Toward Genuine Tribal Consultation In The 21st Century, Colette Routel, Jeffrey K. Holth

The tribal right to consultation requires the federal government to consult with Indian tribes prior to the approval of any federal project, regulation, or agency policy. This article, which provides the first comprehensive analysis of this right, highlights the current inconsistencies in interpretation and application of the consultation duty. It then attempts to provide suggestions for changes that can be implemented by the legislative, executive or judicial branches.
In Part I, we provide a brief overview of the development of the trust responsibility and explain how it came to include three substantive duties: to provide services to tribal members, to …

Development Of A Standard And Functional Tactical Emergency Medical Curriculum -- Tems Medic, Benjamin Hannon
Honors Theses
Violent crime causes death and injury regularly in the United States. Some events such as the Newtown shootings, the Oklahoma City bombings, or the Washington, DC sniper case acutely focus the entire nation’s attention while other, less contemporary events fade away. The public safety apparatus – police, fire, and emergency medical services – always respond to save lives. On December 11, 2012 a man opened fire at a mall in Clackamas County, Oregon. The 9-1-1 dispatchers sent units to a shooting at the mall and then quickly reported that the shooter was still firing in the mall. One of the …

Conceptualizing Identity As Performance In Young Adult Dystopian Literature, Kelly F. Franklin
Conceptualizing Identity As Performance In Young Adult Dystopian Literature, Kelly F. Franklin
Masters Theses
Young Adult Literature has historically been read as a genre that encourages singular identity formation. Scholars have argued that this literature inspires young adult readers to find their true identity by showcasing characters in the process of identity construction. However, when read through the lens of performance theory - a vast field that encompasses many disciplines such as sociology, psychology, anthropology, literature and theatre - it becomes evident that YAL actually encourages the formation of multiple roles and identities. This genre features characters trying on new roles, casting assigned roles aside, and assuming new identities to best suit their settings. …

Reconceptualizing States Of Emergency Under International Human Rights Law: Theory, Legal Doctrine, And Politics, Scott P. Sheeran
Reconceptualizing States Of Emergency Under International Human Rights Law: Theory, Legal Doctrine, And Politics, Scott P. Sheeran
Michigan Journal of International Law
States of emergency are today one of the most serious challenges to the implementation of international human rights law (IHRL). They have become common practice and are associated with severe human rights violations as evidenced by the Arab Spring. The international jurisprudence on states of emergency is inconsistent and divergent, and what now constitutes a public emergency is ubiquitous. This trend is underpinned by excessive judicial deference and abdication of the legal review of states' often dubious claims of a state of emergency. The legal regime, as positively expressed in international human rights treaties, does not adequately reflect the underlying …

As Seen On Tv: Your Compromising Cameo On National Reality Programming, 12 J. Marshall Rev. Intell. Prop. L. 403 (2013), Ryan Westerman
UIC Review of Intellectual Property Law
The pop-culture phenomenon of reality television has taken over national programming. With the click of a remote, viewers can gain an inside look into the daily lives of celebrity families, toddler pageant queens, wealthy housewives, even pregnant teenagers. Reality television also profiles different professions: repo-men, pawn shop owners, and real estate agents all have television time slots. While it seems everyone is desperate for their fifteen minutes of fame, there are still those who wish to avoid the public spotlight. However, a recent Illinois ruling may make avoiding prime-time attention impossible for certain individuals caught on tape in compromising, and …

The Impact Of Young Unlicensed Driving On Passenger Restraint Use: Concern For Risk Spillover Effect?, Jonathan Fu
The Impact Of Young Unlicensed Driving On Passenger Restraint Use: Concern For Risk Spillover Effect?, Jonathan Fu
Yale Medicine Thesis Digital Library
Background: Despite recent prevention gains, motor vehicle crashes continue to be the leading cause of death for US adolescents and young adults. Many of these deaths involve young unlicensed drivers that are more likely to be in fatal crashes and to engage in high-risk driving behaviors like impaired driving, speeding, and driving unrestrained. In a crash context, the influence of these high-risk behaviors may spillover to adversely affect passenger safety restraint use. Objective: To examine the effect of young unlicensed drivers on safety restraint use and mortality of their passengers. Methods. A cross-sectional analysis of the National Highway Traffic Safety …
