Non-Binary Gender Concepts And The Evolving Legal Treatment Of Uk Transsexed Individuals: A Practical Consideration Of The Possibilities Of Butler, Alex Harris Dec 2012

Non-Binary Gender Concepts And The Evolving Legal Treatment Of Uk Transsexed Individuals: A Practical Consideration Of The Possibilities Of Butler, Alex Harris

Journal of International Women's Studies

This essay seeks to bridge the gap between the UK legal system’s treatment of transsexuals and post-structuralist gender theory. It argues that whilst the greater representation of transsexuals in UK legal discourse embodied in the Gender Recognition Act is a positive move forward in terms of classic liberal notions of human rights and in its acceptance of transsexuals as proper subjects before the law, it nonetheless represents an essentialist conception of transsexuals; requiring them to ‘fit’ within binary categories of male and female. It is argued that post-structuralist thought regarding gender can illuminate some of the problems inherent within the …

Serving Youth Who Are Serving Time: A Study Of The Special Education Services For Incarcerated Youth In A Short-Term Care Facility, Sachiko Hoshide Dec 2012

Serving Youth Who Are Serving Time: A Study Of The Special Education Services For Incarcerated Youth In A Short-Term Care Facility, Sachiko Hoshide

Doctoral Dissertations

This study examined the communication between sending court and community schools of a County Office of Education’s (COE) Alternative Education program and the receiving juvenile detention facility of a county in a Western state and how the communication between the two facilities affected the level of special education services provided to incarcerated youth, specifically the occurrence of 30-day placement IEPs. The juvenile detention facility was selected as a site because it was a lighthouse program, one of the few chosen to pilot the juvenile detention alternatives initiative (JDAI). JDAI sought to lower the number of incarcerated youth through viable alternatives …

Coder Reliability And Misclassification In The Human Coding Of Party Manifestos, Slava Mikhaylov, Michael Laver, Kenneth Benoit Dec 2012

Coder Reliability And Misclassification In The Human Coding Of Party Manifestos, Slava Mikhaylov, Michael Laver, Kenneth Benoit

Research Collection School of Social Sciences

The Comparative Manifesto Project (CMP) provides the only time series of estimated party policy positions in political science and has been extensively used in a wide variety of applications. Recent work (e.g., Benoit, Laver, and Mikhaylov 2009; Klingemann et al. 2006) focuses on nonsystematic sources of error in these estimates that arise from the text generation process. Our concern here, by contrast, is with error that arises during the text coding process since nearly all manifestos are coded only once by a single coder. First, we discuss reliability and misclassification in the context of hand-coded content analysis methods. Second, we …

The Pragmatic Confucian Approach To Tradition In Modernizing China, Sor-Hoon Tan Dec 2012

The Pragmatic Confucian Approach To Tradition In Modernizing China, Sor-Hoon Tan

Research Collection School of Social Sciences

This paper explores the Confucian veneration of the past and its commitment to transmittingthe tradition of the sages. It does so by placing it in the context of the historicaltrajectory from the May Fourth attacks on Confucianism and its scientistic, iconoclasticapproach to “saving China,” to similar approaches to China’s modernization in laterdecades, through the market reforms that launched China into global capitalism, to therevival of Confucianism in recent years. It reexamines the association of the Pragmatismof John Dewey and Hu Shih with the scientistic iconoclasm of the May Fourth Movementand argues that a broader scrutiny of Dewey’s and Hu’s works, …

Grandparents As Guards: A Game Theoretic Analysis Of Inheritance And Post Marital Residence In A World Of Uncertain Paternity, Brishti Guha Dec 2012

Grandparents As Guards: A Game Theoretic Analysis Of Inheritance And Post Marital Residence In A World Of Uncertain Paternity, Brishti Guha

Research Collection School Of Economics

I unify the following (1) men face paternal uncertainty while women do not face maternal uncertainty, (2) putative fathers and paternal kin care about true paternity, (3) paternity confidence is systematically lower in matrilocal cultures than in patrilocal ones, (4) inheritance tends to be patrilineal in high paternity confidence cultures and matrilineal in low confidence ones, and (5) most societies with patrilineal inheritance were patrilocal while most societies with matrilineal inheritance were matrilocal. I model the co-evolution of inheritance patterns and post-marital residence patterns - and their relationship with paternity uncertainty. Using a game theoretic model, I examine how a …

A Preliminary Survey Of The Right To Presumption Of Innocence In Singapore, Siyuan Chen Dec 2012

A Preliminary Survey Of The Right To Presumption Of Innocence In Singapore, Siyuan Chen

Research Collection Yong Pung How School Of Law

The right to presumption of innocence is said to exist in almost all criminal justice systems, including Singapore. Curiously, however, no Singapore case has ever attempted to establish the exact source and contours of this longstanding right. This is unsatisfactory, as this diminishes the meaningfulness of what is supposed to be a fundamental right in the criminal justice process. The primary aim of this article is thus to conduct a preliminary survey of the law on the presumption of innocence in Singapore. It begins by proposing the Woolmington conception as a workable starting point, but posits a guiding principle to …

Cyberloafing At The Workplace: Gain Or Drain On Work?, Vivien K. G. Lim, Don Jiaqing Chen

Research Collection Lee Kong Chian School Of Business

This study examined the impact of cyberloafing on employees' emotion and work. We also examined gender differences in employees' perception towards cyberloafing. In general, respondents felt that some form of cyberloafing at work was acceptable. Men were also more likely to report that cyberloafing has a positive impact on work compared to women. As well, our findings suggest that browsing activities have a positive impact on employees' emotion while emailing activities have a negative impact. Results of our study provide useful insights for researchers and managers in understanding employees' attitudes towards cyberloafing, and how cyberloafing can result in gain or …

Validity Evidence For The Situational Judgment Test Paradigm In Emotional Intelligence Measurement, Nele Libbrecht, Filip Lievens Dec 2012

Validity Evidence For The Situational Judgment Test Paradigm In Emotional Intelligence Measurement, Nele Libbrecht, Filip Lievens

Research Collection Lee Kong Chian School Of Business

To date, various measurement approaches have been proposed to assess emotional intelligence (EI). Recently, two new EI tests have been developed based on the situational judgment test (SJT) paradigm: the Situational Test of Emotional Understanding (STEU) and the Situational Test of Emotion Management (STEM). Initial attempts have been made to examine the construct-related validity of these new tests; we extend these findings by placing the tests in a broad nomological network. To this end, 850 undergraduate students completed a personality inventory, a cognitive ability test, a self-report EI test, a performance-based EI measure, the STEU, and the STEM. The SJT-based …

Mythmaking: How Introductory Psychology Texts Present B. F. Skinner's Analysis Of Cognition, Robert Jensen, Helene Burgess Nov 2012

Mythmaking: How Introductory Psychology Texts Present B. F. Skinner's Analysis Of Cognition, Robert Jensen, Helene Burgess

The Psychological Record

Fifteen introductory psychology textbooks are examined to determine the accuracy and completeness of their treatment of B. F. Skinner's approach to human activities commonly referred to as cognitive processes. Six of the textbooks ignore Skinner's contribution to the study of cognitive variables altogether, four deny that Skinner had anything to say about such processes and five textbooks acknowledge elements of Skinner's viewpoint, though the acknowledgments are incomplete and suffer from inaccuracies. Discussion encourages textbook writers and publishers to present a more accurate and complete picture of the discipline of psychology for the introductory student.

Three Contributions Of Social Psychology To The Analysis Of The Behavior-Consequence Linkage, John H. Kunkel Nov 2012

Three Contributions Of Social Psychology To The Analysis Of The Behavior-Consequence Linkage, John H. Kunkel

The Psychological Record

This article describes major differences in research focus and methods between behavior analysis and social psychology, and it outlines some of the ways in which fruitful cooperation between the two fields can be established. Attribution, optimism, and time horizons are considered to be measures of past behavior-consequence linkages, which provide information about otherwise unknown aspects of people's learning histories. Experiments in these research areas of social psychology contribute to the improvement of the three-term contingency by (a) introducing past experiences and (b) providing explanations of behavior variability in the laboratory and in daily life.

Behavioral Changes For African Americans To Improve Health, Embrace Culture, And Minimize Disparities, Dashiel J. Geyen Ed.D., M.P.H. Nov 2012

Behavioral Changes For African Americans To Improve Health, Embrace Culture, And Minimize Disparities, Dashiel J. Geyen Ed.D., M.P.H.

The Bridge: Interdisciplinary Perspectives on Legal & Social Policy

In spite of significant advances in the prevention, diagnoses, and treatment of most chronic diseases, there is evidence that racial and ethnic people of color tend to receive lower quality of care and less preventive interventions than the majority members of a community. While our health system should improve its efforts at addressing and reducing disproportionality in health care, African Americans can make behavioral changes through diet and exercise that will reduce their susceptibility to chronic illnesses. This article first reviews the prevalence, disparities, and characteristics of chronic diseases impacting the African American population. Second, it discusses culturally connected practices …

Praying Hands: Influences Of Religiosity And Spirituality On Sexual Risk-Taking Among Black, College-Attending Emerging Adults, Tralonda C. Triplett

Open Access Dissertations

The Centers for Disease Control and Prevention have confirmed persistent disproportionate burdens of HIV/AIDS among Black populations in the United States. While treatment advancements have greatly improved qualities of life for persons living with HIV/AIDS, prevention efforts remain focused to reduce incidence among vulnerable populations. Research distinguishing emerging adulthood in the US has characterized it entailing identity formations influencing sexual risk-taking. Religiosity and spirituality have remained pivotal in Black cultures influencing beliefs and normative behaviors around pre-marital sex. The Praying Hands study combines ethnic, demographic, contextual and socio-environmental factors to investigate influences of religiosity and spirituality on HIV risks among …

Mental Health Treatment For Children And Adolescents: Cost Effectiveness, Dropout, And Recidivism By Presenting Diagnosis And Therapy Modality, David Fawcett

Theses and Dissertations

As many as one in five children and adolescents may suffer from a mental health disorder, yet there are barriers that often prevent children from receiving optimal treatment. The current study explores the influence of practitioner license type, therapy modality, diagnosis, age, and gender on mental health therapy for children and adolescents. Data was provided by Cigna, a leading health care insurance provider in the United States. Participants include 106,374 boys (53.2%) and 93,753 girls (46.8%) ages 3 to 18 (M = 12.1, SD = 3.9) who were treated in outpatient facilities throughout the United States of America. Results indicate …

The Legal Significance Of The Psychological Ability To Appreciate The “Other”, Paul F. Rothstein Nov 2012

The Legal Significance Of The Psychological Ability To Appreciate The “Other”, Paul F. Rothstein

Georgetown Law Faculty Publications and Other Works

Recently the U.S. Supreme Court, citing neurological and psychological studies, held that because juveniles are deficient in appreciating consequences to others, they should never be given the death penalty. The author found, in his years as a legal scholar, educator, and practitioner, that “appreciating the ‘other’”--putting oneself in the position of others---is critical to law and the study of law in more than the obvious ways.

The author became aware of empirical studies and psychological experiments demonstrating that children below a certain age have trouble seeing things from another’s vantage point, and found that the facility to do so develops …

When Worldviews Collide: What Linguistic Style Matching And Distal Language Reveal About Deception In Political Discourse, Lucille Marie Booker Nov 2012

When Worldviews Collide: What Linguistic Style Matching And Distal Language Reveal About Deception In Political Discourse, Lucille Marie Booker

Electronic Theses and Dissertations Archive

Political discourse is an observable, measurable, and testable manifestation of political worldviews. However, when worldviews collide, notions of truth and of lies are put to the test. The challenge for researchers is how to establish confidence in their analysis. Despite the growing interest in deception research from a diversity of fields and industries, the trend is to focus on validating the assessment approach to the data without considering validity issues related to the data itself. Such a trend is concerned more with how to assess linguistic features and less with what is being assessed. By contrast, this dissertation is concerned …
