Community And Individual Well-Being In Nonmetropolitan Nebraska, Rebecca Vogt, Cheryl A. Burkhart-Kriesel, Randolph Cantrell, Bradley Lubben
Publications from the Center for Applied Rural Innovation (CARI)
Following record levels of farm income in Nebraska in 2011, those levels only dropped slightly in 2012 even though the state experienced one of the worst droughts in 50 years. And, historically Nebraska’s per capita income has been below the national average. However, in 2012 the Bureau of Economic Analysis estimates show the state’s per capita income was higher than the national average. Given the challenges and uncertainties of recent years, how do rural Nebraskans feel about their community? Are they satisfied with the services provided by their community? Are they planning to move from their community in the next …

Health Care Reform: Perceptions Of Nonmetropolitan Nebraskans, Rebecca Vogt, Cheryl A. Burkhart-Kriesel, Randolph Cantrell, Bradley Lubben
Publications from the Center for Applied Rural Innovation (CARI)
The Affordable Care Act (also known as the health care reform law) includes provisions that are intended to expand access to insurance, increase consumer insurance protections, improve quality and system performance and curb rising health care costs. Though some of the reforms were effective in 2010, many provisions will be effective January 1, 2014. How well do rural Nebraskans understand what’s in the new law? How do they think the law will affect various groups? Do they think it will be successful at accomplishing its objectives? How do rural Nebraskans currently obtain their health insurance? This paper provides a detailed …

Water And Climate: Perceptions Of Nonmetropolitan Nebraskans, Rebecca Vogt, Cheryl A. Burkhart-Kriesel, Randolph Cantrell, Bradley D. Lubben
Publications from the Center for Applied Rural Innovation (CARI)
Water has always been an important resource to rural areas. Competing demands for water come from communities, households, agriculture, industry and the environment. After last summer’s drought, one of the worst in the state’s history, more attention was placed on water issues in the state. The drought also caused increased awareness of global climate change issues. Given these conditions, what impacts did rural Nebraskans experience as a result of last summer’s drought? What priority do rural Nebraskans place on various uses of water? Have those priorities changed over time? What do rural Nebraskans think about global climate change? What are …
The Other Missouri Model: Systemic Juvenile Injustice In The Show-Me State, Mae C, Quinn
The Other Missouri Model: Systemic Juvenile Injustice In The Show-Me State, Mae C, Quinn
Journal Articles
For years Missouri has been touted as a model for juvenile justice. Stakeholders and commentators continually declare that the Show-Me State – with its “Missouri Model” – employs the most modern and innovative ap-proaches when it comes to treatment of court-involved youth. This account is reflected in press coverage, television news shows, and agency white papers. But this is only part of the picture; there is much more happening in Missouri when it comes to juveniles. However, this “other” part of the story seldom has been openly discussed – until now.1. This Article seeks to contrast the rosy picture painted …

The Great American Gun Violence Lottery, Erin Ryan
The Great American Gun Violence Lottery, Erin Ryan
Scholarly Publications
Reflecting on the one-year anniversary of the Sandy Hook elementary school shooting, this very short essay compares the experience of gun violence in America to the dystopian game of chance in Shirley Jackson’s classic American short story, "The Lottery." With references to the role of Constitutional law, media consumption, and cultural change, it urges an available, common-sense middle ground on gun policy. The essay was first published by the American Constitution Society (Dec. 17, 2013) and later appeared in the Huffington Post (Dec. 20, 2013).
Utah Should Adopt A Law Allowing Courts To Apply Cash Bail Toward Restitution, Amy J. Lavin
Utah Should Adopt A Law Allowing Courts To Apply Cash Bail Toward Restitution, Amy J. Lavin
Utah OnLaw: The Utah Law Review Online Supplement
Utah’s restitution laws are not effective. Too many victims are not fully compensated for their losses following a crime. Many states allow courts to require defendants to pay cash bail and to apply cash bail toward restitution. Utah should adopt a similar law to improve the collection of court-ordered restitution.
This Note analyzes Utah’s current restitution process and identifies its weaknesses. Then it proposes a cash bail plan to improve the collection of restitution. Finally, it examines potential problems to having a cash bail system and how Utah can avoid those problems to create a successful restitution collection system.

'Lonesome Road': Driving Without The Fourth Amendment, Lewis R. Katz

American states and municipalities have so many minor traffic regulations that every time a driver gets behind the wheel of a car he or she is likely to commit multiple violations. The violation of any traffic regulation empowers police officers to stop the vehicle, ticket and, in some states, arrest the motorist. Police are physically unable to stop and ticket, let alone arrest, every motorist committing a traffic violation. Instead, police are vested with unlimited discretion when choosing which motorists to stop, warn, ticket, or arrest. So long as there is probable cause for a traffic violation, courts will not …

Toward Genuine Tribal Consultation In The 21st Century, Colette Routel, Jeffrey Holth
Toward Genuine Tribal Consultation In The 21st Century, Colette Routel, Jeffrey Holth
University of Michigan Journal of Law Reform
The federal government's duty to consult with Indian tribes has been the subject of numerous executive orders and directives from past and current U.S. Presidents, which have, in turn, resulted in the proliferation of agency-specific consultation policies. However, there is still no agreement regarding the fundamental components of the consultation duty. When does the consultation duty arise? And what does it require of the federal government? The answers to these questions lie in the realization that the tribal consultation duty arises from the common law trust responsibility to Indian tribes, which compels the United States to protect tribal sovereignty and …

People V. Diaz, Senate Bill 914 And The Fourth Amendment, Caitlin Keane
People V. Diaz, Senate Bill 914 And The Fourth Amendment, Caitlin Keane
UC Law SF Communications and Entertainment Journal
After the Diaz decision in January, Senator Mark Leno, a Democrat representing San Francisco, took matters into his own hands and drafted Senate Bill 914. In short, the bill would have overturned the Court's decision and required law enforcement to obtain a search warrant from a neutral magistrate before searching arrestees' portable electronic devices. The bill passed with overwhelming support from both political parties in the State Assembly and State Senate and needed only Governor Brown's signature or tacit approval to become law. Governor Brown vetoed the bill in October 2011, stating, "[t]he courts are better suited to resolve the …
Self-Defense And Gun Regulation For All Commentary: Gun Control Policy And The Second Amendment: Responses, David Kairys
Self-Defense And Gun Regulation For All Commentary: Gun Control Policy And The Second Amendment: Responses, David Kairys
Connecticut Law Review
The importance and universality of self-defense rights are beyond dispute. Self-defense emerged as a major social and constitutional issue in the second half of the twentieth century focused on minorities and women before it provided the primary basis for expansive Second Amendment rights. Supporters of broad Second Amendment rights base them on an individual and collective right to self-defense against attacks by others, but they differ about the source of the danger—the others who are attacking. Professor Nicholas Johnson emphasizes that law-abiding blacks are most at risk and most need guns to defend themselves because of black-on-black violence and the …

Risk Factors For Release In Nurses With Substance Use Disorder, Kathleen J. Tinklenberg
Risk Factors For Release In Nurses With Substance Use Disorder, Kathleen J. Tinklenberg
Electronic Theses and Dissertations
Substance Use Disorder (SUD) is defined as the continued use of mood-altering addicting substances despite adverse consequences (Morse & Flavin, 1992). Nurses are not immune from this progressive and fatal disease and if left untreated, a nurse with SUD poses a double jeopardy: risk to the patients and a threat to her or his own health. Many State Boards of Nursing (SBN) have implemented a non-disciplinary alternative to punitive treatment of professionals with SUD; such programs offer monitoring for nurses afflicted with SUD. While studies have found a lower relapse rate for healthcare professionals enrolled in these monitoring programs than …
