The Convergence Of International Trade And Investment Arbitration, Roger P. Alford
The Convergence Of International Trade And Investment Arbitration, Roger P. Alford
Journal Articles
The World Trade Organization (“WTO”) and bilateral investment treaties (“BITs”) are among the most significant legal developments in the history of international economic law. Never before in the history of international relations has trade and investment been supported by such powerful legal guarantees and adjudicative processes. In less than two decades the WTO and BITs have permanently altered the legal landscape with reciprocal and mutually advantageous arrangements designed to reduce barriers to trade and investment and eliminate discriminatory treatment in international economic relations. In most respects the worlds of trade and investment are on parallel tracks headed in the same …

Impact Of Race On Juvenile Forensic Assessment: Clinician Perceptions Of Adequate Test Norms, Nathan E. Cook
Impact Of Race On Juvenile Forensic Assessment: Clinician Perceptions Of Adequate Test Norms, Nathan E. Cook
Open Access Dissertations
The psychological assessment of racial and ethnic minority groups is often substantially limited by the lack of adequate normative data for these groups. This study examined the impact that race has on forensic psychologists’ (N=145) diagnostic decision making as well as judgments of the quality of normative data. It was hypothesized that the forensic psychologists would accept lower quality normative data for African American youth compared to White youth. However, although the quality of the test norms influenced the dependent measures in the expected direction, no significant interaction was noted between norm quality and youth’s race. Participants judged the likelihood …
Solid State Gas Sensors For Detection Of Explosives And Explosive Precursors, Yun Chu
Solid State Gas Sensors For Detection Of Explosives And Explosive Precursors, Yun Chu
Open Access Dissertations
The increased number of terrorist attacks using improvised explosive devices (IEDs) over the past few years has made the trace detection of explosives a priority for the Department of Homeland Security. Considerable advances in early detection of trace explosives employing spectroscopic detection systems and other sensing devices have been made and have demonstrated outstanding performance. However, modern IEDs are not easily detectable by conventional methods and terrorists have adapted to avoid using metallic or nitro groups in the manufacturing of IEDs. Instead, more powerful but smaller compounds, such as TATP are being more frequently used. In addition, conventional detection techniques …

Uncoupling The Constitutional Right To Self-Defense From The Second Amendment: Insights From The Law Of War Commentary: Gun Control Policy And The Second Amendment: Responses, William G. Merkel
Connecticut Law Review
This Article contextualizes Professor Nicholas Johnson’s argument that a robust right to arms is essential to the security of Black communities in the United States. While accepting Johnson’s premise that private self-defense is necessary where government is hostile towards or unable to defend a community against violence, this Article maintains that the Second Amendment as understood at the time of its ratification did not extend to private self-defense. Rather than forcefitting a private right to self-defense into the syntactically and contextually unrelated Second Amendment as one-Justice majorities have done in District of Columbia v. Heller and McDonald v. City of …
Firearms And The Black Community: An Assessment Of The Modern Orthodoxy Commentary: Gun Control Policy And The Second Amendment, Nicholas J. Johnson
Firearms And The Black Community: An Assessment Of The Modern Orthodoxy Commentary: Gun Control Policy And The Second Amendment, Nicholas J. Johnson
Connecticut Law Review
The heroes of the modern civil rights movement were more than just stoic victims of racist violence. Their history was one of defiance and fighting long before news cameras showed them attacked by dogs and fire hoses. When Fannie Lou Hamer revealed she kept a shotgun in every corner of her bedroom, she was channeling a century old practice. And when delta share cropper Hartman Turnbow, after a shootout with the Klan, said “I don’t figure I was being non-nonviolent, (yes non-nonviolent) I was just protecting my family”, he was invoking an evolved tradition that embraced self-defense and disdained political …
Domestic Violence In Indian Country: Improving The Federal Government's Response To This Grave Epidemic Note, Jeana Petillo
Domestic Violence In Indian Country: Improving The Federal Government's Response To This Grave Epidemic Note, Jeana Petillo
Connecticut Law Review
The pervasiveness of domestic violence against Native American women in Indian country is alarming. Pursuant to the doctrine of trust responsibility, the federal government has recently responded to the epidemic of domestic violence in Indian country by passing three pieces of legislation—18 U.S.C. § 117, the Tribal Law and Order Act of 2010, and the Violence Against Women Reauthorization Act of 2013. This Note discusses the shortcomings of these pieces of legislation and proposes two courses of action by which the federal government may improve its response to domestic violence in Indian country. First, this Note suggests that the federal …
Ideological Exclusion In The Post-9/11 Era: A Case For Increased Judicial Oversight And Recognition Of The Right To Hear Speech Note, Sean D. Acevedo
Ideological Exclusion In The Post-9/11 Era: A Case For Increased Judicial Oversight And Recognition Of The Right To Hear Speech Note, Sean D. Acevedo
Connecticut Law Review
Following the terror attacks of September 11, 2001, the George W. Bush Administration actively engaged in a policy of ideological exclusion. During the Bush Administration, the State Department routinely denied visas to foreign nationals whose political views it disfavored. The primary targets of ideological exclusion during the post-9/11 era were members of the Arab and Muslim intellectual communities. Opponents have argued that ideological exclusion violates United States citizens’ First Amendment right to hear and debate speech. After offering an extensive background of the history of ideological exclusion in the United States, this Note argues that the Bush Administration’s policy of …
Agency Discretion And Statutory Mandates In A Time Of Inadequate Funding: An Alternative To In Re Aiken County Note, Bret Kupfer
Agency Discretion And Statutory Mandates In A Time Of Inadequate Funding: An Alternative To In Re Aiken County Note, Bret Kupfer
Connecticut Law Review
When an agency fails to abide by a statutory mandate, aggrieved parties may petition the courts for an order compelling the agency to act. In the interest of Congress’s constitutional power, courts will grant the petition and force agencies to comply. However, it is unclear whether an agency violates a statutory mandate when Congress intentionally withholds adequate funds to comply with the mandate. On August 13, 2013, the United States Court of Appeals for the District of Columbia Circuit ordered the Nuclear Regulatory Commission to spend $11.1 million in carryover appropriations to review an application for a nuclear waste repository …
Firearms Policy And The Black Community: Rejecting The Wouldn't You Want A Gun If Attacked Argument Commentary: Gun Control Policy And The Second Amendment: Responses, Andrew J. Mcclurg
Firearms Policy And The Black Community: Rejecting The Wouldn't You Want A Gun If Attacked Argument Commentary: Gun Control Policy And The Second Amendment: Responses, Andrew J. Mcclurg
Connecticut Law Review
The gun lobby has succeeded in focusing the gun debate on a narrow, oversimplified question: “If a criminal attacked you, wouldn’t you prefer to have a gun to protect yourself?” This Article asserts that the question—which correlates with a “more guns” argument—is a red herring, a diversion that leads us off track and blinds us to the need for comprehensive strategies to address the complex, polycentric issues of gun violence in America. In his article, Firearms Policy and the Black Community: An Assessment of the Modern Orthodoxy, Professor Nicholas Johnson pursues a version of the “Wouldn’t you want a gun …
Mentally Defective Language In The Gun Control Act, Jana R. Mccreary
Mentally Defective Language In The Gun Control Act, Jana R. Mccreary
Connecticut Law Review
The oft-quoted argument asserts that “Guns don’t kill people; people kill people.” It is essential, then, that gun legislation clearly address who the people are who should not possess or purchase guns. As the country once again reacts to a tragedy with renewed interest in implementing new gun legislation, we must use caution to clearly identify who should be restricted from acquiring firearms. The Gun Control Act of 1968 and its subsequent amendments fail at this task. When considering the ease with which persons with dangerous mental illnesses may legally purchase firearms because they do not meet technical and vague …

Let Us Talk Past Each Other For A While: A Brief Response To Professor Johnson Commentary: Gun Control Policy And The Second Amendment: Responses, Michael De Leeuw
Connecticut Law Review
This Article is a brief response to Professor Johnson’s excellent lead article, Firearms Policy and the Black Community: An Assessment of the Modern Orthodoxy. Professor Johnson has (I would say unfairly) counted me among the “orthodoxy” that believes that any and all gun control measures are good for communities of color. He accuses me (and the rest of those who hew to the modern orthodoxy) of ignoring the clear and present danger faced by what he calls the “Parker/MacDonald class”—law-abiding citizens who live in dangerous neighborhoods that are (perhaps) not well served by law enforcement. Professor Johnson urges that members …
Public Employee Speech And The Privatization Of The First Amendment, Adam Shinar
Public Employee Speech And The Privatization Of The First Amendment, Adam Shinar
Connecticut Law Review
Constitutional protection of public employee speech has been declining for the past forty years, yet the reason for the decline has remained elusive. This Article puts forward a novel theory situating public employee speech in larger structural transformations in governmental organization. It identifies a “public/private convergence,” the main feature of which is that public officials are increasingly viewed as private employees, resulting in a significant erosion of their free speech rights. This erosion is exacerbated by rising levels of privatization and civil service reforms exhibiting the same mode of thought: that public employees are no different from private employees. These …
