Getting Slapp-Ed In Federal Court: Applying State Anti-Slapp Special Motions To Dismiss In Federal Court After Shady Grove, Katelyn E. Saner

In recent years, dozens of states have enacted anti-Strategic Lawsuits Against Public Participation (SLAPP) laws to counter SLAPP suits, or lawsuits filed to silence a defendant who has spoken out against a plaintiff. The goal of a SLAPP suit is not to win on the merits, but rather to discourage the defendant's right to free speech through the prospect of ruinously expensive litigation. State anti-SLAPP laws provide for special motions to dismiss, which allow a defendant to file an expedited motion to dispose of the SLAPP suit before engaging in costly discovery.

Integration of nanoscience and nanotechnology curricula into the College of Science, Mathematics, and Technology (CSMT) at the University of Texas at Brownsville (UTB) is reported. The rationale for the established multidisciplinary Nanoscience Concentration Certificate Program (NCCP) is to: (i) develop nanotechnology-relevant courses within a comprehensive Science, Engineering and Technology curriculum, and, to offer students an opportunity to graduate with a certificate in nanoscience and nanotechnology; (ii) to contribute to students' success in achieving student outcomes across all college's majors, and, improve the breath, depth and quality of science, technology, engineering and mathematics (STEM) graduates' education; (iii) through NCCP, recruit certificate- …

According to the Centers for Disease Control (CDC), motor vehicle incidents has been reported to be the leading cause of the accidental deaths in the United States accounting for more than 42,000 deaths every year. Distracted driving and Driving under influence (DUI) are the major contributors to these roadway crashes. Moreover, drivers fatigue and drowsiness behind the wheel is another important factor contributing to the high fatality rate. These factors results in significant decline in the driver's abilities of perception, recognition and vehicle control.

Living In The Outskirts, Thomas De La Cruz

Living in the Outskirts is a bildungsroman collection of short stories of a young Chicano growing up in the Rio Grande Valley town of Elsa, Texas. In the critical introduction of this thesis, I discuss how my stories challenge traditional Chicano/a cultural ideals of masculinity, language, class and nationality. Included in my introduction are other Chicano/a writers who engaged with these Chicano/a cultural ideals, and who I find myself in conversation with through my work. Inspired by Gloria Anzaldúa’s theory of the “New Mestiza Consciousness,” I show how the protagonist of my stories gradually changes throughout the collection and adopts …

Achieving The Dream: Extending Immigration Reform To Administrative Case Closure, Tory E. Smith

This Comment compares DACA to administrative case closure and argues that Congress or the President should grant employment authorization to individuals whose cases have been administratively closed. Part I describes the current interpretation of the employment authorization regulation and provides the background of administrative case closure. Part I highlights the disparate treatment that the regulation affords to undocumented immigrants facing deferred action and administrative closure—offering employment authorization to only deferred action recipients. Part II examines the history of deferred action in immigration cases and uses DACA as a framework to show how the scope of the employment authorization regulation should …

Modern county jails have increasingly adopted policies to bill their inmates for some or all of the costs of their room and board. Statutes authorizing counties to implement these “pay-to-stay” programs are on the books in roughly seventy percent of states, yet the financial mechanism on which these programs typically rely is not well understood. Although the pay-to-stay obligation bears some resemblance to familiar citizen-state financial transactions—such as fines and penalties, restitution, taxes, and fees—it usually belongs to a distinct model that this Article calls the “government-imposed loan.” This Article provides an overview of the landscape of pay-to-stay programs and …

The availability of GPS technology has allowed for significant advances in the research of freight transportation. Current systems enable information to be gathered on an individualistic scale including informations such as speed, direction and location within feet of their actual location. Several agencies have begun the process of collection and archiving data into large databases to make access and continuity of the information readily available to researchers. A Statistical Analysis Of The Beneficial Effects Of Ferrous Chloride At The T. E. Maxson Treatment Plant, Bjorn Carlsson

Addition of ferrous chloride can improve wastewater treatment plant process outcomes. In the study, a municipal wastewater treatment plant ceased adding ferrous chloride to its anaerobic lagoon and belt filter press filtrate return streams. Total suspended solids (TSS) and five-day biochemical oxygen demand (BOD5) effluent concentrations and percent removals, primary clarifier BOD5 and TSS effluent concentration and percent removals, sludge volume index (SVI), sludge polymer feed demand, and H2S concentration in biogas on days with ferrous chloride addition were all compared using non-parametric randomization statistical techniques to days without ferrous chloride addition. Work Hope And The Socioemotional Functioning Of Offenders, David Guion

For offenders returning to society at record levels, securing work looms as one of the most crucial factors in successful reentry. Work hope is a construct that seeks to measure the relative presence of goals of securing desired work, thoughts about how to achieve those goals, and agency to achieve those goals, even in the presence of obstacles. This study sought to examine relationships among work hope, the socioemotional variables of attachment, emotion regulation, physical, relational, and workplace victimization, and coping, and the career-related variables of perceptions of career-related barriers and complexity level of career goals.
