Is Canada The New Shangri-La Of Global Securities Class Actions?, Tanya J. Monestier
Is Canada The New Shangri-La Of Global Securities Class Actions?, Tanya J. Monestier
Northwestern Journal of International Law & Business
There has been significant academic buzz about Silver v. Imax, an Ontario case certifying a global class of shareholders alleging statutory and common law misrepresentation in connection with a secondary market distribution of shares. Although global class actions on a more limited scale have been certified in Canada prior to Imax, it can now be said that global classes have “officially” arrived in Canada. Many predict that the Imax decision means that Ontario will become the new center for the resolution of global securities disputes. This is particularly so after the United States largely relinquished this role in Morrison v. …

King Alfonso Xi In Lope’S Amor, Pleito Y Desafío: A Practical And Just Model Of Kingship In A Time Of Moral Ambiguity, Terri Carney
Scholarship and Professional Work - LAS
It is an axiom that the king is a pillar of Spanish Golden Age drama. Indeed, whether fictional or historic, on the stage or in the audience, the figure of the king is prevalent in the world of the comedia as a site of cultural anxiety surrounding the role of the monarchy in the newly urbanized and litigious seventeenth-century Spanish society. Scholars such as Melveena McKendrick (Playing the King) and Frank Casa (“The Duality of the King in Golden Age Drama”) have explored the personage of the king in a variety of these plays. Neither of these studies …
Dancing The Numinous: Sacred And Spiritual Techniques Of Contemporary American Belly Dancers, Jeana Jorgensen
Dancing The Numinous: Sacred And Spiritual Techniques Of Contemporary American Belly Dancers, Jeana Jorgensen
Scholarship and Professional Work - LAS
In this paper, I explore how contemporary American practitioners of belly dance (as Middle Eastern dance and its many varieties are often called in the English-speaking world) conceptualize not only the spiritual dimensions of their dance, but also how the very notion of performance affects sacred and spiritual dance practices. Drawing on interviews with this community, I describe the techniques of sacred and spiritual belly dancers, how these dancers theorize performance, and how the conflicts inherent to patriarchal mind-body dualism are resolved in these practices. My purpose here is twofold: to document an emergent dance tradition and to analyze its …
Does Lincoln Still Belong To The Ages?, Allen C. Guelzo
Does Lincoln Still Belong To The Ages?, Allen C. Guelzo
Civil War Era Studies Faculty Publications
Edwin M. Stanton gets only a footnote in John Bartlett’s Familiar Quotations, but the phrase is one that many know by heart, words this normally irascible and overbearing powder-keg of a man uttered at Abraham Lincoln’s deathbed: “Now he belongs to the ages.” That, at least, was how John Hay recorded Stanton’s words. Dr. Charles Sabin Taft, who had been boosted awkwardly from the stage to the presidential box in Ford’s Theatre and who accompanied the dying Lincoln across Tenth Street to the Petersen House’s back bedroom, thought that Stanton had said, “He now belongs to the ages.” James …

Constructing The Other: U.S. Muslims, Anti-Sharia Law, And The Constitutional Consequences Of Volatile Intercultural Rhetoric, Carlo A. Pedrioli

Recently, legislators have proposed, discussed, and passed various laws that aimed to limit the use of foreign law, international law, and Sharia (a branch of Islamic law) in state court systems. Because it became law, one proposed state constitutional amendment that rhetorically linked Sharia to foreign and international law is of particular note. In the 2010 midterm elections, Oklahoma passed State Question 755 (SQ 755), a constitutional amendment that aimed to place restrictions on the use of foreign law, international law, and Sharia in Oklahoma courts. Laws like Oklahoma’s State Question 755 are problematic for a variety of reasons. One …

Why The Law Needs Music: Revisiting Naacp V. Button Through The Songs Of Bob Dylan, Renee Newman Knake
Why The Law Needs Music: Revisiting Naacp V. Button Through The Songs Of Bob Dylan, Renee Newman Knake
Fordham Urban Law Journal
The law needs music, a truth revealed by revisiting the United States Supreme Court’s opinion in NAACP v. Button through the songs of Bob Dylan and the play Music History. This Essay proceeds in three parts. Part I opens with a summary of the Court’s decision in NAACP v. Button, focusing particularly on the expanded understanding of First Amendment rights related to access to the law that flow from this legal opinion. Part II explains the inspiration for this Essay, Seaton’s play Music History, which reveals the influence of music on law and culture during the civil rights movement. Part …

The Association Of Adult Businesses With Secondary Effects: Legal Doctrine, Social Theory, And Empirical Evidence, Alan C. Weinstein, Richard D. Mccleary
Law Faculty Articles and Essays
In the decade since the U.S. Supreme Court’s decision in Alameda Books v. City of Los Angeles, 535 U.S. 425 (2002), the adult entertainment industry has attacked the legal rationale local governments rely upon as the justification for their regulation of adult businesses: that such businesses are associated with so-called negative secondary effects. These attacks have taken a variety of forms, including: trying to subject the studies of secondary effects relied upon by local governments to the Daubert standard for admission of scientific evidence in federal litigation; producing studies that purport to show no association between adult businesses and negative …
Indeterminacy And Balance: A Path To A Wholesome Corporate Law, Fenner L. Stewart Jr.
Indeterminacy And Balance: A Path To A Wholesome Corporate Law, Fenner L. Stewart Jr.
Comparative Research in Law & Political Economy
This article argues that corporate legal scholarship needs to focus primarily upon the indeterminacy of essentialist theories about the corporation. This will result in greater pluralism, since no essentialist legal theory would become heavily privileged over any other. When such a balance is created between theories, a robust debate can occur where no ideas are raised to the status of being “undiscussable preferences” and no essentialist theory is off the table before the debate begins. This would lead to fewer consensuses but more complexity than presently exists within corporate legal discourse, helping to immunize the law from the sort of …
And No More Shall We Shout: Noise By-Laws, Freedom Of Expression And A Montréal Sex Club, Richard Haigh
And No More Shall We Shout: Noise By-Laws, Freedom Of Expression And A Montréal Sex Club, Richard Haigh
Comparative Research in Law & Political Economy
In 1994, the City of Montréal attempted to deal with troublesome noises by enacting a bylaw dealing with the control of noise in the metropolitan area. The By-law became the subject of litigation in the Supreme Court of Canada case Montréal (City) v. 2952-1366 Québec Inc. The comment focuses almost entirely on the Court’s s. 2(b) analysis. It first explores the science of noise and its control is fundamental to analyzing how sound might legitimately affect freedom of expression, before critiquing the Court’s assessment of noise as expression. It looks at how the Court provided a rejuvenated understanding of the …

Constitutional Cases And The Four Cardinal Virtues, R. George Wright
Constitutional Cases And The Four Cardinal Virtues, R. George Wright
Cleveland State Law Review
In addressing constitutional cases, judges face no shortage of legal rules, tests, principles, doctrines, and policies upon which to draw. In those cases, the challenge is assumed to be to identify and apply the most relevant such legal rules, tests, principles, doctrines, and policies. An accompanying judicial opinion tries to articulate this process, partly to legitimize the outcome, partly to provide guidance, and perhaps partly for purposes of civic education and inspiration. This Article recommends a somewhat different approach to constitutional adjudication. Specifically, this Article recommends supplementing the above standard forms of constitutional adjudication with appropriate and legitimate attention to …
If Clothes Could Speak: Sartorial Analysis Of Japanese Cultural Identity, Ivy Han
If Clothes Could Speak: Sartorial Analysis Of Japanese Cultural Identity, Ivy Han
Whittier Scholars Program
This project is a deep sartorial analysis of Rei Kawakubo’s and Yohji Yamamoto’s designs and how they reveal the global influences that shaped the cultural identity of contemporary Japan. However, such analysis of high fashion would only be half of the identity; to fully understand Japanese cultural identity, it is equally important to delve into the sartorial phenomenon of Harajuku street fashion. While Japanese avant-garde fashion and Harajuku youth culture seem to be at opposite ends of the sartorial spectrum, the two have a closely entwined complementary relationship. Japanese high fashion and street fashion demonstrate how such cultural commodification impacts …

Training Parent Volunteers As Effective Allies In Youth Empowerment Programs, Ria Shroff
Training Parent Volunteers As Effective Allies In Youth Empowerment Programs, Ria Shroff
Capstone Collection
Empowering adolescent girls is an effective and sustainable way to break the cycle of poverty and initiate a process of worldwide change. It is also extremely challenging, given the traditional perceptions of adolescents as reckless, carefree, incapable of assuming responsibility and unaware of their own needs for success and positive development. While organizations can provide many of the resources that adolescent girls need, the lack of parental support can be detrimental to both the overall development of the adolescent girl, her access to services, her mobility in society and the choices she will have in her future.
In order to …
