(CRC) is a landmark in the modern international protection of children's rights. Adopted by the United Nations General Assembly in 1989, its fifty-four articles and two Optional Protocols set out a lengthy catalogue of rights for children. The CRC bans all discrimination against children, including on grounds of their birth status. Freedom Struggles And The Limits Of Constitutional Continuity, Aziz Rana

This Essay challenges the view that although the actual and everyday Constitution may be riddled with real injustices, progressives should maintain faith in an idealized document and should see the shared language of constitutionalism as the privileged instrument for redeeming political life. Instead, it argues that faith should reside in an ideal of effective and equal freedom alone. Indeed, such a commitment may at key moments require pursuing constitutional rupture and rejection. The Essay highlights this point by reinterpreting two central decisions from the Civil War and Reconstruction eras: The Prize Cases (1863) and Ex parte Milligan (1866). These cases …

The following is a summary of research for a portion of the project titled Nano-Enhanced and Bio-Inspired Composite Materials for Mitigation and Protection of TIH Railcars and Stationary Tanks Against High Power Impact. This research investigated several nano-enhanced polymers for their suitability in high-speed impact protection applications. The polymers were tested mechanically to find ideal nano-particle additive percentages then coated onto steel substrates. These coated substrates were impacted using 0.50-caliber projectiles in order to find the ballistic limit (V50) for each combination. Computer modeling in ANSYS AUTODYN was undertaken to calculate a numerical ballistic limit for each plate configuration. The …

The Jim Crow South was a land saturated in religiosity. Emerging from the defeat of the Civil War and the utter oppression of slavery, southerners used religion to make sense of their painful world. This was a time marked by extreme religious conviction that gave way to racial violence. In this study, I will examine the southern lynching culture in the context of southern religion. Once the nation commits to engage in heavy, sustained military action abroad, particularly including the deployment of ground forces, political support is scrupulously observed and dissected. One of the most graphic factors influencing that support is the number of military soldiers who have made the ultimate sacrifice on the nation’s behalf. In the modern era, most studies suggest that the public considers the potential and actual casualties in U.S. wars to be an important factor, and an inverse relationship exists between the number of military deaths and public support. Economists have dubbed this the "casualty sensitivity" effect.

Some scholars have argued that the Framers of the U.S. Constitution did not have a common set of views on economics, or that the Constitution, except perhaps in isolated clauses, does not reflect any specific economic views. The principal Framers did, in fact, share a basic set of economic views, though of course they did not agree on all economic questions. Their shared economic views were common to enlightenment thinkers: promoting free trade, curtailing rent-seeking (the transfer of wealth from producers to non-producers through political power), and, in most instances, eliminating monopolies. This article provides a historical review of nuclear arms control agreements from 1925 to 2011, describing how these agreements helped diminish the nuclear arms threat and build up. As this article explains, nuclear arms control agreements can be segmented into distinct periods reflecting different approaches to the nuclear arms threat, with each stage addressing different focused objectives. As negotiations evolved throughout history, the United States and Soviet Union undertook a nuclear arms race, each striving to gain a military advantage over the other by building more and more nuclear weapons and the means to deliver them. In May 2012, Liechtenstein became the first State to ratify amendments to the Rome Statute of the International Criminal Court (ICC) that seek to activate the Court’s jurisdiction over the crime of aggression. The amendments, which were adopted by consensus at the ICC Review Conference that met in Kampala, Uganda, in 2010, establish definitions for “act of aggression” and “crime of aggression,” and provide the Court with jurisdiction even in the absence of a referral from the Security Council. In the current economic climate, there is a requirement to justify all government spending by demonstrating the added-value that the expenditure gives. Modeling and Simulation (M&S) community is not exempted from this rule. This paper focuses on attempts to value standards and demonstrates that even though a myriad of different standards exist in the United States today, no one has "cracked the nut" on determining their value. For more than a century, the United States has taken the lead in organizing international responses to international environmental problems. In the last two decades, however, U.S. environmental leadership has faltered. The best-known example is the lack of an effective response to climate change, underscored by the U.S. decision not to join the Kyoto Protocol. But that is not the only shortfall. The United States has also failed to join a large and growing number of treaties directed at other environmental threats, including marine pollution, the loss of biological diversity, persistent organic pollutants, and trade in toxic substances. The argument of this dissertation is that a critical reading of the concept of "covenant" in early American writings is instrumental to understanding the paradoxes in the American political concepts of freedom and equality. Following Slavoj Zizek's theoretical approach to theology, I trace the covenant concept in early American literature from the theological expressions and disputes in Puritan Massachusetts through Jonathan Edwards's Freedom of Will and the essays of Ralph Waldo Emerson, showing how the covenant theology of colonial New England dispersed into more "secular" forms of what may be called an American political theology. In the two decades prior to Cherokee Removal, Georgians discussed removal as a way for the state to create and maintain order, a cluster of ideas that revolved around a social system that championed white superiority, a political system that adhered to republican thinking, and a legal system that prevented lawlessness. To create a well-ordered society, Georgia’s leaders believed that authority flowed from white settlers to civil institutions, which benignly administered over the idealized society. Despite modern conceptions, pirates were not typically cruel, greedy, and dishonest men of the lowest social ranks, but often began as privateers for local navies. It was only when they attacked an unassigned target that their status changed to that of piracy in the eyes of their patrons. However, if the illegal attack was against an enemy, the Crown often allowed the action to continue. This created a fluid status between legality and treason. The appropriate response to human shields is a recurring issue in modern warfare. Technological asymmetry, disparate obligations, and doctrinal divergence between state and nonstate adversaries combine to make civilians account for 84 percent of combat deaths. Just as a slot machine entices a gambler though he rarely wins, the international community's inconsistent response to human shields has placed shield users on an intermittent reinforcement schedule, thereby ensuring that this tactic remains part of insurgent strategy. The article discusses the use of international and domestic laws to capture suspected art thieves as of September 2012. International treaties reportedly impose criminal charges for the theft and trafficking of cultural properties such as works of art. The author argues that foreign nations should look to the U.S. as an example of how to successfully prosecute art thieves and corrupt art dealers under domestic fraud laws.

For the past six years, the war on drugs in Mexico has resulted in the out-migration of tens of thousands of Mexican nationals fleeing violence, many settling in El Paso, Texas. The historical context of being pulled to the U.S. for economic opportunity had changed. Mexican nationals were now refugees pushed out of their country for safety. Because the context of migration had changed, the close proximity and similarities between El Paso, Texas and Ciudad Juárez, and the availability of social support in the U.S., the experiences of this refugee cohort were unique. The United States and Russia have sought to reduce the danger of nuclear war by limiting offensive strategic capabilities through negotiated agreements, relying on mutual deterrence based on reciprocal threats and the corresponding fear of retaliation. Although nuclear arsenals have been pared, this is fundamentally the same way the United States and Soviet Union sought to reduce the danger of nuclear war during the Cold War, when both were impelled to do so because they were adversaries and able to do so despite being adversaries. For all their power, both the United States and China are increasingly vulnerable. Each faces a range of strategic dangers, from nuclear weapons to disruption of critical computer networks and space links. Because their relationship is at once interdependent and potentially adversarial, the United States and China are especially vulnerable to each other: interdependence exposes each to the other, while the potential for conflict impels each to improve strategic capabilities against which defenses can be futile. Strategic vulnerability cannot be eliminated, only mitigated.

Irregular warfare and insurgencies have been on the rise since the end of World War II. A particularly strong example of these conflicts is the ongoing conflict between the Lebanese Hezbollah and the state of Israel. In the course of the conflict, Hezbollah was able to accomplish what other; more powerful Arab states could not: Hezbollah forced Israel to unilaterally end a conflict. How did Hezbollah accomplish this? This thesis will provide a qualitative analysis of Hezbollah's use of the instruments of power in their irregular warfare strategy against Israel during the occupation of southern Lebanon.

Lipid containing biomass from microalgae has received recent research interest as a renewable and sustainable feedstock for biofuel production. Algae is known to offer as much as 30 times the energy density than corn based ethanol, the current world standard for biomass based liquid transportation fuels. The development of large scale systems and methods of extracting lipids from microalgae is still in the early stages of development and significant increases in efficiency and reduction in costs are necessary to substantiate algae as a feasible alternative source of fuel. This thesis explores how the People's Republic of China (PRC) has attempted to halt internal migration, particularly rural-to-urban migration, in order to maintain socio-political control, and how by the mid-1980s migrant laborers from the countryside had unintentionally created conflicts between authorities from different regions of the country who were either for or against large-scale migration. With the advent of a more open market system that was created after the economic reforms began in 1978, we see that the migrants' movements exposed the differing economic situations of the wealthier coastal provinces and the poor inland ones. The United States Supreme Court recently overturned the Stolen Valor Act on the grounds that the law’s blanket prohibition on falsely claiming to have received a military medal or decoration violated the First Amendment right to free speech. This Article uses the controversy provoked by the law to explore the implications of offering compensation for military service in the form of medals. How is compensation in medals related to monetary compensation? Federal bankruptcy law incorporates a broad range of commercial and related matters that are otherwise left to the States under the Constitution, follows an efficiency-centered process model that may implicate due process, and relies upon a judicial structure that appears to be inconsistent with Article III.
