Contract Texts, Contract Teaching, Contract Law: Comment On Lawrence Cunningham, Contracts In The Real World, Brian H. Bix

Washington Law Review

Lawrence Cunningham’s Contracts in the Real World offers a good starting place for necessary conversations about how contract law should be taught, and, more generally, for when and how cases—in summary form or in longer excerpts—are useful in teaching the law. This Article tries to offer some reasons for thinking that their prevalence may reflect important truths about contract law in particular and law and legal education in general.

Unilateral Reordering In The Reel World, Jake Linford Dec 2013

Unilateral Reordering In The Reel World, Jake Linford

Washington Law Review

Professor Larry Cunningham’s new book, Contracts in the Real World, demonstrates that there is much to learn about contract law from a few well-chosen stories. The goal of this Essay is to provide a similar service, relying on stories gleaned from movies and television—contracts in the “reel world,” so to speak—to illustrate and then undermine the traditional stories told about contract formation and modification. We can learn much from the scenes discussed herein about how consumers might be led to think contracts are formed, and perhaps misled about the certainty contracts provide.

Reflections On Contracts In The Real World: History, Currency, Context, And Other Values, Lawrence A. Cunningham Dec 2013

Reflections On Contracts In The Real World: History, Currency, Context, And Other Values, Lawrence A. Cunningham

Washington Law Review

It is gratifying to read that this symposium issue of the Washington Law Review was stimulated by Contracts in the Real World. Thanks to the editors for the opportunity to ruminate on the place of the book’s approach—stressing context through stories—in the tradition of contracts pedagogy. To that end, Part I first pinpoints relevant historical milestones in the field of contracts casebooks. Building on that historical grounding, Part II then highlights the values of currency and context that the stories approach epitomizes. Turning more speculative, Part III considers the value of this approach from the perspective of the purpose …

Incidence Of Obesity Among Young Us Children Living In Low-Income Families, 2008–2011, Liping Pan, Ashleigh L. May, Holly Wethington, Karen Dalenius, Laurence M. Grummer-Strawn

United States Public Health Resources

OBJECTIVE: To examine the incidence and reverse of obesity among young low-income children and variations across population subgroups.

METHODS: We included 1.2 million participants in federally funded child health and nutrition programs who were 0 to 23 months old in 2008 and were followed up 24 to 35 months later in 2010–2011. Weight and height were measured. Obesity at baseline was defined as gender-specific weight-for-length >/=95th percentile on the 2000 Centers for Disease Control and Prevention growth charts. Obesity at follow-up was defined as gender-specific BMI-for-age >/=95th percentile. We used a multivariable log-binomial model to estimate relative risk of …

Cell Culture-Selected Substitutions In Influenza A(H3n2) Neuraminidase Affect Drug Susceptibility Assessment, Daisuke Tamura, Ha T. Nguyen, Katrina Sleeman, Marnie Levine, Vasiliy P. Mishin, Hua Yang, Zhu Guo, Margaret Okomo-Adhiambo, Xiyan Xu, James Stevens, Larisa V. Gubareva

United States Public Health Resources

Assessment of drug susceptibility has become an integral part of influenza virus surveillance. In this study, we describe the drug resistance profile of influenza A(H3N2) virus, A/Mississippi/05/2011, collected from a patient treated with oseltamivir and detected via surveillance. An MDCK cell-grown isolate of this virus exhibited highly reduced inhibition by the neuraminidase (NA) inhibitors (NAIs) oseltamivir (8,005-fold), zanamivir (813-fold), peramivir (116-fold), and laninamivir (257-fold) in the NA inhibition assay. Sequence analysis of its NA gene revealed a known oseltamivir-resistance marker, the glutamic acid-to-valine substitution at position 119 (E119V), and an additional change, threonine to isoleucine at position 148 (T148I). Unlike …

Molecular and Cellular Biochemistry Faculty Publications

Congenital disorders of glycosylation are a group of metabolic disorders with an expansive and highly variable clinical presentation caused by abnormal glycosylation of proteins and lipids. Dolichol kinase (DOLK) catalyzes the final step in biosynthesis of dolichol phosphate (Dol-P), which is the oligosaccharide carrier required for protein N-glycosylation. Human DOLK deficiency, also known as DOLK-CDG or CDG-Im, results in a syndrome that has been reported to manifest with dilated cardiomyopathy of variable severity. A male neonate born to non-consanguineous parents of Palestinian origin presented with dysmorphic features, genital abnormalities, talipes equinovarus, and severe, refractory generalized seizures. Additional multi-systemic manifestations developed …

Smokeless Tobacco Use: A Risk Factor For Hyperhomocysteinemia In A Pakistani Population, Mohammad Perwaiz Iqbal, Mohsin Yakub Dec 2013

Smokeless Tobacco Use: A Risk Factor For Hyperhomocysteinemia In A Pakistani Population, Mohammad Perwaiz Iqbal, Mohsin Yakub

Department of Biological & Biomedical Sciences

Background

Smokeless tobacco (ST) use is highly prevalent in the South Asian populations. While there have been a number of reports on association of ST consumption with cancer, very few studies have been conducted to investigate its relationship with cardiovascular disease. Hyperhomocysteinemia is a well-recognized risk factor for cardiovascular disease; however, its association with ST use has never been investigated. The objective of this study was to evaluate the relationship of ST use with hyperhomocysteinemia in an urban Pakistani population.

Methodology/Principal Findings

In a cross-sectional study for assessment of risks of hyperhomocysteinemia, 872 healthy adults (355 males and 517 females …

Economic Effects Of Sox Section 404 Compliance: A Corporate Insider Perspective, Cindy Alexander, Scott Bauguess, Gennaro Bernile, Alex Lee, Jennifer Marietta-Westberg

Research Collection Lee Kong Chian School Of Business

We use survey responses from 2,901 corporate insiders to assess the costs and benefits of compliance with Section 404 of the Sarbanes-Oxley Act. The majority of respondents recognize compliance benefits, but they do not perceive these benefits to outweigh the costs, on average. This is particularly true among smaller companies where the start-up costs are proportionately larger. However, the perceived efficiency of compliance increases with auditor attestations, years of compliance experience, and after the remediation of a material weakness. Notably, the perceived effects of compliance depend largely on firm complexity, but are mostly unrelated to firm governance structure.

Disproportional Ownership Structure And Ipo Long-Run Performance Of Entrepreneurial Firm In China, Jerry X. Cao, Gary Gang Tian, Vincent Tang, Xiaoming Wang

Research Collection Lee Kong Chian School Of Business

This paper examines the relationship between ownership structures and IPO long-run performance in China. Although entrepreneurial firms underperform the market in general after IPO but the poor performance is mainly caused by the IPOs with ownership control wedge. Entrepreneurial firms with one share one vote structure outperform those with ownership control wedge by 30% for 3 years post-IPO in either buy-and-hold or cumulative monthly returns. Entrepreneurial firms with excess ownership control wedge have higher frequency of undertaking value-destroying related party transactions. These findings suggest that entrepreneurial firms need to improve corporate governance such as disproportional ownership structure to better safeguard …

What Are Analysts Really Good At?, Ohad Kadan, Leonardo Madureira, Rong Wang, Tzachi Zach

Research Collection Lee Kong Chian School Of Business

Sell-side analysts employ different benchmarks when defining their stock recommendations. For example, a ‘buy’ for some brokers means the stock is expected to outperform its peers in the same sector (“industry benchmarkers”), while for other brokers it means the stock is expected to outperform the market (“market benchmarkers”), or just some absolute return (“total benchmarkers”). We use these benchmarks to analyze the role of stock picking, industry picking and market timing in contributing to the performance of stock recommendations. We are able to do so given that different benchmarks suggest the use of different sets of abilities. Analysis of the …

Divided We Stand: Defying Hegemony In Global Public Relations And Practice?, Gregor Halff, Anne Gregory

Research Collection Lee Kong Chian School Of Business

The last decade has seen the world becoming increasingly complex. One way of dealing with complexity, according to Schwab (2010a, is to look for certainties or solutions that impose order by simplifying. The authors contend that this is a risk in public relations practice and the academy. While recognizing their benefits they warn against attempts to produce global models which also seek to impose hegemony and argue for maintaining a diversity that reflects reality. They take the cases of the UK and Singapore as respective exemplars where hegemony has arguably occurred and where it can still be resisted. They call …

Between The Posts: Research On The Cap And Top Rail To Guardrail Post Connection, Blake Buckner

Landscape Architecture Undergraduate Honors Theses

Between 2003 and 2007, an estimated 11,120 Americans went to the emergency room as a direct result of a structural failure or collapse of wood deck railings. This is an average of 2,224 people each year. Furthermore, estimates show there are over 40 million decks in the United States and about half of these are more than fifteen years old, which is past their expected lifespan (Legacy Services, 2012). Decks are exterior structures susceptible to the elements that degrade over time, making the need for proper, safe construction techniques even more important. The safety of unsuspecting people who use decks …
