The Death Of The Common Law: Judicial Abdication And Contributory Negligence In Maryland, Donald G. Gifford Jan 2013

The Death Of The Common Law: Judicial Abdication And Contributory Negligence In Maryland, Donald G. Gifford

Maryland Law Review Online

The issue of how to handle a victim’s own contributory negligence that combines with the negligence of a tortfeasor in causing harm is one of the most important, if not the most important, issue in all of tort law. Forty-six states now apply some version of comparative fault that holds the defendant liable for its negligence even when the plaintiff is also careless, but reduces the award in proportion to the plaintiff’s degree of fault when compared with that of the defendant. In contrast, the Maryland Court of Appeals in Coleman v. Soccer Association of Columbia recently refused again to …

“It’S Good To Be Shifty”: The Local Democracies Of Old Southwestern Humor, D. Berton Emerson Jan 2013

“It’S Good To Be Shifty”: The Local Democracies Of Old Southwestern Humor, D. Berton Emerson

English Faculty Scholarship

This essay reassesses representative texts of the popular antebellum tradition known as Old Southwestern Humor—among them Augustus Baldwin Longstreet’s Georgia Scenes (1835), Johnson Jones Hooper’s Adventures of Captain Simon Suggs (1845), and George Washington Harris’s Sut Lovingood: Yarns Spun by a Durn’d Fool (1867)— arguing for a new point of departure from the level of locality and with special attention to democratic decision making. Most nation-oriented readings portray the humor of the Old Southwest either as a regional subset supplementing nationalization via print culture or as reactionary polemics rejecting the impingements of nation, market capitalism, urbanization, or modernity. This essay, …

Pornography And The Connection To Commerical Sexual Exploitation, Cheryl Page

Journal Publications

Human Trafficking is a violation against humanity and a contradiction to the notion that all people are born free and have rights that are equal. 1 This global crime is a part of practically every country in the world. No nation is immune from its reaches. Every year thousands of women, men and children fall prey to human commercial exploitation and are trapped in a criminal enterprise that profits in the billions. Human trafficking is defined as, “recruitment, transportation, transfer, harboring or receipt of persons, by means of the threat or use of force or other forms of coercion, of …

Injury Establishes Constitutive Μ-Opioid Receptor Activity Leading To Lasting Endogenous Analgesia And Dependence, Gregory F. Corder Jan 2013

Injury Establishes Constitutive Μ-Opioid Receptor Activity Leading To Lasting Endogenous Analgesia And Dependence, Gregory F. Corder

Theses and Dissertations--Physiology

Injury causes increased pain sensation in humans and animals but the mechanisms underlying the emergence of persistent pathological pain states, which arise in the absence of on-going physical damage, are unclear. Therefore, elucidating the physiological regulation of such intractable pain is of exceptional biomedical importance. It is well known that endogenous activation of µ-opioid receptors (MORs) provides relief from acute pain but the consequences of prolonged endogenous opioidergic signaling have not been considered. Here we test the hypothesis that the intrinsic mechanisms of MOR signaling promote pathological sensitization of pain circuits in the spinal cord. We found that tissue inflammation …

In The Cards: A Collection Of Short Stories And Poetry, Alise Vick

HIM 1990-2015

In the Cards is a collection of five interrelated short stories with six related poems in between each piece. Each of the selections features a female protagonist with a focus on two main characters, Shelley and Caroline, half-sisters trying to regain their sisterhood after their father's death. Themes explored in the fiction and poetry include faith and relationships, and how they can be connected. Caroline and Shelley drive the primary storyline with the former, a self-described goody goody who has surrounded herself with superficial friends. Between the expectations of the community that surrounds her and the standards she has set …

The Uncanny And The Postcolonial In J.R.R. Tolkien's Middle-Earth, Molly Brown Fuller Jan 2013

The Uncanny And The Postcolonial In J.R.R. Tolkien's Middle-Earth, Molly Brown Fuller

HIM 1990-2015

Concluding on this note, the thesis argues that reading The Lord of the Rings in this way renders postcolonial concepts accessible to a whole generation of readers already familiar with the series, and points to the possibility of examining other contemporary texts, or even further analysis of Tolkien's to reveal more postcolonial sensitivities engendered in the texts.; This thesis examines J.R.R. Tolkien's texts The Hobbit, The Fellowship of the Ring, The Two Towers, and The Return of the King from a postcolonial literary perspective. By examining how these texts, written at the decline of the British Empire, engage with the …

Gridlocks And Padlocks, Rachel Chapman

HIM 1990-2015

Gridlocks and Padlocks is a collection of short fiction and personal essays whose goal is to create characters with depth in both real-world and not-entirely-real-world situations. The strength of nonfiction is the capacity to observe the writer's thinking and motivation. "Ashes to Ashes, Trust to Dust" is a personal essay that explores my struggle with the faith I was raised in, with an emphasis on how friendships and relationships have shaped my perceptions. "The List of Unacceptable Faults" is a personal essay about unwanted interactions with the opposite sex; it is an examination of men and boys through the lens …

Maid For Man, Elyse Kelly Jan 2013

Maid For Man, Elyse Kelly

HIM 1990-2015

This thesis is a novella highlighting the struggle many religious individuals face to maintain a faith with or without physical props and boundaries, and why some people voluntarily live with pharisaical rules that make it harder to reside in the modern world. Maid for Man is the story of Caty, a young woman brought up by the strict conservatism of a combined church and homeschool group, who, after marrying a man and discovering he has no physical interest in her, must decide whether or not to divorce him, even though her family and community believe divorce is an excommunicable sin.

The Service Learning Experience: How Storytelling Evolves In People With Alzheimer's And Dementia And Why This Is Important To The Creative Writing Student And The Community, Alice Spicer Jan 2013

The Service Learning Experience: How Storytelling Evolves In People With Alzheimer's And Dementia And Why This Is Important To The Creative Writing Student And The Community, Alice Spicer

HIM 1990-2015

All meaningful communication is a form of storytelling, according to Walter Fisher, who introduced the narrative paradigm to communication theory, and storytelling is universal across cultures and time as the manner in which people comprehend life. Storytelling is also a creative form of art. This interdisciplinary, multimedia work will explore the creative use of non-traditional storytelling to gather information about how creativity evolves in people with Alzheimer's and dementia and why this is important to both academia and the community. Currently, there is a lot of research available about the debilitating affects of memory loss, but there is very little …

Dehydration In Southern Toads (Anaxyrus Terrestris): Metabolic Costs And Effects Of Temperature Selection, Claire E. Forster Jan 2013

Dehydration In Southern Toads (Anaxyrus Terrestris): Metabolic Costs And Effects Of Temperature Selection, Claire E. Forster

Scripps Senior Theses

Southern toads (Anaxyrus terrestris) are ectothermic terrestrial amphibians. As such they are sensitive to thermal and hydric variability. The interactive effect of hydration state and body temperature is not well understood. The aim of this study is to determine if the costs of dehydration vary at different temperatures and if so, whether toads will select different temperatures to minimize these costs. Costs of dehydration were evaluated by measuring metabolic rate at 100% and 85% hydration state, at 30 and 20 oC. Temperature selection of toads at 100% and 85% hydration state was measured using a thermal gradient. …

She Makes Me Ashamed To Be A Woman: The Genocide Conviction Of Pauline Nyiramasuhuko, 2011, Mark A. Drumbl

Michigan Journal of International Law

In the nearly twenty years since 1994, the international community and the Rwandan government have pushed to hold individual perpetrators accountable for the genocide. Judicialization has occurred at multiple levels. Over ninety persons-those deemed most responsible-have been indicted by the International Criminal Tribunal for Rwanda (ICTR), an ad hoc institution established by the U.N. Security Council in November 1994. Approximately ten thousand individuals have been prosecuted in specialized chambers of national courts in Rwanda. According to the Rwandan government, nearly two million people have faced neo-traditional gacaca proceedings conducted by elected lay judges throughout the country. Gacaca proceedings concluded in …

Identification Of Salivary Antigens From The Deer Tick Ixodes Scapularis As Novel Vaccine Candidates, Martin Becker Jan 2013

Identification Of Salivary Antigens From The Deer Tick Ixodes Scapularis As Novel Vaccine Candidates, Martin Becker

Open Access Master's Theses

Ticks act as vectors for a number of different pathogens such as Borrelia burgdorferi the causative agent of Lyme disease. The most prominent tick vector in the United States is the deer tick Ixodes scapularis. Tick bites are of special public health concern since there are no vaccines available against most tick transmitted pathogens. Based on the observation that host animals such as guinea pigs or humans can develop adaptive immune responses to tick bites, anti-tick vaccination is a potential approach to mitigate health risks associated with tick bites.

The study presented here aimed at identifying immunogenic salivary proteins …

Soil Quality In Rhode Island Pastures Grazed By Different Types Of Livestock, Alissa H. Becker Jan 2013

Soil Quality In Rhode Island Pastures Grazed By Different Types Of Livestock, Alissa H. Becker

Open Access Master's Theses

Historically, much of the New England landscape was converted to pasture for grazing animals and harvesting hay. Today, consumer demand for local, sustainably produced food, the number of livestock farms and the land area used for farming are increasing in Rhode Island. In order to make sound management decisions, it is important to characterize the effects of livestock on the quality of pasture soils. Although pastures remain a fairly common part of the New England landscape, little research has been published on the effects of grazing animals on pasture soil quality. To assess this, I examined soil quality in farms …

Comparative Phylogeography And A Mitochondrial Dna Barcode For Identifying Three Sympatric Lagomorphs In The Northeastern United States, Mary E. Sullivan Jan 2013

Comparative Phylogeography And A Mitochondrial Dna Barcode For Identifying Three Sympatric Lagomorphs In The Northeastern United States, Mary E. Sullivan

Open Access Master's Theses

The New England cottontail (Sylvilagus transitionalis), New England’s endemic cottontail, has been experiencing dramatic population declines and is estimated to exist in only 14% of its historical range. The New England cottontail is currently a candidate for endangered species listing under the Endangered Species Act of 1973. New England cottontails may be distinguished accurately from eastern cottontails (S. floridanus) with the use of non-invasive genetic techniques (e.g., fecal sample collection) that allow sampling of large geographical areas with minimal cost. A restriction enzyme technique has been published based on NlaIII (New England Biolabs Inc, Massachusetts) cut …

The Distribution And Ontogeny Of Neuromast Receptor Organs And A Comparison Of Methods For Chemical Albation Of The Lateral Line System In Two Cichlid Fishes, Emily Anne Becker Jan 2013

The Distribution And Ontogeny Of Neuromast Receptor Organs And A Comparison Of Methods For Chemical Albation Of The Lateral Line System In Two Cichlid Fishes, Emily Anne Becker

Open Access Master's Theses

The lateral line system is composed of a series of mechanoreceptors called neuromasts, which are found on the head and trunk in specific patterns. On the head, larger canal neuromasts (CNs) are enclosed in cranial canals and smaller superficial neuromasts (SNs) are embedded in the skin in lines or clusters. Among species the lateral line canals can be narrow, widened, branched, or reduced. Through the use of fluorescent stains, Scanning Electron Microscopy, and cleared and stained specimens the distribution and ontogenetic appearance of SNs and CNs were mapped in two species of Lake Malawi cichlids with divergent adult lateral line …

Conservation Tillage Techniques For Mixed Vegetable Production In Southern New England, Jeffrey Ross Pieper Jan 2013

Conservation Tillage Techniques For Mixed Vegetable Production In Southern New England, Jeffrey Ross Pieper

Open Access Master's Theses

Vegetable farming is an intensive practice that typically relies on several tillage passes to prepare fields for production. Repeatedly tilling the soil, however, is unsustainable and has been shown to decrease soil structure and organic matter while increasing erosion rates. A 3-year experiment was conducted in a mixed vegetable production system in southern New England to determine how crop yield, weed abundance, and soil health were affected by conservation tillage practices. Three conservation tillage systems were compared to conventional tillage to determine the effects on yields of six vegetable crops, weed abundance, and soil health.

Six 50 m planting beds …

Using Seaweed As A Soil Amendment: Effects On Soil Quality And Yield Of Sweet Corn (Zea Mays L.), Angela R. Possinger Jan 2013

Using Seaweed As A Soil Amendment: Effects On Soil Quality And Yield Of Sweet Corn (Zea Mays L.), Angela R. Possinger

Open Access Master's Theses

Application of seaweed to manage soil fertility is a traditional practice in many coastal regions, utilizing an inexpensive, abundant, and nutrient-rich resource. As a practice that re-purposes waste materials, diversifies inputs, and relies on coastal resources, seaweed amendment may be an effective and inexpensive means of strengthening and supporting agriculture in coastal agroecosystems. Putatively, seaweed biomass may be a useful amendment for crop production and soil quality improvement due to provision of plant nutrients (e.g. N, P, K, Ca), and promotion of microbial activity, among other benefits. However, limitations of seaweed application include high sulfur (S), salt, and heavy metal …

Development Of Enhanced Lateral Flow Test Devices For Point-Of-Care Diagnostics, Roman Gerbers Jan 2013

Development Of Enhanced Lateral Flow Test Devices For Point-Of-Care Diagnostics, Roman Gerbers

Open Access Master's Theses

Lateral flow Imunoassays (LFIA) are common, simple to use point-of-care devices for the diagnostic market. Conventionally LFIAs are limited in their complexity since they are optimized for minimally trained operators. Paper-based analytical devices (PAD) are advanced sensors based on a wide range of recently developed techniques for complex analytical methods. In this research, a point-of-care (POC) immunosensor was developed based on techniques adapted from lateral flow and paper-based analytical devices. Alternating layers of paper and tape were used to expand the common 2D design of lateral flow tests to 3D in order to enable complex fluid flow control. Four fluidic …

The Morphology And Biomechanics Of Jaw Structures In Chondrichthyes, Jordan Balaban Jan 2013

The Morphology And Biomechanics Of Jaw Structures In Chondrichthyes, Jordan Balaban

Open Access Master's Theses

The skeletons of chondrichthyans (sharks, skates, rays, and chimeras) are composed entirely of cartilage, yet must still provide the skeletal support that bone does in other vertebrates. There is also an incredible range of diversity in the morphology of the cartilaginous skeleton of the feeding apparatus in Chondrichthyans. The goal of this research is to provide insight into the morphological evolution and biomechanical function of the cranial skeleton in chondrichthyans. Feeding style changes can occur with morphological changes in the skeletal elements of the shark feeding apparatus. In chapter one, to increase our understanding of how the feeding skeletal morphology …

Ecology Of Menidia Menidia Larvae In Two Temperate Estuarine Littoral Habitats, Miranda Lopez Jan 2013

Ecology Of Menidia Menidia Larvae In Two Temperate Estuarine Littoral Habitats, Miranda Lopez

Open Access Master's Theses

The Atlantic silverside (Menidia menidia) is one of the numerically most abundant fish species in estuaries along the East Coast of North America, but its ecology during the first two weeks post-hatch has not been described. Therefore ecological investigations into appropriate sampling methods, preferred habitats, feeding ecology and growth of these larvae will contribute valuable information to our knowledge base for this species. The upper reaches of two Rhode Island, USA, estuaries, with differing levels of anthropogenic inputs, were the study sites for this project. Previous studies have shown that during early spring M. menidia adults ripen for …
