Obesity and diabetes are major contributors to morbidity and mortality in the United States. According to the American Public Health Association and Partnership for Prevention, obesity is growing faster than any other public health problem in the United States. The prevalence of diabetes has also increased significantly with an estimated 79 million Americans aged 20 years or older suffering from prediabetes. Few studies have examined the influence of perceived stress on obesity and prediabetes among working adults. Families are frequently identified as a risk for supporting and perpetuating sexually abusive behavior among youth. Traditionally, the field has focused on deficits of families rather than considering them as a resource to promote change. Although emerging literature strongly argues the need to target families in the healing process, treatment initiatives rarely follow suite, and research has failed to comprehensively document the effectiveness of family-inclusive treatment. Recently, immigration scholars have focused on the relationship between federal, state, and local governments in regulating immigration to the exclusion of civil rights issues. States and localities assert that they should be able to use their Tenth Amendment police powers to regulate unauthorized immigrants within their borders, while the federal government claims exclusivity in the area of immigration law and policy. In the middle of this debate, there is the question of whether states abrogate individual civil rights and civil liberties when exercising their police powers to regulate immigration. Yonder Stands Your Orphan With His Gun: The International Human Rights And Therapeutic Jurisprudence Implications Of Juvenile Punishment Schemes, Michael L. Perlin

In the last decade, the US Supreme Court has ruled that the death penalty, a life sentence without possibility of parole (LWOP), and mandatory LWOP for homicide convictions violate the Eighth Amendment when applied to juvenile defendants. These decisions were premised, in large part, on findings that "developments in psychology and brain science continue to show fundamental differences between juvenile and adult minds," and that those findings both lessened a child's "moral culpability" and enhanced the prospect that, as the years go by and neurological development occurs, his "deficiencies will be reformed."

One of the most important developments in the past two decades in the way that criminal defendants with mental disabilities are treated in the criminal process has been the creation and the expansion of mental health courts, one kind of “problem-solving court.” There are now over 300 such courts in operation in States, some dealing solely with misdemeanors, some solely with non-violent offenders, and some with no such restrictions. There is a wide range of dispositional alternatives available to judges in these cases, and an even wider range of judicial attitudes. And the entire concept of “mental health courts” is …

The current study examines the gender based violence policies and programs of large, public universities in Florida. Current literature argues that preventing and responding to gender based violence in institutions of higher education requires comprehensive and ecological techniques at the individual, interpersonal, community, and societal level. In recent years, various institutions and agencies have showed increasing administrative commitment to addressing these issues. This study centers on the political aspects of human trafficking and sexual exploitation in Southeast Asia. Specifically, the human trafficking is a security studies concern because it is not only a social issue, but also a security threat. Just as with drug trafficking, human trafficking has security consequences. The study analyzed human trafficking issues in the following three countries in Southeast Asia: Thailand, Myanmar, and Cambodia. The following study is an exploratory analysis of intimate partner kidnapping. The current study will give a descriptive picture of the victim, offender, and incident characteristics of a form of intimate partner violence that has never been studied before, intimate partner kidnapping, as well as a form of physical violence often seen in the literature, intimate partner assaults. The study will use a combination of the National Incident Based Report System (FBI, 2009), and the American Community Survey (Census, 2012) to identify these characteristics and also to identify any potential relationships between structural-level correlates and rates of intimate partner violence. …

Like A Hurricane: A Citation Analysis Of Emergency Management Scholarly Literature, Jennifer Noe, Julia M. Furay

This bibliometric study used citation analysis to uncover citing characteristics in the burgeoning academic field of emergency management. Of the 281 degree programs listed by the Federal Emergency Management Agency nationwide, those at community colleges accounted for 17 percent of the total. Using the interdisciplinary database of Academic Search Complete, a sample of 5,099 citations was collected from 146 articles published between 2002 and 2012. The most strongly represented disciplines revealed by the analysis were Social Science, Science/Technology and Medicine. A majority of citations (45%) came from academic journals, with nearly half (44%) of those from Social Science. When citing …

A significant pending case will carve the contours of United States constitutional governance for the nation regarding our most important technology and its implementation and "will probably be determined by the U.S. Supreme Court.... Geomorphological mapping is the attempt to depict the physical setting of the surface of the earth by mapping the landforms present and the processes responsible for their appearance, and is method that is practiced worldwide. Currently, there is no universally accepted legend for mapping the geomorphological features of all environments, though there have been several attempts made to develop such a legend. Instead, many different European nations have developed their own geomorphologic mapping legends for mapping the landscapes that exist within their national boundaries. The current application (or lack thereof in some cases) and review of investigative necessity in wiretap case law suggests that the Supreme Court of Canada's decision in R. v. Araujo is not being applied in spirit or in substance. Wiretaps represent a serious risk to the privacy of targets and their associates; they are indiscriminate in their acquisition of information. Recognizing the risk wiretaps pose to privacy, the Supreme Court of Canada directed in R. v. Araujo that the wiretap authorizing judge "should not view himself or herself as a mere rubber stamp"; rather he or she should closely examine …

Chronic Trauma Effects On Personality Trait Trajectory In Police Officers, Jennifer Leigh Wills

The impact of chronic trauma exposure on personality trajectories over time was examined in a sample of urban police officers. Scores from a personality measure taken in pre-hire psychological evaluations were compared with follow up scores administered for this study five to ten years later. An urban police agency of approximately 1000 commissioned police officers agreed to allow its officers to be recruited as participants. The consulting psychologist who performed the agency’s pre-hire psychological evaluations during the applicable period supplied historical data with participant consent and agency approval. Personality change between the two times was analyzed using hierarchical regression analysis, …

Habeas corpus has been referred to as the cornerstone of the common law. Indeed, it is the “Great Writ of Liberty.” Chief Justice John Marshall confirmed this singular status given to the writ of habeas corpus in 1807 when he called it the “great constitutional privilege.” This article explores the use of this most famous writ during the early nineteenth century and specifically how Joseph Smith used it against those who sought his incarceration.

Innocence, it turns out, is a complex concept. Yet the Innocence Movement has drawn power from the simplicity of the wrong-person story of innocence, as told most effectively by the DNA cases. The purity of that story continues to have power, but that story alone cannot sustain the Innocence Movement. It is too narrow. It fails to accommodate the vast majority of innocent people in our justice system. It fails to embrace innocence in its full complexity. . . . The objective of this study was to examine the perceptions of sex offenders about their mandated outpatient group treatment. The investigator developed an 81−item questionnaire that inquired about respondent characteristics and history; curriculum content; group therapy process; group facilitator characteristics; program policies and procedures; and offender perspectives on program strengths and weaknesses. The sample consisted of 31 male sex offenders who had all served prison sentences for a sexual offense and were involved in mandated outpatient treatment at 1 of 3 private, community−based clinics. A Twice-Told Tale: Plausibility And Narrative Coherence In Judicial Storytelling, Chris Rideout

What makes the stories told in court believable, and thus convincing? Part of the answer, this article suggests, lies in narrative coherence. Stories “make sense” and are plausible, not because they necessarily correspond in a direct way to “what really happened,” but rather because they seem structurally whole, consistent, and complete. They have achieved narrative coherence. After considering the role of narrative coherence in the plausibility of narratives, the article presents a typology for narrative coherence, breaking it down into external and internal coherence, with further component parts to each one. This Article examines the modern utility of the Second Amendment's guarantee of "the right to keep and bear arms" in light of the phenomenon of modern crime, particularly black-on-black violence in urban America. Although many advocates of gun control have argued that crime in modern cities is a reason for modifying or severely truncating the right to have arms, the Authors argue that the right to have arms and the Second Amendment's notion of a universal militia can be the basis of a new partnership between police and citizens in urban America. It is my great pleasure to introduce the sixth volume of the College of Liberal Arts and Social Sciences’ “Creating Knowledge,” our undergraduate student scholarship and research journal. First published in 2008, the journal is the outcome of an initiative to enhance and enrich the academic quality of the student experience within the college. Through this publication, the college seeks to encourage students to become actively engaged in creating scholarship and research and gives them a venue for the publication of their essays.
