Blue-Collar Crime: Conspiracy, Organized Labor, And The Anti-Union Civil Rico Claim, Benjamin Levin

This Article provides an historically-rooted analysis of a recent spate of civil RICO complaints arising from labor union organizing campaigns. The Article historicizes contemporary civil RICO suits against labor unions by analogizing to nineteenth century conspiracy prosecutions of unions. In tracing this history of organized labor’s social standing, the Article addresses the cultural framing of the union and its place in political and cultural discourse over the past century. The civil RICO complaints have received limited scholarly attention mainly focusing on issues of federal preemption; this Article argues for a broad reading of the cases as a way to understand …

Section 301 of the 2009 federal Credit Card Accountability, Responsibility, and Disclosure Act prohibits the issuance of consumer credit cards to young adults ages 18–20 unless the credit contract is cosigned by an older adult who accepts joint liability for the card, or else the young adult proves she has “independent means of repaying” her credit card obligations. This prohibition is at odds with a 50-year trend of extending the rights of adulthood to people ages 18–20. It also blocks an important source of credit for young entrepreneurs, who often use consumer credit to launch their enterprises.

Pragmatism dominates contemporary legal thought, but knowing this isn’t knowing so much. Legal pragmatism means different things to different people, and as this essay argues, minimalist and experimentalist forms of regulation both share a broadly pragmatic sensibility about law and democracy. As a consequence, we need to tease out the various threads of legal pragmatism in the hope of distinguishing the pragmatisms that work from the ones that don’t, or less pragmatically, the ones that are just from the ones that are not. Catholic identity is considered to be the single most important issue facing Catholic higher education in the United States. The yield of preoperative PET/CT (PET/CT) for regional and distant metastases for thin/intermediate thickness melanoma is low. Objective of this study is to determine if PET/CT performed for T4 melanomas helps guide management and alter treatment plans. Methods. Retrospective cohort of 216 patients with T4 melanomas treated at two tertiary institutions. Fifty-six patients met our inclusion criteria (T4 lesion, PET/CT and no clinical evidence of metastatic disease). Results. Fifty-six patients (M: 32, F: 24) with median tumor thickness of 6 mm were identified. PET/CT recognized twelve with regional and four patients with metastatic disease. But the continuous monitoring of antisemitic incidents—a critical exercise that this journal painstakingly reflects in its “Antisemitica” feature—is merely the beginning of the everlasting effort to limit them. Bigotry comes in many guises and is a constantly evolving target, exposing the limitations of law and the frustrations of justice.

Alpha catenin is a cytoskeleton protein that acts as a regulator of actin rearrangement by forming an E-cadherin adhesion complex. In Dermacentor variabilis, a putative α-catenin (Dvα-catenin) was previously identified as differentially regulated in ovaries of ticks chronically infected with Rickettsia montanensis. To begin characterizing the role(s) of Dvα-catenin during rickettsial infection, the full-length Dvα-catenin cDNA was cloned and analysed. Comparative sequence analysis demonstrates a 3069-bp cDNA with a 2718-bp open reading frame with a sequence similar to Ixodes scapularis α-catenin. This dissertation explores the relationship between land tenure and livelihoods in pre-Saharan Morocco as an ethical struggle over subsistence rights and the definition of community. Research in an oasis valley of southern Morocco indicated how changing land use practices framed contestations over community, political authority, and social hierarchies. The dissertation specifically examines the extension of settlement and cultivation from the oasis into the arid steppe. The research methodology contextualizes household decision-making around land use and livelihood strategies within the framework of land tenure regimes and other regional, national, and global processes. As people increasingly use social media to organize both protests and robberies, government will try to regulate these calls to action. With an eye to this intensifying dynamic, this Article reviews First Amendment jurisprudence on incitement and applies it to existing statutes on incitement to riot at a common law, state, and federal level. The article suggests that First Amendment jurisprudence has a particularly tortuous relationship with regulating speech directed to crowds. It examines current crowd psychology to suggest which crowd behavior, if any, should as a matter of policy be subject to regulation. It concludes that many existing incitement-to-riot …

Although personality constructs are now widely accepted as being important for understanding work behavior, self-report personality tests as a method of assessment are not without their critics (e.g., Morgeson et al., 2007). Whether misguided or not, concerns persist regarding the validity of these measures and the issue of applicant faking has yet to be fully resolved (Tett & Christiansen, 2007). Moreover, applicant reactions tend to be less favorable for personality inventories than many other assessments commonly used in employment settings (Hausknecht, Day, & Thomas, 2004). Previously our laboratory had identified a novel component of the Staphylococcus aureus regulatory network, an extracytoplasmic function ó factor, óS, involved in stress response and disease causation. Here we present additional characterization of óS, demonstrating a role for it in protection against DNA damage, cell wall disruption and interaction with components of the innate immune system. Promoter mapping reveals the existence of four unique sigS start sites, one of which appears to be subject to auto-regulation. Transcriptional profiling revealed that sigS expression remains low in a number of S. aureus wild-types, but is upregulated in the highly mutated strain RN4220. …

This paper presents designs for Multistable Shape-Shifting Surfaces (MSSS) by introducing bistability into the Shape-Shifting Surface (SSS). SSSs are defined as surfaces that retain their effectiveness as a physical barrier while undergoing changes in shape. The addition of bistability to the SSS gives the surface multiple distinct positions in which it remains when shifted to, i.e. by designing bistability into a single SSS link, the SSS unit cell can change into multiple shapes, and stabilize within the resulting shape, while maintaining integrity against various forms of external assaults normal to its surface. Brazil is a nation that has professed to be a `racial democracy' such that race categories are not recognized. This implies that every citizen experiences equal access from a political, social and economic point of view, irrespective of skin color. Nevertheless, palpable racial inequalities exist in Brazil such that there is a primarily white elite class while Brazilians of African descent are typically poor. As a consequence of aging, the brain is subject to chronic neuroinflammatory conditions. The resident immune cells of the brain, microglia, act similarly to peripheral macrophages to protect the brain from insults, infection, and physical trauma. However, without proper regulation of their respective host defense mechanisms, these actions can become neurotoxic. In the healthy brain neurons have several signaling systems that directly interact with microglia in order to maintain a calming influence upon their actions, one of particular interest is the chemokine CX3CL1. This chemokine is found predominantly on neurons, while its cognate receptor CX3CR1 is found exclusively on microglia. …

This study seeks to understand how global discourses of sea level rise (SLR) and mangrove ecology influence national climate change adaptation policy to reduce coastal vulnerability in Suriname. A majority of the Surinamese population lives along the low elevation coastal zone and is highly exposed to projected SLR. Failure by the international community to reach agreement on climate change mitigation means that vulnerable coastal communities must adapt. Domoic acid (DA), a potent neurotoxin that has the potential to cause amnesic shellfish poisoning (ASP), is produced by members of the marine diatom genus Pseudo-nitzschia. Outbreaks of ASP in humans and of DA poisoning in birds and marine mammals have been reported across the United States and Canada since the late 1980's. Pseudo-nitzschia species can be extremely abundant in Florida waters, with densities often exceeding 10⁶ cells/L, and sometimes exceeding 10⁷ cells/L. Under the ancient threat of morbidity and mortality from infectious diseases, human societies have responded for thousands of years by imposing social containment measures. Even before theorists and laymen recognized the existence of pathogenic organisms, or fully understood the principles of contagion, many societies and individuals did empirically infer that such diseases were transmissible from human to human (as well as sometimes between animals and humans).
