Multiculturalist Liberalism And Harms To Women: Lookin Through The Issue Of "The Veil", Anissa Helie, Marie Ashe Oct 2012

Multiculturalist Liberalism And Harms To Women: Lookin Through The Issue Of "The Veil", Anissa Helie, Marie Ashe

Publications and Research

Hélie & Ashe law review writing raises and responds to a reformulated and broadened version of Susan Okin’s 1999 inquiry, Is Multiculturalism Bad for Women? It identifies social and political developments, as well as legal and theoretical developments, that have occurred in the 21st century and that demand that reformulation.

Not limiting itself (as did Okin’s question) to interrogating the relationship between women’s equality interests and interests in “religious freedom” advanced by minority-religious groups, Hélie & Ashe is the broader inquiry, critical for liberal theory of the 21st century which has been greatly affected by the “ethos …

Paradox In Preventing And Promoting Torture: Marginalising 'Harm' For The Sake Of Global Ordering: Reflections On A Decade Of Risk/Security Globalisation, Mark Findlay Oct 2012

Paradox In Preventing And Promoting Torture: Marginalising 'Harm' For The Sake Of Global Ordering: Reflections On A Decade Of Risk/Security Globalisation, Mark Findlay

Research Collection Yong Pung How School Of Law

The ultimate result of globalisation is that as the world setting is compressed there is an intensification of consciousness towards global interests, such as selective ordering, running parallel with strongly influential autonomous interests of the nation state and regional concerns. However, as risk and security disproportionately motivate globalisation, dominant nation state interests (which are at the heart of what operationalises global hegemony) become the prevailing measure of global ordering. Attitudes to ‘harm’ converge around these sectarian interests from the local to the global. As such, the need to torture, it is logically and even ‘legally’ argued, to better ensure domestic …

Constitutional Cacophony: Federal Circuit Splits And The Fourth Amendment, Wayne A. Logan Oct 2012

Constitutional Cacophony: Federal Circuit Splits And The Fourth Amendment, Wayne A. Logan

Vanderbilt Law Review

Despite their many differences, Americans have long been bound by a shared sense of constitutional commonality. Federal constitutional rights, however, can and do often vary based on geographic location, and a chief source of this variation stems from an unexpected origin: the nation's federal circuit courts of appeals. While a rich literature exists on federal circuit splits in general, this Article provides the first empirical study of federal constitutional law circuit splits. Focusing on Fourth Amendment doctrine in particular, the Article highlights the existence of over three dozen current circuit splits, which result in the unequal allocation of liberty and …

Punishment Without Conviction: Controlling The Use Of Unconvicted Conduct In Federal Sentencing, Gerald F. Leonard, Christine Dieter Oct 2012

Punishment Without Conviction: Controlling The Use Of Unconvicted Conduct In Federal Sentencing, Gerald F. Leonard, Christine Dieter

Faculty Scholarship

Federal sentencing law is widely applied to punish offenders not only for the offenses of which they have been convicted, but also, in the same proceeding, for offenses of which they have not been convicted. Unlike many scholars, we accept that federal courts can, in the right circumstances, legitimately enhance sentences for facts and conduct found at sentencing, even when those facts and conduct constitute uncharged offenses or even charges on which the defendant actually won an acquittal. But we argue that in identifiable cases, the use of such sentencing facts does cross the line from appropriate contextualization of the …

Regenerating Out Crime - The Impact Of An Urban Regeneration Programme On Safety And Security In A Dublin Suburb, Jonathan Grant Sep 2012

Regenerating Out Crime - The Impact Of An Urban Regeneration Programme On Safety And Security In A Dublin Suburb, Jonathan Grant

Dissertations

The regeneration of Turristown was a programme for the economic, social and physical renewal of a suburban town in the north-west of Dublin, which began in 1997 and which remains on-going to this date. The area of Turristown is one which has been blighted by socioeconomic and physical deprivation since its establishment in the late 1960s, and the regeneration programme was therefore formulated to provide much needed housing, social services and economic investment to the area. This study sought to assess the impact of this urban regeneration on security and safety as perceived by the suppliers and consumers of security …

Ida B. Wells-Barnett And The Carceral State, Patricia A. Schechter Sep 2012

Ida B. Wells-Barnett And The Carceral State, Patricia A. Schechter

History Faculty Publications and Presentations

My remarks today are entitled "Ida B. Wells-Barnett and the Carceral State." I want to focus on the carceral state—that is, the government functions of 'confining, surveillance and punishment'—in order to engage with some recent scholarship on race, policing, and imprisonment in the United States. These are topics that Wells-Barnett had a great deal to say about hundred years ago, especially as related to lynching. I’d like to suggest that her work in prison reform, probation work, and advocacy for inmates back in the progressive era connects to the contemporary crisis around race and mass incarceration in important ways.
