Exile On Main Street: Competing Traditions And Due Process Dissent, Colin Starger
Exile On Main Street: Competing Traditions And Due Process Dissent, Colin Starger
Marquette Law Review
Everybody loves great dissents. Professors teach them, students learn from them, and journalists quote them. Yet legal scholars have long puzzled over how dissents actually impact the development of doctrine. Recent work by notable empirical scholars proposes to measure the influence of dissents by reference to their subsequent citation in case law. This Article challenges the theoretical basis for this empirical approach and argues that it fails to account for the profound influence that uncited dissents have exerted in law. To overcome this gap in the empirical approach, this Article proposes an alternative method that permits analysis of contextual and …

"I Fear The Consequences To Our Animals": Emigrants And Their Livestock On The Overland Trails, Diana L. Ahmad
"I Fear The Consequences To Our Animals": Emigrants And Their Livestock On The Overland Trails, Diana L. Ahmad
Great Plains Quarterly (through 2013)
"You cannot be too careful of your teams; on their condition depends entirely your success in getting through" to the Pacific coast, warned Philip L. Platt and N. Slater in their 1852 Travelers' Guide across the Plains upon the Overland Route to California.1 The diaries, letters, and guidebooks written by the emigrants who crossed North America on the overland trails during the mid-nineteenth century reveal a new awareness of the animals that journeyed with them. Often written as advice to those who might follow them, the travelers worried about their animals in ways beyond what theologians and philosophers …
Review Of Masculine Style: The American West And Literary Modernism By Daniel Worden, Blake Allmendinger
Review Of Masculine Style: The American West And Literary Modernism By Daniel Worden, Blake Allmendinger
Great Plains Quarterly (through 2013)
Daniel Worden argues that masculinity isn't a biological identity or a fixed construct, but a type of performance that allows for fluidity, enabling individuals "the freedom to refashion the self and live as an equal among others." The men and women who assume such a style challenge a hierarchical system in which men are equated with power and dominance. They reveal a complex subjectivity, sometimes engaging in sentimental relationships and forming unorthodox friendships and unions-unlike the traditional cowboy, who is portrayed in literature as a rugged and isolate, though presumably heterosexual, male. Worden examines the subversion of stereotypical western masculinity …
The Class Differential In Privacy Law, Michele E. Gilman
The Class Differential In Privacy Law, Michele E. Gilman
All Faculty Scholarship
This article analyzes how privacy law fails the poor. Due to advanced technologies, all Americans are facing corporate and governmental surveillance. However, privacy law is focused on middle-class concerns about limiting the disclosure of personal data so that it is not misused. By contrast, along the welfare-to-work continuum, poor people face privacy intrusions at the time that the state or their employers gather data. This data collection tends to be stigmatizing and humiliating, and it thus not only compounds the harmful effects of living in poverty, but also dampens democratic participation by the poor. The poor interact with the government …

Not Congruent But Quite Complementary: U.S. And Chinese Approaches To Nontraditional Security, Lyle J. Goldstein
CMSI Red Books
U.S.-China relations, difficult in the best of times, have lurched in a dangerous direction since 2009. Against the backdrop of a weakened global economy and sharpened ideological tensions, there has been a disturbing new atmosphere of crisis in East Asia over the last two years, with incidents occurring in greater frequency and sowing serious doubts about the sustainability of the "long peace" that this region has enjoyed for decades. Indeed, any one of the following incidents could have escalated into a serious regional crisis: the sinking of the South Korean frigate Cheonan; the collision between a Japanese coast guard …

Studying Human Disease Genes In Caenorhabditis Elegans : A Molecular Genetics Laboratory Project, Elisabeth A. Cox-Paulson, Theresa M. Grana, Michelle A. Harris, Janet M. Batzli
Biological Sciences Research
Scientists routinely integrate information from various channels to explore topics under study. We designed a 4-wk undergraduate laboratory module that used a multifaceted approach to study a question in molecular genetics. Specifcally, students investigated whether Caenorhabditis elegans can be a useful model system for studying genes associated with human disease. In a large-enrollment, sophomore-level laboratory course, groups of three to four students were assigned a gene associated with either breast cancer (brc-1), Wilson disease (cua-1), ovarian dysgenesis (fshr-1), or colon cancer (mlh-1). Students compared observable phenotypes of wild-type C. elegans and C. elegans with a homozygous deletion in the assigned …

Conserving The Platte: A Documentary Short, Steven Speicher
Department of Environmental Studies: Undergraduate Student Theses
With a history of litigation, deliberation, and conversation, the Platte River’s waters have been topic of much debate. In recent memory, historical decisions have been made regarding how to successfully manage this crucial water resource that sustains life in the Great Plains. The Platte River Recovery Implementation Program, a federally mandated tri-state conservation organization, began after years of consideration and an adamancy to avoid major litigation battle. Audubon Society has been a major player in conservation of habitats and protecting endangered species; Audubon Society’s Rowe Sanctuary, in specific, has worked in a variety of community- centered ways to conserve the …

Integration Of Multiple Stakeholders In Scientific Research: A Sensemaking-Sensegiving Approach, Nicolas Battard, Paul F. Donnelly, Vincent Mangematin
Conference papers
This paper argues that senior scientists in the area of nanoscience and nanotechnology build a new vision of their research activity in order to encompass multiple stakeholders such as policy makers, funding agencies and PhD students. Through a qualitative and inductive study and the lens of sensemaking and sensegiving, we show that senior scientists shape new boundaries in order to make the new vision visible to both internal and external stakeholders. Finally, they engage in sensemaking and sensegiving on a daily basis in order to adapt and sustain their activity over time.
Brain Recorder, Anthony M. Garcia
Brain Recorder, Anthony M. Garcia
Computer Engineering
Electroencephalography (EEG) is the recording of electrical activity along the scalp. Our mind regulates its activities by means of electric waves which are registered in the brain, emitting tiny electrochemical impulses of varied frequencies, which can be registered by an electroencephalogram. These “brainwave” frequencies are split into different bands. There is ongoing research that attempts to correlate the frequencies in the different bands to different emotional states and levels of concentration. With the increase in availability of commercial EEG devices, such studies can be sped up by making the collection of data easier, faster, and mobile. Creating a mobile application …

Biology
A phylogenetic analysis of the order Embioptera is presented with a revised classification based on results of the analysis. Eighty-two species of Embioptera are included from all families except Paedembiidae Ross and Embonychidae Navás. Monophyly of each of the eight remaining currently recognized families is tested except Andesembiidae Ross, for which only a single species was included. Nine outgroup taxa are included from Blattaria, Grylloblattaria, Mantodea, Mantophasmatodea, Orthoptera, Phasmida and Plecoptera. Ninety-six morphological characters were analysed along with DNA sequence data from the five genes 16S rRNA, 18S rRNA, 28S rRNA, cytochrome c oxidase I and histone III. Data were …
The Effects Of Genetic Ancestry And Sociocultural Factors On Pulmonary Tuberculosis Susceptibility In Northeastern Mexico, Bonnie Nadyne Young
The Effects Of Genetic Ancestry And Sociocultural Factors On Pulmonary Tuberculosis Susceptibility In Northeastern Mexico, Bonnie Nadyne Young
Anthropology ETDs
Genetic and environmental factors contribute to variation in tuberculosis (TB) disease risk among individuals in the Americas, although the relative contribution of each of these factors remains unclear. Genetic ancestry may serve as a proxy for underlying genetic differences in TB risk between the European, Native American, and African groups that formed many populations in the Americas, but this has never been tested. Such tests are complicated by the fact that genetic ancestry and important potential social predictors of TB are usually confounded. The urban center of Nuevo León, the Monterrey Metropolitan Area (MMA), presents a unique setting to tease …
Shamanism In Cross-Cultural Perspective, Michael Winkelman
Shamanism In Cross-Cultural Perspective, Michael Winkelman
International Journal of Transpersonal Studies
This article reviews the origins of the concept of the shaman and the principal sources of
controversy regarding the existence and nature of shamanism. Confusion regarding the
nature of shamanism is clarified with a review of research providing empirical support for a
cross-cultural concept of shamans that distinguishes them from related shamanistic healers.
The common shamanistic universals involving altered states of consciousness are examined
from psychobiological perspectives to illustrate shamanism’s relationships to human nature.
Common biological aspects of altered states of consciousness help explain the origins of
shamanism while social influences on this aspect of human nature help to explain …

We used data from a convenience sample of 410 Midwestern United States students from six secondary schools to develop parsimonious models for explaining and predicting precautions and illness related to influenza. Scores for knowledge and perceptions were obtained using two-parameter Item Response Theory (IRT) models. Relationships between outcome variables and predictors were verified using Pearson and Spearman correlations, and nested [student within school] fixed effects multinomial logistic regression models were specified from these using Akaike’s Information Criterion (AIC). Neural network models were then formulated as classifiers using 10-fold cross validation to predict precautions and illness. Perceived barriers against taking precautions …

Like other efforts at institutional restructuring or innovation, the full-flowering of the modern urban university is a work in progress. Whether we can identify a formula for success, or not, remains to be seen. Nonetheless, universities are moving ahead to design and implement a wide range of university-community linkages and, in the process, are generating new insights into the extent to which universities and communities can substantively join in common purpose. This paper reports on the experience at Portland State University with the creation and first six years of operation of the Institute of Portland Metropolitan Studies.

Violence And Masculinity In American Fiction, 1950-1975, Magdalen Mckinley
Violence And Masculinity In American Fiction, 1950-1975, Magdalen Mckinley
Dissertations (1934 -)
This dissertation explores the intersections of violence, masculinity, and racial and ethnic tension in America as it is depicted in fiction published by Richard Wright, Norman Mailer, Saul Bellow, James Baldwin, and Philip Roth between 1950 and 1975. Through close literary analysis coupled with a study of race and gender in 20th century American culture, I examine the manner in which gendered existential dilemmas are portrayed in this fiction as arising from a number of external factors, including racism, ethnic stereotyping, and the triumph of white heteronormativity as a model of masculinity. In doing so, I offer a reconsideration of …

BACKGROUND: Drugs dedicated to alleviate neurodegenerative diseases like Parkinson's and Alzheimer's have always been associated with debilitating side effects. Medicinal mushrooms which harness neuropharmacological compounds offer a potential possibility for protection against such diseases. Pleurotus giganteus (formerly known as Panus giganteus) has been consumed by the indigenous people in Peninsular Malaysia for many years. Domestication of this wild mushroom is gaining popularity but to our knowledge, medicinal properties reported for this culinary mushroom are minimal. METHODS: The fruiting bodies P. giganteus were analysed for its nutritional values. Cytotoxicity of the mushroom's aqueous and ethanolic extracts towards PC12, a rat pheochromocytoma …

The Role Of Islamic Institutions In The Adoption Of Reduce, Reuse, And Recycle (3r) Practices Among Muslim Communities In Malaysia., N. Idris
Research Publications (2011 to 2015)
It has been argued in the literature that religious belief has a role to play in dealing with environmental issues and enhancing environmental practices. In line with this perspective, it is interesting to observe that Muslim communities have started to use the Islamic institutions as an organizational and institutional platform for shown their environmental programmes. In some mosques and small mosques (surau), inspiring green programmes such as the 3R programme have also conducted. However, previous research on the role of religious community in enhancing environmental practices is mostly discussed at the theoretical level and only a handful have undertaken in …

Characterization Of Polymeric Phthalocyanine Nanoparticles Using Dynamic Light Scattering Laser, Satish Kumar Murarishetty
All Capstone Projects
The objective of this study is to use DLS (Dynamic Light Scattering) to analyze polymeric copper phthalocyanine nanoparticles (CuPcNPs). CuPcNPs are synthesized in order to facilitate drug penetration of bacterial biofilms for the treatment of chronic wounds. Microorganisms that reside inside the biofilms of chronic wounds are very resistant to any kind of treatment, even to the host’s own immune system. Therefore we have proposed an alternative method to destroy the microorganisms existing within the biofilms. Photodynamic anti-bacterial chemotherapy (PACT) has received much attention for the past decade due to the multi-drug resistant strands. PACT uses photons, a photosensitizer, and …

Nano Encapsulated Drug Delivery For Biofilms, Arunakanth Chavala
All Capstone Projects
Biofilms are now considered ubiquitous in the natural world. Bacterial biofilms have been observed to be extremely heterogeneous, both structurally and with regard to the physiology of the bacterial cells within them. The prevailing conceptual model depicts bacterial biofilms as being made up of microcolonies, which serve as the basic unit of the greater biofilm structure. A major concern with this approach is the frequently observed development of resistance to antimicrobial compounds. A number of elements in the process of biofilm formation have been studied as targets for novel drug delivery technologies. The present study aimed to penetrate biofilm by …

The purpose of this study is to develop a unique nanoparticulated system that has the capability of providing sustained drug delivery into the eyes. In ophthalmic preparations, poor ocular drug delivery of ocular dosage form is due to the production of tears and impermeability through corneal epithelium. The usage of liposomes in ophthalmic disorders shows promising results in ocular drug delivery. Liposomes are bilayered, microscopic vesicles surrounded by the aqueous compartments. Liposomes have the ability to encapsulate both hydrophilic and hydrophobic drugs. This unique property of liposomes helps in delivering the drug at specific site. This invention involves three major …

Atherosclerosis is an infl ammatory disease that cytokines such as tumor necrosis factor-α (TNF-) plays a critical role in acute phase response and is expressed in the intima of lesion. The activation of TNF- in endothelial dysfunction leading to an initial step of atherosclerosis is obscure. In this study, we hypothesized that endothelial dysfunction was triggered by an excess of reactive oxygen species (ROS) through TNF- induced lectin-like oxidized low density lipoprotein receptor-1 (LOX-1) overexpression. Human umbilical artery culture was used as organ model and also, was treated with 40 ng/ml TNF- for 2, 4, 8, 16 and 24 hrs. …
