Contract Theory And The Failures Of Public-Private Contracting, Wendy Netter Epstein Aug 2013

Contract Theory And The Failures Of Public-Private Contracting, Wendy Netter Epstein

Cardozo Law Review

The market for public-private contracting is huge and flawed. Privatization proponents predict that privatizing will both cut costs and improve service quality. But public-private contracts for services such as prisons and welfare administration tend to result in cost savings at the sacrifice of quality service. For instance, to cut costs, private prisons skimp on security. Public law scholars have studied these problems for decades and have proposed various public law solutions. But the literature is incomplete because it does not approach the problem through a commercial lens. This Article fills that gap by applying contract-theory principles to public-private contracting.

Risk Assessment In Corrections: An Analysis Of Variables Related To Suicide Attempts And Self-Mutilation, Melissa Ann Fine

Theses and Dissertations

Suicide and self-mutilation risk assessment is a complicated process, especially within a correctional setting. According to the Bureau of Justice Statistics, over 50% of incarcerated individuals have a mental health illness, further reinforcing the need for concise, evidence-based risk assessment practices. The Virginia Department of Corrections collected data on suicide attempts, completed suicides, and incidents of self-injurious behavior for 17 months with a measure created to assess risk factor found in the community. Results indicated that numerous factors were related to suicide attempts, however only having made prior suicide attempts, the presence of a major depression diagnosis, and placement in …

A Comparative Analysis Of Emergency Management Decision-Making Skills Of School Officials: The Impact Of Training On Perspectives And Performance, Matthew Miraglia

Education Doctoral

School officials are responsible for preparing schools to meet students’ needs while facing the complex security challenges of the 21st century. In the event of a disaster, school officials, despite not being emergency management professionals, must make appropriate decisions and lead effectively in order to maintain safety and ensure educational continuity at their schools. The actions of school officials before, during, and after a disaster will likely play a key role in the safe and effective delivery of education in the future. This study was a comparative analysis of school officials in the New York City Metropolitan Region. The study …

Dammed Arkansas: Early Developments In How Arkansas Came To Be A Dammed State, 1836-1945, Mary Suter Aug 2013

Dammed Arkansas: Early Developments In How Arkansas Came To Be A Dammed State, 1836-1945, Mary Suter

Graduate Theses and Dissertations

The need to manage the rivers of Arkansas has been a driving force in developments that have resulted in dramatic changes to the geographical "face" of Arkansas over the last 200 years. These changes are the creation of man-made lakes throughout the state, where before, there had been none. The many lakes that dot the Ozarks and the Ouachitas were created by dams. There are 1,251 dams over 25 feet in height, or that impound more that 50 acre-feet of water, in Arkansas, and uncounted smaller dams. No matter their size, dams were constructed to manage the rivers and streams …

Nonprofit Board Members' Self-Perception In The Role Of Organizational Governance And The Balanced Scorecard, Jeffrey John Aulgur Aug 2013

Nonprofit Board Members' Self-Perception In The Role Of Organizational Governance And The Balanced Scorecard, Jeffrey John Aulgur

Graduate Theses and Dissertations

This qualitative case study examines the gap between expectations of board performance held by the senior leadership and the governing board's self-perception of their role in the governance of the nonprofit organization. The primary research question is: Is an analysis of the gap between governance expectations and the board members' self-perception of governance performance an effective methodology for enhancing the efficacy of the governing board of directors? Nonprofit governance and its effectiveness are difficult concepts to define, given the wide disparity in organizational sizes, structures, and missions. While the academic literature does not identify a dominant methodology for organizational effectiveness …

Decoding Literary Aids: A Study On Issues Of The Body, Masculinity, And Self Identity In U.S. Aids Literature From 1984-2011, Alexander Shimon Abrams Aug 2013

Decoding Literary Aids: A Study On Issues Of The Body, Masculinity, And Self Identity In U.S. Aids Literature From 1984-2011, Alexander Shimon Abrams

Graduate Theses and Dissertations

Rather than waiting decades to respond, novelists of nearly every literary genre began conceptualizing the AIDS epidemic shortly after the first documented case of the virus in the United States in 1981. Writers, feeling a sense of urgency, wasted little time constructing didactic texts that differ from much historical fiction in that they were written as the tragedy they are commenting on occurred. However, AIDS literature has changed as the disease has spread well beyond the gay communities of San Francisco and New York, causing people to reexamine their longstanding beliefs on masculinity, sexuality, and body politics.

Privacy And Unmanned Aerial Systems Integration In The National Aerospace System: Navigating Fourth Amendment Concerns, Dennis Vincenzi, David Ison, Dahai Liu

A variety of challenges to the successful assimilation of UASs into the National Airspace System (NAS) currently exist. Technical issues and human factors related hurdles have brought forth a range of research efforts to help to mitigate or resolve these challenges. Regulations and legislation play a significant role in controlling or restricting the use of UASs in the NAS. Currently there appears to be a contraposition of sentiment between the Federal Aviation Administration and Congress on the inclusion of UASs in the NAS. Congress has called for the adoption of UAS operations in the NAS by 2015 yet the FAA …

Cross-Layer Optimized Wireless Video Surveillance, Yun Ye Jul 2013

Cross-Layer Optimized Wireless Video Surveillance, Yun Ye

Department of Computer Electronics and Engineering: Dissertations, Theses, and Student Research

A wireless video surveillance system contains three major components, the video capture and preprocessing, the video compression and transmission over wireless sensor networks (WSNs), and the video analysis at the receiving end. The coordination of different components is important for improving the end-to-end video quality, especially under the communication resource constraint. Cross-layer control proves to be an efficient measure for optimal system configuration. In this dissertation, we address the problem of implementing cross-layer optimization in the wireless video surveillance system.

The thesis work is based on three research projects. In the first project, a single PTU (pan-tilt-unit) camera is used …

Kansas State Dmc Assessment, Elizabeth Neeley, Mitchel N. Herian Ph.D., Anne M. Hobbs, Juvenile Justice Institute, University Of Nebraska At Omaha

Reports

The Juvenile Justice Delinquency Prevention Act charges states to institute multipronged strategies not only to prevent delinquency but to improve the juvenile justice system and assure equal treatment of all youth. To successfully address Disproportionate Minority Contact (DMC), the U.S. Office of Juvenile Justice and Delinquency Prevention recommends a five-phase process, whereby jurisdictions: 1) identify whether disproportionality exists and the extent to which it exists at all contact stages of the juvenile justice system; 2) assess the contributing factors; 3) provide an intervention plan; 4) evaluate the efficacy of efforts to reduce DMC; and 5) monitor and track DMC trends …

Adjudicating Sex Crimes As Mental Disease, Melissa Hamilton Jul 2013

Adjudicating Sex Crimes As Mental Disease, Melissa Hamilton

Pace Law Review

The psychiatric diseases of the paraphilias are now entrenched in the law in decisions concerning culpability, desert, and risk. Though, as the foregoing cases suggest, it is a tough balancing act, considering the existence of psychiatric illness suggests less responsibility, while at the same time implying a greater risk of future dangerousness. To better navigate this conundrum, the law has drawn on the psychiatric sciences. Part II of this Article outlines a basic need for law and science to serve each other even though they may not share objectives. With respect to the advent of new laws to control sex …
