Significant Learning: Effectively Using Tarantino’S Reservoir Dogs In A Critical Writing Class, Chad Rohrbacher

Using film in class is nothing new. Film in higher education has been used to explore content, ideas, context, social or political issues, highlight discussions and model certain behaviors, among other things. For years I have used film to highlight rhetorical appeals, audience awareness, and logical fallacies, or to set up critical thinking discussions and writing assignments. We might watch Monty Python and the Holy Grail, for example, and highlight the various logical fallacies that are present; however, there seemed to be a lack of “deeper learning.” While these types of assignments focusing on one specific student learning outcome like …
Parochialism, Cosmopolitanism, And The Foundations Of International Law, Mortimer N.S. Sellers
Parochialism, Cosmopolitanism, And The Foundations Of International Law, Mortimer N.S. Sellers
Books
Summary: "This book determines the boundary between parochial and cosmopolitan justice. To what extent should law recognize or support the political, historical, cultural, and economic differences among nations? Ten lawyers and philosophers from five continents consider whether certain states or persons deserve special treatment or exemptions or heightened duties under international law. Parochialism and cosmopolitanism are the two faces of international law, which recognizes our common humanity by protecting us in our differences"-- Provided by publisher.

Bosnia And Herzegovina General Elections, 2010: Analysis Of Pre-Election Rhetoric, Adis Arapovic, Bedrudin Brljavac
Khazar Journal of Humanities and Social Sciences
Bosnia and Herzegovina, as a postconflict and transitional country with sui generis political system of low efficiency, creates and conducts its politics in a specific ambient of reduced sovereignty and responsibility of domestic institutions and other political subjects. Such political ambient is suitable to proliferation of nationalistic, confrontational and anticonstitutional rhetoric and practices, which reach its peak during period of pre-election campaigns. Unfinished legislative election framework, purposeful obstruction of international election standards and domestic legislative on behalf of most of political subjects, deficiency of professional and independent media, undeveloped civic society, and politicized and undercapacitated institutions which are involved with …
Strategic Perspectives: Clausewitz, Sun-Tzu And Thucydides, Richard Rousseau
Strategic Perspectives: Clausewitz, Sun-Tzu And Thucydides, Richard Rousseau
Khazar Journal of Humanities and Social Sciences
This article illustrates the nature and function of strategy in military affairs. The main argument of the article is that strategy is a bridge connecting military power with political purpose. Strategy and military power are not alike, nor is strategy the actual application of power. Similarly, strategy is not policy. Strategy should be seen as a “theory of success.” Strategy is the source of operational plans intended to convert nominal military capability into useful performance against the enemy. To illustrate the nature and function of strategy, the article reflects on the behavior of Winston Churchill’s British government in the summer …
Through Process, Mitchell Goldstein
Through Process, Mitchell Goldstein
Theses and Dissertations
At the core of any designer’s activity is the process they engage with to create design. Process is not only a way to get from an idea to a completed work, it is also what determines our attitude towards design. This is the place where both the design and the designer are created. The gray area between nothing and something is where we go to discover design, and in turn to discover who we are and what matters to us. In this thesis I am investigating the nebulous place between ideas and things, thoughts and artifacts, and being just a …
Elevating The Everyday: Designed Objects As Companions, Cassie Hester
Elevating The Everyday: Designed Objects As Companions, Cassie Hester
Theses and Dissertations
From fleeting interactions to long affairs, our relationships with things are diverse and complex. Like people, designed objects and environments are close companions in our lives. The way we understand and engage with artifacts is parallel to the way we interpret and interact with each other. A constant source of comfort and delight, frustration and anxiety, their personalities inform our everyday dialogues and experiences. Designed artifacts assume engaging and pleasurable personalities when they transcend materials, challenge perceptions, and garner active, reflective interactions. Through the investigation of familiar materials such as concrete, crayons, paper, sequins, and thread in unfamiliar formats and …
Factors Influencing Pharmacists’ Decision To Report Adverse Events Related To Dietary Supplements, Ali M. Alhammad
Factors Influencing Pharmacists’ Decision To Report Adverse Events Related To Dietary Supplements, Ali M. Alhammad
Theses and Dissertations
Background: The increasing consumption of dietary supplements (DS) has drawn the attention of regulatory agencies, researchers and healthcare professionals. The US Food and Drug Administration (FDA) does not require premarketing assessment of DS considering them safe unless proven otherwise. However, the reporting rate of DS adverse events (DS-AE) is low. Objective: To describe pharmacists’ attitudes and knowledge of DS and DS information resources, and to determine the importance of selected attributes in pharmacists’ decisions to report a DS-AE. Methods: A convenience sample of practicing pharmacists in Virginia was surveyed using a web-based self-administered questionnaire. A conjoint analysis exercise was developed …
The Impact Of Service-Learning Among Other Predictors For Persistence And Degree Completion Of Undergraduate Students, Kelly Lockeman
The Impact Of Service-Learning Among Other Predictors For Persistence And Degree Completion Of Undergraduate Students, Kelly Lockeman
Theses and Dissertations
College completion is an issue of great concern in the United States, where only 50% of students who start college as freshmen complete a bachelor's degree at that institution within six years. Researchers have studied a variety of factors to understand their relationship to student persistence. Not surprisingly, student characteristics, particularly their academic background prior to entering college, have a tremendous influence on college success. Colleges and universities have little control over student characteristics unless they screen out lesser qualified students during the admissions process, but selectivity is contrary to the push for increased accessibility for under-served groups. As a …

Impacts Of Marine Invasive Species On Subtidal And Intertidal Food Web Dynamics, Nicole Rohr
Open Access Dissertations
Invasive species can have a variety of impacts on food web structure and interspecific interactions. They can impact recruitment rates of associated marine species, influence behavior of potential prey items, and alter predator-prey relationships. This research is designed to assess 1) the relationship between the recruitment of Lacuna vincta and two species of algal epiphytes, the native Ceramium virgatum and the invasive Neosiphonia harveyi, in the shallow subtidal zone; 2) the spatial and temporal distribution of the invasive Hemigrapsus sanguineus in the intertidal zone of cobble beaches; and 3) the top-down effects and predator-prey interactions of H. sanguineus.

An Investigation Of Internal Control Related Frauds And Auditor Litigation: Pre- And Post- Sarbanes-Oxley, Section 404, Ifeoma Udeh
Theses and Dissertations
Using 629 observations of U.S. publicly listed firms with internal control related frauds from 2000 to 2006; this study investigates the change in auditor litigations in the Post- Sarbanes Oxley, Section 404 period. To the extent the conditions of the internal control in place are inadequate or non-existent, the possibility of the occurrence of internal control related fraud heightens. Thus, the inability of auditors to detect a financial statement misstatement due to internal control fraud in a timely manner exposes auditors to litigation (Barra, 2010; Heninger, 2001; Caplan, 1999). This situation was prevalent in the recent notable corporate failures that …

Blue-Collar Crime: Conspiracy, Organized Labor, And The Anti-Union Civil Rico Claim, Benjamin Levin

This Article provides an historically-rooted analysis of a recent spate of civil RICO complaints arising from labor union organizing campaigns. The Article historicizes contemporary civil RICO suits against labor unions by analogizing to nineteenth century conspiracy prosecutions of unions. In tracing this history of organized labor’s social standing, the Article addresses the cultural framing of the union and its place in political and cultural discourse over the past century. The civil RICO complaints have received limited scholarly attention mainly focusing on issues of federal preemption; this Article argues for a broad reading of the cases as a way to understand …

Made In The U.S.A.: Corporate Responsibility And Collective Identity In The American Automotive Industry, Benjamin Levin
Publications
This Article challenges the corporate-constructed image of American business and industry. By focusing on the automotive industry and particularly on the tenuous relationship between the rhetoric of automotive industry advertising and doctrinal corporate law, this Article examines the ways that social and legal actors understand what it means for a corporation or its products to be American. In a global economy, what does it mean for a corporation to present the impression of national citizenship? Considering the recent bailout of American automotive corporations, the automotive industry today becomes a powerful vehicle for problematizing the conflicted public/private nature of the corporate …

Section 301 of the 2009 federal Credit Card Accountability, Responsibility, and Disclosure Act prohibits the issuance of consumer credit cards to young adults ages 18–20 unless the credit contract is cosigned by an older adult who accepts joint liability for the card, or else the young adult proves she has “independent means of repaying” her credit card obligations. This prohibition is at odds with a 50-year trend of extending the rights of adulthood to people ages 18–20. It also blocks an important source of credit for young entrepreneurs, who often use consumer credit to launch their enterprises.
The Perpetual Corporation, Andrew A. Schwartz
The Perpetual Corporation, Andrew A. Schwartz
Publications
Courts and commentators take for granted that the ultimate objective of a business corporation is long-run profitability, not immediate profits. But a corporation is a creature of statute, so a statutory source for this rule must be found--or it is not really a rule. Yet prior literature has not identified any such legal basis, leaving a gap in corporate theory. This Article fills that gap by showing that the modern corporation is obliged to act with a long-term view because it has "perpetual existence" under the law. This Article then explains that because they must plan for a perpetual future, …

Lies And The Constitution, Helen Norton
Lies And The Constitution, Helen Norton

Although the Supreme Court declared almost forty years ago that “there is no constitutional value in false statements of fact,” the Court in United States v Alvarez ruled that the First Amendment protects at least some -- and perhaps many -- intentional lies from government prohibition. In Alvarez, a divided Court struck down the Stolen Valor Act, a federal statute that made it a crime for any person to state falsely that he or she had received a military decoration or medal. In three separate opinions, all of the Justices agreed that the First Amendment permits the government to …
Government Speech In Transition, Helen Norton
Government Speech In Transition, Helen Norton

This symposium essay explores the legacy of the Supreme Court’s decision in Johanns v. Livestock Mktg. Ass’n. There the Court offered its clearest articulation to date of its emerging government speech doctrine. After characterizing contested expression as the government’s, the Court then held such government speech to be exempt from free speech clause scrutiny. In so doing, the Court solved at least one substantial problem, but created others that remain unresolved today. On one hand, Johanns marked the Court’s long overdue recognition of the ubiquity and importance of government speech, appropriately exempting the government’s own expressive choices from free …

Reining In The Rogue Squadron: Making Sense Of The "Original Source" Exception For Qui Tam Relators, Dayna Bowen Matthew

The qui tam provision of the Civil False Claims Act effectively serves to expand the government’s capacity to combat fraud, but also invites abusive prosecution against blameless public contractors. Although the public disclosure jurisdictional bar is designed to permit worthy claimants to proceed as whistle blowers while precluding parasitic opportunists from unfairly imposing litigation costs and reaping undeserved awards, the inconsistent judicial interpretation of the original source exception threatens predictable and just law enforcement. Christopher Alexion’s note categorizes the approaches courts have taken as ranging from permissive, to “middle ground” to restrictive based on the timing of the relator’s disclosure, …

Courts address equal protection questions about the distinct legal treatment of American Indian tribes in the following dichotomous way: are classifications concerning American Indians "racial or political?" If the classification is political (i.e., based on federally recognized tribal status or membership in a federally recognized tribe) then courts will not subject it to heightened scrutiny. If the classification is racial rather than political, then courts may apply heightened scrutiny. This Article challenges the dichotomy itself. The legal categories "tribe" and "tribal member" are themselves political, and reflect the ways in which tribes and tribal members have been racialized by U.S. …

I am a Chinese American who at 14 enrolled at Princeton and at 17 began my applied mathematics Ph.D. at Harvard. I was a first-year law student at the University of Chicago before transferring to Stanford, preferring the latter's pedagogical culture. This Article offers a complementary account to Amy Chua's parenting memoir. The Article discusses how mainstream legal education and tiger parenting are similar and how they can be improved by fostering life-long learning about character strengths, emotions, and ethics. I also recount how a senior professor at the University of Pennsylvania law school claimed to have gamed the U.S. …

This response to Yale Law Professor Amy Chua’s book, Battle Hymn of the Tiger Mother, complements a much longer and related article that is also in part a response to Chua’s book: Tiger Cub Strikes Back: Memoirs of an Ex-Child Prodigy About Legal Education and Parenting, 1 British Journal of American Legal Studies 297 (2012). This brief essay discusses the cultural differences between Chinese and Western views about education, learning, and parenting. This editorial draws on research in social psychology to analyze the stereotype of Asians and Asian Americans as being competent yet unsociable. Finally, this reflection draws …
