Jail Incarceration And Violent Crime Rates: A Cross-Sectional Exploratory Analysis In Albuquerque, New Mexico, Saundra Trujillo Feb 2012

Jail Incarceration And Violent Crime Rates: A Cross-Sectional Exploratory Analysis In Albuquerque, New Mexico, Saundra Trujillo

Sociology ETDs

A core idea in the collateral consequences literature is that incarceration stimulates residential instability — a process referred to as coercive mobility — which in turn weakens community social organization and elevates local crime levels. I test this idea with an exploratory cross-sectional analysis of Albuquerque neighborhoods (2000-2001) using a general linear model with a negative binomial response function. Net of rigorous controls I find that jail incarceration increases violent crime rates. Further I find that the positive effect of jail incarcerations on violent crime is weakened at relatively high levels of jail incarceration for majority Latino neighborhoods. Whereas, in …

Criminal Sanctions In The Defense Of The Innocent, Ehud Guttel, Doron Teichman Feb 2012

Criminal Sanctions In The Defense Of The Innocent, Ehud Guttel, Doron Teichman

Michigan Law Review

Under the formal rules of criminal procedure, fact finders are required to apply a uniform standard of proof in all criminal cases. Experimental studies as well as real world examples indicate, however, that fact finders often adjust the evidentiary threshold for conviction in accordance with the severity of the applicable sanction. All things being equal, the higher the sanction, the higher the standard of proof that fact finders will apply in order to convict. Building on this insight, this Article introduces a new paradigm for criminal punishments-a paradigm that focuses on designing penalties that will reduce the risk of unsubstantiated …

Egyptian Criminals In Suits- Analytical Study On The Criminology Of White Collar Crimes: Special Focus On Egyptian Cases, Sue Ellen Hassouna Feb 2012

Egyptian Criminals In Suits- Analytical Study On The Criminology Of White Collar Crimes: Special Focus On Egyptian Cases, Sue Ellen Hassouna

Theses and Dissertations

Criminology is the science of crime and until the year 1939 crimes were limited to street or conventional crimes committed by criminals of lower socio-economic segments in the society. After 1939 the American criminologist, Edwin Sutherland, has challenged this stereotype of crimes and criminals through his introduction of white-collar crimes that are perpetrated by elite offenders. However, the term has been introduced and utilized for more than seventy years across criminologists and law enforcement agencies it is still a foreign concept to the Egyptian legal system; hence the Criminal Law Code is predominately focused on mainstream criminalities. This absence of …

Hard Cases Make Good Law: The Intellectual History Of Prior Acquittal Sentencing, Claire Mccusker Murray Jan 2012

Hard Cases Make Good Law: The Intellectual History Of Prior Acquittal Sentencing, Claire Mccusker Murray

St. John's Law Review

(Excerpt)

This Article attempts to answer those questions both historically and theoretically. On a historical level, it traces the heretofore unexamined course of the congressional, judicial, and administrative actions leading from a pre-1970s sentencing regime that viewed any use of extra-trial evidence in sentencing as constitutionally suspect to the 1997 case that embraced prior acquittal sentencing as a foregone conclusion. On a more theoretical level, the Article traces the justification for prior acquittal sentencing to two doctrinal tensions: the differing goals of trials and sentencing and the semiotic gap between acquittal and innocence. As outside forces exerted pressure on those …
