Teacher Perceptions Of Effective School Leadership Using Twenty-First Century Skills And Knowledge, Bobbie Anita Augspurger Nov 2013

Teacher Perceptions Of Effective School Leadership Using Twenty-First Century Skills And Knowledge, Bobbie Anita Augspurger

Dissertations

This quantitative study was conducted to examine the primary components of school leadership for 21st-century skills and knowledge integration. With the passing of the National Educational Technology Standards (NETS) for students, teachers, and administrators, the need for administrative leadership within the realm of technology is continually evolving and growing. The NETS based survey required teachers from three varying sized school districts, who have implemented a 1:1 student device initiative, to answer statements, using a Likert scale, about themselves and their principal. Survey statement data results were revealed using a Pearson Product Moment Correlation Coefficient formula, scatter plots, and regression studies …

Not Just Kid Stuff - Extending Graham And Miller To Adults, Michael M. O'Hear Nov 2013

Not Just Kid Stuff - Extending Graham And Miller To Adults, Michael M. O'Hear

Missouri Law Review

Part II more fully unpacks the central jurisprudential values that animate Graham and Miller. By reference to these values, Part III explains how Graham and Miller may be reconciled with Harmelin and Ewing. Finally, Part IV discusses the application of Graham and Miller to one particular category of adult offenders – those sentenced under the three-strikes provision of 21 U.S.C. § 841(b)(1)(A) – and concludes that at least some of these offenders may have viable Eighth Amendment claims

Precedent As A Policy Map: What Miller V. Alabama Tells Us About Emerging Adults And The Direction Of Contemporary Youth Services, Clark M. Peters Nov 2013

Precedent As A Policy Map: What Miller V. Alabama Tells Us About Emerging Adults And The Direction Of Contemporary Youth Services, Clark M. Peters

Missouri Law Review

To illuminate the role that Miller plays with regard to the wider realm of youth policy, I will employ the analytic approach of Professor John Kingdon, whose influential book Agendas, Alternatives, and Public Policies (Agendas) provides a framework for understanding how ideas move from mere proposals to effectuated policy. His approach emerges from the pluralist tradition, which emphasizes government processes and the role of political influence in affecting policy choices. In posing Kingdon’s central question – “How does an idea’s time come?” – to the Miller decision, this Article employs Kingdon’s theoretical framework in two ways. First, Kingdon’s framework is …

Where The Judiciary Prosecutes In Front Of Itself: Missouri's Unconstitutional Juvenile Court Structure, Josh Gupta-Kagan Nov 2013

Where The Judiciary Prosecutes In Front Of Itself: Missouri's Unconstitutional Juvenile Court Structure, Josh Gupta-Kagan

Missouri Law Review

Part II will describe the juvenile officer’s unique role in Missouri law, and explain how this role makes Missouri an outlier within the United States. Part III will argue that the juvenile officer’s prosecutorial discretion violates the separation of powers required by the Missouri Constitution and informed by the U.S. Constitution. Part IV will describe the real world harms that flow from this violation, with a particular focus on the harms in child abuse and neglect cases. Part V will outline potential policy solutions to this problem.

Bargaining With Bite: Missouri High Court's Constitutional Holdings Alter Public Sector Labor Law, Peter W. Bay Nov 2013

Bargaining With Bite: Missouri High Court's Constitutional Holdings Alter Public Sector Labor Law, Peter W. Bay

Missouri Law Review

Collective bargaining – negotiations over working conditions between an employer and representatives of their employees – appeared as early as 1891 as labor unions arose in response to the Industrial Revolution. Collective bargaining in private industry was recognized in 1935 by the National Labor Relations Act but was considered prohibited in the public sector. In 1945, the state of Missouri ratified its constitution, which included article 1, section 29, a provision protecting employee collective bargaining rights. That provision, however, was quickly interpreted by courts as applying only to private employees, and thus, public employees had little power to negotiate employment …

Userra Oxymoron: Termination As A Valid Reemployment Position, The, Breanna Hance Nov 2013

Userra Oxymoron: Termination As A Valid Reemployment Position, The, Breanna Hance

Missouri Law Review

This Note assesses Milhauser’s impact on reemployment claims under USERRA. Part II begins with an analysis of the facts and holding of the case. Next, Part III synthesizes the background of USERRA, provides an overview of the statute, and introduces the escalator principle. Part IV outlines the court’s rationale in deciding Milhauser. Finally, Part V discusses the impact of Milhauser on USERRA reemployment claims. This Note argues that: (1) the court’s reliance on USERRA regulation § 1002.194 was misplaced because the court’s interpretation presents a conflict between two sections of the statute and creates burden of proof issues; (2) the …

Cyclin E Induction And Oncolytic Replication Of E1b-Deleted Adenoviruses., Pei-Hsin Cheng Nov 2013

Cyclin E Induction And Oncolytic Replication Of E1b-Deleted Adenoviruses., Pei-Hsin Cheng

Electronic Theses and Dissertations

Virus-mediated oncolysis has been considered as a new and promising cancer therapeutic approach. Although adenoviruses (Ads) with deletion of E1b55K preferentially replicate in cancer cells and have been used in numerous cancer treatments, the selective replication mechanism of this kind of virus still remains controversial. The lack of a well-established studies focusing on possible mechanisms enabling tumor selectivity of oncolytic Ads has hindered the further development of virotherapies and limits their clinical applications. Therefore, uncovering the molecular basis behind the tumor-killing phenomena will fill critical gaps in our understanding of the oncolytic adenovirology. Previously our laboratory has demonstrated that Ad …

The Gravitational Force Of Originalism, Randy E. Barnett Nov 2013

The Gravitational Force Of Originalism, Randy E. Barnett

Fordham Law Review

In Part I of this Article, I describe four aspects of the New Originalism: First, New Originalism is about identifying the original public meaning of the Constitution rather than the original Framers’ intent. Second, the interpretive activity of identifying the original public meaning of the text is a purely descriptive empirical inquiry. Third, there is also a normative tenet of the New Originalism that contends that the original public meaning of the text should be followed. Finally, distinguishing between the activities of interpretation and construction identifies the limit of the New Originalism, which is only a theory of interpretation. In …

Not Interested? A Trustee Lacks “Party In Interest” Standing To Move For An Extension Of The Nondischargeability Bar Date On Behalf Of Creditors, Stephen C. Behymer Nov 2013

Not Interested? A Trustee Lacks “Party In Interest” Standing To Move For An Extension Of The Nondischargeability Bar Date On Behalf Of Creditors, Stephen C. Behymer

Fordham Law Review

Chapter 7 bankruptcy is designed to provide a financially distressed debtor with a “fresh start.” Towards that end, an individual debtor’s debts are typically discharged during the case. A creditor has only a short window of time in which to object to the dischargeability of its claims. This bar date can only be extended for cause and upon the application of a “party in interest.” Occasionally, a trustee will move for such an extension on behalf of the creditors. There is a split, however, between the Fourth and Sixth Circuits regarding whether a trustee is a “party in interest” and, …

Love And Belonging: Strategies To Help Mentally Ill Patients, Shirin Rahim Nov 2013

Love And Belonging: Strategies To Help Mentally Ill Patients, Shirin Rahim

School of Nursing & Midwifery

Love and belonging is a concept, used by Abraham Maslow (a humanistic psychologist) in his motivation theory. Love and belonging is one of the human needs in Maslow's hierarchy and required to be fulfilled in order to achieve self-actualization. According to Lisbeth (2003) “Because of the social nature of humans and the long developmental period from birth to adulthood, the need for love and belonging is closely linked to the need for survival” (p.128). If a child is left with unmet need of love and belonging he may feel difficulties in forming lasting relations in future also and may get …

Food Safety Education Using Conceptual Change Teaching Strategies Among Native American Nebraskans, Rachel C. Sinley, Kris Foley, Julie A. Albrecht

The Nebraska Educator: A Student-Led Journal

Foodborne illnesses impact millions of individuals each year, with young children at high risk of contracting such diseases. Many of the pathogens responsible for these illnesses can be destroyed with proper food handling techniques. Research has shown that there is a need for improved food safety education among the general public and among specific sub-populations. This project seeks to increase food safety knowledge, motivation and behavioral skills among Native American food preparers with young children. A food safety education curriculum was developed using the Conceptual Change Teaching Method and was guided by the Information-Motivation-Behavioral Skills Theory of health behavior change. …

Identifying Optimal It Portfolios To Promote Healthcare Quality, Kenneth Pinaire Nov 2013

Identifying Optimal It Portfolios To Promote Healthcare Quality, Kenneth Pinaire

Masters Theses & Doctoral Dissertations

Healthcare organizations continue to make large investments in health information technology to improve quality of care and lower costs. Therefore, there is an ever-growing need to have an ever-clearer understanding of how IT investments impact these organizations. However, there are no methodologies designed to identify and then leverage these effects to promote healthcare quality. In this research, I present an extensive review of the literature on the impact of health information technology on the quality of care. A research gap is identified where past studies have explored the impact of individual technologies or aggregate all technologies based on overall investment, …

Are Im Injections Im In Obese And Overweight Females?: A Study In Injection Technique, Sara Palma, Pamela Strohfus

Nursing Faculty Publications and Presentations

If given incorrectly, intramuscular injections may result in poor absorption of drug, reduced drug effectiveness, or irritation to surrounding tissues. In this study, IM injection techniques were observed and documented for needle length, injection site, needle insertion, and stretching or bunching of the skin during injection in a population of adult females. The patients' weights and BMIs were recorded to determine the amount of subcutaneous fat at the injection site. In 22 patients of varied weights, 90% of injections were given within current Advisory Committee on Immunization Practice (ACIP) guidelines in normal and underweight patients, and 17% were given within …

Sovereign Wealth Funds As Tools Of National Strategy: Singapore’S Approach, Devadas Krishmadas

CIWAG Case Studies

Across the globe - from the port of New Jersey to the copper mines in trans-Sahel Africa - governments are wrestling with the issue of foreign financial influence and national security. This becomes even more acute in states that are trying to transition from conflict to stability: When should states allow or encourage other countries to invest in them, and what industries should they allow foreign companies to own or build? Should states allow foreign investment funds to build infrastructure, extract rare minerals, and operate ports? How does this support or undermine the legitimacy and authority of the state? Successful …

Microrna-142 Reduces Monoamine Oxidase A Expression And Activity In Neuronal Cells By Downregulating Sirt1, Amrita Datta Chaudhuri, Sowmya V. Yelamanchili, Howard S. Fox

Journal Articles: Pharmacology & Experimental Neuroscience

Aberrant expression of microRNAs (miRs) has been implicated in the pathogenesis of several neurodegenerative disorders. In HIV-associated neurocognitive disorders (HAND), miR-142 was found to be upregulated in neurons and myeloid cells in the brain. We investigated the downstream effects of chronic miR-142 upregulation in neuronal cells by comparing gene expression in stable clones of the human neuroblastoma cell line BE(2)M17 expressing miR-142 to controls. Microarray analysis revealed that miR-142 expression led to a reduction in monoamine oxidase (MAO) A mRNA, which was validated by qRT-PCR. In addition to the mRNA, the MAOA protein level and enzyme activity were also reduced. …
