Within the criminal justice system, DNA (deoxyribonucleic acid) evidence has often been heralded as the gold standard of forensic science. In a 2009 U.S. Supreme Court decision, Chief Justice Roberts wrote that "DNA testing has an unparalleled ability both to exonerate the wrongly convicted and to identify the guilty. It has the potential to significantly improve both the criminal justice system and police investigative practices." The phrases “unparalleled ability” and “significantly improve” reflect the high standard that DNA has attained in both forensic science and the entire criminal justice system.

An Error Quantification Methodology For Hurricane Storm Surge Simulations, Bin Pei

This thesis describes the development of a procedure to quantify errors in hurricane storm surge simulations using a decoupled wind-surge model. The state-of-the-art storm surge simulation program, ADCIRC (Advanced Circulation), and the Georgiou's wind field model were used to simulate the storm surge heights associated with 169 historical hurricanes from 1922 to 2011 along the coast of North Carolina, South Carolina and Georgia. The storm surge modeling errors were quantified by comparing the measured to the simulated annual maximum surge heights at nine water level observation stations maintained by the Center for Operational Oceanographic Products and Services (CO-OPS). This Article surveys cases from the Georgia Supreme Court and the Georgia Court of Appeals from June 1, 2011 through May 31, 2012, during which principles of administrative law were either illuminated or formed an important piece of the decision making. For a change, the Authors observed a significant increase in the number of reported cases during the survey period, but that increase does not necessarily indicate a trend. No attempt has been made to survey cases that properly would fall under categories of more specific articles in this issue, although some degree of overlap is inevitable because of shared …

Harmonizing Equitable Exceptions: Why Courts Should Recognize An “Actual Innocence” Exception To The Aedpa’S Statute Of Limitations, Morgan Suder
San Diego Law Review
This Comment argues that to neutralize this potential inequality, the Supreme Court should affirm the Ninth Circuit’s recent decision in Lee v. Lampert, finding that a credible claim of actual innocence constitutes an equitable exception to the AEDPA’s one-year statute of limitations period. District courts must be able to call on their equitable powers, including both equitable principles already applied to the AEDPA’s statute of limitations as well as the actual innocence exception, in determining whether a district court may consider the merits of a criminal defendant’s otherwise untimely habeas petition.

Large construction projects are highly vulnerable to sediment removal by erosive forces. Turbidity, resulting from this excess sediment, has gained recognition as anindicator of pollution in surface runoff from construction activities. The Environmental Protection Agency (EPA) is currently moving toward regulations that would establish a nationwide maximum turbidity effluent limit discharged from construction sites. Research has shown that current sediment control best management practices (BMPs) are often ineffective at controlling elevated turbidity levels in construction site discharges. Additionally, research confirms that sediment basins may act as reservoirs for bacteria, specifically Escherichia coli (E. coli). During rainfall events, resuspension within sediment …

Although they are two very similar net immigration countries, Australia and the US took very different approaches to immigration policy adoption and implementation and to immigration control, in the last two decades of the 20th century. The literature explains these different approaches by invoking the influence of interest groups, human rights initiatives and the reaction of state institutions to public pressure. This paper proposes an alternative explanation for the difference in immigration policy and control: crisis. Crisis, or a sense thereof, is what leads the population to mobilize and to put pressure on the government for more efficient policies and …

The movement is formed around a common goal, which is to protest the way government actions or inactions have rooted widespread discontent. The Occupy movement has encountered opposition from the cities and counties where it is located. Departmental and programmatic eliminations represent a new paradigm in the history of American higher education. Hastened by a national economic recession and competing state funding priorities, public post-secondary institutions have turned to academic attrition as a solution to continuous budgetary shortfalls. As a means of addressing the lived experience of faculty members and department chairs, the following qualitative case study explores perceptions of implementing departmental and/or programmatic eliminations.
Utilizing uncertainty reduction theory as a conceptual framework, interviewed faculty in saved units experienced considerable strategic uncertainty, failing to understand why they had been selected for elimination. Guided by a college-wide strategic …

The goal of this research was to identify and correlate easily observable characteristics of drivers to different levels of fatigue, thus enabling state patrol officers to make more judicious decisions related to driver fatigue. A literature review was conducted pertaining to the characteristics of fatigued drivers. Next, a nationwide survey was administered to state patrol agencies to assess their practices regarding fatigue-involved driving. To explore relationships between state patrol agency practices and vehicular safety, data collected from the telephone survey were merged with data from different states on fatigue-involved vehicle fatalities and vehicle miles traveled. Cross-median crashes have been identified as one of the highest injury or fatality risk crash types. Although crossmedian crashes account for only 2% to 5% of all median crash events, they are disproportionately represented in the number and frequency of fatalities on interstate roadways. Many states have utilized cable median barriers to reduce the risk of cross-median crashes, frequently with great success. However, cable median barriers are also fixed obstacles to errant vehicles. A low-cost radio direction finding (RDF) VHF receiver has been investigated for development into a radio direction finding network (RDFN) with a particular focus towards public service and commercial asset tracking applications. The primary design criteria were reproducibility, low-cost, and simplicity such that public service and volunteer organizations can benefit from the technology. Two receiver designs were built and tested to allow for comparison of practicality, cost, and accuracy. A pseudo-Doppler RDF and a time difference of arrival (TDOA) receiver were built as proof-of-concept for a system design based on commercial off-the-shelf (COTS) components. For the past 25 years, reality shows, in particular, police reality shows has figured prominently in American culture as a true representation of police/criminal interactions. This dissertation is a case study that examined the portrayal of African Americans as criminals on the police reality show entitled The Police Women of Cincinnati, Memphis, Dallas, Maricopa County (Phoenix, AZ) and Broward County (Ft. Lauderdale, FL). The cities were chosen because they represent the entire five seasons that the series has been on television. This particular police reality show was also chosen due to its mirror image of local and national television newscasts. …

A significant threat to United States national security stems from Mexican drug cartels. Mexican drug cartels are centered on the transit of illegal drugs into the United States. The flow of illegal drugs across the 1,933-mile U.S.-Mexico border now results in a host of crimes and violence that furthers the overall operation of the cartels. With the escalating violence from cartels, there is an increased possibility for spill over into the United States. The Town of Cohasset is considering the construction of a new Senior Center that will provide the opportunity for expanded programming within a dedicated building. In support of planning efforts by the Town of Cohasset, a study was conducted by the Gerontology Institute of the McCormack Graduate School at UMass Boston.
