An Uneasy Union: Same-Sex Marriage And Religious Exemption In Washington State, Peter Dolan Oct 2013

An Uneasy Union: Same-Sex Marriage And Religious Exemption In Washington State, Peter Dolan

Washington Law Review

Same-sex marriage promises to be one of the defining issues of the twenty-first century. While supporters of same-sex marriage have welcomed a shift in the public’s perception and increasing acceptance of same-sex marriage in the last decade, controversy remains over how to balance the competing rights between marriage equality and religious freedom. While most same-sex marriage statutes around the country include religious exemptions for religious officials, it is unclear how, or whether, these protections should extend to wedding service providers who have a religious objection to same-sex marriage. Conflicts between same-sex couples seeking wedding services and wedding service providers who …

Teaching Pronunciation: Is Explicit Phonetics Instruction Beneficial For Fl Learners?, Elizabeth M. Kissling Oct 2013

Teaching Pronunciation: Is Explicit Phonetics Instruction Beneficial For Fl Learners?, Elizabeth M. Kissling

Latin American, Latino and Iberian Studies Faculty Publications

Pronunciation instruction has been shown to improve learners’ L2 accent in some, though certainly not all, cases. A core component of traditional pronunciation instruction is explicit lessons in L2 phonetics. Studies suggest that Spanish FL learners improve their pronunciation after receiving instruction, but the effect of phonetics instruction has not been directly compared with other pedagogical alternatives. This study reports on the pronunciation gains that first, second, and third year learners (n = 95) made after receiving either explicit instruction in Spanish phonetics or a more implicit treatment with similar input, practice, and feedback. The target phones included a …

Incorporating The Aesthetic Dimension Into Pedagogy, R. Scott Webster, Melissa Wolfe Oct 2013

Incorporating The Aesthetic Dimension Into Pedagogy, R. Scott Webster, Melissa Wolfe

Australian Journal of Teacher Education

One of the dimensions of learning experiences, which is not often given much attention outside of the creative arts, is the aesthetic dimension. In this paper we report on a study we conducted which explores the importance of learning through aesthetic experiences as identified by Dewey. While there is literature available which engages with the significance of such experiences (Hinchliffe, 2011; Nakamura, 2009) there is little which explores the nexus between this and specific practices in classrooms. Through examining pedagogical practices and beliefs of some exemplary teachers (as identified by their community), our study uncovered some approaches which offer alternate …

The Journey To Becoming Teaching Professionals In Rural South Africa And Zimbabwe., Tabitha G. Mukeredzi Oct 2013

The Journey To Becoming Teaching Professionals In Rural South Africa And Zimbabwe., Tabitha G. Mukeredzi

Australian Journal of Teacher Education

There seems to be consensus on what constitutes effective professional development although the gap between rhetoric and practice remains wide. Knowing what professional development looks like is insufficient, what is critical is to get it engrained in school structures. The study explored professional development practices of twelve professionally unqualified practicing teachers in rural South Africa and Zimbabwe secondary schools. Drawing on models of professional development, analysis of qualitative interview data suggests that classroom teaching practice, in-school meetings and school-to-school subject cluster and association meetings are effective for teacher professional growth. The paper illustrates that if teacher professional development is to …

Fringed Myotis (Myotis Thysanodes Pahasapensis): Species Conservation Assessment, Melissa J. Panella

Nebraska Game and Parks Commission: Publications

The primary goal in development of at-risk species conservation assessments is to compile biological and ecological information that may assist conservation practitioners in making decisions regarding the conservation of species of interest. The Nebraska Natural Legacy Project recognizes the fringed myotis (Myotis thysanodes pahasapensis) as a Tier I at-risk species. Provided are some general management recommendations regarding the fringed myotis. Conservation practitioners will need to use professional judgment to make specific management decisions based on objectives, location, and a multitude of variables. This resource was designed to share available knowledge of the fringed myotis that will aid in the decision-making …

Saline Area Historical Society's Rentschler Farm Museum Tour, Elizabeth Searls Oct 2013

Saline Area Historical Society's Rentschler Farm Museum Tour, Elizabeth Searls

Historic Preservation Final Projects

The purpose of this project is to update the current tour that is being offered at the Rentschler Farm Museum. It can be all too easy to focus only on the “stuff” or artifacts that are inside a museum. Tours about “stuff” are not relatable, and typically not very interesting. This tour focuses instead on how artifacts may have been used, and on particular stories about the Rentschler family who poured their lives into their farmland. The new tour was also written in a way that is relatable to visitors of the museum. The greatest example being that to the …

In Defense Of Implied Injunction Relief In Constitutional Cases, John F. Preis Oct 2013

In Defense Of Implied Injunction Relief In Constitutional Cases, John F. Preis

William & Mary Bill of Rights Journal

If Congress has neither authorized nor prohibited a suit to enforce the Constitution, may the federal courts create one nonetheless? At present, the answer mostly turns on the form of relief sought: if the plaintiff seeks damages, the Supreme Court will normally refuse relief unless Congress has specifically authorized it; in contrast, if the plaintiff seeks an injunction, the Court will refuse relief only if Congress has specifically barred it. These contradictory approaches naturally invite arguments for reform. Two common arguments—one based on the historical relationship between law and equity and the other based on separation of powers principles—could quite …

The Eighth Amendment As A Warrant Against Undeserved Punishment, Scott W. Howe Oct 2013

The Eighth Amendment As A Warrant Against Undeserved Punishment, Scott W. Howe

William & Mary Bill of Rights Journal

Should the Eighth Amendment prohibit all undeserved criminal convictions and punishments? There are grounds to argue that it must. Correlation between the level of deserts of the accused and the severity of the sanction imposed represents the very idea of justice to most of us. We want to believe that those branded as criminals deserve blame for their conduct and that they deserve all of the punishment they receive. A deserts limitation is also key to explaining the decisions in which the Supreme Court has rejected convictions or punishments as disproportional, including several major rulings in the new millennium. Yet, …

Ecowas's Right To Intervene In Côte D'Ivoire To Install Alassane Ouattara As President-Elect, Julie Dubé Gagnon Oct 2013

Ecowas's Right To Intervene In Côte D'Ivoire To Install Alassane Ouattara As President-Elect, Julie Dubé Gagnon

Notre Dame Journal of International & Comparative Law

On January 6, 2011, President-elect Alassane Ouattara of Côte d’Ivoire requested the Economic Community of West African States (ECOWAS) to intervene in order to remove incumbent Laurent Gbagbo, who refused to leave power following the democratic presidential elections of November 2010. In December 2010, ECOWAS gave a final ultimatum to Laurent Gbagbo to comply with its request on ceding his throne. Otherwise, ECOWAS warned, it would be compelled to use legitimate force to serve the demands of the Ivorian people. This Article ascertains the illegality of a military intervention for pro-democratic motives in light of the current postelection crisis in …

Criminal Forfeiture And The Sixth Amendment: The Role Of The Jury At Common Law, Richard E. Finneran, Steven K. Luther Oct 2013

Criminal Forfeiture And The Sixth Amendment: The Role Of The Jury At Common Law, Richard E. Finneran, Steven K. Luther

Cardozo Law Review

Throughout its recent jurisprudence after Apprendi v. New Jersey, the Supreme Court has emphasized that its analysis of the Sixth Amendment jury trial right centers upon the historical role of the jury at common law. Just last year, in Southern Union Co. v. United States, the Court extended the Sixth Amendment jury trial right to criminal fines after concluding that the jury's verdict determined the maximum fine that could be imposed at common law. The Court remained silent, however, with regard to another financial penalty commonly applied in the federal system: criminal forfeitures. Given that the Supreme Court …

Meaningful Membership: Making War A Bit More Criminal, Rachel E. Vanlandingham Oct 2013

Meaningful Membership: Making War A Bit More Criminal, Rachel E. Vanlandingham

Cardozo Law Review

Should membership in a particular group, by itself be enough for the government to kill you? This Article starts with the classic lawyer's answer of "it depends," but goes beyond it to answer yes, explain why, and recommend limits. The heart of the matter is found in how the law of armed conflict treats transnational, non-state armed groups such as Al-Qaeda. When such groups are viewed analogously to state militaries, their members are lawfully subject to lethal attack based on their membership status, as distinct from their actual hostile conduct. By comparing this focus on status to federal criminal law's …

Understanding Volunteerism In An Animal Shelter Environment: Improving Volunteer Retention, Rebecca Davis Oct 2013

Understanding Volunteerism In An Animal Shelter Environment: Improving Volunteer Retention, Rebecca Davis

Professional Projects

Volunteers are an essential part of any nonprofit organization. In many cases, volunteers play a vital role in the success of the organization in which they serve. Specifically, this paper focuses on the volunteers serving animal shelters: a place that does not always have a positive outcome for the animals. This research serves as a vehicle to determine what encourages people to begin volunteering in such an emotional setting and what motivates them to continue to share their time in the facility. The study serves to aid in the development of a volunteer program at the Milwaukee Area Domestic Animal …

Jerusalem Obscured: The Crescent On The Temple: The Dome Of The Rock As Image Of The Ancient Jewish Sanctuary, Curtis Hutt Oct 2013

Jerusalem Obscured: The Crescent On The Temple: The Dome Of The Rock As Image Of The Ancient Jewish Sanctuary, Curtis Hutt

International Dialogue

To begin with, what is it? In order to answer this question one must, of course, qualify it by asking—to whom? Pamela Berger in The Crescent on the Temple: The Dome of the Rock as Image of the Ancient Jewish Sanctuary has done a great service by supplying us with a history of the iconographic representation of Jerusalem's Dome of the Rock (the Qubbat al-Sakhrah). While no publication could ever exhaustively summarize the countless visual and literary portrayals of this world heritage site, Berger not only makes a valiant attempt at such but necessarily changes the way that almost all …

The Transgressive Allure Of White Gold In Peruvian Amazonia: Towards A Genealogy Of Coca Capitalisms And Social Dread: Andean Cocaine: The Making Of A Global Drug; Coca's Gone: Of Might And Right In The Huallaga Post-Boom, Bartholomew Dean

International Dialogue

“I have tested this effect of coca, which wards off hunger, sleep, and fatigue and steels one to intellectual effort, some dozen times on myself; I had no opportunity to engage in physical work.”—Sigmund Freud, from ‘Über Coca’, Centralblatt für die ges. Therapie, 2, 1884.

Circulating through multiple regimes of value, the transgressive allure of coca has gripped the Occidental imagination for more than a century and a half, shaping the contours of modernity; first as a magical elixir, then to a demonized underground drug, and eventually being transformed into a lucrative global commodity with grievous effects. Coca and cocaine …

Respect For Nature: A Theory Of Environmental Ethics, Edward Abplanalp Oct 2013

Respect For Nature: A Theory Of Environmental Ethics, Edward Abplanalp

International Dialogue

Paul Taylor’s Respect for Nature was first published 1986 when environmental ethics was a relatively new field. In it he defended a deontological biocentric environmental ethic predicated on the idea that all living beings have inherent value. It was a groundbreaking work in non-anthropocentric ethics, and since then it has been frequently anthologized and used in ethics and environmental philosophy courses taught around the world. The Twenty-fifth Anniversary Edition of Respect for Nature (2011) contains a two-page forward by Dale Jamieson, who notes the continued urgency for intellectuals to consider the meaning of “respect for nature.” When Respect for Nature …

Duke-Ing Out Pattern Or Practice After Wal-Mart: The Eeoc As Fist, Angela D. Morrison Oct 2013

Duke-Ing Out Pattern Or Practice After Wal-Mart: The Eeoc As Fist, Angela D. Morrison

Faculty Scholarship

The Equal Employment Opportunity Commission (EEOC) has an essential role to play in bringing pattern or practice suits, and now is the time for it to assert its role. A pattern or practice claim, also called a systemic claim, is one in which an employer has regularly and purposefully discriminated against a class of employees based on their religion, race, sex, color, or national origin, such that the discrimination is the employer's standard operating procedure. In recent years, the Supreme Court has limited private litigants' access to the courts in ways that impact the ability of plaintiff classes to assert …

Left–Right Dewlap Asymmetry And Phylogeography Of Anolis Lineatus On Aruba And Curaçao, Gabriel E.A. Gartner, Tony Gamble, Alexander L. Jaffe, Alexis Harrison, Jonathan B. Losos

Biological Sciences Faculty Research and Publications

Anolis lizards exhibit a remarkable degree of diversity in the shape, colour, pattern and size of their dewlaps. Asymmetry, where one side of the dewlap differs in pattern or colour from the other, has only been reported in one species, Anolis lineatus, and then on only one of the two islands from which it occurs. Given the importance of the dewlap in intra- and interspecific signalling, we expanded on previous work by (1) investigating whether the reported asymmetry actually occurs and, if so, whether it occurs on animals from both Aruba and Curaçao; (2) examining whether populations differ in …
