Factually Innocent Without Dna? An Analysis Of Utah's Factual Innocence Statute, Nic Caine
Factually Innocent Without Dna? An Analysis Of Utah's Factual Innocence Statute, Nic Caine
Utah OnLaw: The Utah Law Review Online Supplement
Since 1989, DNA evidence has fueled the innocence movement, helping hundreds prove their innocence and obtain freedom. DNA technology has been an invaluable development for the innocence movement, and DNA technology will continue to advance and improve in the future. DNA evidence is not available in the majority of cases, however, and many believe that DNA exonerations will eventually diminish as DNA analysis becomes more widely available. Furthermore, “for every DNA exoneree there are hundreds if not over a thousand wrongfully convicted defendants whose cases do not contain biological evidence that could prove innocence.”150 It is time for other states …
2013 Report On The State Of The Legal Market, Georgetown University Law Center, The Center For The Study Of The Legal Profession
2013 Report On The State Of The Legal Market, Georgetown University Law Center, The Center For The Study Of The Legal Profession
CSLP Papers & Reports
As we enter 2013, the legal market continues in the fifth year of an unprecedented economic downturn that began in the third quarter of 2008. At this point, it is becoming increasingly apparent that the market for legal services in the United States and throughout the world has changed in fundamental ways and that, even as we work our way out of the economic doldrums, the practice of law going forward is likely to be starkly different than in the pre-2008 period. The challenge for lawyers and law firms is to understand the ways in which the legal market has …

Whose Choice Are We Talking About: The Exclusion Of Students With Disabilities From For-Profit Online Charter Schools, Matthew D. Bernstein
Whose Choice Are We Talking About: The Exclusion Of Students With Disabilities From For-Profit Online Charter Schools, Matthew D. Bernstein
Richmond Journal of Law and the Public Interest
By examining the history of special education law against the emergence of the for-profit and online education movements, this paper explores the charter school movement from a consumer law perspective. It aims to explain why much of the current debate over test scores, "accountability," and teacher evaluation obscures other systemic fault lines that implicate the very reasons we have a public education system in the first place. In turn, the goal is to suggest solutions to some fundamental questions: in the twenty-first century, do we still need a public education system? What are our collective responsibilities to students? What does …

The Role Of Private International Financial Capital Flows In Support Of Development For Emerging Market Countries, Jason Victor Reuter
Electronic Theses and Dissertations
Economic growth and development are critical issues for emerging market economies as they seek increase their standards of living. Financial globalization, innovation and international financial capital flows are prominent factors influencing macroeconomic stability and the pace of growth and development around the globe. This dynamic has become even more pronounced since the Asian Financial Crisis at the end of the 1990s and the Global Financial Crisis starting in 2008. In the wake of these two global economic events, the need for reflection on the drivers of growth and development as well as impediments to these activities is warranted. This thesis …

Legal Education In Disruption: The Headwinds And Tailwinds Of Technology, Jon M. Garon
Faculty Scholarship
By harnessing improvements on communications and computational systems, law firms are producing a revolution in the practice of law. Self-help legal manuals have transformed into sophisticated interactive software; predictive coding can empower clients to receive sophisticated legal advice from a machine; socially mediated portals select among potential lawyers and assess the quality of the advice given; and virtual law firms threaten to distintermediate the grand edifices of twentieth century Big Law. These changes may profoundly restructure the legal practice, undermining the business model for many solo and small firm practices. This paper focuses on the implications of these profound disruptive …

Medicine And Law As Model Professions: The Heart Of The Matter (And How We Have Missed It), Rob Atkinson
Medicine And Law As Model Professions: The Heart Of The Matter (And How We Have Missed It), Rob Atkinson
Scholarly Publications
This article has two coordinate goals: to undergird the functionalist understanding of professionalism with classical normative theory and to advance the classical theory of civic virtue with the insights of modern social science. More specifically, this article seeks to connect classical theories about the care of the body and the soul with modern theories of market and government failure. The first step is to distinguish two kinds of professions, caring professions like medicine and public professions like law, by identifying the distinctive virtue of each. The distinctive virtue of the caring professions is single-minded commitment to those in their care, …

Unrepresented And Untimely: The Pcra's Disservice To Indigent Prisoners, Nathan Margioni
Unrepresented And Untimely: The Pcra's Disservice To Indigent Prisoners, Nathan Margioni
Utah OnLaw: The Utah Law Review Online Supplement
The Post-Conviction Remedies Act’s fundamental flaw is its effect on the availability of relief to indigent prisoners. A post-conviction review is often a prisoner’s only opportunity to challenge the failure of appellate counsel to provide effective assistance. Because the legislature has eliminated the common law writ of habeas corpus as a method to challenge a conviction or sentence, the PCRA is the only available avenue for a post-conviction review. The indigent defendant, however, is particularly vulnerable to the PCRA’s restrictions, due to his or her reliance on appointed rather than private counsel during the appeals phase, and lack of resources …
