The Traumatized/Traumatizing Subject In Anna Deavere Smith, Suzan-Lori Parks, And August Wilson, Christopher J. Giroux Jan 2013

The Traumatized/Traumatizing Subject In Anna Deavere Smith, Suzan-Lori Parks, And August Wilson, Christopher J. Giroux

Wayne State University Dissertations

The Traumatized/Traumatizing Subject in Anna Deavere Smith, Suzan-Lori Parks, and August Wilson explores how drama, as a genre, is particularly suited for capturing aspects of trauma in ways that other genres cannot; this argument reinforces that trauma must be studied within the humanities, specifically within literature programs. Recognizing that trauma in and of itself is tied to issues of narrativization, textuality, and performativity, this project notes that Smith's, Parks's, and Wilson's work collectively attempt to traumatize contemporary viewing audiences and make them aware—cognitively and emotionally—of the hardships of discrimination and racism, which themselves can be seen as examples of generational …

Increasing Referrals To Small Claims Mediation Programs: Models To Improve Access To Justice, Heather Scheiwe Kulp Jan 2013

Increasing Referrals To Small Claims Mediation Programs: Models To Improve Access To Justice, Heather Scheiwe Kulp

Cardozo Journal of Conflict Resolution

The justice system is in crisis. In 2011, 85% of Connecticut's family court cases had at least one self-represented litigant. In Massachusetts, 92% of parties appearing in housing cases are selfrepresented. New York saw self-representation in 97% of child support cases. Although judges and attorneys are learning to adapt to this new reality, the strain is felt strongly by bench and bar alike.

This article explores a service that many courts already offer-small claims mediation-and studies how courts may more effectively refer parties to such services. Specifically, this article identifies six primary models courts use to refer parties to small …

Hawaiian Land Disputes: How The Uncertainty Of The Native Hawaiian Indigenous Tribal Status Exacerbates The Need For Mediation, Donna S. Salcedo Jan 2013

Hawaiian Land Disputes: How The Uncertainty Of The Native Hawaiian Indigenous Tribal Status Exacerbates The Need For Mediation, Donna S. Salcedo

Cardozo Journal of Conflict Resolution

Many people see the Hawaiian Islands as a paradise in the Pacific Ocean. However, most are unaware that history has left an unpleasant and permanent scar on the original inhabitants of the islands, the Native Hawaiians. It is often forgotten that the islands were once ruled by its monarchy. In fact, the Hawaiian Kingdom was not overthrown until 1893, and the islands did not reach statehood until 1959. Despite this however, Native Hawaiians have never officially been considered an indigenous tribe. This lack of recognition from the federal government has caused a strong sense of injustice that is prevalent throughout …

Exchanging Shares To Settle A Lawsuit: Should A Confidentiality Agreement Bar Evidence Of Securities Fraud?, Christopher Tao Jan 2013

Exchanging Shares To Settle A Lawsuit: Should A Confidentiality Agreement Bar Evidence Of Securities Fraud?, Christopher Tao

Cardozo Journal of Conflict Resolution

Suppose that two parties enter into a mediated written settlement, but in a subsequent court proceeding, one party claims to have discovered evidence clearly establishing fraud by the opposing party during the mediation process. When a court has to determine whether or not to enforce a negotiated settlement, do mediation confidentiality rules permit the court to admit one party's evidence of the other party's fraud or misrepresentations during the mediation?

Law And Negotiation: Necessary Partners Or Strange Bedfellows?, Nancy L. Schultz Jan 2013

Law And Negotiation: Necessary Partners Or Strange Bedfellows?, Nancy L. Schultz

Cardozo Journal of Conflict Resolution

Almost thirty years ago, Robert Condlin wrote an article discussing the frustrations of students in his Negotiations class. He noted that his law students saw legal argument in negotiation primarily as a source of vexation rather than resolution. In the twenty-plus years I have taught negotiations, I have heard the same thing many times. Students will prepare and research and then be disconcerted when their negotiating partners are not swayed by their brilliant legal arguments. One comment by a student in a paper discussing his team's preparation for negotiation shows the initial thought process in a domestic relations negotiation: "It …

The Age Of (Guilt Or) Innocence: Using Adr To Reform New York's Juvenile Justice System In The Wake Of Miller V. Alabama, Morgan Molinoff Jan 2013

The Age Of (Guilt Or) Innocence: Using Adr To Reform New York's Juvenile Justice System In The Wake Of Miller V. Alabama, Morgan Molinoff

Cardozo Journal of Conflict Resolution

"Youth matters." The concept is deceptively simple. Of course youth matters. One must be a certain age to drive, to vote, to drink, to be elected president. However, the issue becomes much more complex in the context of criminal responsibility and punishment. Should children be held less accountable for their crimes because of their age? Do juveniles have a greater capacity for rehabilitation than adults? By explaining that youth matters in Graham v. Florida and holding that juveniles cannot be sentenced to life in prison without parole for non-homicide crimes, Justice Kennedy of the United States Supreme Court answered these …

Three Times Blind: The Wandering, Wondering Path To Asking The Right Question, Bradley W. Bergey Jan 2013

Three Times Blind: The Wandering, Wondering Path To Asking The Right Question, Bradley W. Bergey

Publications and Research

In this chapter, Bradley Bergey, a 2nd-year doctoral student, tells the tale of his ethnographic journey. He focuses on how he struggled to settle on a question for his project. Bradley had done a good bit of thinking about questions, their nature, and development prior to embarking on this study. In this chapter he explores the relationship between question development, data collection, and crafting an answer to his research question. He de- scribes how his question developed while he developed his own set of “eth- nographic eyes” as a researcher and how he worked to settle on a question that …

The Manufacturing And Ballistic Testing Of Tri-Axial Quasi Three Dimensional Woven Composites Layered In Polyurea, Brandon Saint

Electronic Theses and Dissertations

The protection of important infrastructure and vital resources of the United States is essential to the Nation's security. Attacks using the Nation's infrastructure as weapons of mass destruction could have a disturbing physical and psychological consequences. Work needs to be done to enhance the protection of the Nation's infrastructure to prevent, deter, or mitigate the effects of deliberate attacks by terrorist. Toxic inhalation hazard (TIH) chemicals such as chlorine gas and anhydrous ammonia are very dangerous hazardous materials. Rail transportation of TIH creates risk that exposes highly populated areas across the country to this threat. This study investigates the ballistic …

Benzo[A]Pyrene Effects On Fundulus Heteroclitus Reproductive Endpoints, Frank Booc Jan 2013

Benzo[A]Pyrene Effects On Fundulus Heteroclitus Reproductive Endpoints, Frank Booc

Electronic Theses and Dissertations

Benzo[a]pyrene (BaP) is a polycyclic aromatic hydrocarbon (PAH) that modulates aromatase enzyme function and, thus, potentially interrupts normal reproductive function. The aim of this study was to use a fish model, Fundulus heteroclitus, to assess whether BaP exposure adversely impacted reproduction. Adult fish were exposed to waterborne BaP concentrations of (0, 1 or 10 μg/L) for 28 days. Males and females were combined for the second half of the exposure (days 14-28) in order to quantitate egg production and fertilization success. Egg fertilization and subsequent hatching success of F1 embryos was significantly decreased by 10 μg/L BaP. In males, both …

We obtained soil samples from geographically diverse switchgrass (Panicum virgatum L.) and sorghum (Sorghum bicolor L.) crop sites and from nearby reference grasslands and compared their edaphic properties, microbial gene diversity and abundance, and active microbial biomass content. We hypothesized that soils under switchgrass, a perennial, would be more similar to reference grassland soils than sorghum, an annual crop. Sorghum crop soils had significantly higher NO3 −-N, NH4 +-N, SO4 2−-S, and Cu levels than grassland soils. In contrast, few significant differences in soil chemistry were observed between switchgrass crop and grassland …

Chapter 14: Intergenerational Relationships And Rural Return Migration, Christiane Von Reichert, John B. Cromartie, Ryan O. Arthun Jan 2013

Chapter 14: Intergenerational Relationships And Rural Return Migration, Christiane Von Reichert, John B. Cromartie, Ryan O. Arthun

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

In the rural United States (US), where roughly one in five Americans live, elderly are overrepresented, with 14.6% of the population versus 12% for the nation (US Census Bureau 2009a). Additionally, the proportion of elderly is growing faster in rural than in urban places due to persistent outmigration of rural youth (Cromartie 2007; Brown and Glasgow 2008). The shrinking proportion of younger cohorts represents a serious challenge for many rural communities. Especially in geographically isolated areas where elderly make up 18% of the population, prolonged and persistent out-migration of youth goes hand in hand with natural population loss (McGranahan and …

Edwardsiella tarda, a Gram-negative member of the family Enterobacteriaceae, has been implicated in significant losses in aquaculture facilities worldwide. Here, we assessed the intra-specific variability of E. tarda isolates from 4 different fish species in the eastern United States. Repetitive sequence mediated PCR (rep-PCR) using 4 different primer sets (ERIC I & II, ERIC II, BOX, and GTG5) and multi-locus sequence analysis of 16S SSU rDNA, groEl, gyrA, gyrB, pho, pgi, pgm, and rpoA gene fragments identified two distinct genotypes of E. tarda (DNA group I; DNA group II). Isolates that fell into DNA group II demonstrated more similarity …

Dynamics Of Plant Root Growth Under Increased Atmospheric Carbon Dioxide, M. Madhu, J. L. Hatfield

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Plant growth is influenced by above- and belowground environmental conditions and increasing atmospheric carbon dioxide (CO2) concentrations enhances growth and yield of most agricultural crops. This review covers current knowledge on the impact of increasing CO2 concentration on root dynamics of plants in terms of growth, root/shoot (R/S) ratio, root biomass, root length, root longevity, root mortality, root distribution, root branching, root quality, and the response of these root parameters to management practices including soil water and nutrients. The effects of CO2 concentration on R/S ratio are contradictory due to complexity in accurate underground biomass estimation …

Results were positive, and the author will discuss pros and cons that she has experienced in adding this social media component. Suggestions for future implementations and …

Development And Prospect Of Unmanned Aerial Vehicle Technologies For Agricultural Production Management, Yanbo Huang, Steven J. Thomson, W. Clint Hoffmann, Yubin Lan, Bradley K. Fritz Jan 2013

Development And Prospect Of Unmanned Aerial Vehicle Technologies For Agricultural Production Management, Yanbo Huang, Steven J. Thomson, W. Clint Hoffmann, Yubin Lan, Bradley K. Fritz

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Unmanned aerial vehicles have been developed and applied to support agricultural production management. Compared with piloted aircraft, an Unmanned Aerial Vehicle (UAV) can focus on small crop fields at lower flight altitudes than regular aircraft to perform site-specific farm management with higher precision. They can also “fill in the gap” in locations where fixed winged or rotary winged aircraft are not readily available. In agriculture, UAVs have primarily been developed and used for remote sensing and application of crop production and protection materials. Application of fertilizers and chemicals is frequently needed at specific times and locations for site-specific management. Routine …

No Holes Barred: Invasion Of The Intestinal Mucosa By Mycobacterium Avium Subsp. Paratuberculosis, John Bannantine, Luiz E. Bermudez Jan 2013

No Holes Barred: Invasion Of The Intestinal Mucosa By Mycobacterium Avium Subsp. Paratuberculosis, John Bannantine, Luiz E. Bermudez

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

The infection biology of Mycobacterium avium subsp. paratuberculosis has recently crystallized, with added details surrounding intestinal invasion. The involvement of pathogen-derived effector proteins such as the major membrane protein, oxidoreductase, and fibronectin attachment proteins have been uncovered. Mutations constructed in this pathogen have also shed light on genes needed for invasion. The host cell types that are susceptible to invasion have been defined, along with their transcriptional response. Recent details have given a new appreciation for the dynamic interplay between the host and bacterium that occurs at the outset of infection. An initial look at the global expression pathways of …

Biomass And Cellulosic Ethanol Production Of Forage Sorghum Under Limited Water Conditions, Jon Cotton, Gloria Burow, Veronica Acosta-Martinez, Jennifer Moore-Kucera

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

This study presents results from a 2-year evaluation of biomass and cellulosic ethanol (EtOH) production potential of forage sorghum (Sorghum bicolor L. Moench) cultivars differing in brown midrib trait (i.e., bmr12) under dryland (no irrigation) and limited irrigation (2.88 mm day−1; subsurface drip) in the semiarid Southern High Plains of the USA. Commercial cultivar Sorghum Partners 1990 (SP 1990, conventional non-bmr) produced significantly more biomass (29–62 %) than a bmr12 cultivar PaceSetter bmr (PS bmr) under irrigated and dryland conditions during both years of this study. However, PS bmr biomass had higher cellulosic EtOH conversion …

Home Sweet Home: An Infinite Grid Of Memory And Repressed Abuse Trauma, Melissa Bush Jan 2013

Home Sweet Home: An Infinite Grid Of Memory And Repressed Abuse Trauma, Melissa Bush

Electronic Theses and Dissertations

Incorporating traditional craft mediums of crochet and embroidery, I use digital technology to experiment with wording to graphically represent my abuse trauma. Due to the severity of the subject matter and the work ethic I employ in my art practice, using my hands and being completely involved is a form of masochistic pleasure. My process takes on a Sisyphean approach of penance for the sins of others in my work. During my studio practice, my process reaches a meditative state where my mind is clear and free of the burden. Once I've completed a panel of trauma, the burden is …

Mode-Division Multiplexed Transmission In Few-Mode Fibers, Neng Bai Jan 2013

Mode-Division Multiplexed Transmission In Few-Mode Fibers, Neng Bai

Electronic Theses and Dissertations

As a promising candidate to break the single-mode fiber capacity limit, mode-division multiplexing (MDM) explores the spatial dimension to increase transmission capacity in fiberoptic communication. Two linear impairments, namely loss and multimode interference, present fundamental challenges to implementing MDM. In this dissertation, techniques to resolve these two issues are presented. To de-multiplex signals subject to multimode interference in MDM, Multiple-InputMultiple-Output (MIMO) processing using adaptive frequency-domain equalization (FDE) is proposed and investigated. Both simulations and experiments validate that FDE can reduce the algorithmic complexity significantly in comparison with the conventional time-domain equalization (TDE) while achieving similar performance as TDE. To further …

Development Of Thulium Fiber Lasers For High Average Power And High Peak Power Operation, Robert Sims Jan 2013

Development Of Thulium Fiber Lasers For High Average Power And High Peak Power Operation, Robert Sims

Electronic Theses and Dissertations

High power thulium fiber lasers are useful for a number of applications in both continuous-wave and pulsed operating regimes. The use of thulium as a dopant has recently gained interest due to its large bandwidth, possibility of high efficiency, possibility of high power and long wavelength ~1.8 – 2.1 μm. The longer emission wavelength of Tm-doped fiber lasers compared to Yb- and/or Er-doped fiber lasers creates the possibility for higher peak power operation due to the larger nonlinear thresholds and reduced nonlinear phase accumulation. One primary interest in Tm-doped fiber lasers has been to scale to high average powers; however, …

An Exploration Of The Perceived Academic Self-Efficacy And Locus Of Control Of Urban Students With Learning Disabilities, Olukayode Abimbola Nuga Jan 2013

An Exploration Of The Perceived Academic Self-Efficacy And Locus Of Control Of Urban Students With Learning Disabilities, Olukayode Abimbola Nuga

Wayne State University Dissertations

The search for an answer to the question of the achievement gap between Black and other minority students and their White counterparts has been pervasive. This study, however, reframes the question not by using the White student as a frame of reference against which to make the comparison but by using the Black student himself. Therefore, relying on some scholarly work that found that studies of achievement within ethnic groups yielded far more significant results than between groups, the study focused on a comparison of the academic achievement between urban Black students with learning disabilities and their typical peers. The …

Qualitative Reports Of Michigan Medical Marijuana, David Charles Peters Jan 2013

Qualitative Reports Of Michigan Medical Marijuana, David Charles Peters

Wayne State University Dissertations

After hundreds of years of use the medical properties of Marijuana have been marginalized in our society. Qualitative interview data was collected from medical marijuana patients and knowledgeable producers and activists in Michigan about their perceptions and observations on the medical use of marijuana. Patients consistently reported using marijuana to substitute or wean off prescription drugs. All patients and producers who were taking opiate narcotics claimed they reduced overall drug use, especially opiates, by using medical marijuana. Patients and caregivers also claimed medical marijuana was preferred over opiates, eased withdrawal from opiates, and in some cases was perceived as more …

Analysis Of The Structure And Function Of A Timp-1/Cd63 Complex And Its Relationship To An Mt1-Mmp/Cd63 Complex, Richard B. Warner Jan 2013

Analysis Of The Structure And Function Of A Timp-1/Cd63 Complex And Its Relationship To An Mt1-Mmp/Cd63 Complex, Richard B. Warner

Wayne State University Dissertations

The relationship of the extra-cellular matrix (ECM) and secreted proteins to intra-cellular functions has an important impact on disease progression. The tissue inhibitors of metalloproteinases (TIMPs), of which there are four, are known for their broad metalloprotease inhibitory abilities. TIMP-1 has been widely studied as an inhibitor of matrix metalloproteinases (MMPs) and therefore as a molecule that prevents ECM degradation and proteolytic cleavage of extra-cellular molecules, processes thought to be critical for tumor invasion and metastasis. However, TIMP-1 has shown in the clinic to have increased expression in cases of disease progression; especially, it is associated with poor prognosis in …
