Coupled Field Dynamic Model Of Fatigue Evolution, Son Hai Nguyen Jan 2013

Coupled Field Dynamic Model Of Fatigue Evolution, Son Hai Nguyen

Open Access Dissertations

Predicting fatigue life is still an unresolved challenge in engineering practice. One of the problems in developing an effective damage predictive model is that damage variables are hard to measure. In this dissertation, a reliable and practical methodology for estimating damage variables from easily measurable variables is presented and validated by simulations and experiments. The tracking method is based on the application of the smooth orthogonal decomposition and new characteristics of a dynamical system called Characteristic Lengths and Distances. These features which are derived from the Birkhoff Ergodic Theorem, are fast to calculate and do not require large data or …

Gatekeeping Post-Uniloc: Expert Testimony In Multi-Component Patent Litigation, Erika Mayo Jan 2013

Gatekeeping Post-Uniloc: Expert Testimony In Multi-Component Patent Litigation, Erika Mayo

UC Law Business Journal

In recent years, the Federal Circuit has made an effort to rein in excessive or unfounded patent damages awards. In Uniloc v. Microsoft, the Federal Circuit granted a motion for retrial on the issue of damages, rejecting the validity of plaintiff’s damages expert testimony. This note advocates a broad reading of Uniloc and encourages trial courts to take a greater role in providing juries with sound methodology for assessing damages. Specifically, this article encourages the use of court-appointed damages experts to restore predictability in the U.S. patent system.

An Insurance Structure To Encourage Investment In Preventative Health Care, Nicholas Georgakopoulos Jan 2013

An Insurance Structure To Encourage Investment In Preventative Health Care, Nicholas Georgakopoulos

University of Michigan Journal of Law Reform

The incentives for investments in Americans' health are poorly aligned. Health insurers are not sufficiently motivated to invest for the long term. The structure of health insurance does not compensate insurers for investments in lasting health, such as measures preventing chronic disease. If an American changes insurers, the new insurer reaps the benefits of the good health the prior insurer's investment produced. This Essay explores insurers' incentives to invest in health, illustrates how those incentives fail, explores possible improvements, and shows that subsequent insurers should have an obligation to compensate the prior insurer for the averted expenses of expected diseases …

Past The Pillars Of Hercules: Francis Bacon And The Science Of Rulemaking, Daniel R. Coquillette Jan 2013

Past The Pillars Of Hercules: Francis Bacon And The Science Of Rulemaking, Daniel R. Coquillette

University of Michigan Journal of Law Reform

The parallels between Bacon's career and that of Edward H. Cooper are, of course, obvious. Bacon was one of the great legal minds of his day. Unlike the common-law judges who formed the law by deciding cases, Bacon expressed his greatness in writing brilliant juristic treatises and, as Lord Chancellor, drafting one of the first modern rule systems, the Ordinances in Chancery (1617-1620). Indeed, my thesis is that Bacon invented modern, scientific rulemaking by fusing his new theories of inductive, empirical research with the traditions of equitable pleading and is, in fact, the intellectual forbearer of the likes of Charles …

Predictors Of Treatments Acceptable To Patients For Late-Life Depression, Gerald J. Jogerst, Shimin Zheng, Erik Vanderlip Jan 2013

Predictors Of Treatments Acceptable To Patients For Late-Life Depression, Gerald J. Jogerst, Shimin Zheng, Erik Vanderlip

ETSU Faculty Works

Objectives. Describe older patients’ perceptions about depression and characteristics associated with acceptance of treatments. Design. Cross-sectional study. Setting. Three primary care clinics in Iowa. Participants. Consecutive sample of 529 primary care patients. Measurements. Depression screening tool (a 9-item patient health questionnaire [PHQ-9]) and questionnaire including sociodemographic data, patient attitudes about depression, and acceptability of different treatments. Results. Mean age was 71.9 years (range 60–93 years), 314 (59%) female. Among the 529 participants, 93 (17.5%) had history of depression and 60 (11.3%) had PHQ-9 scores of 10 or greater. Participants believed depression is a disease for which they would use medication …

An Investigation Of Palindromes And Their Place In Mathematics, Ryan Andrew Nivens Jan 2013

An Investigation Of Palindromes And Their Place In Mathematics, Ryan Andrew Nivens

ETSU Faculty Works

What do the Honda Civic, the Mazda 626, and the Boeing 747 have in common? What about Weird Al's song Bob, the first name of Miley Cyrus' alter ego, and the 70s sensation Abba? What do all these things have in common? They all contain palindromes. While some people recognise a palindrome when they see one, fewer realise that a palindrome is a special case of a pattern and that these patterns are all around. Palindromes frequently occur in names, both of vehicles and people, and in music.
