“But My Lease Isn’T Up Yet!”: Finding Fault With “No-Fault” Evictions, Eloisa Rodriguez-Dod Jan 2013

“But My Lease Isn’T Up Yet!”: Finding Fault With “No-Fault” Evictions, Eloisa Rodriguez-Dod

Faculty Publications

Historically, tenants could be evicted when their actions put them “at-fault.” Grounds for “at-fault” eviction (i.e., evictions for cause) include a tenant’s failure to pay rent, a tenant’s holding over after termination of the lease, a tenant’s material noncompliance with the lease agreement, and a tenant’s failure to maintain the premises materially affecting health and safety. Recently, some landlords have been evicting tenants for no fault of their own.

This article focuses on three reasons for attempted “no-fault” evictions: foreclosure of the premises, proposed sale of the premises, or intended re-occupancy by the landlord. Part II of this article provides …

New Corporate Forms And Green Business, Antony Page Jan 2013

New Corporate Forms And Green Business, Antony Page

Faculty Publications

You want to start a business: not just an ordinary business, producing ordinary social benefit, but a dual-mission business that will both make a profit and benefit the environment. This green business, you expect, will sometimes face trade-offs between the missions, in the sense that sometimes owners' wealth and profit will have to be sacrificed to pursue environmental benefits. You're optimistic, in that you hope the business will find outside investors and will scale up easily. Moreover, you don't want to lie or even dissemble about your motives or about the business's actions. You want to be both authentic and …

Performance Modeling Of Distributed Collaboration Services With Independent Inputs/Outputs, Toqeer A. Israr, Gregor V. Bochmann

Faculty Research & Creative Activity

This paper deals with modeling and performance analysis of dis-tributed applications, service compositions and workflow systems. From the functional perspective, the distributed application is modeled as an activity in-volving several roles, where behavior is defined in terms of compositions from several sub-activities using the standard sequencing operators found in UML Activity Diagrams. Each activity is characterized by a certain number of input and output events, and the performance of the activity is defined by the mini-mum delays that apply for a given output event in respect to each input event. We use a partial order to model these events, whose …

Ethical Lawyering In A Global Community, Trevor C. W. Farrow Jan 2013

Ethical Lawyering In A Global Community, Trevor C. W. Farrow

Comparative Research in Law & Political Economy

The pressures and opportunities of globalization have dramatically changed the nature of legal practice. How and why we practice law? For whom and whose benefit? In what contexts? And on what terms? The answers to these questions are continuously changing as a result of current global trends. The communities served by lawyers, the practice contexts in which they work and the issues that they face are increasingly diverse, complex, transnational and global in character. All of these challenges demand new competencies and raise a host of new issues about ethics and professionalism. As a threshold matter, more and more lawyers …

Addressing The Foreclosure Crisis Through Law School Clinics, Nathalie Martin, Max Weinstein Jan 2013

Addressing The Foreclosure Crisis Through Law School Clinics, Nathalie Martin, Max Weinstein

Faculty Scholarship

Since the 2008 financial crisis, unprecedented numbers of homes have been lost to foreclosure in the United States, all while public funds for free or reduced fee legal representation in some communities have all but disappeared. This means that most homeowners in foreclosure are unable to find lawyers to represent them. At the same time, clinical legal education, especially in subjects related to business and commercial law, is on the rise. This convergence offers a unique opportunity for law school clinics to give students valuable training in both litigation and financial law and also help fill the deep need for …

A Global Comparison Of Insider Trading Regulations, James H. Thompson Jan 2013

A Global Comparison Of Insider Trading Regulations, James H. Thompson

All Faculty Scholarship for the College of Business

As the business world continues to expand in global markets, trading of shares, bonds, derivatives and other instruments continues to increase. One form of trading that has received considerable interest in recent years is insider trading. Insider trading occurs when individuals with potential access to non-public information about a corporation buy or sell stock of that corporation. When the information is material and non-public, such trading is illegal. However, if the trading is done in a manner that does not take advantage of non-public information, it is often permissible. This study compares insider trading laws, penalties, and convictions in countries …

Advance Health Care Directives: Problems And Solutions For The Elder Law And Estate Planning Practitioner, Brooke M. Benzio

St. Thomas Law Review

"Remember that what you possess in the world will be found at the day of your death to belong to some one else; but what you are, will be yours forever. "' -Henry Van Dyke.

Since the modem movement for patient autonomy began gathering steam in the 1900s, individual concerns about the purpose, nature, and quality of medical care have become a larger component of the practice of medicine. However, state and federal law has been relatively slow to respond, and establishment of the relevant legal framework is relatively recent. New Jersey courts led the charge with their decision in …

Reverse Regulatory Arbitrage: An Auction Approach To Regulatory Assignments, M. Todd Henderson, Frederick Tung Jan 2013

Reverse Regulatory Arbitrage: An Auction Approach To Regulatory Assignments, M. Todd Henderson, Frederick Tung

Articles

In the years before the Financial Crisis, banks got to pick their regulators, engaging in a form of regulatory arbitrage that we now know was a race to the bottom. We propose to turn the tables on the banks by allowing regulators—specifically, bank examiners—to choose the banks they regulate. We call this "reverse regulatory arbitrage," and we think it can help improve regulatory outcomes. Building on our prior work that proposes to pay bank examiners for performance—by giving them financial incentives to avoid bank failures—we argue that bank supervisory assignments should be set through an auction among examiners. Examiner bidding …

Dispute System Design: A Comparative Study Of India, Israel And California, Janet Martinez, Sheila Purcell, Hagit Shaked-Gvili, Mohan Mehta

Cardozo Journal of Conflict Resolution

Alternative dispute resolution ("ADR") is practiced around the world with myriad approaches, though not without common ground. In an increasingly interconnected world, the sharing of this knowledge and experience has become a natural and even necessary step in the evolution of ADR. Professor Frank Sander, of Harvard Law School, spoke at the Pound Conference in 1976 and posed the notion of the multi-door courthouse, a concept that led to the development of ADR process options in courts throughout the country.
