Genocide, And Its Definition As The "Partial Elimination Of A National Group", Marcelo Ferreira Nov 2013

Genocide, And Its Definition As The "Partial Elimination Of A National Group", Marcelo Ferreira

Genocide Studies and Prevention: An International Journal

This paper is primarily about the crimes committed by Argentina’s last military dictatorship and whether these deserve the legal qualification of crimes against humanity or “genocide.” This question has consequences which go beyond the field of law and affect society and collective psychology through the reconstruction of historical memory. From this perspective, this paper argues that the definition of Genocide set forth in international law is directly applicable in Argentine national law. It also examines the different problems with the use of this term. Finally, it aims to reconstruct the figure of Genocide from the original interpretation of the works …

A Genealogy Of Genocide In Francoist Spain, Antonio Miguez Macho Nov 2013

A Genealogy Of Genocide In Francoist Spain, Antonio Miguez Macho

Genocide Studies and Prevention: An International Journal

The extermination that was associated with the violence of the Spanish Civil War period and the early 1940s has been studied in depth in recent decades. Until now, however, the concept of genocide has not been discussed with an eye to understanding and interpreting this violence. The hermeneutical and comparative potential of the concept is, however, unquestionable. This article aims both to contextualize the origin and development of the debates about the concept of genocide, and to show what the concept could add to the debate in the case of Spain. In particular, this paper proposes to apply the concept …

A Conceptual Framework For E-Commerce Innovation In Chinese Smes Chun-Sheng Yu, Chun-Sheng Yu, Xue-Bing Dong Nov 2013

A Conceptual Framework For E-Commerce Innovation In Chinese Smes Chun-Sheng Yu, Chun-Sheng Yu, Xue-Bing Dong

Journal of International Technology and Information Management

As E-Commerce (EC) is rapidly gaining popularity in China, EC innovation becomes a major growth strategy for many SMEs. Meanwhile, problems and challenges are hindering proliferation of EC innovation. The need exits for a theoretical model to forge EC innovation: a dynamic process with progressive stages of both internal and external e-readiness. Derived from theories and evidenced by the case studies from Hangzhou, China, our conceptual framework reveals top management, organizational learning, government support, market forces, and technology readiness as essential in each development stage, but with different emphasis. Implications of the framework are discussed.

A Software Platform To Support Collaboration In Express Delivery Services , Duo Xu, T.N Wong, D. Sculli

Journal of International Technology and Information Management

The express delivery industry in China has seen rapid growth in recent years. The majority of the express delivery companies can still be classified as medium-sized enterprises (SMEs). They are not just limited in terms of size, but also in terms of funds available for investment and in area of service coverage. Many such SMEs have chosen to collaborate so as to enhance their competitiveness. The current approach is to collaborate with another company located in a different city, and so effectively extend operations to inter-city delivery. However, this twosome type of collaboration has created problems in delivery efficiency and …

Approximating The Seismic Amplification Effects Experienced By Solar Towers Mounted On The Rooftops Of Low-Rise Industrial Buildings, Peter Luiz Balla Nov 2013

Approximating The Seismic Amplification Effects Experienced By Solar Towers Mounted On The Rooftops Of Low-Rise Industrial Buildings, Peter Luiz Balla

Master's Theses

This thesis investigates the acceleration amplification experienced by solar towers mounted on the rooftops of low-rise industrial buildings during a seismic event. Specifically, this thesis looks to assess the validity of using amplification factors adopted by the ASCE 7-05Minimum Design Loads for Buildings and Other Structures to approximate seismic acceleration amplification for roof-mounted solar towers. To investigate the validity of the ASCE 7-05 amplification factors, this thesis conducts timehistory analyses of three theoretical solar towers mounted on the roof of a case study building. The time history analyses are conducted in the finite element computer modeling program SAP 2000 using …

The State Of Healthcare For Bhutanese Refugees In South Philadelphia: Challenges & Progress, Sarah Wells

CwiC-PH

Who the Bhutanese Refugees Are [1]

  • Mid-19th Century: Nepalese farmers recruited to work farmlands of Southern Bhutan (called Lhotshampa, or “southerners”)
  • Lhotshampa retained Nepali and Hindu customs, but lived in peace with the Drukpa (Buddhist elite) majority for many years
  • 1989: “One Nation, One People” policy of ethnic cleansing: Drukpa culture imposed on all Bhutanese
  • Torture, sexual assault and murder forced over 130,000 Lhotshampa to flee Bhutan
  • These refugees spent decades of their lives in camps in Nepal (many still remain there)
  • Over 68,000 have resettled to the USA, many coming to South Philadelphia [2]

Authority Control For Digital Collections: Preparing For Linked Data, Jeremy Myntti, Nate Cothran

Faculty Publications

One of the first steps to preparing for Linked Data is to identify existing controlled vocabularies with URIs that can be used for representing strings of data. This project demonstrates how an automated authority control project is being used to match names and subjects within the University of Utah’s Digital Library with name and subject authority records available on the Library of Congress’ Linked Data Service.

Private Environmental Governance, Michael P. Vandenbergh Nov 2013

Private Environmental Governance, Michael P. Vandenbergh

Vanderbilt Law School Faculty Publications

Environmental law has quietly transformed from a positive law field deeply rooted in administrative law to one that is also heavily rooted in private law and private governance. After two decades (1970-1990) of remarkable activity, more than two decades have now passed without a major federal environmental statute (1991-2012). Whether the appropriate next step is expansion or contraction, reforms to the federal statutory framework have stalled. Federal regulatory activity and state and local measures have filled some of the gap, but private governance efforts – the pursuit of public ends through private standards, monitoring, enforcement, and dispute resolution – now …

Oasis Or Mirage: The Supreme Court's Thirst For Dictionaries In The Rehnquist And Roberts Eras, James J. Brudney, Lawrence Baum Nov 2013

Oasis Or Mirage: The Supreme Court's Thirst For Dictionaries In The Rehnquist And Roberts Eras, James J. Brudney, Lawrence Baum

William & Mary Law Review

The Supreme Court’s use of dictionaries, virtually non-existent before 1987, has dramatically increased during the Rehnquist and Roberts Court eras to the point where as many as one-third of statutory decisions invoke dictionary definitions. The increase is linked to the rise of textualism and its intense focus on ordinary meaning. This Article explores the Court’s new dictionary culture in depth from empirical and doctrinal perspectives. We find that while textualist justices are heavy dictionary users, purposivist justices invoke dictionary definitions with comparable frequency. Further, dictionary use overall is strikingly ad hoc and subjective. We demonstrate how the Court’s patterns of …

Introduction: Religion And Place: Landscape, Politics, And Piety, Elizabeth Olson, Peter Hopkins, Lily Kong Nov 2013

Introduction: Religion And Place: Landscape, Politics, And Piety, Elizabeth Olson, Peter Hopkins, Lily Kong

Research Collection School of Social Sciences

In 2010, a 14-year-old boy was brutally murdered in a suburb outside of Rio de Janeiro when a group of skinheads observed him at a party and suspected that he might be gay (McLoughlin 2011). This scale of horrific homophobia is not uncommon in Brazil, where rates of violence against gays, lesbians, and transgendered people are reported to be amongst the highest in the world. A study conducted with the support of Grupo Gay da Bahia offers the conservative estimate of 260 gays killed in the country in 2010, indicating that rates doubled in only 5 years. The statistic sits …

Mate Preferences Do Predict Attraction And Choices In The Early Stages Of Mate Selection, Norman P. Li, Jose C. Yong, William Tov, Oliver Sng, Garth J. O. Fletcher, Katherine A. Valentine, Yun F. Jiang, Daniel Balliet Nov 2013

Mate Preferences Do Predict Attraction And Choices In The Early Stages Of Mate Selection, Norman P. Li, Jose C. Yong, William Tov, Oliver Sng, Garth J. O. Fletcher, Katherine A. Valentine, Yun F. Jiang, Daniel Balliet

Research Collection School of Social Sciences

Although mate preference research has firmly established that men value physical attractiveness more than women do and women value social status more than men do, recent speed-dating studies have indicated mixed evidence (at best) for whether people’s sex-differentiated mate preferences predict actual mate choices. According to an evolutionary, mate preference priority model (Li, Bailey, Kenrick, & Linsenmeier, 2002; Li & KENRICK, 2006; Li, Valentine, & Patel, 2011), the sexes are largely similar in what they ideally like, but for long-term mates, they should differ on what they most want to avoid in early selection contexts. Following this model, we conducted …

Developing Socially Just Teachers: The Interaction Of Experiences Before, During, And After Teacher Preparation In Beginning Urban Teachers, Joan L. Whipp Nov 2013

Developing Socially Just Teachers: The Interaction Of Experiences Before, During, And After Teacher Preparation In Beginning Urban Teachers, Joan L. Whipp

College of Education Faculty Research and Publications

This interpretive study investigated how 12 graduates from a justice-oriented teacher preparation program described their teaching goals, practices, and influences on those practices after their 1st year of teaching in an urban school. Relationships among these teachers’ orientations toward socially just teaching, self-reported socially just teaching practices, and self-reported preprogram, program, and postprogram influences were explored. Teachers who were individually and structurally oriented exhibited a sociocultural consciousness and described socially just teaching in various combinations of culturally responsive pedagogies, consciousness-raising, and advocacy; whereas individually oriented teachers focused primarily on “color-blind” caring relationships with their students. Factors that seemed to influence …

The Fraud-On-The-Market Tort, John C.P. Goldberg, Benjamin C. Zipursky Nov 2013

The Fraud-On-The-Market Tort, John C.P. Goldberg, Benjamin C. Zipursky

Vanderbilt Law Review

It is commonplace to observe that there are differences between private 10b-5 actions and common-law actions for deceit, notwithstanding that both travel under the name of "fraud."' It is equally commonplace to suppose that these differences primarily reflect the need to adapt law that was first developed in a world of face-to-face transactions to the modern reality of large-scale, impersonal markets. The poster children for the transition from common-law fraud to securities fraud are, first, the Supreme Court's adoption in Basic, Inc. v. Levinson of the fraud-on-the-market doctrine and, second, the related emergence of securities fraud class actions. Amidst this …
