Imagining The Swamp Fox: William Gilmore Simms And The National Memory Of Francis Marion, Steven D. Smith Jan 2013

Imagining The Swamp Fox: William Gilmore Simms And The National Memory Of Francis Marion, Steven D. Smith

Faculty Publications

William Gilmore Simms's Unfinished Civil War measures the effects of the Civil War and its aftermath on one of the Old South's foremost intellectuals. Simms's mid-nineteenth-century poems, novels, and essays and the personal and societal trauma and destruction Simms experienced are all portrayed here. This collection of essays by historians and literary scholars first explores William Gilmore Simms's antebellum treatment of the role of warfare in America's past and the South's future. The contributors then consider the impact of the secession crisis, the Civil War, and the Confederate defeat on Simms's and other white and black Southerners' perceptions of their …

Policing And Social Influence: Procedural Justice And Compliance Dynamics In The Work Of Garda Juvenile Liaison Officers, Eoin Morrison Jan 2013

Policing And Social Influence: Procedural Justice And Compliance Dynamics In The Work Of Garda Juvenile Liaison Officers, Eoin Morrison

Dissertations

This study investigates the role of social influence, in the context of the professional relations between Garda Juvenile Liaison Officers (JLOs), and the young people they work with. Of specific importance is the concept of procedural justice, and its relation to perceptions of legitimacy and compliance dynamics. The aim of the research was to investigate whether the particular interaction patterns, enabled in the context of the JLOs professional role, could be found to have a positive impact upon young people’s levels of compliance with legal authority, in and of themselves. In order to examine this element of lived experience, five …

Consent And The Subjective World Of The Worker, Marty Laubach, Michael Wallace Jan 2013

Consent And The Subjective World Of The Worker, Marty Laubach, Michael Wallace

Sociology and Anthropology Faculty Research

Purpose: This study tests three theories of determinants of workers’ subjective response to work situations – structural factors (measured by individual, organization and job characteristics), general disposition, or informal work arrangements as constructed by Laubach’s (2005) “consent deal.”

Design/methodology/approach: Data were obtained from the Indiana Quality of Employment Survey, a survey of workers covering general working conditions. We constructed 10 models regressing worker perceptions and attitudes (e.g. satisfaction, relations with supervisors, meaningfulness) on structural determinants. We then used structural equation modeling to identify an underlying factor representing a general worker response from elements of the attitudes and perceptions. …

Licensed To Care: Inhabiting The Transnational Economy Of "Global Pinoy", Fidel Taguinod Jan 2013

Licensed To Care: Inhabiting The Transnational Economy Of "Global Pinoy", Fidel Taguinod

Doctoral

The Philippines’ experience in international labour migration is widely considered a success – an observation endorsed by international bodies such as the World Health Organisation. As an active source of professional nurses to the developed world, the country continues to produce more nurses than the local nursing market can employ; a labour strategy that is promoted, facilitated and supported by the Philippine state and nursing educational system. This thesis interrogates Filipino nurse migration through the methodological prism of autoethnography, drawing on first-hand experience and reflexive accounts, interviews, photographs, policy documents and material cultural artefacts, to critically examine and challenge the …

Cultural Policy And The Creative City: Legitimation Discourses, Culture And The State, Tara Byrne Jan 2013

Cultural Policy And The Creative City: Legitimation Discourses, Culture And The State, Tara Byrne

Doctoral

This thesis addresses cultural policy. It proposes that the creative city urban development paradigm is a useful perspective from which cultural policy can be analysed in order to reveal the imperatives, pressures, contingencies and deficits within it and the state, vis-à-vis the market. The thesis, therefore, rests on three analytical pillars: the general field of cultural policy, the specific construct of the creative city paradigm, and an investigation of relations between these domains through a study of policy texts in Scotland, Finland and Ireland. Using Michel Foucault’s discourse formation theory and Jurgen Habermas’s concepts of lifeworld, system, legitimation and colonisation, …

Countering-Insurgency : A Comparative Analysis Of Campaigns In Malaya (1948-1960), Kenya (1952-1960) And Rhodesia (1964-1980), William J. Bailey Jan 2013

Countering-Insurgency : A Comparative Analysis Of Campaigns In Malaya (1948-1960), Kenya (1952-1960) And Rhodesia (1964-1980), William J. Bailey

Theses: Doctorates and Masters

History has lessons for the present; could this be the case for modern counterinsurgency operations in countries resembling Iraq and Afghanistan? This research set out to study three historical counter-insurgencies campaigns in, Malaya (1947-1960), Kenya (1952- 1960) and Rhodesia (1964-1980), with a view to establishing whether or not the Colonial authorities had a substantial advantage over modern forces when combating insurgencies. If this was the case, are these advantages transferable to aid forces involved in modern counterinsurgencies?

The research questions focussed on how important the role of the Colonial Forces was to the eventual outcome, examining the principal factors that …

Representation And Symbolic Politics In Indonesia : An Analysis Of Billboard Advertising In The Legislative Assembly Elections Of 2009, Eva Leiliyanti Jan 2013

Representation And Symbolic Politics In Indonesia : An Analysis Of Billboard Advertising In The Legislative Assembly Elections Of 2009, Eva Leiliyanti

Theses: Doctorates and Masters

The overarching characteristic of the 2009 legislative elections lay in the legislative candidates’ politics of image. It stemmed from the amendment to the election Law no. 10/2008 article 214 that ostensibly cut off the parties’ power in determining their candidates without the public’s “direct” consent. The public was then given a direct opportunity to choose and vote for their preferred candidates in the 2009 elections. This marked the emergence and proliferation of the candidates’ image construction, especially in the “outdoor” political arena. Billboards were chosen as the most effective outdoor advertising medium to introduce the candidates and propagate their slogans …

Experiences Of Adult Siblings Of Illicit Drug Users, Amy Mcalpine Jan 2013

Experiences Of Adult Siblings Of Illicit Drug Users, Amy Mcalpine

Theses: Doctorates and Masters

The sibling relationship is unique in that it is relatively egalitarian, ascribed, and can be the longest-lasting across the lifespan. Siblings can act as supports for one another during major life events, both in childhood and adulthood. Siblings can also be a source of significant stress. The literature on family coping indicates that there are significant impacts to family members’ well-being from dealing with stress and strain that result from a family member’s drug use problem. However, researchers have not investigated the impacts on adult siblings despite the importance and uniqueness of sibling relationships. The broad aim of this research …

A Transcultural Journey : Integrating Elements Of Persian Classical Music With Jazz, Kate Pass

Theses : Honours

This study centres on the integration of Jazz with Persian classical music. In particular it documents the processes and the outcomes of a musical collaboration between myself—an Australian jazz double bass player—and a group of classically trained Persian musicians.

The study is in three parts. Part one serves as a backdrop to parts two and three and explores notable examples of collaborations between jazz musicians and musicians from other cultures. Part two provides a succinct exposition of the main features of Persian music, and part three documents my work in integrating Persian classical music with Jazz.

The Case For Online Obscurity, Woodrow Hartzog, Frederic Stutzman Jan 2013

The Case For Online Obscurity, Woodrow Hartzog, Frederic Stutzman

Faculty Scholarship

On the Internet, obscure information has a minimal risk of being discovered or understood by unintended recipients. Empirical research demonstrates that Internet users rely on obscurity perhaps more than anything else to protect their privacy. Yet, online obscurity has been largely ignored by courts and lawmakers. In this Article, we argue that obscurity is a critical component of online privacy, but it has not been embraced by courts and lawmakers because it has never been adequately defined or conceptualized. This lack of definition has resulted in the concept of online obscurity being too insubstantial to serve as a helpful guide …

Legal Norms' Distinctiveness In Legal Transplants And Global Legal Pluralism, Toby S. Goldbach Jan 2013

Legal Norms' Distinctiveness In Legal Transplants And Global Legal Pluralism, Toby S. Goldbach

All Faculty Publications

This paper examines the transnational movement of law and legal pluralism in the transnational domain in order to play with a specific question: whether legal norms are distinctive or whether there is a distinctive way that legal norms operate in practice. The paper engages with the International and considers two empirical domains or sets of disciplines: Legal Transplants and Global Legal Pluralism. Both reflect on the relationships between multiple overlapping legal orders and between "donors" and "recipients" in interactional legal practices. These disciplines point to moments of problem-articulation, periods of translation, and practices of acceptance and recognition. The paper suggests …

Parent Participation In Family Programs: Involvement In Literacy Interactions, Adult And Child Instruction, And Assessment, Andrea D. Parecki, Sabra B. Gear Jan 2013

Parent Participation In Family Programs: Involvement In Literacy Interactions, Adult And Child Instruction, And Assessment, Andrea D. Parecki, Sabra B. Gear

Human Movement Studies & Special Education Faculty Publications

The purpose of this article is to describe optimal parent participation in family literacy programs and parent-child literacy interactions, most specifically during interactive reading. Family literacy can be interpreted in many ways, resulting in diverse models of implementation that take place in Head Start programs, community agencies, schools and other venues. Since early literacy starts in the home environment where parents, across cultural, ethnic, and socioeconomic backgrounds, want their children to learn successfully, family literacy programs that enhance parent-child interactions can directly assist many parents in supporting their children to become proficient readers. Implementation and outcomes of program activities on …

A Qualitative Inquiry Into The Experiences Of People Living With Hiv/Aids For An Extended Period Of Time, Sylwia P. Hodorek

All-Inclusive List of Electronic Theses and Dissertations

The experience of living with a chronic illness such as HIV/AIDS is complex. The longevity of people living with HIV/AIDS is increasing and changing the medical and mental health care provision for these individuals. A qualitative approach was used to explore the lived experiences of long-term survivors of HIV/AIDS along three factors: (a) uncertainties, (b) stigma, and (c) coping. The research was guided by the constructivist paradigm and biopsychosocial approach. The methodology utilized was the constructivist grounded theory approach, which emphasizes simultaneous data collection and analysis. Semi-structured interviews were conducted with 10 participants who have been living with HIV/AIDS for …

Chanted Landscapes, Fernando N. Zialcita Jan 2013

Chanted Landscapes, Fernando N. Zialcita

Sociology & Anthropology Department Faculty Publications

Landscapes within, landscapes without. Contrary to positivist science, the boundary between our body and the world is indefinite and shifting. When I experience space, according to the phenomenologist Maurice Merleau-Ponty (1964: 59), I do not experience it as “an exterior wrap.” Instead, “I see space from within, I am enfolded by it… rather than the world being in front of me, it is around me.” Moreover, in our experience there is a constant interplay between the open and the closed, between the within and the without, between the here and the yonder, between inner space and outer space, writes Gaston …

Normal Mysticism : An Interdisciplinary Study Of Max Kudushin's Rabbinic Hermeneutic, Thomas L. Head Jan 2013

Normal Mysticism : An Interdisciplinary Study Of Max Kudushin's Rabbinic Hermeneutic, Thomas L. Head

Theses: Doctorates and Masters

Max Kadushin (1895-1980) was a rabbi, professor, and preeminent figure in the history of American Conservative Jewish rabbinic thought. His hermeneutic system, which centers on the idea of organic religious value-concepts, has had a significant influence on the emerging Textual Reasoning movement.

In chapter one, I describe the intellectual climate in which Kadushin's system took shape—providing a short history of the 19th-century reform and haskalah movements, discussing the general outline of Alfred North Whitehead's process philosophy tradition, and placing new focus on the tension between Conservative Judaism and Mordecai Kaplan's emerging philosophy of Reconstructionism as a critical factor in the …

Drawn From Artists’ Lives: An Empirical Study Of The Situation And Realisation Of Professional Visual Art Practices In The Western Australian Field Of Cultural Production, Duncan Robert Mckay

Theses: Doctorates and Masters

This thesis presents the findings of empirical research on the working lives of visual artists living and working in Western Australia. No detailed studies of this kind have previously been undertaken in a Western Australian context, though a series of national, economically framed studies have surveyed Australian artists working in a variety of art forms about their working lives on five occasions since the early 1980s. Collectively the reports published from these five studies make up the most comprehensive picture of artists’ economic activity that has been available to policymakers and others involved in arts and culture in this country …

Towards Aid Effectiveness : Contested Theories And Concepts : A Case Study Of Ghana’S Community–Based Rural Development Project, Kwadwo Adusei-Asante Jan 2013

Towards Aid Effectiveness : Contested Theories And Concepts : A Case Study Of Ghana’S Community–Based Rural Development Project, Kwadwo Adusei-Asante

Theses: Doctorates and Masters

The discussion of aid effectiveness continues to gain prominence in international development policy discourse and analysis. However, the question of why aid seems to be ineffective is far more complicated and remains largely unanswered. While the notions that aid drives donors’ interests and creates dependency are still relevant, this thesis confronts the problem, by examining the issues that influenced the operationalisation and effectiveness of aid programs in the context of Ghana’s Community-Based Rural Development Project (CBRDP) (2005-2011). By arguing that aid dependency and “aid as a concept” are different, the thesis makes the most basic assumption that ‘aid’ is not …

Inside Schizophrenia: Mending The Internal Conflict; And, The Historical, Cultural And Social Aspects Of Schizophrenia, Fiona Erica Nichols

Theses: Doctorates and Masters

This thesis comprises a memoir and essay on schizophrenia. It is estimated that 285,000 people suffer some form of schizophrenia in Australia. There are about five types of schizophrenia: paranoid, catatonic, disorganised, undifferentiated, and residual. The focus of this thesis is on the diagnosis of Paranoid Schizophrenia. There is no cure, but it is treatable. However, people with a treatment resistant schizophrenia can find life difficult. The aim of the thesis is …

A Comparison Of Australian And German Literary Journalism, Christine Boven Jan 2013

A Comparison Of Australian And German Literary Journalism, Christine Boven

Theses: Doctorates and Masters

The purpose of this thesis is to investigate and compare the traditions shaping the development of literary journalism in Australia and Germany. Tracing the different historical developments of the form in the two countries provides the contextual basis for an in-depth comparative analysis, which concentrates on the concepts of credibility and authenticity. The thesis explores whether different attitudes to news and opinion in journalism in the two countries influence these notions that are central to literary journalism. However, in the comparative analysis other significant factors become apparent. In four case studies, two from each country, consisting of book-length examples of …

Framing Anorexia : A Play Script And Multidimensional Investigation Of Anorexia : A Play And Critical Essay, Louise Helfgott

Theses: Doctorates and Masters

This thesis explores anorexia nervosa in young people. It comprises two components: a play script, "Frames", about 16-year-old Elizabeth who is combating the disorder, her troubled friend Ben, and their families, and a critical essay that reviews qualitative and quantitative literature about anorexia and contextualises the play in relation to selected narratives, plays and films. In my field research, I interviewed a number of professionals working in the field of anorexia and the essay also discusses their views and insights.

Few plays deal with anorexia in an in-depth manner to explore the onset and development of the illness. "Frames" addresses …

The Relationship Between The Meaning Of Water And Sense Of Place : A Grounded Theory Study From Northern Thailand, Katesuda Sitthisuntikul Jan 2013

The Relationship Between The Meaning Of Water And Sense Of Place : A Grounded Theory Study From Northern Thailand, Katesuda Sitthisuntikul

Theses: Doctorates and Masters

The literature suggests that a subtle relationship exists for communities between the meaning of water and sense of place, making fertile ground for systematic investigation. The relationship has obvious importance in today’s world, where people’s reliance on water, and the need for reliable supplies, form part of a common discourse in natural resource management. Yet, there has been much less discussion of what water means to people, how it connects with peoples’ sense of place, and what that might mean for the way people interact with their surroundings. The methodology of constructivist grounded theory was therefore appropriate to investigate this …

In the modern discussion over whether women should be ordained as pastors, the foundational passage for both those who affirm and those who oppose women’s ordination is Gen 1–3. Those who affirm women’s ordination find in the Genesis creation accounts a statement of full equality without hierarchy of man and woman, set forth as the divinely ordained creation order. They see the rest of Scripture calling us back toward that creation ideal, and allowing for women to fill any position of authority to which God calls and gifts them. Those who oppose the ordination of women also go to Gen …

Farms On Campus: Strong Stakeholder Support For An Educational Garden At A Non-Land-Grant University, Gina M. Bacigalupi Jan 2013

Farms On Campus: Strong Stakeholder Support For An Educational Garden At A Non-Land-Grant University, Gina M. Bacigalupi

Master's Theses

University farms and gardens are increasingly seen as effective tools for learning a variety of academic subjects and as resources that allow users to connect experientially to nature. Most existing university farms, however, are found at resource-rich land-grant universities. This research evaluated stakeholder interest and willingness-to-pay in money, time, and labor for a proposed educational farm at a public, urban, non-land-grant university through an online survey of over 400 members of the California State University East Bay, Concord Campus community. Overall, support for an educational farm at this site was high amongst all stakeholder groups. Students and stakeholders who hold …

Night Of The Living Dead Hand: The Individual Mandate And The Zombie Constitution, Gary S. Lawson

If someone had told me on June 27, 2012, that five Justices of the U.S. Supreme Court were about to hold in National Federation of Independent Business v. Sebelius 1 (NFIB) that the individual mandate provision in the Patient Protection and Affordable Care Act 2 (PPACA) was not constitutionally authorized either by the Commerce Clause or the Necessary and Proper Clause, 3 I would have popped a cork. I don't even drink, but I would have popped the cork on principle just to hear the sound (and also to irritate my colleagues, most of whom revere the PPACA the way …

Law And Religion For Nonhuman Persons, Mark Goldfeder Jan 2013

Law And Religion For Nonhuman Persons, Mark Goldfeder

Scholarly Works

On December 2, 2013, the Nonhuman Rights Project (NHRP), a national nonprofit organization working to get actual legal rights for members of nonhuman species filed a lawsuit in Fulton County, New York petitioning the judges for a writ of habeas corpus. A habeas corpus allows for a person being held captive to be brought before a court to determine if their imprisonment is lawful. Habeas corpus suits are filed all the time; what made this one historic was that it was not filed for a human being. The writ in question asked the court to formally recognize that a 26 …

Christianity, Islam, And Secular Law, Zachary R. Calo

Scholarly Works

No issue is more central to theological engagement with law than the meaning of the secular. Indeed, the capacity of constructive religious thought to inform the modern legal order depends in large measure on developing a theological account of the secular and secular law in particular.
