Texas After City Of Dallas V. Stewart: Police Nuisances Or City Police Power Abated, Lindsay Matthews
Texas After City Of Dallas V. Stewart: Police Nuisances Or City Police Power Abated, Lindsay Matthews
Texas Wesleyan Journal of Real Property Law
The current economic recession has been the single worst in the United States since the Great Depression. In 2010, 46.2 million people were living at or below the poverty level. As a result of the nation's economic downturn and unemployment rates, there has been an onslaught of municipal decay and abandoned buildings. Nonseasonal vacant properties increased from 7 million in the year 2000 to 10 million in the year 2010. Texas, in particular, experienced a 41% to 50% increase in the number of vacant properties in its cities. Public nuisances such as deteriorating buildings, pest infestations, and overgrown vegetation commonly …

United States Flood Control Policy: The Incomplete Transition From The Illusion Of Total Protection To Risk Management, A. Dan Tarlock
United States Flood Control Policy: The Incomplete Transition From The Illusion Of Total Protection To Risk Management, A. Dan Tarlock
All Faculty Scholarship
Until the mid-twentieth century, the story of modern flood control was the transition from adaptation to the inevitable to an expectation that government would provide maximum flood prevention and generous post-disaster relief for floodplain dwellers. For the last sixty years or so, the story has been the growing recognition, especially as the understanding of climate change has increased, that the goal of maximum protection is unobtainable because flood damage is an inevitable risk that can only be managed, but never totally avoided. Thus, we are now making the transition to the idea that we must manage floodplains through a combination …
Birds Of A Feather? Irish Public Attitudes Towards Sex Crime And Sex Offender Reintegration. Is There A Publically Perceived Scale Of Sexual Deviance?, Judy Mcavoy
Dissertations
This dissertation implements research in relation to public attitudes towards sex crime and sex offender reintegration with the objective of outlining a publically perceived scale of sexual deviance and exploring how this impacts on reintegrative measures. In addition, it investigates public knowledge of existing legislation and prevalence of sex crime. A web-based approach and electronic data collection method are used, whereby 84 participants are sampled from an Irish discussion forum-based website (www.boards.ie). An online survey in the form of a self-completion questionnaire explores their attitudes in relation to various scenarios of sex crime and various types of sex offenders. Willingness …
Residential Square In The 21st Century: Applying A Typology To Create A New Urban Morphology, Elizabeth Whittington
Residential Square In The 21st Century: Applying A Typology To Create A New Urban Morphology, Elizabeth Whittington
Architecture Thesis Prep
"As a low-rise high-density mixed-use typology, the reconsideration of the residential square can provide a new urban morphology that densifies residential zones, while providing safe public spaces. In addition, I assert that through its combination of juxtaposed functional uses, unit typology the language of the façade, the historical European residential square, can articulate the identity of residents."

The Oil And Gas Evolution: Learning From The Hydraulic Fracturing Experiences In North Dakota And West Virginia, Joshua P. Fershee
The Oil And Gas Evolution: Learning From The Hydraulic Fracturing Experiences In North Dakota And West Virginia, Joshua P. Fershee
Texas Wesleyan Law Review
This Article will thus consider major differences and similarities in United States oil and gas extraction via hydraulic fracturing through a comparison of the experiences in North Dakota and West Virginia. Although there are other parts of the country experiencing growth in oil and gas extraction, Pennsylvania and Texas are two good examples, North Dakota and West Virginia are particularly apt for comparison. Both states have relatively small populations, meaning that the impact of large-scale energy extraction in each state is likely to have a large impact on the state, economically, environmentally, and socially. There are three main areas worth …

Policing Identity, Wayne A. Logan
Policing Identity, Wayne A. Logan
Scholarly Publications
Identity has long played a critical role in policing. Learning “who” an individual is not only affords police knowledge of possible criminal history, but also of “what” an individual might have done. To date, however, these matters have eluded sustained scholarly attention, a deficit that has assumed ever greater significance as government databases have become more comprehensive and powerful. Identity evidence, in short, has and continues to suffer from an identity crisis, which this Article seeks to remedy. The Article does so by first surveying the methods historically used by police to identify individuals, from nineteenth-century efforts to measure bodies …

Talking Drugs: The Burden Of Proof In Post-Garcetti Speech Retaliation Claims, Thomas E. Hudson
Talking Drugs: The Burden Of Proof In Post-Garcetti Speech Retaliation Claims, Thomas E. Hudson
Washington Law Review
Law Enforcement agencies fire their employees for speaking out in favor of drug legalization, which leads the employees to sue their former employers for violating their First Amendment Free Speech rights. These employee claims fall under the U.S. Supreme Court’s complex speech retaliation test, most recently articulated in Garcetti v. Ceballos. The analysis reveals that circuit courts are inconsistent as to who bears the burden of proving that they prevail under “Pickering balancing,” and how they should construct that burden. This Comment argues that U.S. Supreme Court precedent demands that the employer bears the “Pickering balancing” burden, and that …

Shadow Citizens: Felony Disenfranchisement And The Criminalization Of Debt, Ann Cammett
Dickinson Law Review (1908-2003)
The disenfranchisement of felons has long been challenged as antidemocratic and disproportionately harmful to communities of color. Critiques of this practice have led to the gradual liberalization of state laws that expand voting rights for those who have served their sentences. Despite these legal developments, ex-felons face an increasingly difficult path to regaining the franchise. This article argues that, for ex-felons in particular, criminal justice debt can serve as an insurmountable obstacle to the resumption of voting rights and broader participation in society. This article uses the term "carceral debt" to identify criminal justice penalties levied on prisoners, "user fees" …
