Whole-Nature: Integrating Science And Eco-Phenomenology, Bartholomew Patrick Walsh Jan 2013

Whole-Nature: Integrating Science And Eco-Phenomenology, Bartholomew Patrick Walsh

Graduate Student Theses, Dissertations, & Professional Papers

A review of the literature in environmental philosophy reveals a certain tension between what we might call science-based and experience-based approaches to environmental ethics. The main trend of thought here follows seminal figures like Aldo Leopold and Holmes Rolston III by generally looking to the sciences for disclosing value in nature, particularly ecology and evolutionary biology. However others, such as David Abram and Jack Turner, worry that scientifically disclosed nature is in itself too distancing, objectifying, and abstract to engender any real care for nature and instead emphasize direct, embodied experience with actual wild places, hence the label “eco-phenomenology.” The …

Designing Islamic Constitutions: Past Trends And Options For A Democratic Future, Clark B. Lombardi Jan 2013

Designing Islamic Constitutions: Past Trends And Options For A Democratic Future, Clark B. Lombardi

Articles

In recent years a growing number of countries have adopted constitutional provisions requiring that state law respect Islamic law (sharia). Muslims today are deeply divided, however, about what types of state action are consistent with sharia. Thus, the impact of a "Sharia Guarantee Clause" depends to a large degree on questions of constitutional design -- on who is given the power to interpret and apply the provision and on what procedures that they follow when making their decisions. This article explores the trends that gave rise to SGCs and provides a history of their incorporation into national constitutions. It then …

Consumer Subject Review Boards: A Thought Experiment, Ryan Calo Jan 2013

Consumer Subject Review Boards: A Thought Experiment, Ryan Calo

Articles

The adequacy of consumer privacy law in America is a constant topic of debate. The majority position is that United States privacy law is a “patchwork,” that the dominant model of notice and choice has broken down, and that decades of self-regulation have left the fox in charge of the henhouse. A minority position chronicles the sometimes surprising efficacy of our current legal infrastructure.

But the challenges posed by big data to consumer protection feel different. They seem to gesture beyond privacy’s foundations or buzzwords, beyond “fair information practice principles” or “privacy by design.” The challenges of big data may …

Eggshell Economics: A Revolutionary Approach To The Eggshell Plaintiff Rule, Steve Calandrillo, Dustin E. Buehler Jan 2013

Eggshell Economics: A Revolutionary Approach To The Eggshell Plaintiff Rule, Steve Calandrillo, Dustin E. Buehler

Articles

For more than a century, courts have universally applied the eggshell plaintiff rule, which holds tortfeasors liable for the full extent of the harm inflicted on vulnerable “eggshell” victims. Liability attaches even when the victim’s condition and the scope of her injuries were completely unforeseeable ex ante.

This Article explores the implications of this rule by providing a pioneering economic analysis of eggshell liability. It argues that the eggshell plaintiff rule misaligns parties’ incentives in a socially undesirable way. The rule subjects injurers to unfair surprise, fails to incentivize socially optimal behavior when injurers have imperfect information about expected accident …

Extrahepatic 25-Hydroxylation Of Vitamin D3 In An Engineered Osteoblast Precursor Cell Line Exploring The Influence On Cellular Proliferation And Matrix Maturation During Bone Development, Shelley S. Mason, Sean S. Kohles, Shelley R. Winn, Randy D. Zelick Jan 2013

Extrahepatic 25-Hydroxylation Of Vitamin D3 In An Engineered Osteoblast Precursor Cell Line Exploring The Influence On Cellular Proliferation And Matrix Maturation During Bone Development, Shelley S. Mason, Sean S. Kohles, Shelley R. Winn, Randy D. Zelick

Biology Faculty Publications and Presentations

Osteoblastic precursors experience distinct stages during differentiation and bone development, which include proliferation, extracellular matrix (ECM) maturation, and ECM mineralization. It is well known that vitamin D plays a large role in the regulation of bone mineralization and homeostasis via the endocrine system. The activation of vitamin D requires two sequential hydroxylation steps, first in the kidney and then in the liver, in order to carry out its role in calcium homeostasis. Recent research has demonstrated that human-derived mesenchymal stem cells (MSCs) and osteoblasts can metabolize the immediate vitamin D precursor 25- dihydroxyvitamin D₃(25OH₂D₃) to the active steroid 1α,25-dihydroxyvitamin D₃ …

Effects Of Disturbance On Tree Community Dynamics In Whitebark Pine Ecosystems, Jeremy Travis Amberson Jan 2013

Effects Of Disturbance On Tree Community Dynamics In Whitebark Pine Ecosystems, Jeremy Travis Amberson

Graduate Student Theses, Dissertations, & Professional Papers

Whitebark pine (Pinus albicaulis), a keystone species of high-elevation ecosystems of western North America, is warranted for listing under the Endangered Species Act due to the combined threats of fire exclusion, white pine blister rust (Cronartium ribicola), and increased pressure from insects due to climate warming. Despite widespread knowledge of the potential causes of the tree’s decline, there is limited understanding of its ecology, including successional dynamics in forests disturbed by white pine blister rust and mountain pine beetle. Specifically, there is a need for more information on successional replacement by subalpine fir and whitebark seedling regeneration dynamics. I assessed …

A Reliance Approach To Precedent, Hillel Y. Levin Jan 2013

A Reliance Approach To Precedent, Hillel Y. Levin

Georgia Law Review

Why and when should courts presumptively defer to their
own past precedents? The doctrine of precedent lies at the
core of American jurisprudence and legal practice, but the
source of its normative force remains unclear.
Consequently, its application is confused and contested.
In this Article, I argue that precedent matters because
and to the extent that it generates reliance interests on the
part of the public. Although I am not the first to suggest
that reliance is the foundational justification for deference
to precedent, this Article represents the first sustained effort
to defend the reliance approach in deontological terms and …

Air Circulation Under Reduced Atmospheric Pressures, Lendell E. Hillhouse Jan 2013

Air Circulation Under Reduced Atmospheric Pressures, Lendell E. Hillhouse

Theses and Dissertations

The control of heat exchange is vital for plant life in off-world, low pressure,

greenhouses. The ability to control this process was limited by methodology and

technology. Mathematical models, based on classical mechanics are created to enhance

our control capabilities. Data is collected using various sensors placed inside the Low

Pressure Test Bed (LPTB) Chamber at Kennedy Space Center. Data from those sensors

became non-linear at various pressures below 25 kPa. We introduced mathematical

calibration corrections and found that sensor data linearity could be extended to a greater

range of pressures. These calibration corrections allow for sensor calibration corrections

An Investigation Of Gender's Role In Three- And Four-Year-Old Children's Musical Play, Kari Jo O'Keefe Jan 2013

An Investigation Of Gender's Role In Three- And Four-Year-Old Children's Musical Play, Kari Jo O'Keefe

Theses and Dissertations

Young children engage in many activities, with play being the most prominent. Musical play occurs when children freely investigate sound through vocal, instrumental, or other means. Identifying the extent of musical play - and the role that gender plays in musical play - may provide important information about children's natural tendencies.

The purpose of this study was to investigate gender's role in three- and four-year-old children's musical play, and to investigate further the general nature of musical play. A grounded theory methodology was used, and data was gathered from field and individual child observations, and parent and preschool teacher surveys. …

Pregnancy, Sexism, And The Greek System, Taylor Marie Walkky Jan 2013

Pregnancy, Sexism, And The Greek System, Taylor Marie Walkky

Theses and Dissertations

Both hostile and benevolent sexism have been found to correlate with attitudes related to pregnancy (Terrell et al, in prep). Benevolent and hostile sexism have both been shown to correlate with attitudes towards sorority members as well (Walkky, unpublished). The goal of the present study was to expand on the knowledge of how sexism relates to pregnancy attitudes, especially how it relates to sorority membership. Participants read a scenario about a college woman, who was either in a sorority or not, who had just discovered that she was pregnant. In the scenario, she chose to either end the pregnancy, continue …

Determination Of Optimum Polymer Dose For Grand Forks Wastewater Treatment Plant Lagoon Sludge Dewatering, Dipesh Das Jan 2013

Determination Of Optimum Polymer Dose For Grand Forks Wastewater Treatment Plant Lagoon Sludge Dewatering, Dipesh Das

Theses and Dissertations

The Grand Forks Waste Water Treatment Plant (GFWWTP) is currently sending its waste activated sludge (WAS) from the activated sludge treatment process to an existing on-site wastewater treatment lagoon which has been in operation since 2003. The plant produces approximately 65,000 gallons of WAS per day. Because of this high level of loading, the existing lagoon system is no longer considered as a treatment option for the produced sludge. The Plant Authority is trying to find a sustainable solution for sludge disposal and for this reason the GFWWTP is interested in introducing screw press system for the dewatering process. As …

Epigenetic Patterns: Process-Driven Or Sequence-Driven?, Amanda Gefroh Jan 2013

Epigenetic Patterns: Process-Driven Or Sequence-Driven?, Amanda Gefroh

Theses and Dissertations

Some of the most rapidly-evolving fields of study in the medical and research communities presently are those which investigate our genetic code, the elements and factors that control the expression of our genetic code, as well as fields of study which analyze theories about an organisms' physiology and phenotype from the information that both of the previous topics concomitantly provide. The work of the Milavetz lab, among many others, is striving to fill the gaps in knowledge about epigenetic regulation of biological processes - here by using the well-suited model virus, Simian Virus 40. It has for some time now …

A Mass Spectrometry-Based Method For Quantification Of Human Metallothionein Isoforms And Usefulness In Biomarker Detection Of Cancers And Metal Toxicity, Aaron Andrew Mehus Jan 2013

A Mass Spectrometry-Based Method For Quantification Of Human Metallothionein Isoforms And Usefulness In Biomarker Detection Of Cancers And Metal Toxicity, Aaron Andrew Mehus

Theses and Dissertations

Current methods for detecting metallothionein (MT) protein expression lack the specificity to distinguish between all twelve human isoforms. Each, however, can be distinguished by the masses of their acetylated, cysteine-rich, hydrophilic N-terminal tryptic peptides. These properties were exploited to develop a mass spectrometry-based method for their simultaneous quantification.

Human kidney HK-2 epithelial cells expressing recombinant MT-3 were grown in the presence or absence of cadmium. Cytosolic proteins were alkylated with 14N- or 15N-iodoacetamide and digested with trypsin. The N-terminal MT peptides were enriched by two-dimensional liquid chromatography and analyzed by MALDI-TOF/TOF mass spectrometry. Relative expression was measured by combining 14N-labeled …

The Ecology Of Host-Seeking Mosquitoes Within The Red River Valley Of Central North Dakota, Joseph Orlo Mehus Jan 2013

The Ecology Of Host-Seeking Mosquitoes Within The Red River Valley Of Central North Dakota, Joseph Orlo Mehus

Theses and Dissertations

Host-seeking mosquitoes are taxing for people and wildlife alike in the Red River Valley (RRV). During the summer massive numbers of mosquitoes swarm the RRV, yet little is known about the ecology and biology of the mosquito species that inhabit this area. This research will help to fill some of those knowledge gaps by studying the ecology of host seeking mosquitoes in the RRV.

Host-seeking mosquitoes were collected using CO2-baited MMXTM traps. Trapping was conducted in two very different rural settings within the RRV. One site, a 40-acre hardwood forest with closed canopy, the other a farmstead …

The fuzzy rule-based algorithms were developed with the aim to improve quality of life of epilepsy patients by utilizing intelligent methods. An adaptive fuzzy logic system was developed to detect seizure onset in a patient specific way. Fuzzy if-then rules were developed to mimic the human reasoning and taking advantage of the combination in spatial-temporal domain. Fuzzy c-means clustering technique was utilized for optimizing the membership functions for varying patterns in the feature domain. In addition, application of the adaptive neuro-fuzzy inference …

Improving The Palmer Drought Severity Index By Incorporating Snow And Frozen Ground, Shaoyue Qiu Jan 2013

Improving The Palmer Drought Severity Index By Incorporating Snow And Frozen Ground, Shaoyue Qiu

Theses and Dissertations

Drought causes extensive damage and affects a significant number of people. To quantify the severity of drought and to better monitor drought, drought indices are necessary. The Palmer Drought Severity Index (PDSI) has its advantages of comprehensive and taking the characteristics of drought into concern so that it was regarded as the milestone in the revolution of drought indices (Heim, 2002). The PDSI has been widely used, tested, and modified since its development in 1965. However, a commonly documented limitation to this index is the lack of consideration for snow and the treatment of ground status. In this study, a …

Wendell Berry's Philosophy Of Education: Lessons From Port William, Jane Margaret Schreck Jan 2013

Wendell Berry's Philosophy Of Education: Lessons From Port William, Jane Margaret Schreck

Theses and Dissertations

In the midst of a proclaimed crisis in higher education, in the clamor and clamber to leverage technology for such innovations as mass open online courses and differentiated learning modules, in the speculative frenzy of preparing students for the careers of a fantasy future, and in the swirl of angst about funding accountability and economic relevance, Wendell Berry's philosophy of education declares that the essential element missing from most current discussions and considerations of education is love. As explained in his essays and revealed in his fiction and poetry, Berry's philosophy centers on love as the best animator of learning: …

Is There A Disconnect? Comparing North Dakota And National Geography Standards, Lori Jean Young

Theses and Dissertations

In 1994, Geography for Life was published. From this publication the national geography and state geography standards were developed. These national standards were the basis of the state standards.

North Dakota Studies is a Grade 9-12 course offered in North Dakota high schools. This course is offered under mandate in North Dakota high schools, so a broad range of data could be obtained by contacting those teachers.

Prior research has shown that students exposed to 3-D geographic technologies have better spatial abilities than students without a technologic background. A recent study showed that adults wanted to know more about geography …

Acetate Increases Brain Purine Metabolism And Glial Cell Culture Fatty Acid Content: Studies Investigating Glyceryl Triacetate's Therapeutic Mechanism Of Action, Dhaval Paresh Bhatt Jan 2013

Acetate Increases Brain Purine Metabolism And Glial Cell Culture Fatty Acid Content: Studies Investigating Glyceryl Triacetate's Therapeutic Mechanism Of Action, Dhaval Paresh Bhatt

Theses and Dissertations

Acetate supplementation is anti-inflammatory and neuroprotective in rat models of neuroinflammation and Lyme neuroborreliosis. Oral administration of glyceryl triacetate (GTA) is used to induce acetate supplementation in rodents, which increases plasma acetate and brain acetyl-CoA levels. Acetyl-CoA is a ubiquitous substrate for several biochemical pathways including carbohydrate, protein, and lipid metabolism. Acetate increases the in vivo and in vitro acetylation-state of histones and is associated with altered cytokine balance. However, the effect that acetate supplementation has on brain purine and lipid content remains unknown. Since labeled-acetate is incorporated into the purine and lipid pools, we proposed that acetate supplementation by …

Characterization Of Phosphorus, Nitrogen, And Sulfur Concentrations In A Paired Disturbed And Natural Wetland In Northwest Minnesota, Nicolas Buer Jan 2013

Characterization Of Phosphorus, Nitrogen, And Sulfur Concentrations In A Paired Disturbed And Natural Wetland In Northwest Minnesota, Nicolas Buer

Theses and Dissertations

A degraded wetland with a history of human-induced hydrologic alterations lies within northwestern Minnesota's Skull Lake Wildlife Management Area (WMA). Although conservation practices have been enacted by the Minnesota Department of Natural Resources (MNDNR), there remains interest in the wetland's potential for ecological restoration. Restoration should not be undertaken without an understanding of underlying factors leading to degradation. A paired study between the disturbed wetland at Skull Lake WMA and the relatively natural wetland in the nearby Caribou WMA was designed to help understand near surface pore water geochemistry in an effort to determine causes of degradation and the potential …

Tackling Overweight And Obesity: Does The Public Health Message Match The Science?, Katherine Hafekost, David Lawrence, Francis Mitrou, Therese O'Sullivan, Stephen Zubrick

Research outputs 2013

Background: Despite the increasing understanding of the mechanisms relating to weight loss and maintenance, there are currently no validated public health interventions that are able to achieve sustained long-term weight loss or to stem the increasing prevalence of obesity in the population. We aimed to examine the models of energy balance underpinning current research about weight-loss intervention from the field of public health, and to determine whether they are consistent with the model provided by basic science. EMBASE was searched for papers published in 2011 on weight-loss interventions. We extracted details of the population, nature of the intervention, and key …

Stories Of Snow And Fire: The Importance Of Narrative To A Critically Pluralistic Environmental Aesthetic, John C. Ryan Jan 2013

Stories Of Snow And Fire: The Importance Of Narrative To A Critically Pluralistic Environmental Aesthetic, John C. Ryan

Research outputs 2013

Written narratives enable humans to appreciate the natural world in aesthetic terms. Firstly, narratives can galvanize for the reader a sense for another person’s experience of nature through the aesthetic representation of that experience in language. Secondly, narratives can encode and document for the human appreciator as writer an experience of nature in aesthetic terms. Through different narrative lenses, the compelling qualities of environments can be crystallized for both the reader (who vicariously experiences nature through language) and the human appreciator (who directly experiences nature through the senses). However, according to philosopher Allen Carlson’s “natural environmental model” of landscape aesthetics, …

Research outputs 2013

Background:Snake bite is one of the most neglected public health issues in poor rural communities worldwide. In addition to the clinical effects of envenoming, treatment with antivenom frequently causes serious adverse reactions, including hypersensitivity reactions (including anaphylaxis) and pyrogenic reactions. We aimed to investigate the immune responses to Sri Lankan snake envenoming (predominantly by Russell's viper) and antivenom treatment.Methodology/Principal Findings:Plasma concentrations of Interleukin (IL)-6, IL-10, tumor necrosis factor α (TNFα), soluble TNF receptor I (sTNFRI), anaphylatoxins (C3a, C4a, C5a; markers of complement activation), mast cell tryptase (MCT), and histamine were measured in 120 Sri Lankan snakebite victims, both before and …

Computer-Based Exams In Schools: Freedom From The Limitations Of Paper?, Christopher Paul Newhouse Jan 2013

Computer-Based Exams In Schools: Freedom From The Limitations Of Paper?, Christopher Paul Newhouse

Research outputs 2013

There is little doubt that the curriculum content and pedagogy in schools is driven by the structure and forms of assessment employed, particularly for summative purposes. When most such assessment was limited to what a student could do with a pen and paper in short ‘exams’ this pushed the content of the curriculum towards small descriptive chunks, and the pedagogy towards memorisation and replication techniques. Over the past two decades alternative forms of assessment supported by the power of computer systems have been conceived and tried. This paper discusses progress towards various forms of computer-based exams and how these may …

Patterns Of Physical And Psychological Development In Future Teenage Mothers, Daniel Nettle, Thomas E. Dickins, David A. Coall, Paul De Monrnay Davis Jan 2013

Patterns Of Physical And Psychological Development In Future Teenage Mothers, Daniel Nettle, Thomas E. Dickins, David A. Coall, Paul De Monrnay Davis

Research outputs 2013

Background and objectives: Teenage childbearing may have childhood origins and can be viewed as the outcome of a coherent reproductive strategy associated with early environmental conditions. Life-history theory would predict that where futures are uncertain fitness can be maximized through diverting effort from somatic development into reproduction. Even before the childbearing years, future teenage mothers differ from their peers both physically and psychologically, indicating early calibration to key ecological factors. Cohort data have not been deliberately collected to test life-history hypotheses within Western populations. Nonetheless, existing data sets can be used to pursue relevant patterns using socioeconomic variables as indices …

Toward A Phen(Omen)Ology Of The Seasons: The Emergence Of The Indigenous Weather Knowledge Project (Iwkp), John Charles Ryan

Research outputs 2013

Since European settlement, the Western calendar has insufficiently accounted for the seasonal nuances and multiple temporalities of Australia. Beginning with Tim Entwistle’s recent proposal to revise the four-season Australian norm, this article traces the emergence of the Western calendar in Europe and its institutionalization ‘Down Under.’ With its emphasis on land-based calendars, the Indigenous Weather Knowledge Project (IWKP) is a partnership between Aboriginal communities and the Bureau of Meteorology aimed at preserving and promoting knowledge of the endemic seasons of Australian regions. As the most recent addition to the IWKP, the six-season Nyoongar calendar of the South-West of Western Australia …
