Religious Freedom Legislation In The 2013 Virginia General Assembly, Ellis M. West Jan 2013

Religious Freedom Legislation In The 2013 Virginia General Assembly, Ellis M. West

Richmond Public Interest Law Review

This article consists of the following sections: Section one presents the content of the proposed amendment and explains the ways in which it is unclear, redundant, and otherwise poorly written. Section two addresses the issue of whether the provisions intended to protect religious expression, including prayer, are necessary and can solve the problems they are intended to solve. It also identifies the crucial challenge in cases involving religious expression - namely, determining correctly whether it is the government or a private individual or group that is expressing or promoting a religious belief or practice. This determination must be made because …

Federalism As A Preventative Measure: Avoiding State Enforcement Of Federal Anti-Gun Legislation In 2013, Brielle Hunt Jan 2013

Federalism As A Preventative Measure: Avoiding State Enforcement Of Federal Anti-Gun Legislation In 2013, Brielle Hunt

Richmond Public Interest Law Review

This comment will delve into this question, seeking to answer whether or not the Constitution allows states to refuse to comply with federal law. This analysis requires the application of a constitutional principle that reaches far beyond the scope of the Right to Bear Arms; it calls into play the vertical separation of powers and the rights belonging to state sovereigns described in the Tenth Amendment. The comment will proceed as follows. Part II will address the constitutionality of House Bill 2340, compared against other kinds of legislation and in light of case law. It will be argued that the …

The All Students Initiative, Anti-Bullying And Athletics For Home-Schooled Children: Education Reform In The 2013 General Assembly Session, Ashley Allen

Richmond Public Interest Law Review

In 2012, Virginia Governor Robert F. McDonnell announced "The Governor's K-12 Education Reform Summit: Investing in Students Today, Creating the Workforce of Tomorrow. " With this announcement, the Governor praised the Commonwealth's public school system while underscoring the need for improvement by stating, "Until every child, in every zip code is guaranteed access to a quality education, we have not done our job." The Governor's summit brought legislators, education stakeholders, and policymakers into one room to discuss issues facing the K-12 education system, such as teacher pay, educational choice, technology and innovation, and workforce development." At the summit, the Governor …

Christian Parking, Hindu Parking: Applying Established Civil Rights Principles To Rluipa's Nondiscrimination Provision, Roman P. Storzer, Blair Lazarus Storzer Jan 2013

Christian Parking, Hindu Parking: Applying Established Civil Rights Principles To Rluipa's Nondiscrimination Provision, Roman P. Storzer, Blair Lazarus Storzer

Richmond Public Interest Law Review

This article is divided into three parts. First, it explores certain issues inherent in a Nondiscrimination claim, including how the Nondiscrimination provision has been mistakenly conflated with other RLUIPA land use provisions, whether a showing of direct hostility toward a particular faith by governmental actors is required, and what might qualify as adequate comparators in a case where a claimant asserts that it was treated differently and worse than similarly situated applicants. Second, the article proposes application of the reasoning in McDonnell Douglas Corp. v. Green to some Nondiscrimination claims. This would be achieved by burden shifting; after the plaintiff …

Probiotic Strains For Shellfish Aquaculture: Protection Of Eastern Oyster, Crassostrea Virginica, Larvae And Juveniles Againsl Bacterial Challenge, Murni Karim, Wenjing Zhao, David C. Rowley, David R. Nelson, Marta Gomez-Chiarri

Fisheries, Animal and Veterinary Sciences Faculty Publications

Bacterial pathogens, including several Vibrio spp. and Roseovarius crassostreae, cause severe mortality of larval and juvenile eastern oysters. The introduction of beneficial bacterial isolates in oyster hatcheries and nurseries for the biocontrol of bacterial diseases is a good alternative to the use of antibiotics. The goal of this study was to screen and characterize marine bacterial isolates as potential agents to prevent larval and juvenile mortality by the oyster pathogens Vibrio tubiashii and R. crassostreae. Screening of bacterial isolates from Rhode Island marine organisms and environment using agar-based assay methods for detection of antimicrobial activity against oyster pathogens led …

Parental Rejection Upon Coming-Out As A Risk Factor For Substance Abuse For Gay/Bisexual Adolescents, Jessica Goheen

Theses, Dissertations, and Projects

Very few studies have examined how parental rejection impacts substance use or abuse behaviors among lesbian, gay, and bisexual adolescents. The purpose of this study was to explore lesbian, gay, and bisexual men and women's experiences with substance use or abuse after experiencing parental rejection upon coming out in adolescence. This qualitative study looked at the unique experiences of coming out during adolescence through in-person interviews with twelve lesbian, gay, and bisexual men and women,. Narratives from these interviews were obtained through a structured self-created interview guide, consisting of open-ended questions. Findings varied among each participant, but shared themes also …

The Grapes Of Wrath: Encouraging Fruitful Collaborations Between Local Governments And Farm Wineries In The Commonwealth, Andrew E. Tarne Jan 2013

The Grapes Of Wrath: Encouraging Fruitful Collaborations Between Local Governments And Farm Wineries In The Commonwealth, Andrew E. Tarne

Law Student Publications

While there is fairly substantial federal regulation in the field of wine law, this essay's scope will be limited to the interplay of Virginia's state and local laws that affect wineries close to home. Within that scope, this essay's purpose is threefold. First, it will highlight the key legislation and ordinances that affect farm wineries. Second, it will discuss the interplay between state and local level regulations, concluding that the General Assembly has intended to retain near exclusive regulatory powers over farm wineries. Third, it will briefly analyze the impact of the wine industry on three Virginia counties, concluding that …

Eminent Domain: The Solution To The Foreclosure Crisis Or Overstepping Government Boundaries?, Anne T. T. Jensen Jan 2013

Eminent Domain: The Solution To The Foreclosure Crisis Or Overstepping Government Boundaries?, Anne T. T. Jensen

Law Student Publications

This article will provide both an analysis of the legal concept of eminent domain and its likelihood of success in resuscitating real estate markets in towns like San Bernandino. Sections Two and Three will explore the background of the mortgage crisis and provide an in-depth description of the eminent domain proposal by the Mortgage Resolution Partners ("MRP"). Section Four takes a deeper look into the state and federal precedent on a municipality's power to use eminent domain, revealing that the definition of "legitimate public purpose" would likely apply to the seizing of mortgages. Finally, Section Five will focus on the …
