Risk Of Resource Failure And Toolkit Variation In Small-Scale Farmers And Herders, M. Collard, A. Ruttle, B. Buchanan, Michael J. O'Brien Jan 2012

Risk Of Resource Failure And Toolkit Variation In Small-Scale Farmers And Herders, M. Collard, A. Ruttle, B. Buchanan, Michael J. O'Brien

History Faculty Publications (Archived)

Recent work suggests that global variation in toolkit structure among hunter-gatherers is driven by risk of resource failure such that as risk of resource failure increases, toolkits become more diverse and complex. Here we report a study in which we investigated whether the toolkits of small-scale farmers and herders are influenced by risk of resource failure in the same way. In the study, we applied simple linear and multiple regression analysis to data from 45 small-scale food-producing groups to test the risk hypothesis. Our results were not consistent with the hypothesis; none of the risk variables we examined had a …

Aggregate Litigation Goes Public: Representative Suits By State Attorneys General, Margaret H. Lemos Jan 2012

Aggregate Litigation Goes Public: Representative Suits By State Attorneys General, Margaret H. Lemos

Faculty Scholarship

State attorneys general represent their citizens in aggregate litigation that bears a striking resemblance to the much-maligned damages class action. Yet, while class actions are subject to a raft of procedural rules designed to protect absent class members, equivalent suits in the public sphere are largely free from constraint. The procedural disconnect between the two categories of aggregate litigation reflects a widespread assumption that attorneys general will adequately represent the interests of the state’s citizens, obviating any need for case-specific mechanisms for assuring the loyalty of lawyer to client.

This Article challenges the presumption of adequate public representation. By conflating …

An Examination Of The Relationship Between Transformational Leadership Tendencies And Safety Outcomes In Selected Manufacturing Settings, Barbara J. Boroughf Jan 2012

An Examination Of The Relationship Between Transformational Leadership Tendencies And Safety Outcomes In Selected Manufacturing Settings, Barbara J. Boroughf

All-Inclusive List of Electronic Theses and Dissertations

Each year about 6 to 8 percent of the U.S. workforce sustains a work related injury of which 3 to 4 percent of the injured population ends up losing time from work due to the severity of the injury (National Safety Council [NSC], 2011). According to the NSC Injury Facts (2011), every 147 minutes in the United States, a worker will be fatally injured, and every six seconds a worker will sustain an injury that is serious enough to require medical treatment. There is a wide variability in safety performance among organizations. Studies have found there is a relationship between …

Bullying, Cyberbullying, Incivility, And Sexual Harassment: A Spectrum Of Interpersonal Mistreatment, Christine D. Love Jan 2012

Bullying, Cyberbullying, Incivility, And Sexual Harassment: A Spectrum Of Interpersonal Mistreatment, Christine D. Love

All-Inclusive List of Electronic Theses and Dissertations

With the growing occurrence of deadly shootings on college campuses (Jenson, 2007), campus administrators have placed emphasis on early detection of potentially dangerous students. One indicator of possible violence is perpetration of uncivil or aggressive behaviors (Clark, 2008a; Kolanko et al., 2006). Placing behaviors on a spectrum of interpersonal mistreatment can provide cues to behaviors that could escalate into greater violence. The main purpose of this study was to determine whether bullying, cyberbullying, incivility, and sexual harassment directed at faculty members occurs on such a spectrum and as separate or overlapping constructs. Factor analyses were conducted on frequency of occurrence …

Effects Of Message Interactivity Upon Relational Maintenance Strategy In Digital Communications Between Organizations And The Public, Zhan-Qing Liu Jan 2012

Effects Of Message Interactivity Upon Relational Maintenance Strategy In Digital Communications Between Organizations And The Public, Zhan-Qing Liu

All-Inclusive List of Electronic Theses and Dissertations

Digital communication between organizations and the public is strategically important in shaping mutual understanding and long term relationship. The primary focus of this project was to investigate the relationship between message interactivity and relational maintenance strategy in the email communication process on organization websites. At issue is to what extent message interactivity and relational maintenance strategy is purposefully incorporated in email responses to public inquiries and consequently, to what extent such interactivity is potentially related to the quality of communication in terms of relationship maintenance. An experimental approach was used to exchange emails with randomly selected 2011 Fortune 500 companies …

Examining The Impact Parental Educational Attainment Has On Students' Perceptions Of Residence Hall Living, Joshua D. Lawrie Jan 2012

Examining The Impact Parental Educational Attainment Has On Students' Perceptions Of Residence Hall Living, Joshua D. Lawrie

All-Inclusive List of Electronic Theses and Dissertations

The current study sought to examine the impact parentalEducational attainment had on how students perceived their residence hall environment. This multi-campus study utilized the University Residence Environment Scale, along with a demographic form to gather data. The study occurred on three campuses during the Spring 2012 semester and had 347 participants. The findings suggest there were no differences in how parentalEducational attainment impacted participants' perspectives of the residence hall. ParentalEducational attainment was a significant factor when coded only as two options (i.e. college degree, no college degree). Additional results were that gender and ethnicity played a role in how students …

Resources And Instructional Strategies Effective Middle School Science Teachers Use To Improve Content Area Reading Skills, Melanie S. Beaver Jan 2012

Resources And Instructional Strategies Effective Middle School Science Teachers Use To Improve Content Area Reading Skills, Melanie S. Beaver

All-Inclusive List of Electronic Theses and Dissertations

This study examined the resources and instructional strategies effective middle school science teachers use to improve content area reading skills. Reading instruction in the middle school years should follow the natural cognitive progression that occurs in the adolescent brain from learning to read to reading to learn. Scientific reading is a different type of reading than most middle school students are accustomed to. It is important to understand that students will continue to be expected to read non-fiction critically for success in the 21st century. Effective teachers know this, and they perceive themselves as teachers of reading regardless of the …

How Open Innovation Affects The Drivers Of Competitive Advantage, Richard Reed, Susan Storrud-Barnes, Len Jessup Jan 2012

How Open Innovation Affects The Drivers Of Competitive Advantage, Richard Reed, Susan Storrud-Barnes, Len Jessup

Business Faculty Publications

PURPOSE: This paper aims to explore how community-controlled open innovation affects cost- and differentiation-based competitive advantage, and to explain how it allows some sources of economic rent to remain while others are taken away. Although models of competitive-advantage remain relevant, open innovation means that the main drivers of performance are changed. Open innovation means that there are implications for firms’ ability to profit from intellectual property that they do not own. The paper seeks to address those issues. DESIGN/METHODOLOGY/APPROACH: The work is conceptual. FINDINGS: Economic rents from property rights disappear, those from economies of scale and capital requirements are reduced, …

The Internationalization Of Chinese Firms: A Critical Review And Future Research*, Ping Deng Jan 2012

The Internationalization Of Chinese Firms: A Critical Review And Future Research*, Ping Deng

Business Faculty Publications

The important phenomenon that the internationalization of Chinese firms (ICF) represents has attracted increasing interest from scholars from multiple fields over the past 20 years (1991–2010). Although this proliferation of research has the potential to significantly improve understanding of Chinese multinational enterprises (MNEs), the necessary step of consolidating and integrating extant knowledge is absent. This paper reviews the scholarship on the ICF and offers insights into the specific areas in critical need of further development. By focusing on articles published in major scholarly journals during the period 1991–2010, the authors develop a coherent framework to organize and review conceptual and …

Factors Affecting The Governance Of Innovation Commercialization: A Theoretical Model, Datta Avimanyu, Richard Reed, Len Jessup Jan 2012

Factors Affecting The Governance Of Innovation Commercialization: A Theoretical Model, Datta Avimanyu, Richard Reed, Len Jessup

Business Faculty Publications

The ability to commercialize innovations is central to firm survival and success and despite research on parts of the process, there is no overarching framework. Successful commercialization can include retaining ownership of the innovation and bringing it to market, sharing it by licensing or developing it with partners, or by selling it. A firm-level model is constructed that goes from innovation sourcing, through assessment of viability, to selection of the optimum form of governance. External networks and absorptive capacity at the meso level, plus micro- and macro-level factors, as moderators affecting the strength of the relationship between viability and governance …

China's Tax Policy Response To The Global Financial Crisis, Wei Cui Jan 2012

China's Tax Policy Response To The Global Financial Crisis, Wei Cui

All Faculty Publications

VAT reform constituted the most important tax policy action China took during the global financial crisis in 2008-9. If China had had a more typical tax structure, this specific policy instrument (as well as certain others) would not have been available. Conversely, because of the idiosyncrasies of China’s current tax structure, some of the policy measures commonly deployed in other countries also cannot be used. In comparing China and Europe in the tax policies adopted since 2008, therefore, major differences in prior tax structures must be taken into account. There are also two other potential determinants of China’s tax policy. …

Foreign Administrative Law And International Taxation: A Case Study Of Tax Treaty Implementation In China, Wei Cui Jan 2012

Foreign Administrative Law And International Taxation: A Case Study Of Tax Treaty Implementation In China, Wei Cui

All Faculty Publications

U.S. taxpayers and the IRS increasingly have to take into account the interactions between U.S. and foreign laws, but they have paid little attention to the administrative law backgrounds of foreign tax laws. In a growing range of cases, the need for such attention has become urgent. This Article describes a novel class of cases encountered by U.S. taxpayers that emanate from tax treaty implementation in China. In these cases, U.S. (and other foreign) investors face certain rules that conflict with common treaty interpretations, and that, at the same time, are not legally binding under Chinese domestic law. The question …

Kigyo No Shakai-Teki Sekinin: Challenges For Corporate Social Responsibility In Japan, Janis P. Sarra, Masafumi Nakahigashi Jan 2012

Kigyo No Shakai-Teki Sekinin: Challenges For Corporate Social Responsibility In Japan, Janis P. Sarra, Masafumi Nakahigashi

All Faculty Publications

Globally, there is increasing discussion about corporate social responsibility (CSR). Many large multinational enterprises, particularly in mining and other resource sectors, have voluntarily adopted CSR programs, having concluded that social, economic, and environmental sustainability measures are good for the "bottom line" and fro the communities in which they operate. Companies in Japan have yet to move in that direction, although there are a few notable exceptions. In part, this lack of adaptation to the growing interest in CSR internationally is due to cultural and social norms in Japan that suggest that many aspects of CSR properly belong to the domain …

The Basics Of Species At Risk Legislation In Alberta, Shaun Fluker, Jocelyn Stacey Jan 2012

The Basics Of Species At Risk Legislation In Alberta, Shaun Fluker, Jocelyn Stacey

All Faculty Publications

This article examines Alberta's Wildlife Act and the federal Species at Risk Act (SARA) to assess the legal protection of endangered species in Alberta. Most of the discussion related to provisions contained in SARA, as there is comparatively less to discuss under the Wildlife Act. The fact that legal protection for endangered species in Alberta consists primarily of federal statutory rules is unfortunate, as wildlife and its habitat are by and large property of the provincial Crown, and it is a general principle of constitutional law that the federal government cannot in substance legislate over provincial property under the guise …

A Pragmatic Critique Of Corporate Criminal Theory: Lessons From The Extremity, James G. Stewart Jan 2012

A Pragmatic Critique Of Corporate Criminal Theory: Lessons From The Extremity, James G. Stewart

All Faculty Publications

Corporate criminal liability is a controversial beast. To a large extent, the controversies surround three core questions: first, whether there is a basic conceptual justification for using a system of criminal justice constructed for individuals against inanimate entities like corporations; second, what value corporate criminal liability could have given co-existent possibilities of civil redress against them; and third, whether corporate criminal liability has any added value over and above individual criminal responsibility of corporate officers. In this paper, I use examples from the frontiers of international criminal justice to criticize all sides of these debates. In particular, I harness the …

Overdetermined Atrocities, James G. Stewart Jan 2012

Overdetermined Atrocities, James G. Stewart

All Faculty Publications

An event is overdetermined if there are multiple sufficient causes for its occurrence. A firing squad is a classic illustration. If eight soldiers are convened to execute a prisoner, they can all walk away afterwards in the moral comfort that “I didn’t really make a difference; it would have happened without me.” The difficulty is, if we are only responsible for making a difference to harm occurring in the world, none of the soldiers is responsible for the death — none made, either directly or through others, an essential contribution to its occurrence. In many respects, this dilemma is the …

A Railway, A City, And The Public Regulation Of Private Property: Cpr V. City Of Vancouver, Douglas C. Harris Jan 2012

A Railway, A City, And The Public Regulation Of Private Property: Cpr V. City Of Vancouver, Douglas C. Harris

All Faculty Publications

The doctrine of regulatory or constructive taking establishes limits on the public regulation of private property in much of the common law world. When public regulation becomes unduly onerous — so as, in effect, to take a property interest from a private owner — the public will be required to compensate the owner for its loss. In 2000, the City of Vancouver passed a by-law that limited the use of a century-old rail line to a public thoroughfare. The Canadian Pacific Railway, which owned the line, claimed the regulation amounted to a taking of its property for which the city …

Gladue: Beyond Myth And Towards Implementation In Manitoba, Debra Parkes, David Milward Jan 2012

Gladue: Beyond Myth And Towards Implementation In Manitoba, Debra Parkes, David Milward

All Faculty Publications

In the mid-1990s, section 718.2(e) of the Criminal Code of Canada was enacted in response to the alarming over-representation of Aboriginal people in Canada’s prisons and jails. Its admonition to consider “all available sanctions other than imprisonment that are reasonable in the circumstances… with particular attention to the circumstances of Aboriginal offenders” requires, according to the Supreme Court in the leading case of R v Gladue, that justice system participants do things differently in sentencing Aboriginal people. However, in the ensuing years the level of over-representation has got worse, rather than better. There are a number of different explanations that …

Sexual Assault Cases In The Supreme Court Of Canada: Losing Sight Of Substantive Equality?, Emma Cunliffe Jan 2012

Sexual Assault Cases In The Supreme Court Of Canada: Losing Sight Of Substantive Equality?, Emma Cunliffe

All Faculty Publications

The equality guarantee contained in section 15 of the Canadian Charter of Rights and Freedoms has prompted reforms that protect women as complainants in sexual assault cases. This article considers the effectiveness of these reforms. Part 2 supplies a history of the relationships between consent, trial procedure, and substantive equality in sexual assault law. The author argues that substantive equality has had a significant effect on both substance and procedure. Part 3 examines the impact of these reforms by considering the extent to which substantive equality has infused judicial reasoning and fact determination in contested sexual assault cases. Specifically, the …

Prospects For Scalability: Relationships And Uncertainty In Responsive Regulation, Cristie Ford Jan 2012

Prospects For Scalability: Relationships And Uncertainty In Responsive Regulation, Cristie Ford

All Faculty Publications

Ian Ayres’s and John Braithwaite’s book Responsive Regulation: Transcending the Regulatory Debate (1992) gave us many significant insights. The book has transcended its own time. At the same time, on the 20th anniversary of its publication, two things about Responsive Regulation are striking. The first is the direct, personal relationship on which the regulatory interaction is premised. The second is the boundedness and manageability of the regulatory project. At least in prudential regulation of global financial institutions in the wake of the recent financial crisis (though surely elsewhere too), neither of these features can be taken for granted. This brief …

Order And Disorder: Rational Acumen And Emotional Incompetence In The Television Detective Story, E. Deidre Pribram Ph.D. Jan 2012

Order And Disorder: Rational Acumen And Emotional Incompetence In The Television Detective Story, E. Deidre Pribram Ph.D.

Communications: Faculty Publications

‘Order and Disorder’ examines the relationship between emotional disorders and the exquisite rationality of contemporary televisions detectives as portrayed in such series as Monk (USA), House (Fox), and Cracker (ITV). Television heroes who combine both emotionality and rationality would seem a more integrated form of human characterization. However, the permitted configuration of emotion and reason is highly constrained. Theirs is an ongoing struggle between thinking and feeling, in which rationality is their gift and emotionality, depicted as illness, is the constant curse that both threatens and enables their gift. These characters’ conflicts become a barometer for contemporary attitudes about emotional …

A Teaching Practice Review Of The Use Of Multiple-Choice Questions For Formative And Summative Assessment Of Student Work On Advanced Undergraduate And Postgraduate Modules In Engineering, Aidan O'Dwyer Jan 2012

A Teaching Practice Review Of The Use Of Multiple-Choice Questions For Formative And Summative Assessment Of Student Work On Advanced Undergraduate And Postgraduate Modules In Engineering, Aidan O'Dwyer

Articles

This paper reflects on, reports on and evaluates the use of multiple-choice questions, in both formative and summative assessment modes, on control engineering modules taken by advanced undergraduate and postgraduate engineering students, over four academic years. The material covered by the modules is analytical in nature. The rationale for examining the assessment strategy was the poor performance by students in a closed book traditional terminal examination on one of the advanced undergraduate modules over some years. The change in assessment strategy has improved student learning, as measured by assessment data; student feedback on the assessment methods is broadly positive. The …

Analysis Of Wind Velocity And The Quantification Of Wind Turbulence In Rural And Urban Environments Using The Levy Index And Fractal Dimension, Jonathan Blackledge, Eugene Coyle, Niall Mccoy, Derek Kearney, Keith Sunderland, Thomas Woolmington Jan 2012

Analysis Of Wind Velocity And The Quantification Of Wind Turbulence In Rural And Urban Environments Using The Levy Index And Fractal Dimension, Jonathan Blackledge, Eugene Coyle, Niall Mccoy, Derek Kearney, Keith Sunderland, Thomas Woolmington

Articles

This paper is concerned with a quantitative and comparative analysis of wind velocities in urban and rural environments. It is undertaken to provide a route to the classification of wind energy in a rural and urban setting. This is a common problem and the basis of a significant focus of research into wind energy. In this paper, we use a non-Gaussian statistical model to undertake this task, and, through a further modification of the data analysis algorithms used, extend the model to study the effect of wind turbulence, thereby introducing a new metric for this effect that is arguably superior …

Upqc For Power Quality Improvement In Dg Integrated Smart Grid Network: A Review, Shafiuzzaman Khadem, Malabika Basu, Michael Conlon

Articles

Quality of power supply has become an important issue with the increasing demand of Distributed Generation (DG) systems either connected to the grid through some power electronics grid-tie inverters or to work in isolated (microgrid) mode towards the development of a smart grid network. In this paper a technical review of Integration of Unified Power Quality Conditioner (UPQC) in Distributed Generation Network has been presented. Though the primary task of UPQC is to minimize the grid voltage and load current disturbance along with the reactive and harmonic power compensation, additional functionalities like compensation of voltage interruption and active power transfer …

Journal of Strategic Security

This article examines the issue of riot control agents as it relates to the subject of chemical weapons arms control at the international level and, more specifically, implications for the United States. The article examines how the issue of riot control agents has complicated efforts for the United States to enter into and ratify chemical weapons-related arms control agreements. The article provides an overview of chemical weapons, examines the relevant arms control agreements, explores why and how riot control agents influence debates over the merits of these treaties, and explains why riot control agents remain a contentious issue in chemical …

The Libyan Model And Strategy: Why It Won't Work In Syria, Lance Kildron Jan 2012

The Libyan Model And Strategy: Why It Won't Work In Syria, Lance Kildron

Journal of Strategic Security

Operation Unified Protector (Libya, 2011) is the latest example of how a limited-means military intervention in a humanitarian crisis can stop the murder of innocent civilians. Proponents of intervention in the name of "responsibility to protect" (R2P) have stated that the air campaign strategy used in Libya could be the model for future U.S. military engagement overseas. This begs the question of when the United States should insert itself militarily into a humanitarian crisis. For instance, Syria is a potential candidate for military intervention. The following article takes the reasons for military intervention in Libya, as explained by President Obama …
