Deportation And The War On Independence , Stephen H. Legomsky Apr 2013

Deportation And The War On Independence , Stephen H. Legomsky

Journal of the National Association of Administrative Law Judiciary

Judicial independence, despite its long history and cherished place in American jurisprudence, has periodically been attacked by those who disagree with particular outcomes. In recent years, Congress and the executive branch have mounted a sustained assault on decisional independence in the adjudication of deportation (now called “removal”) cases. Various actions taken by Attorney General Ashcroft in 2002 and 2003 and still in place today have left both immigration judges and the members of the Board of Immigration Appeals without any meaningful decisional independence. Meanwhile, in 1996 and again in 2005, Congress imposed severe limitations on judicial review of administrative orders …

Anachronistic Policies In The United States: What All Policymakers Need To Know About Marijuana, Alex Riggs '13

Honor Scholar Theses

The following paper contains vital information for policymakers in the United States who wish to take first steps to challenge antiquated laws surrounding marijuana. It includes essential information concerning the history of the drug, the drug’s biology, the potential medical and nonmedical uses of the drug, genuine health concerns associated with its use, marijuana myths, and the many costs to society as a result of its prohibition. Ultimately, this paper argues why a United States without a federal ban on marijuana would improve economic conditions and personal liberty for its citizens, governs itself more transparently, and abides more closely to …

How Administrative Law Halted The Death Penalty In Maryland , Arnold Rochvarg Apr 2013

How Administrative Law Halted The Death Penalty In Maryland , Arnold Rochvarg

Journal of the National Association of Administrative Law Judiciary

Numerous arguments have been raised to halt the death penalty, including constitutional claims such as ineffective assistance of counsel, equal protection, right to trial by jury, and cruel and unusual punishment. The winning argument, however, in Evans v. State, a Maryland death penalty appeal, was based not on constitutional or criminal law, but rather Administrative Law. A death row inmate attacked the validity of the procedures for administering lethal injection capital punishment because the Maryland Department of Corrections had not followed the proper statutory procedures for adopting the regulation which set forth the capital punishment process. In order for a …

Due Process; A Detached Judge; And Enemy Combatants, Julian Mann Iii Apr 2013

Due Process; A Detached Judge; And Enemy Combatants, Julian Mann Iii

Journal of the National Association of Administrative Law Judiciary

In the landmark administrative law decision of Goldberg v. Kelly, Justice Brennan stated that an “impartial decision maker is essential” to procedural due process. As a corollary, in the more recent decision of Hamdi v. Rumsfeld, Justice O'Connor stated that “due process requires a neutral and a detached judge in the first instance.” Thus, the due process clauses of the Fifth and Fourteenth Amendments to the U.S. Constitution require that the essential element of neutrality remain an integral part of any administrative hearing. There can be no departure from this fundamental guarantee of constitutional due process for the administrative hearings …

Know Your Audience: How Nyc Tribunals Have Addressed Self-Represented Litigants And Increased Access To Justice, Sherry M. Cohen, Joanna Weiss Apr 2013

Know Your Audience: How Nyc Tribunals Have Addressed Self-Represented Litigants And Increased Access To Justice, Sherry M. Cohen, Joanna Weiss

Journal of the National Association of Administrative Law Judiciary

The first rule of communication is to know your audience. The “audience” at hearings in New York City (NYC) tribunals is mostly comprised of self-represented respondents with Limited English Proficiency. In order to provide full access to the hearing process, NYC tribunals must know and understand the needs of this audience of respondents. The challenge is not only to keep this audience engaged, but also to ensure that it can navigate and fully participate in the hearing process. Tribunals must communicate in a way that protects the respondents' rights and affords them an opportunity to be heard. NYC tribunals, especially …

Interactive Aphra: Skyping Behn Into Your Classroom, Cheryl Wanko Apr 2013

Interactive Aphra: Skyping Behn Into Your Classroom, Cheryl Wanko

ABO: Interactive Journal for Women in the Arts, 1640–1830

Beginning by asking how teachers manage the presence of the author in their literature classrooms, this article describes the classroom experiment of interviewing Karen Eterovich, an actor who portrays Aphra Behn, using Skype. It describes the planning and scripting processes, explains the particular interests of this group of students, and assesses the final activity. Questions arose about topics for the interview, appropriate ways for Behn to respond, and the need for a script. The pedagogical opportunities for preparing students as interviewers and of expanding their understanding of performance, historical reenactment, and the construct of the author are discussed. Possible extensions …
