The Prison Fix: Race, Work, And Economic Development In Elmira, New York, Andrea R. Morrell
The Prison Fix: Race, Work, And Economic Development In Elmira, New York, Andrea R. Morrell
Dissertations, Theses, and Capstone Projects
Based on more than a year of ethnographic and archival research in Elmira, New York and, to a lesser extent, New York City, this dissertation analyzes the social, economic, and political processes through which Elmira, New York was transformed by the construction of the Southport Correctional Facility in 1988 as a project of economic development during a period of massive expansion of the New York State prison system. It focuses on the unfolding of the project of mass incarceration and its impact on the lives of Elmira's citizens and workers, as well as the men incarcerated in Elmira's prisons and …

A fundamental pillar of the Rome Statute of the International Criminal Court (ICC) is Article 17, which enshrines the complementarity principle – the idea that ICC jurisdiction will only be triggered when states fail to act to prosecute genocide, crimes against humanity and war crimes within their national courts or in circumstances where they prove unwilling and or unable to do so. The problem is that, as shown in this case report in the American Journal of International Law on the first ICC Appeals Chamber ruling regarding a state party’s objection to the court’s assertion of jurisdiction over its nationals, …

Due Process, The Sixth Amendment, And International Extradition, Roberto Iraola
Due Process, The Sixth Amendment, And International Extradition, Roberto Iraola
Nebraska Law Review
Fugitives whose extradition from the United States is sought by foreign countries at times argue that the delay between the commission of the alleged crime for which they are wanted and the submission of the request for their extradition violates their rights to a speedy trial or extradition under the Sixth Amendment, and/or their right to due process under the Fifth Amendment. In a similar vein, defendants who are returned to the United States from abroad to face criminal charges often argue that their right to a speedy trial under the Sixth Amendment was violated because the government failed to …
Punitive Juvenile Justice And Public Trials By Jury: Sixth Amendment Applications In A Post-Mckeiver World, Martin R. Gardner
Punitive Juvenile Justice And Public Trials By Jury: Sixth Amendment Applications In A Post-Mckeiver World, Martin R. Gardner
Nebraska Law Review
This Article argues that the continued homage to McKeiver in an era of punitive juvenile justice is the misguided result of judicial inattention to the distinction between punitive and rehabilitative dispositions. In Part II, I clarify this distinction and demonstrate why understanding it is essential to a sound analysis of whether jury determinations and public proceedings are constitutionally required in delinquency adjudications. I show that the concepts of rehabilitation and punishment are distinct and, for purposes of constitutional analysis, mutually exclusive. From this discussion I derive a conceptual framework, which I apply in Part IV to analyze several cases. These …

On Oct. 27, 2011, a report entitled “Garden of Truth: The Prostitution and Trafficking of Native Women in Minnesota” was released in St. Paul, Minn. The report was the culmination of a three-year research project conducted in Minnesota by two nonprofit organizations: the Minnesota Indian Women’s Sexual Assault Coalition, a grassroots organization of Native American women that is based in St. Paul and focuses on outreach and awareness for survivors of sexual assault, and Prostitution Research and Education, a nonprofit organization based in San Francisco. This unique collaboration between advocates of Native American women and social scientists has produced a …
Look Before You Leap: Court System Triage Of Family Law Cases Involving Intimate Partner Violence, Nancy Ver Steegh
Look Before You Leap: Court System Triage Of Family Law Cases Involving Intimate Partner Violence, Nancy Ver Steegh
Faculty Scholarship
Family courts are increasingly interested in matching parties with appropriate dispute resolution processes and related services. For many parties, especially those who are self-represented, triage of cases could be helpful and efficient. Nevertheless, implementation of triage in complex cases may bring unintended repercussions, and in the spirit of averting these, this Article identifies and discusses challenging issues that become apparent when triage systems are viewed through the lens of intimate partner violence.
Some questions about triage in the context of intimate partner violence were raised at the Wingspread Conference on Domestic Violence and Family Courts and explored more fully by …
Note – Why Can’T We Be “Friends”? A Call For A Less Stringent Policy For Judges Using Online Social Networking, Brian Hull
UC Law Journal
Judges are increasingly using social networking websites like Facebook, Twitter, LinkedIn, MySpace, and Google+, and, naturally, the question arises: What are the ethical limits for judges doing so? A number of judicial ethics committees and others knowledgeable about judicial ethics have analyzed this question. Not all, however, were familiar with the nuances of online social networking. The California Judges Association falls into both of these categories. In November 2010, it released an advisory opinion, Opinion 66, describing its views on judges using social networking sites. This Note details the views expressed by Opinion 66 and by opinions from Florida, Indiana, …

Universal Jurisdiction And The Crime Of Aggression, Michael P. Scharf
Universal Jurisdiction And The Crime Of Aggression, Michael P. Scharf
Faculty Publications
In June 2010 in Kampala, Uganda, the states that are party to the Statute of the International Criminal Court agreed to amend the ICC Statute to add the crime of aggression to the Court's jurisdiction. One of the key compromises that made this possible was the adoption of a U.S.-proposed “understanding” which provided that the aggression amendment should not be interpreted as creating a right for national courts to prosecute the crime of aggression under universal jurisdiction. If, however, national courts already possess the right to do so under customary international law, stemming from the Nuremberg precedent, then the understanding …

Fighting Extremism: Strategies Used To Combat Extremism And Radicalization, Scott Michel Caldwell
Fighting Extremism: Strategies Used To Combat Extremism And Radicalization, Scott Michel Caldwell
Electronic Theses and Dissertations
Ever since the terrorist attacks of September 11, 2001, the United States has been awakened to the threat that extremist organizations pose to our national security. The greatest transnational terrorist threat to the United States right now comes primarily from extremist groups such as Al-Queda, Hamas, and Hezbollah. These extremist groups are fueled by the desire to influence political, religious, and/or ideological causes. The political "end-state" or objective of the extremist is to overthrow "heretic" governments which currently exist and replace them with Islamic governments based on the rule of the Shariah (the first book of the Quran which strongly …

Graham V. Florida And A Juvenile’S Right To Age-Appropriate Sentencing, Martin Guggenheim
Faculty Articles
The Solicited Content portion of this issue is devoted to exploring the future of juvenile justice. In the landmark 2010 decision Graham v. Florida, the Supreme Court held that sentencing juveniles to life in prison without the possibility of parole for crimes other than homicide is categorically forbidden as a violation of the Eighth Amendment. But, I predict, Graham will eventually come to stand for considerably more. It is the most significant juvenile justice case advancing children’s rights since the landmark In re Gault decision in 1967. In an unprecedented way, Graham paves the way toward a new jurisprudence based …
Implicit Bias In The Courtroom, Jerry Kang, Mark Bennett, Devon W. Carbado, Pam Casey, Nilanjana Dasgupta, David Faigman, Rachel Godsil, Anthony G. Greenwald, Justin Levinson, Jennifer Mnookin
Implicit Bias In The Courtroom, Jerry Kang, Mark Bennett, Devon W. Carbado, Pam Casey, Nilanjana Dasgupta, David Faigman, Rachel Godsil, Anthony G. Greenwald, Justin Levinson, Jennifer Mnookin
Faculty Articles
Given the substantial and growing scientific literature on implicit bias, the time has now come to confront a critical question: What, if anything, should we do about implicit bias in the courtroom? The author team comprises legal academics, scientists, researchers, and even a sitting federal judge who seek to answer this question in accordance with behavioral realism. The Article first provides a succinct scientific introduction to implicit bias, with some important theoretical clarifications that distinguish between explicit, implicit, and structural forms of bias. Next, the Article applies the science to two trajectories of bias relevant to the courtroom. One story …
Rights And Votes, Daryl J. Levinson
Rights And Votes, Daryl J. Levinson
Faculty Articles
This Article explores the functional similarities, residual differences, and interrelationships between rights and votes, both conceived as tools for protecting minorities (or other vulnerable groups) from the tyranny of majorities (or other dominant social and political actors). The Article starts from the simple idea that the interests of vulnerable groups in collective decisionmaking processes can be protected either by disallowing certain outcomes that would threaten those interests (using rights) or by enhancing the power of these groups within the decisionmaking process to enable them to protect their own interests (using votes). Recognizing that rights and votes can be functional substitutes …
