Social Justice And The Charter: Comparison And Choice, Margot Young Jan 2013

Social Justice And The Charter: Comparison And Choice, Margot Young

Osgoode Hall Law Journal

At a time of radical inequality, the changes sought by social justice advocacy are urgently needed. Yet repeatedly, courts fail to respond adequately to this challenge. A core issue plagues social justice jurisprudence under sections 7 and 15: the difficulty inevitable in the contemplation and expression of the social and political forms in which oppression and social injustice occur. This problem manifests doctrinally in ways specific to the rights at issue. In section 15 cases, the casting of comparator groups has been deeply problematic, and in both section 15 and section 7 cases, the courts fail to deliver a nuanced …

Improving Performance By Re-Rating In The Dynamic Estimation Of Rater Reliability, Alexey Tarasov, Sarah Jane Delany, Brian Macnamee

Conference papers

Nowadays crowdsourcing is widely used in supervised machine learning to facilitate the collection of ratings for unlabelled training sets. In order to get good quality results it is worth rejecting results from noisy/unreliable raters, as soon as they are discovered. Many techniques for filtering unreliable raters rely on the presentation of training instances to the raters identified as most accurate to date. Early in the process, the true rater reliabilities are not known and unreliable raters may be used as a result. This paper explores improving the quality of ratings for train- ing instances by performing re-rating. The re-rating relies …

A Next, Big Step For The West: Using Model Legislation To Create A Water-Climate Element In Local Comprehensive Plans, Michelle Bryan

Faculty Law Review Articles

The West is witnessing early, important efforts to join water supply and land use planning, and the reality of climate change makes this convergence all the more critical. Local comprehensive planning presents itself as an existing and indispensable tool for unifying important planning efforts in the areas of land use, water, and climate change. As the primary regulators of land use, local governments are at the front line of regulating a myriad of environmental concerns. They are also integral partners in planning and implementing water-related initiatives alongside tribal, state, federal, and private partners. The West’s potential for broad-based action is …

Family Mediation After Hendershott: The Case For Uniform Domestic Violence Screening And Opt-In Provision In Montana, Eduardo R.C. Capulong Jan 2013

Family Mediation After Hendershott: The Case For Uniform Domestic Violence Screening And Opt-In Provision In Montana, Eduardo R.C. Capulong

Faculty Law Review Articles

In Hendershott v. Westphal, the Montana Supreme Court held that § 40-4-301(2) of the Montana Code Annotated absolutely bars mediation in family law cases involving domestic violence. Yet neither the Court nor the statute prescribes a method by which to screen for such cases. In this article, the author argues that a uniform, statewide screening method is the only way by which to implement this policy. The author also argues that Hendershott should be interpreted narrowly and Montana should allow parties to opt in to mediation and other forms of alternative dispute resolution. The Court's understanding of domestic violence …

The System Of Campaign Finance Disclosure, Anthony Johnstone Jan 2013

The System Of Campaign Finance Disclosure, Anthony Johnstone

Faculty Law Review Articles

This Essay considers Professor Gilbert’s model as the core element in a dynamic system of campaign finance disclosure. First, it recognizes several useful contributions of the model’s framework of informational costs and benefits. In the simplest analysis, disclosure increases the information available to voters by adding source revelation to campaign speech. However, the reality is more complicated. Disclosure can have a chilling effect that decreases the amount of campaign speech by imposing administrative and exposure burdens on speakers. As Professor Gilbert shows, this cannot end the analysis. What matters is not just the magnitude of the chilling effect on speech, …

Recalibrating Campaign Finance Law, Anthony Johnstone Jan 2013

Recalibrating Campaign Finance Law, Anthony Johnstone

Faculty Law Review Articles

This Essay seeks to provide a theoretical framework for conceptualizing this relationship and considering reforms. Part I traces the variation of campaign finance regimes across several political eras and several jurisdictional scales. Strikingly, although similar six-figure campaign finance scandals prompted the reforms of each era, federal lawmakers in each era have drawn progressively lower one-size-fits-all contribution limits and disclosure thresholds. Meanwhile, state campaign finance laws have been more carefully calibrated to reflect the electoral and financial circumstances of particular electoral contests. Part II considers the currently permissible means and ends of campaign finance law and how they constrain the calibration …

If Skilling Can't Get A Change Of Venue, Who Can? Salvaging Common Law Implied Bias Principles From The Wreckage Of The Constitutional Pretrial Publicity Standard, Jordan Gross Jan 2013

If Skilling Can't Get A Change Of Venue, Who Can? Salvaging Common Law Implied Bias Principles From The Wreckage Of The Constitutional Pretrial Publicity Standard, Jordan Gross

Faculty Law Review Articles

Fifty years ago, the United States Supreme Court issued three landmark decisions recognizing local pretrial publicity and community hostility in a charging venue as extraneous forces that can impact jurors’ ability to be constitutionally impartial. It later held that local prejudice can be so incompatible with a defendant’s right to an impartial jury that a trial in that community violates due process and may require a change in venue. Paradoxically, successful venue challenges under this federal constitutional pretrial publicity standard have become increasingly rare even as the volume, sensationalism, and pervasiveness of media coverage of criminal trials have increased with …

This study looks at 82 contemporary pedagogical progressive schools to identify common characteristics. Child-centered learning, community integration, and democratic decision-making were the three overarching philosophies covered in this study. Data was collected through an online survey of school leaders. The majority of research surrounding progressive education is qualitative and focuses …

In Situ Vision: The Student Experience Of Collaborative Learning In A Virtual Drawing Class, Annette Cohen

Antioch University Dissertations & Theses

The purpose of this study was to elucidate the construct of collaboration and the co-construction of knowledge in a distance learning drawing class. Distance learning drawing classes are rare, due to resistance by fine arts departments holding onto traditions that date back to Renaissance times. As a result, there is a paucity of literature on the subject. This multiple method study seeks an understanding of how students collaborate in critiques, form virtual communities and socially construct knowledge about learning how to draw. The study commences with the following three research questions: what social processes facilitate learning to draw from the …

Meta-For, Vincent Mario Pignatiello Ii Jan 2013

Meta-For, Vincent Mario Pignatiello Ii

Antioch University Dissertations & Theses

A clinician is entrusted with the difficult task of organizing, integrating, and formulating a vast amount of information provided by a patient in order to conduct therapy. Typically, a theoretical paradigm is employed in this endeavor. This paper constructs a theory of theoretical paradigms—a meta-theory—to understand better how clinicians organize and understand patient information. The theory of theory posits that theoretical paradigms function as complex metaphors developed within a culture. The argument presented here utilizes research from various areas of psychology—including those focusing on cognitive research, psycholinguistics, and philosophy of theory—to develop the meta-theory. The central thesis of this research …

Emerging Forms Of Awareness About Forgiveness: An Analysis Of What High Profile Leaders Think, Stephen Bauman

Antioch University Dissertations & Theses

Over the last several decades forgiveness research has exploded across a wide array of scholarly disciplines from psychology and sociology to political theory, medicine and the arts, but it has not yet captured the full attention of researchers concerned specifically with leadership. This situation is further complicated by the lack of an agreed-upon definition/understanding of forgiveness both within and across disciplines. This study explores what high profile leaders think about forgiveness and begins to fill the gap in leadership studies concerning the meanings and applications of forgiveness among leaders. Data was gathered through responsive interviewing of 13 high profile leaders …

The Impact Of Voluntary Aftercare On Recidivism Rates For Adult Male Sex Offenders, Alexandra Schmidt

Antioch University Dissertations & Theses

The recidivism rate of eighteen sex offenders participating in Stepping Up, a voluntary aftercare program, was compared to the overall recidivism rate of convicted sexual offenders in California in order to determine the effectiveness of voluntary participation in a post-mandated treatment program. Attendance for a minimum of six months in Stepping Up was required for inclusion in the study, and recidivism rates were calculated by a review of records. Although participants in the Stepping Up aftercare program had a re-offense rate of 0%, results were not statistically significant when compared with California's overall recidivism rates. While a 0% recidivism rate …
