Waiving Goodbye To Due Process: The Juvenile Waiver System, Rachel Jacobs
Cardozo Journal of Equal Rights & Social Justice
The juvenile waiver system is flawed as it arbitrarily subjects minors to adult criminal proceedings, disregarding their potential for rehabilitation and violating their due process rights. The system must be reformed to ensure fair, individualized assessments and protect juveniles' rights.
Front-Of-Package Nutrition Claims: Trustworthy Facts Or Deceptive Marketing? Closing The Loopholes In Labeling, Kathryn E. Hayes
Front-Of-Package Nutrition Claims: Trustworthy Facts Or Deceptive Marketing? Closing The Loopholes In Labeling, Kathryn E. Hayes
Cardozo Journal of Equal Rights & Social Justice
The note argues that front-of-package (FOP) labeling on children's food products is insufficient and often misleading, failing to meet basic nutritional standards. It advocates for the adoption of uniform, science-based labeling standards developed by an objective body like the Institute of Medicine (IOM) to help parents make healthier choices. The analysis highlights the limitations of self-regulation by manufacturers and the need for stronger governmental oversight to address deceptive practices and improve public health outcomes.

Book Review: Alphabet To Internet: Media In Our Lives, Sue Burzynski Bullard
College of Journalism and Mass Communications: Faculty Publications
Technology has changed virtually every aspect of communication. As more of us adapt to news and information delivered almost instantly on devices that handily fit into a pocket, we’ve become accustomed to new tools and quick changes. Irving Fang’s second edition of Alphabet to Internet puts it all in perspective, starting with the dawn of writing and including today’s 140-character Tweet. In a word, the impact is mind-boggling.

Integrating Evidence-Based Practices Into Public Relations Education, Karen Freberg, David L. Remund, Kathy Keltner-Previs
College of Journalism and Mass Communications: Faculty Publications
Public relations continue to play an essential and changing role in society, requiring the regular reassessment of the education of future public relations practitioners. Academics and practitioners often differ in how they view the public relations field, how they define the discipline, and how they view the major pedagogical approaches. This paper explores the impact of integrating three different perspectives in public relations education, including practitioner perspective, client perspective, and the evidence-based perspective. Results from students’ reaction papers and an online questionnaire suggest that integrating an evidence-based approach improves the competence and clarity of communications counsel provided by aspiring practitioners.

Although vertebrates harbor bacterial communities in their gastrointestinal tract whose composition is host-specific, little is known about the mechanisms by which bacterial lineages become selected. The goal of this study was to characterize the ecological processes that mediate host-specificity of the vertebrate gut symbiont Lactobacillus reuteri, and to systematically identify the bacterial factors that are involved. Experiments with monoassociated mice revealed that the ability of L. reuteri to form epithelial biofilms in the mouse forestomach is strictly dependent on the strain’s host origin. To unravel the molecular basis for this host-specific biofilm formation, we applied a combination of transcriptome …

Digital Heritage: Digitization Of Museum And Archival Collections, Genevieve A. Horan
Research Papers
The purpose of this paper is to trace the utilization of computer technology within museums and archival institutions, and relate how they have adapted to survive in today’s society that is obsessed with technological advancement. Beginning in the 1960s, computer technology started to integrate into the federal government and professional business sectors. Because of its success in these sectors, museums and archival institutions, began to gradually recognize the use of computers and associated technologies as a means to not only increase administrative productivity, but as a way to enable staff to delve deeper into their available collections through the automation …

An Update On Vitamin D: The Role In Chronic Disease, Clinical Practice Implications, And The Current Status Of Nurse Practitioner Knowledge, Sara E. Robertson
DNP Projects
The discovery that a large portion of the United States population is vitamin D deficient, has led to hundreds of studies in the last decade which aim to discover the role of vitamin D in overall health and to determine what clinical consequences occur in a deficient state. The current clinical knowledge regarding vitamin D deficiency is reviewed, including the definition of vitamin D insufficiency and deficiency and its correlation to chronic disease states; the risk factors and epidemiology of vitamin D deficiency; and appropriate clinical screening and treatment of vitamin D deficiency. A research study completed in 2012 to …

Obesity interventions that involve family members may be effective with racial/ethnic minority youth. This review assessed the nature and effectiveness of family involvement in obesity interventions among African-American girls aged 5-18 years, a population group with high rates of obesity. Twenty-six databases were searched between January 2011 and March 2012, yielding 27 obesity pilot or full-length prevention or treatment studies with some degree of family involvement and data specific to African-American girls. Interventions varied in type and level of family involvement, cultural adaptation, delivery format, and behavior change intervention strategies; most targeted parent-child dyads. Some similarities in approach based on …
Nitrate Reduction Coupled To Iron(Ii) And Manganese(Ii) Oxidation In An Agricultural Soil, Stephanie Pyzola
Nitrate Reduction Coupled To Iron(Ii) And Manganese(Ii) Oxidation In An Agricultural Soil, Stephanie Pyzola
Theses and Dissertations--Plant and Soil Sciences
New evidence shows iron(II) oxidation is strongly coupled to nitrate reduction under anaerobic conditions in freshwater sediments and agricultural soils. However, the contribution of iron(II) oxidation to nitrate reduction is unknown. Furthermore, oxidation of manganese(II) by nitrate has been largely overlooked. This study investigated nitrate-dependent iron(II) and manganese(II) oxidation in an agricultural soil (Sadler silt loam) using stirred-batch kinetic techniques with native soil organic carbon (SOC) as the electron donor and included addition of amendments (hydrogen gas and wheat residue). In the presence of native SOC, nitrate-dependent Fe(II) and Mn(II) oxidation occurred at early stages of the reaction while organic …
Calendula Officinalis Growth And Production Of Secondary Compounds In Greenhouse And Soil-Based Herbal Organic Production Systems, Victoria M. Anderson
Calendula Officinalis Growth And Production Of Secondary Compounds In Greenhouse And Soil-Based Herbal Organic Production Systems, Victoria M. Anderson
Theses and Dissertations--Plant and Soil Sciences
Calendula officinalis is a useful model crop because calendula flowers are used both ornamentally and medicinally. Organic production systems have many challenges; among these is the synchrony of nitrogen mineralization with the requirements of the crop. Organic greenhouse substrates have significantly different initial nitrogen levels which influence the performance of calendula, the highest initial N and plant performance was found in the organic compost peat substrate (OCP). The addition of supplemental nitrogen improved performance, but only OCP performed as well as the conventionally fertilized peat-based substrate. The nitrogen mineralization patterns in a soil-based greenhouse pot experiment showed that highly processed …
Control Of Erwinia Tracheiphila In Cucumis Melo, John R. Caudle
Control Of Erwinia Tracheiphila In Cucumis Melo, John R. Caudle
Theses and Dissertations--Plant and Soil Sciences
Currently there is no control of bacterial wilt disease, Erwinia tracheiphila, in susceptible cucurbit crops, once infection of the plant occurs. Conventional and organic production systems rely on insecticide applications to kill the vectors, striped and spotted cucumber beetles, Acalymma vittatum and Diabrotica undecimpunctata, respectively, prior to transmission of the pathogen which indirectly controls the disease to some extent. Physical barriers such as row covers are used to exclude the vectors from plants prior to flowering; however, pollination requirements expose plants to potential infection. Experimental field plots were developed to test various enhanced organic production systems in an …

What's Law Got To Do With It?: Why We Should Mediate, Rather Than Litigate, Cases Of Wrongful Life, Shawna Benston
Cardozo Journal of Conflict Resolution
In light of the legal and societal disfavor toward wrongful life suits, this Note examines the cultural, (bio)ethical, legal, and philosophical background of the wrongful life tort. While the disability rights movement and the pro-life strains of the abortion debate hope to silence proponents of wrongful life suits, the evolution of a legal right to die underscores the importance of autonomy and privacy for the individual. Philosophical exploration of prospective children-including the nonidentity problem, claim-rights and corresponding duties, and the subjunctive-threshold notion of harmhelps explain the confusion and moral conundrum that pervade the very notion of "wrongful life" and that …

From The People's Court To American Idol: The Relationship Between Reality Television And Arbitration, On-Air And Off, Jared Bloch
Cardozo Journal of Conflict Resolution
The first section discusses the background of the role of alternative dispute resolution ("ADR") in television, starting with the courtroom dramas that helped bring ADR to mainstream culture. Next, the Note will explore the regulations that helped to shape the television industry, in conjunction with a discussion of why the impact of these regulations is still being felt today. Then, the Note will discuss the effect that guilds, such as the Screen Actors Guild ("SAG") and American Federation of Television and Radio Artists ("AFTRA"), have on arbitration provisions and contracts as a whole, as well as a bigger picture analysis …

Deconstructing Disintermediation: A Skeptical Copyright Perspective, Guy Pessach
Deconstructing Disintermediation: A Skeptical Copyright Perspective, Guy Pessach
Cardozo Arts & Entertainment Law Journal
This essay attempts to uncover the impacts of disintermediation in copyright law. I argue that contrary to the common view, within the political economy of networked communication platforms and the Internet, disintermediation in copyright law does not necessarily lead to its expected outcomes. Disintermediation may undermine cultural diversity, decentralization and authors' welfare no less than the traditional corporate media proprietary model. My analysis focuses on the manner in which disintermediation in copyright law tends to stimulate concentrated markets, which channel audience attention to a handful of mega networked intermediaries. The market and media power, which is then held by these …

The Semiotics Of Alpha Brands: Encoding/Decoding/Recoding/Transcoding Of Louis Vuitton And Implications For Trademark Laws, David Tan
Cardozo Arts & Entertainment Law Journal
Alpha brands are the most influential global brands that possess significant configurations of meanings and can offer peculiarly powerful affirmations of belonging and recognition in the lives of their consumers. The trademark, as the visual source-designating emblem of a brand, is also a semiotic sign that resonates with the structure of myths and archetypes within a cultural environment of desire. Focusing on the world-renowned Louis Vuitton trademark, this Article explores how an understanding of semiotics can be useful to a legal analysis of trademarks. Two decisions involving the iconic Louis Vuitton brand one from the United States and one from …

Reduced Translocation Is Associated With Tolerance Of Common Lambsquarters (Chenopodium Album) To Glyphosate, M. K. Yerka, Andrew T. Wiersma, R. Bradley Lindenmayer, Philip Westra, William G. Johnson, Natalia De Leon, David E. Stoltenberg
United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications
Common lambsquarters tolerance to glyphosate is problematic because of the species’ widespread distribution, competitive ability with many crop species, the widespread use of glyphosate in agriculture, and the weed’s potential to develop decreased sensitivity to multiple herbicide sites of action. The mechanism that confers common lambsquarters tolerance to glyphosate is not known. Therefore, we conducted experiments to determine the mechanism of tolerance to glyphosate in an accession of common lambsquarters from Indiana relative to a sensitive accession from Wisconsin. The ED50 (the effective dose that reduced shoot mass 50% relative to nontreated plants) value for the tolerant accession (1.6 …

Batman Meets Gagne: Analyzing Commercial Video Game Instruction Through The Lens Of Instructional Design, Susan E. Copp, Rebecca L. Fisher, Tian Luo, Seann Dikkers
STEMPS Faculty Publications
This paper will examine how Gagne’s Nine Events of Instruction (1992) may appear, perhaps inadvertently, within commercial games that guide the user from novice to expert player. By employing a qualitative artifact analysis methodology, we examine a popular action adventure video game to determine if game designers encourage players to build game expertise by employing similar events to Gagne’s instructional design model. We demonstrate that our artifact of analysis does consistently employ Gagne’s events, though often in a manner unique to a digitally mediated space. We conclude that an experiential game setting has the potential to be a platform for …

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications
Agriculture in the United States (US) cycles large quantities of nitrogen (N) to produce food, fuel, and fiber and is a major source of excess reactive nitrogen (Nr) in the environment. Nitrogen lost from cropping systems and animal operations moves to waterways, groundwater, and the atmosphere. Changes in climate and climate variability may further affect the ability of agricultural systems to conserve N. The N that escapes affects climate directly through the emissions of nitrous oxide (N2O), and indirectly through the loss of nitrate (NO3-), nitrogen oxides (NOx) and ammonia to downstream and …
