The Balkinization Of Originalism, James E. Fleming

This Article suggests that, with the publication of Jack Balkin's Living Originalism, we are witnessing the "Balkanization" of originalism (when originalism splits into warring camps) along with the "Balkinization" of originalism (when even Balkin, hitherto a pragmatic living constitutionalist, becomes an originalist). It goes on to argue that Balkin's living originalism is what Ronald Dworkin has called a "moral reading" of the Constitution, for it conceives the Constitution as embodying abstract moral and political principles, not codifying concrete historical rules or practices. Furthermore, despite important differences, there are unmistakable affinities between Balkin's commitment to interpret the Constitution so as to …

Within a population, susceptibility to parasitism may vary. Individuals possessing certain intrinsic or extrinsic traits are often more likely to be parasitized than individuals within that population that do not possess those certain traits. As a result, parasites can have profound effects of the population dynamics of theirs hosts. Much research has been done on the host-parasite interaction of the eastern grey squirrel {Sciurus caroUnensis) and the tree squirrel hot fly {Cuterebra emasculator). The Effect Of Temperature And Turbidity On The Swimming Performance Of Golden Shiner (Notemigonus Crysoleucas)., Emily Katherine Hildebrandt

The purpose of this study was to examine the effects of turbidity and temperature on golden shiner critical swimming speed, and tail beat frequency, and how these relationships might be altered when fish are in a group. It was found that both temperature and turbidity positively affected critical swimming speeds; critical swimming speeds increased significantly with rising temperature and turbidity values. Tail beat frequencies increased with increasing temperature and turbidity, echoing the rise in critical swimming speed. A group effect was only evident at the lowest temperature for the highest turbidity, but tail beat frequencies indicate greater stress when alone …

This thesis is a comparative study of the rise of sectionalism in northern and southern antebellum American institutions of higher education. The West Point Military Academy, which maintained a roughly equal number of southern and northern cadets. presents a case-study of how faculty, staff, and students dealt with sectionalism in a mixed group. Information was gathered from numerous sources including college histories, archival material from the University of Mississippi, and southern military school studies. The purpose of this thesis is to demonstrate how Walker Percy, through fiction, explores the various inadequacies of place, ontology, and religious belief through his representation of his characters* engagement with these three areas in their attempt to live a meaningful life. 1 analyze three of Percy's novels. The Moviegoer (1961), The Last Gentleman (1966). and The Second Cowmg (1980), as well as Percy's non-fiction essays and Percy criticism. I find that the novels are continuous with Percy's non-fiction, and that Percy critics too often simply restate the author's beliefs instead of undergoing a thorough examination of what the author …

This research examines the literacy programs conducted in 1961 Cuba and 1980 Nicaragua. Given the similarities in the structure and implementation of the plan as well as the congruencies in rhetoric promoting the plans, this thesis explores the various internal and external variables that affected each country’s program to better understand the widely different results. To research these countries’ programs, I examined both primary and secondary source material related to each country, their educational programs specifically, as well as information about US foreign policy relationships with the countries during this time. In this thesis, I compare the fiction of Mississippi author Larry Brown and Scottish author Irvine Welsh, specifically in how they represent their respective regions’ working classes. The project concerns the genre of working-class fiction in both the American South and Scotland, as well as the general fields of Southern and Scottish contemporary fiction. The federal court system under the United States Constitution varied substantially from the English judicial system. This thesis will explore the extent to which the Court of Session, Scotland’s highest court, influenced the form of the United States federal court system. First, the thesis will examine the Acts of Union of 1707, the contract binding the kingdoms of England and Scotland into one political body. The language of the Acts of Union, specifically the language regarding the form and power of the Court of Session, will serve to draw a parallel with the United States Constitution. Individual investors victimized by securities fraud have no voice in directing class actions brought on their behalf once institutional investors obtain lead plaintiff appointments. The same holds for state-level transactional class actions claiming breaches of fiduciary duty by boards of directors in connection with mergers and acquisitions. In theory, the interests of institutional and individual investors align, nullifying the need for a separate voice for individuals; one rationale for the lead plaintiff modifications of the Private Securities Litigation Reform Act of 1995 was that individuals would benefit from the sophistication of institutional investor lead plaintiffs. The First Ever (Maybe) Original Jurisdiction Standings, David Hatton, Jay D. Wexler

One of the more interesting clauses of the Constitution is the one that gives the Supreme Court original jurisdiction to hear lawsuits brought by one state against another state. These cases have historically made up a consistent, though small, part of the Supreme Court’s docket, but nobody has yet to investigate how the various states have fared in these suits. In this article, we analyze all of the state versus state cases decided over the past 112 years and provide the first ever (we think) official standings of how the states stack up. Minnesota is the big winner.

Deductions For Drug Ads? The Constitution Does Not Require Congress To Subsidize Direct-To-Consumer Prescription Drug Advertisements, Shoshana Speiser, Kevin Outterson

The First Amendment protects lawful, non-misleading advertising as commercial speech, which constrains Congressional attempts to regulate direct-to-consumer advertising (DTCA) of prescription drugs. But the Constitution does not require the federal government to subsidize advertising through the Tax Code. Congress could revoke the legislative gift of tax deductions for DTCA without running afoul of regulating speech. While DTCA proponents maintain that DTCA increases disease awareness and leads to more doctor-patient conversations, Congress could find that these purported benefits are outweighed by other negative consequences, including excessive prescribing.

This thesis investigates the influence fairytales have on society, how they dichotomously reflect cultural worldviews yet set standards for appropriate behavior and prescribe hegemonic ideologies. It specifically explores the fairytales told in America over the last couple of centuries, examining how those stories have evolved in correlation with the shifting values of the country. Each chapter lays a foundation for how certain characters are normally portrayed in fairytale tradition - the hero, the beauty, and the villain - and then evaluates how our culture has Americanized those figures, consequently making each of them less idealistic or archetypal and evolution of …
