Criminal Law--Invisible In The Courtroom Too: Modifying The Law Of Selective Enforcement To Account For White Privilege, Mara Shulman Ryan
Criminal Law--Invisible In The Courtroom Too: Modifying The Law Of Selective Enforcement To Account For White Privilege, Mara Shulman Ryan
Western New England Law Review
In this Note, the Author asserts that, although Massachusetts courts never formally acknowledged white privilege, Commonwealth v. Vassell (HSCR 2008-00056) illustrates that white privilege plays a very real role in the administration of criminal laws and contributes to many instances of selective enforcement. Specifically in the context of selective enforcement claims, courts focus on whether people of color are arrested or prosecuted for belonging to a racial minority group (a result of racism) rather than on whether people evade arrest or prosecution for being white (a result of white privilege). This Note examines the development of the law of selective …

Right To Counsel/Criminal Law--Wishing For Rights: Interpreting The Article 12 Right To Counsel In Massachusetts In The Aftermath Of Montejo V. Louisiana, Raquel E. Babeu
Western New England Law Review
This Note reviews Montejo v. Louisiana (2009) and discusses its implications on Article 12 of the Massachusetts Declaration of Rights, particularly related to post-arraignment waivers of a defendant’s right to counsel at a police-initiated interrogation. Montejo’s appeal relied upon a bright-line rule (Jackson rule) established 26 years before, which makes post-arraignment waivers of a defendant’s right to counsel at a police-initiated interrogation presumptively invalid. In Montejo, the Supreme Court did away with the Jackson rule, while allowing that a state may continue to adhere to the Jackson rule under its state constitution.
The Author finds that historically the right to …

Undoing Time: A Proposal For Compensation For Wrongful Imprisonment Of Innocent Individuals, Muhammad U. Faridi, Hillel Hoffman, Paul A. Montuori
Western New England Law Review
This Article identifies the shortcomings in the American justice system relating to the inadequate compensation for innocent individuals wrongfully imprisoned for crimes they did not commit and for which they were later exonerated. Fairness and justice is considered a cornerstone of the justice system and the Authors contend that a just government cannot deny its citizens of life, liberty, or property without adequate compensation. Studies cited conclude that hundreds of individuals were exonerated after spending decades in prison for crimes they did not commit. The number of similar cases is on the rise due to advances in DNA testing.

Racial Disparities In Sentencing In The U.S. And Georgia, Kamal Rattray, Nicole Lee
Georgia Journal of Public Policy
Incarceration represents the ultimate use of coercive power, and in the state of Georgia, that power is being disproportionately levied upon people of color, particularly African Americans.1 According to 2011 statistics from the Georgia Department of Corrections, the total prison population statewide was approximately 53,341 inmates. The majority of that number were Blacks (33,069 inmates), followed by Whites (17,752 inmates), Hispanics (2,306 inmates) and other ethnic groups.

"This Is Exactly What This Study Is All About And It Is Happening Right In Front Of Me!" Using Participatory Action Research To Awaken A Sense Of Injustice Within A Privileged Institution, Brett G. Stoudt
Publications and Research
Rockport is an elite, all boys, day school in the northeast United States. It educates mostly white, wealthy, young men. Student researchers, faculty researchers and I collaborated to study bullying at Rockport using an approach to research known as participatory action research (PAR). In the process we also gained a better understanding of how privilege, especially gendered privilege, was socialized and (re)produced. The participatory research spaces that emerged in our project - grounded in the experiences of students, teachers, and administrators - facilitated critical awareness of self and context that Deutsch (2006) referred to as "awaking the sense of injustice." …
