Evaluating Flexibility In International Patent Law, Sarah R. Wasserman Rajec
Evaluating Flexibility In International Patent Law, Sarah R. Wasserman Rajec
UC Law Journal
Global patent law has raced toward harmonization over the past decades. Countries with vastly different industries, values, and levels of development now offer robust patent rights with similar contours through membership in the World Trade Organization and consequent adoption of the Agreement on Trade-Related Aspects of Intellectual Property Rights (“TRIPS”). However, patent law is still far from harmonized among countries or static within countries. Jurisdictions tailor their patent laws to accommodate differences between industries, unforeseen inefficiencies, and diverse views of the costs and benefits associated with offering patent rights to stimulate innovation. Prior scholarly work consists of either doctrinal analyses …
Aerodynamic Performance And Particle Image Velocimetery Of Piezo Actuated Biomimetic Manduca Sexta Engineered Wings Towards The Design And Application Of A Flapping Wing Flight Vehicle, Anthony M. Deluca
Theses and Dissertations
Considerable research and investigation has been conducted on the aerodynamic performance, and the predominate flow physics of the Manduca sexta size of biomimetically designed and fabricated wings as part of the AFIT FWMAV design project. Despite a burgeoning interest and research into the diverse field of flapping wing flight and biomimicry, the aerodynamics of flapping wing flight remains a nebulous field of science with considerable variance into the theoretical abstractions surrounding aerodynamic mechanisms responsible for aerial performance. Traditional FWMAV flight models assume a form of a quasi-steady approximation of wing aerodynamics based on an infinite wing element model (BEM). An …

Physics Faculty Publications and Presentations
System integrity is important for fast and accurate measurement and control. LabVIEW is widely used in education and industry. Many LabVIEW codes are hard to be read and shown because of their 2D topology. In order to simplify the programming, a 4-layer model of developing sensor or measurement systems with LabVIEW is proposed in this paper. The purpose of this paper is to show the readers how to design simple, clear and strong automated systems with LabVIEW. Using a Sensirion SHT75 humidity sensor and an NI USB6008 DAQ board as an example, this paper describes the steps of developing a …

Information technology (IT) has great potential to improve healthcare quality while also improving efficiency, and thus has been a major focus of recent healthcare reform efforts. However, developing, deploying and using IT that is both secure and genuinely effective in the complex clinical, organizational and economic environment of healthcare is a significant challenge. Further, it is imperative that we better understand the privacy concerns of patients and providers, as well as the ability of current technologies, policies, and laws to adequately protect privacy. The Securing Information Technology in Healthcare (SITH) workshops were created to provide a forum to discuss security …

Constructing A Scale Of Attitudes Toward School Science Using The General Graded Unfolding Model, Taghreed Hijazi, Zaid Bani Ata
Journal of Educational and Psychological Studies
The present study aimed at constructing an attitude scale toward school science using the generalized graded unfolding model (GGUM). A 47-item scale (24 positive, 23 negative) with 4-point response format was used to measure attitudes toward science among 9th (n=424) and 10th (n=420) grade students in 38 sections distributed randomly over 22 schools in Irbid district. Respondents selected one of four options to represent their level of agreement with each item. The findings support the hypothesis that the data form a single unidimensional unfolding model. Furthermore, the findings showed that the GGUM didn’t fit the data of 7 items, leaving …
The Role Of Government In Energy Markets: A Look At The Market-Based Rates Process, The Ferc, And The Future Of Energy Markets In America, Andrew Laquet
Southern Illinois University Law Journal
It is often argued that markets can solve anything, and market-based policies have steadily crept into many of the policies that affect our everyday lives, especially when it comes to energy regulation. For years, the Federal Energy Regulatory Commission (FERC) has increasingly used a market-based rates strategy to spur investment in energy infrastructure.
However, market-based rate policies have been wholly inadequate to spur this investment in infrastructure, particularly in transmission infrastructure and promoting efficiency, and alternative approaches should be used to accomplish these goals. This Comment will take a look at the history and theoretical underpinnings of market-based rates before …
Random Search Models Of Foraging Behavior: Theory, Simulation, And Observation, Ben C. Nolting
Random Search Models Of Foraging Behavior: Theory, Simulation, And Observation, Ben C. Nolting
Department of Mathematics: Dissertations, Theses, and Student Research
Many organisms, from bacteria to primates, use stochastic movement patterns to find food. These movement patterns, known as search strategies, have recently be- come a focus of ecologists interested in identifying universal properties of optimal foraging behavior. In this dissertation, I describe three contributions to this field. First, I propose a way to extend Charnov's Marginal Value Theorem to the spatially explicit framework of stochastic search strategies. Next, I describe simulations that compare the efficiencies of sensory and memory-based composite search strategies, which involve switching between different behavioral modes. Finally, I explain a new behavioral analysis protocol for identifying the …
Magnetic Anisotropy And Exchange In (001) Textured Fept-Based Nanostructures, Tom George
Magnetic Anisotropy And Exchange In (001) Textured Fept-Based Nanostructures, Tom George
Department of Physics and Astronomy: Dissertations, Theses, and Student Research
Hard-magnetic L10 phase FePt has been demonstrated as a promising candidate for future nanomagnetic applications, especially magnetic recording at areal densities approaching 10 Tb/in2. Realization of FePt’s potential in recording media requires control of grain size and intergranular exchange interactions in films with high degrees of L10 order and (001) crystalline texture, including high perpendicular magnetic anisotropy. Furthermore, a write-assist mechanism must be employed to overcome the high coercivity of L10 FePt nanograins. The research described in this dissertation examines potential solutions to the aforementioned problems. Specifically, a nonepitaxial method of fabricating highly (001) textured …

Monochloramine is primarily used as a disinfectant in the drinking water distribution industry. The degradation of styrene butadiene rubber (SBR), natural rubber (NR), and ethylene propylene diene monomer-peroxide cured (EPDM-P) by monochloramine was first reported in a study published by the American Water Works Association (AWWA) in 2007. The study exposed samples of various types of rubber, including SBR, NR, and EPDM-P, to monochloramine solutions at varying concentrations and temperatures for 30 days. This study provided the basis for the present research, as at the medium temperatures and concentrations used in the study, 45 °C and 30 parts per million …
Feasibility Of Using Computational Fluid Dynamics For Analysis Of Flow In An Orbiting Dish., Matthew R. Purcell
Feasibility Of Using Computational Fluid Dynamics For Analysis Of Flow In An Orbiting Dish., Matthew R. Purcell
Electronic Theses and Dissertations
The oscillatory flow provided by an orbital shaker table correlates somewhat to the pulsatile flow seen in the human vasculature. This parallel allows for the use of the orbital shaker table in a large range of biomedical research. However, the fluid dynamics is not well characterized in this system. This research employed the computational fluid dynamics (CFD) package FLUENT in an effort to better understand the fluid dynamics in an orbiting dish. This work was performed at low resolution as a first attempt to examine the fluid flow characteristics. The first objective was to determine the time required to reach …
Face Recognition In The Wild., Mostafa A. Farag
Face Recognition In The Wild., Mostafa A. Farag
Electronic Theses and Dissertations
Research in face recognition deals with problems related to Age, Pose, Illumination and Expression (A-PIE), and seeks approaches that are invariant to these factors. Video images add a temporal aspect to the image acquisition process. Another degree of complexity, above and beyond A-PIE recognition, occurs when multiple pieces of information are known about people, which may be distorted, partially occluded, or disguised, and when the imaging conditions are totally unorthodox! A-PIE recognition in these circumstances becomes really “wild” and therefore, Face Recognition in the Wild has emerged as a field of research in the past few years. Its main purpose …

Identifying Formative Assessment In Classroom Instruction: Creating An Instrument To Observe Use Of Formative Assessment In Practice, Steven G. Oswalt
Identifying Formative Assessment In Classroom Instruction: Creating An Instrument To Observe Use Of Formative Assessment In Practice, Steven G. Oswalt
Boise State University Theses and Dissertations
Is formative assessment observable in practice? Substantial claims have been made regarding the influence of formative assessment on student learning. However, if researchers cannot be confident whether and to what degree formative assessment is present in instruction, then how can they make claims with confidence regarding the efficacy of formative assessment? If it is uncertain whether and to what degree formative assessment is being used in practice, then any claims regarding its influence are difficult to support. This study aims to provide a vehicle through which researchers can make stronger, more substantiated reports about the presence and impact of formative …

Building The Modern World: Morrison-Knudsen Construction Company, James David Duran
Boise State University Theses and Dissertations
After working on construction projects in Boise, Idaho, Morris Hans Knudsen and Harry Morrison combined their resources and skills to form Morrison-Knudsen Company (M-K) in 1912. The two of them built a world-class construction and engineering company that, at one time, was the industry leader in their field. Their success relied upon fast, cost-effective, construction and an uncanny ability to match their company’s mission to the goals of U.S. foreign and domestic policy. When Harry Morrison moved to the position of president in 1939, he took M-K international by presenting his company as the deliverer of modernization to the developing …
Ordinary Effort, John Mcmahon
Ordinary Effort, John Mcmahon
Boise State University Theses and Dissertations
The thesis is primarily concerned with how the search for knowledge is driven by a quest for certainty, resulting in a compulsion to fix knowledge in explicit rules and procedures. Rather than producing a satisfactory sense of stability, this produces comedy and tragedy as human endeavors play out against a backdrop of arbitrary structure.
Three videos explore this problem through the lens of professional sport, where the quest for certainty is evaluated against the application of rules, against rules governing the action of the body, and against the attempt to circumvent the rules. Theoretical background is provided by examining the …

What Is Meant By Argumentative Competence? An Integrative Review Of Methods Of Analysis And Assessment In Education, Chrysi Rapanta, Merce Garcia-Mila, Sandra Gilabert
What Is Meant By Argumentative Competence? An Integrative Review Of Methods Of Analysis And Assessment In Education, Chrysi Rapanta, Merce Garcia-Mila, Sandra Gilabert
All Works
The need to enhance argument skills through education has become increasingly evident during the past 20 years. This need has resulted in an ongoing discussion that focuses on students' and teachers' argumentation and its support. However, apart from the extended competence-based discourse, no clear and homogeneous definition exists for argumentative competence and its constituent skills. To respond to this deficiency, we conducted an integrative literature review focusing on the methods of argument analysis and assessment that have been proposed thus far in the field of education. Specifically, we constructed an interpretative framework to organize the information contained in 97 reviewed …
Assessing Growth Response To Climate Controls In A Great Basin Artemisia Tridentata Plant Community, Lorenzo F. Apodaca
Assessing Growth Response To Climate Controls In A Great Basin Artemisia Tridentata Plant Community, Lorenzo F. Apodaca
UNLV Theses, Dissertations, Professional Papers, and Capstones
An assessment of the growth response of key vegetative species to climatic variability is vital to identifying possible local impacts on ecosystems faced with imminent climate change. With current climate projections in Nevada predicting a shift to an even more arid climate with greater year-to-year variability, the imperative exists to identify the effects of specific climatic controls on plant growth and to research methods to assess large-scale vegetative changes, especially in more remote areas where readily available data sets may be lacking. This study utilized annual growth ring indices constructed from big sagebrush (Artemisia tridentatassp.tridentata) stems collected in Spring Valley, …

Marriage is associated with improved health outcomes for many conditions. Married persons enjoy financial stability, social and emotional support, and tend to have better control of health risk behaviors compared to the unmarried. The marriage scene is changing continuously. Americans are marrying less or delaying the engagement to an older age. They are divorcing more, they choose cohabitation as an alternative to marriage, or engage in premarital relationships. As a consequence, barely half of Americans were married in 2011 compared to close to three quarters of Americans were married in the sixties. With the increase of the unmarried population - …

UNLV Theses, Dissertations, Professional Papers, and Capstones
Supervisory Control and Data Acquisition (SCADA) system is a control system which is widely used in Critical Infrastructure System to monitor and control industrial processes autonomously. Most of the SCADA communication protocols are vulnerable to various types of cyber-related attacks. The currently used security standards for SCADA communication specify the use of asymmetric cryptographic algorithms like RSA or ECC for securing SCADA communications. There are certain performance issues with cryptographic solutions of these specifications when applied to SCADA system with real-time constraints and hardware limitations. To overcome this issue, in this thesis we propose the use of a faster and …
