Of Guilds And Men: Copyright Workarounds In The Cinematographic Industry, Adriane Porcin Jan 2012

Of Guilds And Men: Copyright Workarounds In The Cinematographic Industry, Adriane Porcin

UC Law SF Communications and Entertainment Journal

The motion picture industry utilizes a varied collection of more or less formal mechanisms for dealing with the collective nature of audiovisual works, ranging from collective bargaining to legal presumptions. What these instances of copyright workarounds have in common is that they are all about circumventing traditional notions of authorship (the right to be deemed the author of a work) and ownership (the right to exert control over a work). When considered from an international perspective, the cinematographic industry is fertile ground for an exploration of such mechanisms.

After a recitation of the Berne Convention, this paper will proceed to …

Competitive Entertainment: Implications Of The Nfl Lockout Litigation For Sports, Theatre, Music, And Video Entertainment, Henry H. Perritt Jr. Jan 2012

Competitive Entertainment: Implications Of The Nfl Lockout Litigation For Sports, Theatre, Music, And Video Entertainment, Henry H. Perritt Jr.

UC Law SF Communications and Entertainment Journal

The 2011 dispute between the National Football League ("NFL" or "League"), representing the football teams, and NFL Players' Association ("NFLPA," or "Players," or "Players Association"), the union representing its football players, oscillated among the collective bargaining table, the National Labor Relations Board ("NLRB"), and the courts. The League preferred labor law as the matrix of the controversy. The Players preferred antitrust law. Ultimately, the union's most powerful weapon was not to withhold player services in a strike, but to challenge various anticompetitive arrangements wanted by the teams under the antitrust laws.

This article begins with a brief review of the …

The Gift: Synesthesia In Translingual Texts, Natasha Lvovich Jan 2012

The Gift: Synesthesia In Translingual Texts, Natasha Lvovich

Publications and Research

This article explores the relationship between multilingualism and synesthesia (neuro-psychological blend of senses). In the absence of research in any of the related fields, the author (a multilingual, a L2 scholar, a writer, and a synesthete all at once) views synesthesia through the lens of “translingual texts” written in L2 by multilingual authors and takes an interdisciplinary perspective, fusing L2 scholarship, cognitive theory, neuroscience, literary theory, and semiotics to investigate the complexities and subjectivities of the multilingual mind. ‘Translingual synesthesia’ appears to represent an idiosyncratic form of language emotionality and creativity, allowing translingual authors to transcend cognitive and linguistic realms …

Praesentia Ex Machina: The Millennial Technoculture, Liveness And Theatre, Reid J. Reimers Jan 2012

Praesentia Ex Machina: The Millennial Technoculture, Liveness And Theatre, Reid J. Reimers

Graduate Student Theses, Dissertations, & Professional Papers

This work examines the modern technoculture, its component parts and the changing role of theatre in Anglo-American culture. Our contemporary society is marked by the ubiquity of digital technologies and has become reliant on their commodities. The emerging Millennial Generation has matured with many of these devices and has embraced the modern technoculture. Many changes in daily life brought on by new technologies are obvious, but fundamental shifts remain obscured by the nature of technology itself. These subtle transformations are cumulative and have caused a technological disorientation with broad reaching implications. Liveness, initially defined as that which is unrecorded, has …

Theater As A Medium Of Healing: A Critical Analysis Of Copper Thunderbird By Marie Clements, Anna Dulba-Barnett Jan 2012

Theater As A Medium Of Healing: A Critical Analysis Of Copper Thunderbird By Marie Clements, Anna Dulba-Barnett

Graduate Student Theses, Dissertations, & Professional Papers

The idea of the healing power of theater reaches back to Aristotle and his concept of catharsis. Greek philosopher states that tragedy “with incidents arousing pity and fear, wherewith to accomplish its katharsis of such emotions.” The process of catharsis is interpreted as purification or purging of the audience members’ strong emotions as a response to the dramatic action taking place on stage. Today very few western theater practitioners mention that particular aspect of theater in their artistic manifestoes. Yet in Native American theater narratives of illness and healing are ever present. The need for change, and faith in the …

A Year Of Practice And Performance: Improving Piano Skills To Become A Better Choral Director, Ellen Mckenzie

Graduate Student Theses, Dissertations, & Professional Papers

Piano skills are extremely important to a choral teacher’s success, and I always considered my piano playing as a weak point in my teaching. The intent of my project was to dedicate a year of intensive practicing and performing as an accompanist in order to improve my piano technique, gain a wider repertoire of music to use in teaching private lessons and choir, and gain confidence in my abilities as an accompanist. Through one hundred and three hours of documented practice time, eight performance experiences in a variety of settings, and eighteen pieces prepared and performed, my playing has improved …

Assessing The Role Of Shame And Honor During The Alta Conflict, Michael T. Bremmer Jan 2012

Assessing The Role Of Shame And Honor During The Alta Conflict, Michael T. Bremmer

Graduate Student Theses, Dissertations, & Professional Papers

For nearly a century the Sami peoples of Norway were subject to colonial policies of assimilation and integration. According to historians of the Sami, colonial processes stigmatized Sami individuals and the Sami culture, producing feelings of shame. The concept of shame, for both individuals and groups, centers on experiencing fear, pain, and/or uneasiness, and requires a judging audience. Honor is about individuals transcending self-interest and the need for individuals and groups to acquire self-esteem for that purpose; it also requires a judging audience. Concepts of shame and honor played an important role during the Alta conflict; a watershed moment in …

King Of Kings: Human Rights Rhetoric And Regional Security In The Shah's Iran, 1968-1978, Bennett Gabriel Sherry

Graduate Student Theses, Dissertations, & Professional Papers

In the spring of 1968, Mohammad Reza Shah Pahlavi’s personal rule and Iran’s domestic stability were at an all-time high. For five years, Iran had enjoyed the boons of the Shah’s White Revolution. This program of economic and social reform had placed Iran on the path to becoming one of the most populous, prosperous, and powerful nations in the Middle East. In January 1968 the United Kingdom announced it would withdraw its military from the Persian Gulf. The Shah seized upon this opportunity and that provided by the promulgation of the Nixon Doctrine in 1969 to put Iran on the …

Investigating Child Sexual Abuse, Lisa. Herman-Davis Jan 2012

Investigating Child Sexual Abuse, Lisa. Herman-Davis

Harriet L Wilkes Honors College Theses 2010 - 2019

The issue of sexual exploitation of children occurs in various forms and across socio-economic, racial, and cultural classes. Children experience abuse at the hands of authority figures who are family members, friends, and sometimes strangers. The discussions on this social issue tell the stories of children who have experienced abuse along with the processes and outcomes that arise in providing assistance to help them cope with these unwanted experiences. Discourses in the fields of psychology, social work, medical sciences, and law have in their own unique style, taken different measures to highlight and address this social problem. However, there is remarkably …

The Center Of A Homesteading Community In Northwest Montana: Archaeological Investigations On The Polebridge Schoolhouse, Alexander J. Kroll

Graduate Student Theses, Dissertations, & Professional Papers

In the summer of 2010, I excavated the remnants of a historic one-roomed schoolhouse near Polebridge, Montana, just outside of Glacier National Park. The schoolhouse’s recovered artifacts represent a lively community of homesteaders residing in the North Fork Valley of the Flathead River during the early 20th century. 3,704 individual artifacts in the form of metal, glass, ceramic and faunal remains, tell of life during this time period. The research goals of this thesis have three objectives: 1) the historical record often depicts schoolhouses as serving as public space for the community, the archaeological record can be used to corroborate …

Word Ways: Revisiting Ancient Greco-Latin Myths To Build Vocabulary, Jacqueline S. Thursby Jan 2012

Word Ways: Revisiting Ancient Greco-Latin Myths To Build Vocabulary, Jacqueline S. Thursby

The Utah English Journal

I recently assigned an old children’s tale to my senior undergraduate students called “!e Story of the Cruel Giant Barbarico, the Good Giant Benefico, and the Little Pretty Dwarf, Mignon,” written by Sarah Fielding, who lived from 1710 to1768. It was an unfamiliar story to them and written in the archaic style of 18th century English. The primary characters in the story were the giants, Barbarico and Benefico, and the sweethearts, Fidus and Amata. The names clearly reflect characteristics of the players in the story. By using root Latinate forms, Sarah Fielding foreshadowed the characters’ primary personality attributes: Barbarico (barbarous: …

Confronting "Difficult Knowledge": Critical Aesthetics And War In The Classroom, Jessica Anne Heybach Vivirito Jan 2012

Confronting "Difficult Knowledge": Critical Aesthetics And War In The Classroom, Jessica Anne Heybach Vivirito

Graduate Research Theses & Dissertations

This qualitative multi-site case study explores critical aesthetic experiences in teacher education classrooms, and advocates for the inclusion of theoretical and practical knowledge of "difficult knowledge," visual culture, and critical aesthetics in the classroom. Social reality consists of a perpetual stream of tragic and horrific images that bombard individuals and leads to the normative assumption that such images are anesthetizing. This study complicates the assumption of apathy and desensitization through an empirical study where participants were asked to witness artwork and images of social injustice—in particular, visual culture depicting the 2004 Abu Ghraib prison scandal. The implications of this study …

We, The Judges: The Legalized Subject And Narratives Of Adjudication In Reality Television, 81 Umkc L. Rev. 1 (2012), Cynthia D. Bond

UIC Law Open Access Faculty Scholarship

At first a cultural oddity, reality television is now a cultural commonplace. These quasi-documentaries proliferate on a wide range of network and cable channels, proving adaptable to any audience demographic. Across a variety of types of "reality" offerings, narratives of adjudication replete with "judges," "juries," and "verdicts"-abound. Do these judgment formations simply reflect the often competitive structure or subtext of reality TV? Or is there a deeper, more constitutive connection between reality TV as a genre and narratives of law and adjudication? This article looks beyond the many "judge shows" popular on reality TV (e.g., Judge Judy') to examine the …
