library, Number Eight: Traveling The Beaten Trail: Charles Tait’S Charges To Federal Grand Juries, 1822-1825, Paul M. Pruitt Jr., David I. Durham, Sally E. Hadden.

Occasional Publications of the Bounds Law Library

Traveling the Beaten Trail, the eighth of the Occasional Publications of the Bounds Law Library, examines Tait’s career with particular emphasis upon his delivery of grand jury speeches in 1822, 1824, and 1825, followed by edited transcripts of those speeches. The author and editors conclude with a list of Tait’s law library in 1818, just prior to his migration to Alabama.

Unraveling The Genetics Of Seed Dormancy In Barley Using Genome-Wide Association And Biparental Mapping, Ana Maria Correa-Morales Jan 2013

Unraveling The Genetics Of Seed Dormancy In Barley Using Genome-Wide Association And Biparental Mapping, Ana Maria Correa-Morales

Plant Sciences

Seed dormancy is the delay or inability of viable seeds to germinate under favorable conditions. The differential expression of dormancy levels in barley (Hordeum vulgare L.) seeds impacts malt quality. While dormant genotypes are required to avoid the incidence of preharvest-sprouting, genotypes with low dormancy are needed for uniform germination of seeds during malting. The objective of this study was to determine the genetic basis underlying seed dormancy in spring barley using genome-wide association mapping (AM) and linkage mapping. A panel of 3,072 elite U.S. spring barley breeding lines from eight breeding programs participating in the USDA-NIFA Barley Coordinated Agricultural …

Effects Of Competitive And Allelopathic Interactions On Field Pea And Soybean Under Organic Management, Aman Anand Jan 2013

Effects Of Competitive And Allelopathic Interactions On Field Pea And Soybean Under Organic Management, Aman Anand

Plant Sciences

Experiments were conducted during 2011 and 2012 at Dickinson Research Extension Center (DREC), ND and at Carrington Research Extension Center (CREC) to understand the effects of competitive and allelopathic interactions on field pea and soybean under organic management. Another preliminary controlled environmental study was conducted with two cultivars of soybean (Viking 1832 and Viking 1706) to provide additional information on crop allelopathy. Five field pea cultivars from two distinct leaf types were chosen to determine competitive ability against weeds. Results indicated that semi-leafless cultivars (Cooper and Golden) had better plant establishment than normal leaf type (PS07100091, NDP080106 and NDP080102). Based …

Identification Of Quantitative Trait Loci Associated With A Low Cadmium Uptake Gene In Durum Wheat (Triticum Turgidum L. Var. Durum), Wesam Ali Abuhammad

Plant Sciences

The main objective of durum wheat breeding is to identify lines that are low in Cadmium accumulation by using linkage mapping. 178 recombinant inbred lines (RILs) derived from across between Grenora × Haurani were used to identify QTL for Cadmium (Cd) tolerance. A total of 1,132 polymorphic loci (1,111 SNP and 21SSR loci) were used for linkage map analysis. Among these, 330 (29 percent) markers were successfully integrated into the linkage maps at a LOD score of 3.0. The linkage map had a total genetic distance of 720.2 cM with an average distance of 2.2 cM between adjacent markers distributed …

Nullification As Law, Jenny E. Carroll Jan 2013

Nullification As Law, Jenny E. Carroll

Articles

The rule of law is central to our notion of governance and our legal system The ideal of a knowable regular public law shimmers in the discourse of our democracy It stands in sharp contrast to the arbitrary and often anarchic law of men in which those with absolute power rule absolutely But the devil is always in the details To move past the idealism is to enter a contested realm where competing theories seek to claim the mantle of the rule of law While this article cannot claim to resolve the dispute over the precise meaning or construct of …

Organized Music Instruction As A Predictor Of Nursing Student Success, Sandra K. Cesario, Robert Cesario, Anthony R. Cesario Jan 2013

Organized Music Instruction As A Predictor Of Nursing Student Success, Sandra K. Cesario, Robert Cesario, Anthony R. Cesario

Arts, Languages and Philosophy Faculty Research & Creative Works

Stringent admission criteria exist for nursing programs in the United States, but better predictors of success are needed to reduce student attrition. Research indicates that organized music experiences are associated with greater academic success. This exploratory study examined the association between early music experiences and undergraduate nursing student success. Findings suggest that students with a music background were more likely to graduate, have higher grade point averages, and pass the licensure examination. Previous music education might be considered as an additional predictor of nursing student success. Copyright © 2013 Wolters Kluwer Health | Lippincott Williams & Wilkins.

Filipino Amerasians: Gauging Stigmatization, Intolerance And Hatemongering In A Pluralistic Asia Pacific Society, Peter C. Kutschera, Marie A. Caputi

Journal of Hate Studies

Empirical and evidence-based researchers have neglected stigmatization, bias, name-calling, intolerance and even hatemongering experienced by military Filipino Amerasians and other biracial Pan Amerasian progeny who were abandoned abroad by their U.S. servicemen fathers. This condi- tion persists in the Philippines and has been reliably documented in other East and Southeast Asian nation-states, such as Japan, South Korea, and Vietnam. A relatively recent multiple-case study investigating psychosocial risk and mental health among Amerasians in Angeles, Pampanga, site of the former Clark Air Base, substantiated long-reported anecdotal claims that Anglo (White) and particularly African (Black) Amerasians were targets of victimization and traumatized …

A Novel Application Of Motion Analysis For Detecting Stress Responses In Embryos At Different Stages Of Development., Oliver Tills, Tabitha Bitterli, Phil Culverhouse, John I. Spicer, Simon Rundle

School of Biological and Marine Sciences

Motion analysis is one of the tools available to biologists to extract biologically relevant information from image datasets and has been applied to a diverse range of organisms. The application of motion analysis during early development presents a challenge, as embryos often exhibit complex, subtle and diverse movement patterns. A method of motion analysis able to holistically quantify complex embryonic movements could be a powerful tool for fields such as toxicology and developmental biology to investigate whole organism stress responses. Here we assessed whether motion analysis could be used to distinguish the effects of stressors on three early developmental stages …

Examining Religion And Spirituality As Diversity Training: A Multidimensional Look At Training In The American Psychological Association, Michael J. Vogel, Mark R. Mcminn, Mary A. Peterson, Kathleen Gathercoal

Faculty Publications - Doctor of Psychology (PsyD) Program

What sort of psychotherapeutic approaches might work well with a client who identifies as Muslim, and would they be different from what might work well with a client who identifies as Christian, a client who identifies as atheistic, or client who identifies as Buddhist? Despite ethical commitments to religiosity and spirituality training, it seems that most training programs in professional psychology have neglected to incorporate content from these areas of diversity into their curricula. The current study evaluated religious and spiritual diversity training in both APA-accredited doctoral programs and predoctoral internships, garnering the perspectives of 292 students, interns, faculty, and …

Incidence rates (IRs) and incidence density ratios (IDRs) of concussion were calculated for games and practices and for age groups. Results There was a total of 11 338 (8415 practice and 2923 game) athletic exposures (AEs) in the study period, during which 20 medically diagnosed concussions occurred. A majority of concussions were the result of head-to-head (45%) contact. The combined concussion IR for practices and games was 1.76 …

Marriage Rights And The Good Life: A Sociological Theory Of Marriage And Constitutional Law, Ari Ezra Waldman Jan 2013

Marriage Rights And The Good Life: A Sociological Theory Of Marriage And Constitutional Law, Ari Ezra Waldman

Articles & Chapters

This is the first in a series of three Articles investigating the underappreciated role that the social theory of Emile Durkheim plays in the quest for the freedom to marry for gay Americans. To that end, this Article begins the discussion by examining the Durkheimian legal arguments that go unnoticed in equal protection and due process claims against marriage discrimination. This Article challenges two assumptions: first, that the most effective legal argument for marriage rights is a purely liberal one, and second, that the substance and rhetoric of liberal toleration cannot exist symbiotically in the marriage discrimination debate with a …

Yonder Stands Your Orphan With His Gun: The International Human Rights And Therapeutic Jurisprudence Implications Of Juvenile Punishment Schemes, Michael L. Perlin Jan 2013

Yonder Stands Your Orphan With His Gun: The International Human Rights And Therapeutic Jurisprudence Implications Of Juvenile Punishment Schemes, Michael L. Perlin

Articles & Chapters

In the last decade, the US Supreme Court has ruled that the death penalty, a life sentence without possibility of parole (LWOP), and mandatory LWOP for homicide convictions violate the Eighth Amendment when applied to juvenile defendants. These decisions were premised, in large part, on findings that "developments in psychology and brain science continue to show fundamental differences between juvenile and adult minds," and that those findings both lessened a child's "moral culpability" and enhanced the prospect that, as the years go by and neurological development occurs, his "deficiencies will be reformed."

These decisions have, by and large, been welcomed …

Wisdom Is Thrown Into Jail: Using Therapeutic Jurisprudence To Remediate The Criminalization Of Persons With Mental Illness, Michael L. Perlin Jan 2013

Wisdom Is Thrown Into Jail: Using Therapeutic Jurisprudence To Remediate The Criminalization Of Persons With Mental Illness, Michael L. Perlin

Articles & Chapters

The common wisdom is that there are two related villains in the saga of the “criminalization of persons with mental illness”: the dramatic elimination of psychiatric hospital beds in the 1970s and 1980s as a result of the “civil rights revolution,” and the failure of the deinstitutionalization movement. Both of these explanations are superficially appealing, but neither is correct; in fact, the causal link between deinstitutionalization and criminalization has never been rigorously tested. It is necessary, rather, to consider another issue to which virtually no attention has been or is being paid: the near-disappearance of mental status issues from the …

John Brown Went Off To War: Considering Veterans’ Courts As Problem-Solving Courts, Michael L. Perlin Jan 2013

John Brown Went Off To War: Considering Veterans’ Courts As Problem-Solving Courts, Michael L. Perlin

Articles & Chapters

In this paper, I seek to contextualize veterans courts in light of the therapeutic jurisprudence (TJ) movement, the turn to problem-solving courts of all sorts (especially focusing on mental health courts), and the societal ambivalence that we have shown to veterans in the four decades since the Vietnam war.

I argue that TJ’s focuses on how law actually impacts people’s lives, on the law’s influence on emotional life and psychological well-being and on the need for law to value psychological health and avoid the imposition of anti-therapeutic consequences whenever possible can serve as a template for a veterans courts model …

The Judge, He Cast His Robe Aside: Mental Health Courts, Dignity And Due Process, Michael L. Perlin

Articles & Chapters

One of the most important developments in the past two decades in the way that criminal defendants with mental disabilities are treated in the criminal process has been the creation and the expansion of mental health courts, one kind of “problem-solving court.” There are now over 300 such courts in operation in States, some dealing solely with misdemeanors, some solely with non-violent offenders, and some with no such restrictions. There is a wide range of dispositional alternatives available to judges in these cases, and an even wider range of judicial attitudes. And the entire concept of “mental health courts” is …

Myths About Shareholder Value, Faith Stevelman

Articles & Chapters

The concept of unitary "shareholder value" and its reflection in nearterm stock prices formed the centrepiece of contemporary corporate governance up to the 2008 financial crisis. The crisis has elicited both more critical and clearer, book-length accounts of the relationship of law, corporate governance and finance. The concepts analysed in Lynn Stout's The Shareholder Value Myth are considered herein, as part of a commentary on the continuing evolution of academic corporate law and governance.

There Must Be Some Way Out Of Here: Why The Convention On The Rights Of Persons With Disabilities Is Potentially The Best Weapon In The Fight Against Sanism, Michael L. Perlin Jan 2013

There Must Be Some Way Out Of Here: Why The Convention On The Rights Of Persons With Disabilities Is Potentially The Best Weapon In The Fight Against Sanism, Michael L. Perlin

Articles & Chapters

It is impossible to consider the impact of anti-discrimination law on persons with mental disabilities without a full understanding of how sanism permeates all aspects of the legal system – judicial opinions, legislation, the role of lawyers, juror decision-making – and the entire fabric of society. For those unfamiliar with the term, I define "sanism" as an irrational prejudice of the same quality and character as other irrational prejudices that cause and are reflected in prevailing social attitudes of racism, sexism, homophobia, and ethnic bigotry, that permeates all aspects of mental disability law and affects all participants in the mental …
